US Embassy and Consulate DiscussionK1 Interview help/questions/advice.
Thank you for your feedback everyone. I am not really worried about her answering the questions, we know each other very well. I really just wanted to know if me being there would make or break an interview. She does get nervous but either way I feel confident about everything.

Thank you.

US Embassy and Consulate DiscussionK1 Interview help/questions/advice.
I have a few questions about the interview which is still a good ways down the road. I just want to be prepared and ask questions early.

My fiancee will be interviewed in Tokyo and to be honest I am a little nervous because she gets very nervous and is also very shy. I have been reading about how they ask a range of questions which seem simple enough. Asking about our history, plans for living and marriage.

I hate to seem so ignorant on the subject, but honestly I do not know what to expect. Some topics say the interviewers are nice, which I hope is the case for her. The real question is this, should I be going with her to the interview? I have read some people brought their significant other and they were not allowed in the interview room. Is that true? Do most couples bring their fiance(e)'s? I would love to be there obviously, but right now it is a bit too early to say I can definitely go. If most people do bring their fiance(e) and it is highly recommended I will definitely fly to Japan to be there.

Any advice is greatly appreciated.

Thank you for the input. Technically we are engaged prior to the I129-F submission, I just did it again when I saw her in May for the purpose of giving her the ring. But I understand what you are all saying. Pick a date and agree on it prior to the interview.

Thank you.

I am very familiar with my fiance and we are comfortable with whatever questions come our way. One thing I wonder about is this..

She was a student in the US when we met and started dating. After a couple of months she had to go back to Japan to take care of some things at home. After about 4 more months we decided to get engaged and even though it is not very romantic, we did the engagement thing long distance so we could get the K1 processing started and be together that much sooner. That was in February when we discussed it by phone, and in April we filed the I129-F. I went and visited her in Japan during the first part of May at which time I asked for her hand in marriage again with a ring this time and the whole ball of wax.

Now my question is, do most interviews ask when we got engaged? And if so would it seem weird to say we got engaged long distance before I gave her the ring in May? I only ask because we submitted the I129-F in April. I do not know if they even ask that question or if they care enough to dig in to it.. I am nervous about the interview only because this is my future all in the hands of one person who will be interviewing us.

I know it is a silly question, I am just nervous even though I hear Japan has pretty nice interviewers.

Any tips or advice are certainly appreciated. Thank you.

you were supposed to be engaged before you filed because the petition is filing for fiance(e), your date is not documented so talk to your fiancee and agree on a date and if the VO asked then your fiancee will know what date to say.... unsure.gif

THey were "engaged" before they filed, they did it over the phone. But if two people decide to get married, then that is, for all intents and purposes, an engagment.

There is nothing in the 129F instructions that stat you have to be engaged.Technically, the I-129F is filing for fiance(e) VISA and in order for you to have a fiance(e) you have to be engaged, again technically whistling.gif, i am just saying, lol

Just letters of intent to marry and meet in the last 2 years prior to the petition submission, and be free to marry smile.gif

US Embassy and Consulate DiscussionI-129F approved! DS-230 questions.
My story is a bit long and complicated, but the I-129 got approved! We have prepared most of the paperwork so far but I do have a simple question to most, probably..

Questions 14, 15 and 18 pertaining to the applicants spouse. My fiancee is a widow, so should she be putting N/A for all 3 or filling it out using her deceased husband's information? I would assume N/A because there is no question pertaining to his death so that makes me think they only want a living spouse.

Thank you.

US Embassy and Consulate DiscussionDS-230 questions.. again..
I asked some questions yesterday on the DS-230 but was given the wrong information. Once I looked up the example someone linked to me from VJ, I noticed it was outdated. The current copy being located at http://travel.state....pdf/DS-0230.pdf.

My questions again asked if anyone knows..
Questions 14 - 18 all reflect the spouse's information but my fiancee is a widow. Maybe the same general answer applies but I want to make sure.

14-18. Spouse's Maiden or Family Name, place of birth and marriage information.. Would this be her maiden name or current name or None/NA since she is a widow? I guess that same questions applies to all of the questions 14-18 including her marriage. Will they all be None/NA since she is a widow? Or should I answer any of them?

Thank you in advance.

US Embassy and Consulate DiscussionI-134 125% question..
From all I have read, the requirement in the I-864P states that the minimum poverty guidelines state you need to be 125% of the poverty guidelines. And according to some stories I have read on Visa Journey, some embassies enforce that amount. But the U.S. Department of State (travel.state.gov) specifically says for the K-1 that the 125% only applies to other Visa's using the I-864, not the K-1 which uses the I-134. So is the 100% correct, or 125%? I am just curious, and possibly confused.. smile.gif

From http://travel.state....types_2994.html ...

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

Thank you for any feedback.

US Embassy and Consulate DiscussionWaiting on Embassy packet, police reports & DS-230 questions..
I have received a letter from USCIS and NVC stating the application was approved and sent on to the Tokyo Embassy.. Reading about the next steps (as we wait for the packet), I have a couple of questions specifically about the DS-230 and other documents I should get a head start on.

Police reports. As long as she has a copy of the NO2 (which I scanned and sent her), she can request that now. Is that correct or should she wait for the packet?

On the Tokyo embassy website it says this..

Step 3: Complete and send in DS-230 Part I
Upon receiving the visa applicant's file from NVC, the embassy/consulate will send him/her fiancé(e) visa instructions. It is not possible to send instructions until the Immigrant Visa Unit receives the visa applicant's file from NVC. After receiving instructions, each person applying for a visa regardless of age must complete the biographic data Form DS-230. The DS-230 should be completed and returned immediately by fax (Tokyo: 03-3224-5929 Naha: 098-876-4243) or mail to the embassy/consulate that sent you the instructions.

Information/documents may be requested from the applicant any time during the processing.

My question is, does she need to fill one out for her and one for her son. Or is her son considered part of her Visa?

That is everything for now. Any help is appreciated.

A question about the DS-230. According to the most recent revision of the DS-230, question 31a asks for the 'Person(s) named in 14 and 19 who will accompany you to the United States now.'. I assume this is an error because in the previous revision of the document question 14 and 19 related to the spouse and children. But in the new revision it asks in those two questions for spouse and fathers name.. I assume I am right and the mistake was made when creating the form?

Also, so every child of my fiance needs their own DS-230 filled out for them?

Thank you.

I think maybe you've misread it. 31a asks for the persons named in 14 and 29 accompanying you, so the spouse and children.

Weird. Mine says '31a. Person(s) named in 14 and 19 who will accompany you to the United States now.'.. I figured mine was wrong, but I appreciate the feedback. I am using the revision released in May.

Yes, you can hand write it. I would try to write the whole address, attach a continuation if you must. Make sure the attachment is very clear what it is in answer to and who's application it is. List her name, NVC case number, and list the question # and re-state the question. Then provide the answer. On the form itself write "see attached"

C: In the sponsor's I-134 for question 11 I answered 'N/A (K-1 visa process for permanent residence)', but for the co-sponsor should I put 'N/A', leave it blank or put the same thing as the sponsor's form?

As mentioned by YMR, being unmarried does not equate single. Single, Married, Divorced, Widowed - (assuming one marriage), these are mutually exclusive groups. (I learned this when filling out the paper work to buy my house)

US Embassy and Consulate DiscussionTokyo Interview on Aug 31st, no response..
I am curious as to whether anyone has had similar issues with Tokyo. The interview with my fiancee was on the 31st of August, and they said everything went great and congratulations. They did not ask for proof of our relationship, they had our proof from the initial submission. We had a lot to give but they did not ask for any. They said congratulations on the Visa and said to expect the Visa in a week or so. Well my fiancee called yesterday and they said she would receive an email within 3 days with more information as to why it has been delayed. She received an email the same day (today) and all it said is that they are still inspecting the Visa. I am curious if inspecting means their is a problem or just delayed due to some other issues.

I worry, if they want more proof even though they did not ask for any will they mail us with a RFE? Is there much a chance of denial after their approval at the end of the interview? I am just nervous. Any feedback is appreciated.

Since the visa was approved - it is valid for 6 months (6 months to enter the US). Is this not sufficient time?

You may ask the Embassy/Consulate to extend/re-validate the Visa - the worse they can say is 'no.' Not sure how asking can complicate matters.

Before going further - it might be helpful if you were to explain briefly what exactly your intentions are.. is this family matter going to take weeks, months or years?

This might belong in the consulate forum. I apologize if I posted in the wrong forum.

My fiancee was approved for her K1 Visa and we are approaching our deadline in a few months. We would like to delay her trip to the U.S. so she can take care of some final family issues. As far as I can tell from reading various websites, extensions are not generally allowed? I also read some embassies allow it, but it is uncommon. I would just like to know if it is even a possibility or any complications that might come up from trying to do this. If anyone has some pointers, I appreciate the advice.

Also, advanced parole. I have been reading up on this and if extensions are not allowed is advance parole a good idea? I have no idea how likely it is to be approved or denied. On that same note, how long is it valid for once they you leave the country on advance parole? Or is there a limit on the time someone be out of the country on an advance parole document? From my understanding, she will require advance parol until she is granted permanent status so roughly two years. Can more than one advance parole be granted in that two years or is that unlikely?

An Advance Parole is required for traveling from and TO the US while the applicant is waiting for the green card (AOS) to be approved. Once the AOS is approved, the green card is then used to show the individual is allowed to enter the US.

An AP type of Travel Document may still be required with a green card if the green card holder intends to be outside of the US for more than 6 months up to 1 or 2 years to show there is no intent to abandon residency in the US. For general purposes though, the AP is primarily used while waiting for the green card.

A few questions about advance parole.

I read this online..

Upon USCIS approval you will be given conditional resident status (CF-1: conditional green card) as an immigrant in the U.S. IF YOU DEPART THE U.S. WITHOUT HAVING GAINED USCIS APPROVAL AS AN IMMIGRANT YOU MUST QUALIFY FOR AN IMMIGRANT VISA OVERSEAS BEFORE YOU MAY RETURN TO THE U.S. If you need to travel outside of the U.S. before completing the processing, you must apply for Advance Parole at USCIS in order to reenter the U.S. and continue processing.

Is advance parole required only until a temporary or permanent green card is issued? Or will she always need one, even with a permanent green card until she becomes a U.S. citizen?

Removing Conditions on Residency General DiscussionI-751 advice
I apologize if some of these questions have been answered. I am just nervous about this as there are some bad stories I have read lately. Do they usually give people a hard time or is this part of the process generally pretty straight forward (especially with the evidence listed below).

One question regarding the paperwork and the fee. Do I need to send $590 and an I-751 for biometrics and removing conditions for my wife, and then another set of paperwork and fees for my step-son? Or does my wifes I-751 cover my son, along with her fee?

Are documents/statements I print out from online source acceptable? Almost all of my statements are online only, but if I need to I will call and have original statements/bills sent if I can.

Also, I am getting ready to send in my I-751 documents to USCIS for my wife and step-son. Here is what I have to send..

• Copies of the passports, green cards and Social Security cards for my wife and step son.
• Birth certificate and passport for our (2 year old) daughter.
• Two sworn affidavits by U.S. citizen friends and family, attesting to our relationship and marriage.
• Copy of the tax statement for 2010 and 2011.
• Many bank statements every few months from 2010 - present from our joint bank account.
• A recent utility statement.
• Letter from my company regarding the designation of my life insurance and medical benefits/coverage regarding my wife and children.
• Property tax statement showing us as the primary names responsible for the residence we currently reside at.
• Copies of various car insurance notices.
• A copy of our airline reservations for a vacation that we planned and took to Japan in November of 2011.
• About 10 photographs of the family at various points over the last 2 years.
• Letter with additional detailed information regarding our relationship and my family.

I do not have any credit cards in both of our names, as with my home loan since my wife does not work.
I would really like some feedback of additional information I should provide. I could not get my wife on the house loan, but she is on the various documents above.

Also, what is the best way to package my documents? In a lose folder? In plastic sleeves?

Thank you so much for any help you can provide.

Removing Conditions on Residency General DiscussionQuick I-751 fee and dependent question.
My wife came over on a K-1 visa with her son using a K-2 visa. When filing for removal of conditions after the initial 2 years of residence, do I need to submit an I-751 for her, and one for her son? From my understanding I submit one I-751 for her, and include her son as a dependent on the I-751.

On that same topic, what is the exact fee amount needed to be sent by personal check? I assume $505 for the I-751 + $85 for the primary applicants biometrics + $85 for her dependents biometrics with a total of $675.

Thank you so much for any clarification and help you can provide.

I am not saying it will provide much insight in to my case being able to track it online, but if you worry about not seeing it online there are options to get it fixed. Ask them to escalate your call to an escalation team when you call.

K-1 Fiance(e) Visa Case Filing and Progress ReportsApril 2009 K-1 Filers
I never saw this threat. I sent it in on April 6th and received my NOA1 one week later dated on the 9th. Now the wait is starting to take its toll. And yes, I hate the weekends which means no possible news. smile.gif I wish all of you a speedy approval.

K-1 Fiance(e) Visa Process & ProceduresG325 questions.
Hello. I am new to posting on Visa Journey but have been reading the forums and website for a few weeks now. I am engaged to a woman who lives in Japan and preparing to file the K-1 Visa application . I do have a few questions specific to our case which I could not find about from the forums or examples. Any help you can provide would be greatly appreciated. Hopefully the answer is not obvious and I just missed it. smile.gif

My questions are specific to the G325.. And I apologize if they seem silly. I have no idea how thorough the paperwork is checked or how specific the answers are required to be. From what I have gathered on some of the forums is that it is a hit or miss thing, and some things slip or are let by while others are not. But I would like to be prepared.

My fiancee is a widow and has a son from her previous marriage. My first question is what do I answer on the G325 for her son in regards to 'City and Country of Residence' for his father? Would it be where he lived and passed away or would I put N/A or Deceased as the answer?

My next question is about my fiancee. She was a student here in the US for a year in 2007, now do I include that address while in the US in her previous address time line? I figured I did but it couldn't hurt to make sure. On that same note, do I add that in the employment history to include that year of school listed as Unemployed or Student? I assume Unemployed.

And last but not least...

This is about my fiancees family. Her mother was born in a city that had its name changed a few years ago. On the 'Date, City and Country of Birth (If known)' do I use the original cities name or the new name? Or is the general rule of thumb that it should match the birth certificate for her mother?

Any advice is welcome. Thank you.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support
I have read many topics on this subject but I wanted specific advice for my situation if anyone can provide assistance.

I am currently out of the military and applying for a K-1 Visa with my fiancee from Japan. I do not meet the minimum poverty guidelines right now by $1000 or so with my current job. But I do receive disability for an injury I received while serving. It amounts to about $6000 a year. If I include bank statements, a letter from my company (stating my position, salary and other job information) and my initial letter stating how much I am paid per month from the government for my disability, will this be enough to satisfy the affidavit of support? I have read the instructions, but with me not meeting the poverty guidelines based on my job income alone I worry.

Another option is that I use a co-sponsor, and he far exceeds the poverty guidelines.. Is there any doubt they would refuse me based on my income and paperwork, or to be safe should I just use a co-sponsor to submit an affidavit or support with me?

Thank you. I appreciate any feedback anyone can provide.

K-1 Fiance(e) Visa Process & ProceduresDeath certificate question.
Thank you. The document she has is the Kaisei Gen Koseki. I just wanted to make sure that even though it is a copy of an old document, it is still valid in the eyes of those processing the application.

Thank you for the help

K-1 Fiance(e) Visa Process & ProceduresDeath certificate question.
I have a question about my fiancee and her previous husband's death certificate. In Japan they came out with a new format which supersedes the prior birth/death certificates. This change was made in 2006 and any new certificates she receives will not show any information on her prior husband's death which occurred in 2003 because it was prior to 2006.

But on the certificate (original Japanese copy and translated copy) it states clearly 'Following the Order of the Ministry of Justice, Ordinance No. 51, Schedule 2, Paragraph 1 (1994), this Family Register was superseded by a new format and was rendered obsolete on October 7, 2006.'. So my question is, will this be accepted when filing the I-129F application, or does that statement above give them reason to request additional proof of her previous marriage ending. I honestly have no idea how strict on the documentation needed to show proof of death is, and this document was issued as of February of 2009. Which kind of confuses me.

It was translated by a professional translation company with credentials posted on the document itself. They did copy everything, including the statement above word for word. FYI.

Any help would be greatly appreciated.

Thank you.

K-1 Fiance(e) Visa Process & ProceduresI-797C online status..
Simple question and I lack patience to find out by waiting so I thought I would ask. I just received my NOA1 2 days ago and it says to check my status online using the WAC receipt number on the I-797C. I did and it can not be found, and the same thing when I call their automated phone service.

My question.. How long until I can check its status online?

I think I need to relax a little, or else this is going to be a long six months. smile.gif

Thank you.
