I sympathize with your medical situation, and I wish you the best with your future surgeries.

 

Unfortunately, at the onset, they only log your petition as received and cash the check.  Then it sits on a shelf for many months waiting for its turn until an officer starts the process of actually looking though the file.  I think that most times that they find something is missing from the file, they will send the Request for Evidence and give the petitioner an opportunity to make the case complete before a decision is made to approve or deny.  Since they are asking you now for the proof of meeting, this would be the time that you would file the hardship waiver.  I personally don't know anything about this waiver.  I'm not sure if it's a form to fill out, or just a letter that you write that you send in with your evidence.  Hopefully someone will come along and provide more helpful advice.

This is going to be a very difficult journey for you.

 

There is an example of the Letter of Intent to Marry on this website.  It is just a simple statement that says that you will marry with 90 days of his arrival to the US.  On the top of the page, go to 'Example Forms' to find it.  It does not need to be notarized, but does need to contain original signatures so your fiance will need to mail you his.

 

Do a search on this website and you will find many cases where the I-129F petition is denied because of people not meeting in person due to the petitioner being disabled.  There is a waiver that you can apply for, but it is seldomly granted.  Along with the waiver, you will need to prove your inability to travel due to your disability and you need to show proof that you two have tried everything possible to meet each other.  This would include him being denied (possibly several times) for a US or Canadian tourist visa.  The expectation is that you meet in person.  It does not have to be in America or the beneficiary's home country, but anywhere in the world.  You would basically need to prove that it was not possible for you to meet anywhere in the world at any time.

 

As far as expeditiong the petition, at this stage in the game, expediting is probably pointless.  Once they have received your response to their Request for Evidence, they will make a decision on the case.  It would probably be difficult to prove that after living alone for so long with this disability that you now need someone by your side ASAP.

 

As someone else noted, there are a lot of red flags in your case.  Not meeing in person, being in an online-only relationship for a short amount of time before engagement, instantly fell in love, needing him to be here ASAP, and his home country is considered a high fraud country.  If your fiance is considerably younger than you are, then that would be another one.

Based on the family connection, and the fact that the petitioner had to leave Pakistan shortly after birth due to the same medical condition that is now preventing them from meeting, I think they might be successful if their case is presented well, and if the CO gives her the opportunity to fully explain. It may not be a cake walk, but I don't think it's hopeless.

The folks at the embassy in Pakistan will be familiar with cases of arranged cousin marriages. I've seen a lot of weaker cases (meeting on the Internet, chatting for a few months, no interaction between families, one 1-week visit together, followed immediately by a petition, etc) approved at tougher consulates on this site.

I just have to say that I'm pretty disappointed with the way this thread has progressed. The first several pages the OP had to repeatedly explain her situation because of the failure of people to read and comprehend what she was plainly saying. Then the Petitioner steps in to clear up confusion and is blasted because he isn't deemed sick enough.

We have all heard how difficult the waiver is to be granted, but if there was ever a case for it, it would be for this couple. The beneficiary has applied and been denied travel to the US twice. The petitioner cannot reasonably travel outside of the US for health reasons that have been documented and verified by his doctors.

To the couple, you both seem like intelligent people that are aware of the challenges you are sure to face in your situation. I do hope that despite the responses you have received on this thread, that you will provide an update for us on your visa journey. I wish you both the very best, and I hope that your waiver is approved.

I received the RFE hardcopy on 7/19.  It says that on my original I-129F I stated that I had never filed an I-129F in the past and that their records indicate that I filed one for <unknown Japanese person's name> that was approved on 4/21/04.  It then requests that I make a statement regarding that relationship.  It then goes on to ask if I married her.  In addition it states that I have filed three I-130 forms  that were approved.  Of course my G-325 I indicated that I have never been married, and it asked for a statement regarding my marital status.  

I have never been married and until just last year had never seen or had a reason to file any of these forms.  In fact, in April 2004 I was one month shy of graduating from university in Iowa where I lived on campus for all four years after graduating high school.  

I am not entirely sure what kind of statement I can make about what they are requesting other than to flat out deny that I had ever done any of the things their "records" indicate.  Shouldn't my personal info and SSN be enough for them to determine that their records are erroneous?  I don't know what kind of documentation I can send to help clear that up.

Any suggestions would be greatly appreciated.





 

My Fiance and I had a similar RFE. It said that he had hada previous petition. He called USCIS and asked them what he should do, being that he never applied previously. They had told him to write a letter stating that this was his first peition.

We received our hard copy of our RFE today. It asked for more information on the petitioner's criminal history. He needs to get copies of his court and police records to send in. Hopefully that doesn't take too long. It also said that he filed out an old copy of I129f. They sent only 1 page to fill out, the page with part c on it. We are guessing that he just needs to fill that in. I am wondering if any of you know if that is the case or not.

Ok so I'm a little confused on a few things,

 

1. How are they going to cash the check when I made it out to USCIS and not US DEPT OF HOMELAND SECURITY??

 

2. Could this really get approved? I had only the I-129F form, that means I was missing

  • G-325A and passport style photo (Petitioner)
  • G-325A and passport style photo (Beneficiary)
  • Birth certificate/US Passport (Petitioner)
  • Letter certifying intent to marry (Petitioner and Beneficiary)
  • Proof of having met in person in the past two years

Proof of ongoing relationship

 

 

For how much of a pain it is to get the initial approval (From what some users have said in past posts) how could mine even come close to getting approved. I will call them on Monday but I have also heard they sometimes do not even bother sending a RFE or responding back to you in cases like this.

I initially sent in the I-129F but I had only sent in the I-129 petition and a check (made out to USCIS and not US Department Of Homeland Security). It had been about 2 weeks since I sent it in and figured they pretty much just threw out the case because I was missing so many thing and didn't even make the check out to the right payee. Today I sent in a second petition but verified I had all the right documents and this time sent a check made out to the right department. Hi everybody,

 

I just wanted to ask a question about the address of the USC (petitioner).

 

I am a graduate student in California.  When we filed our 129F, I did not know where I would be living when classes started in September for school, so I corresponded everything to my parent's address (my "permanent address"), which is also in California.

 

Now that we have received our NOA2 and are in the process of planning for his interview, I was wondering if it is a big deal if I continue to say that my address is with my parents.... or if I should submit a change of address form.  The problem is that I do not know if I will be living at the same address at my university for much longer, because there is a chance that I'll be graduating in December. (in which case I will move back to my parents house until I get a job)

 

I guess my main question is that at the interview when or if they ask my fiancé "where does your fiancee live?" ... should he say with my parents, or should he say in the town of my university, which is 2 hours drive away?

 

Is it that big of a deal?

My mom is our co-sponsor for the Affidavit of support... and she is insisting that I cross out all but the last 4 digits of her SSN on her tax documents for the interview because she is afraid of identity theft.  She is worried the papers will get lost somewhere between California and France (I am shipping the documents to my fiancé for his interview)

 

Is that ok to do?  Or does the embassy need to know her entire SSN for some reason (I would assume yes if they want to confirm her identity somehow?)

First the K-1 visa process can seem intimidating at first but its not if you are diligent and most important sent the information they ask for read the guide on filling proof of the relationship it is important and  will save you time and frustration. The act that you have met him in the past two years is the qualifying thing and that at the time you apply you are both single.It is worth hiring someone to help you with the process.

10 years difference in age is not a problem I have almost a 15 year age difference and we are scheduled for our interview and have had no problems.

Okay so I am filing out all the forms for my K1 visa...  Most of it is pretty straight forward and just takes the time to sit down and think about what you are being asked.  I have a couple questions however...

 

1.  When and how do I file the form for a criminal waiver... What is the form number? It says that even though the case is dismissed I still have to say I have a criminal history.  I had a girl in the past bate me into a text war and when I told her off she told the police I harassed her... My case is sealed and dropped but still have to explain in this situation.   YES my finacee already knows about it.

 

2.  I am located in Colorado and trying to find my filing center address so I can send over all the forms I need my finacee to sign and send back?  Anyone have a link for that information?

Letter from my ex wife that used the fiance Visa saying that there was no abuse or crazy stuff going on.

Copy of police report for my criminal waiver...

 

The only question I have at this time is... I had an issue with a girlfriend that ended up with the poilce... We broke up and I was leaving her alone I had spent the better part of 2 years raising her daughter... When we broke up I left her alone... On Halloween  like a week later she sent me pics of her daughter saying she missed me and wanted to be a family again... Told her thanks for the pics and this is something not to be talked about over text messages... I called her 2 days later and she pulled another 180 on me... At that point we got into a 3 day text war... I did not know talking trash but not threatening to do harm was illegal... So when it was all done because she baited me into it and the officer saw what was going on.. They said if I went through thier DV program they would dismiss the charges if had no further run ins with the Law... Case was dismissed at this point.  It was three years ago... My prior fiance visa was 1999 so I am no longer under obigation under the laws of the affidavit of support.  Are they going to Deny my petition due to my history... I know I make enough to qualify so really I see no other reasons to worry for this case.

So I overnighted my papers... I know I just hurried my papers to get in front of a few more apps... I just want this to happen with my girl as soon as I can so whatever little things I can do to maybe help the timeline a few days I would do...

 

I got the confirmation that they have my paperwork... How long till I get the text that says they accepted my application... What does it mean that they have "accepted my application"?

 

After they accept my application do they then mail it to the corresponding center in this case it would be the Nebraska Center... So when I get my NOA1 what does that mean they have done or what is it's significance other than I cleared another hurdle...

 

What is the significance of the NOA2 as well...

 

last question is... I included my criminal waiver and police report and the proof that the case was dismissed... But because it was a DV for me and my ex girlfriend getting in a phone text war I had to be open about it... My fiancee has all the paperwork about the police report... I sent a letter explaining I completed the counceling and classes the courts requested me to... Is this going to be enough to get me through the gate keepers...  I guess the past is haunting me every night as I love this girl more than life itself and I can not imagine trying to build a family with any one else...

So I am going to go and see my girl in November...  I do not have my NOA2 yet and being we are September Filers I think I would be setting my expectiations crazy high for my girl to get her interview before then...   If she does that would be phenomenal.. But I would rather just not think about that... I found a good list of papers for my Embassy thanks to the VJ reviews!  Can someone please tell me   How many years of Taxes does my girl need to bring with her... I am going to try to bring all the forms down and completed so that when the times comes we just pay the fees and get her on on her way...  Is two years prior 4 most recent pay stubs... My letter from my employer the Affidavit of Support enough or do they more years?

 

Also... Through the interview reviews... Some went with some did not... Which way is best?

Okay... So I got my letter for My RFE...It was for the passport pictures... Do I need to resend the G325A forms as well or just the photos? 

 

My next question is what time frame from this am I looking at... I assume if there were a bigger issue they would have told me at that time.  So my assumption is that I am good to go one they get the photos?  Do they pretty much see what the request was see if I fullfilled it then move it on to NOA2 status?   Once I get my NOA2 status how long should I expect before my girl gets the papers? 

 

There is so many things we are trying to plan with my finacee's grandma having cancer and going through chemo and radiation.. At times it seems like we are trying to be two steps head so that she can care for her as much as possible while doing all this paper work... This is only until her aunt gets there in November.

Skype is a lot harder to get the chat log or call log if you use the app.  You should logging into your Skype account to download the call history (make sure you do this often--I heard Skype deleted it often).

 

As for Viber, it will keep a log of your chat/call record if you maintain the same device.  The log can be sent to an email address of your choice through in the Settings.

 

What I did with all of our call logs was to put it in a presentation binder...this is really cheap and looks organized wink.png

I have a question though. Is it ok if we document communication only after our NOA1 date or do we need it from the very start of the relationship?

 

I asked my fiancé about how he sent evidence of communication and he said he took snapshots of appropriate parts conversations in skype and emails.

 

I found a really great application for downloading skype logs here, http://www.nirsoft.n...e_log_view.html . One drawback in this is that I cannot isolate my fiancé call records, but I manually selected them, turned it into HTML and print it. I'm going to do this regularly so that even if msgs gets deleted, I will have a copy intact. :D

 

For Viber, I just checked the log they sent me in email. It's in excel and I didn't like the way the conversation and calls were listed. :( Really hard to decipher call durations. I'm taking screenshots on my phone periodically for different days where we had particularly long conversations.

 

I guess I can do the same for others as well. :)

My fiancé and I communicate on a daily basis through these various channels according to whichever is suitable at the time.

 

1. Facebook messenger - chat and voice messages

There are thousands of these and most convos are pretty private ;)

 

2. Skype - video calls more than chat

We use it for video chats mostly, but only when there is power in my area, so the records are limited.

 

3. Viber - chat, calls and voice messages.

 

4. Facebook group - we share links for the others mostly

 

5. Emails - well, email

 

6. MagicJack app - I call him on his US cell number (he is currently in US)

 

We also have a blog that we co-write, will that count as proof of ongoing relationship?

 

I know I should create a timeline for any and all sort of communication, but I dunno how to meld all these into one!

 

Any suggestions? :( HELP!

I received an RFE for not submitting the intent to marry from the beneficiary. On the top of the letter it states...

The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. Do not submit the English translation without the foreign language document.

 

 

my question is does he need to do a letter of intent in his native language or can he just do it in English. Last thing we want is for them to send another RFE that it needs to be in his native language.

 

 

 

 

 

Doing it in English is fine. It just mentions that "if" he does it in his native language, you need to provide both, the translation and the original document. Just have him write it in english to save the trouble of translating as well.

As other replies here state, you need to send in the original document. Printed version of a scanned copy might invite another RFE. sad.png Better to be on the safe side and have him send it by FedEx or something similar.

Definitely going to make a whole package. I've decided to make a scrapbook with all the images and ticket stubs (he did save them, yay!! :D ) we have together along with corresponding communication logs (includes skype, email, viber, facebook and magic jack). As you suggested, the scrapbook will be accompanied by a letter than chronologically lists the major events in our relationship. :)

 

We do not have any photos with my family though, as they were against the relationship at first. We only started the process after we finally got their blessing.

 

Your suggestion is duly noted about the blog. I think I'm going to skip mentioning it completely as we have talked a lot about marriage and weddings on it. Planning ours and telling stories of other's wedding though. We are definitely not getting married before we are done with POE. I do not want to screw up the process and have it take any longer than it should. This distance is hard on the heart. :\

Don't over think it. The consulate wants to be sure you have a legitimate relationship. You can include phone and skype logs, but that alone isn't going to get it done.  Photos alone won;t get it done. It's the whole package.

 

Your fiance should make copies of his visa stamps, ticket stubs, hotel, etc.  Anything that puts the two of you together at the same time.

 

Write a simple one page letter about how you met and how the relationship has grown.

 

Photos of the two of you together and with the beneficiary family are helpful.

 

Be very carefull not to mention anything about a wedding or engement ceremony in your letter, blog, or skype logs.  Remmember you are applying to get married in the future any sniff that you may have already gotten married will scuttle your K-1.

 

The beneficiary should know everything about the petitioner and his life. Typical interview questions:

 

Where does he work?

how many siblings does he have? What are there names?

Was he married before? how long?

Does he have children? Names?

Do you know he was arrested for......?

phone logs can easily be faked, so have little value. 

 

Photos, photos, photos.  Show the two of you doing everyday things a couple would do. Photos with the family, etc.  Tickets and recepts showing the two of you in the same place at the same time.  Type out a chronology of your relationship.

 

Ok..so not going to stress too much about phone logs. How about viber and skype? Are screenshots of our communication in those medium taken seriously?

 

We do not have that many photos of us together, but I have saved a few receipts from restaurants where we had meals together. I am confused as how to submit them at evidence as I do not have any supporting evidence that it was the two of us that had the meal in question. :P

 

I'm not sure if my fiancé has saved his tickets, but he has the visa stamps on his passport to prove he has visited the country.

 

When you say "Type out a chronology of your relationship.", does it mean a simple point wise dated events or more of a narrative nature?
