You are getting a bunch of confusing information.

I am self employed, and my Fiance only needed the most current copy of the 1040. There will not be any W2s, since as a self employed he will not have an employer who issues a W2 to him. If he is like most self employed people, his 1040 will show his business income and business expenses in a section on the 1040. The 1040 will then show his net income, and that is what he pays taxes on. The Embassy interviewer will look at his net income to see if it meets minimum guidelines.

In addition to his 1040 you are supposed to have letters signed by an officer of the bank for bank accounts and broker accounts he has, and these letters are supposed to show the current balance, the original deposit when the account was started, and the total amount of deposits since the account was started. I had that for each bank account and investment brokerage account I have, and things went very smoothly.

I can only tell you the procedure here in the Philippines;however, each Embassy likely has their own procedures. A call to the Embassy in the Fiance's (beneficiary) country will provide the accurate answer. In the Phil they permit you to give the Package Delivery company any address you wish to give them. They make it clear that it doesnt have to be to the address you used on the applications.

I went to the US Embassy web site for her country (Philippines) and clicked on Non Immigrant Visa. At that page I looked for Fiance Visa and then for Procedures. It gave the link for every stage of the process, including a link to the K1 Visa Package for download and printing. You dont have to wait until they send it to you, you can download and print straight from Embassy web sites.

The rules in the Philippines permit you to call the Embassy and reschedule the interview. Just call the US Embassy in Dublin and tell them you need to reschedule the Fiance Visa interview.

Our Visa is on its way, so the long and tortuous path through US Immigration approval of a Fiance Visa is finally almost at its end.

The other day I found out about a procedure Maria needs to do called the Exit Seminar through CFO, and it scared the heck out of me; since, no instructions anywhere in the whole ordeal we have been through mentioned it. We found out by accident, so now we will get that done too.

This of course raises the question of what else does she need to do that we have never been told about. I saw mention in my hours of research to find out about CFO, that there is a form she will need to complete called the I 94; however, this seems to be done when she arrives in the airport in the US with US Customs and Border Patrol. My memory in all this reading the other day speaks of some Philippine Emigration Form that will be needed too, but now I can't find reference to it anywhere. Maybe that is just a bad dream.

Aside from the Visa which is soon to arrive from the Embassy with Air 21, and the CFO Exit Seminar she must attent and pay for, are there any other procedures or forms she needs to do before they will let her get on an airplane with me. Is there a Philippine Emigration Form we need to complete and get notarized etc?

Thanks once again for any advice given. VJ has been a god send for me, and I've been going on daily now answering questions for others.

One of the things she needs to bring is something called an Immigration Data Summary for US Bound Emmigrants; however, no where do the instructions tell us how to get one to fill out. Dear Leo and Farah

First I'd like to say congratulations on finding each other, and good luck with the completion of the K1 process. Mine took a full year from filing of the I 129F to the interview, but on June 28 we got off the plane together in Florida and our dream has begun.

I went to be with Maria in January of this year, while awaiting Vermont to finish with their part of the approval process. Our NOAH 1 was on May 27, 2008, so when I arrived in Manila on January 18, 2009 Vermont had my Petition already for over seven months. I was determined to bring Maria home with me, and had already decided I was going to her interview, so when I arrived in January I was committed to stay as long as it took; even, if that ended up being forever. The NOAH 2 finally came on March 27, NVC about six weeks later, and the inteview finally on June 10 (you get to pick the interview date by the way).

In my opinion being at the interview had a positive effect on the outcome; in fact, I am certain it did. I've been in sales for many years, and I know abouut these things and can sense it. The pre screener actually called me up to the window. I made certain he saw me by getting into his line of vision, as opposed to sitting a good distance away from it like most other men did. When he asked Maria to call me to the window, he said to me: " I saw you standing there, figured you were the Fiance, and thought you could be helpful with some questions I have" After the Prescreen I went with her to the seats outside the interview room, and when she was called in I stuck my head inside and asked if I could sit in. The interviewer was polite, but said he would call me if he needed me. The interview was longer than most, but I already expected it to be. If there is going to be a swing vote, so to speak, I feel the Fiance's presence will provide it. Let's face it, one of the key issues is whether or not there is a true relationship. They say that a picture is worth a thousand words; isn't it locigal that your presence will speak volumes?

We have tons and tons upon tons of proof but hoping they'll cut us some slack with him being there with me.

So for those that have jointly attended the interview, any feedback or words of advice?

As the instructions say, the US Embassy uses St. Lukes Extention Clinic for their exams. That means they dont permit you to go to another place.

The Extention Clinic is not on the main grounds of St. Lukes Medical Center. I made the stupid mistake of driving to the main hospital, only to find out the Extention Clinic is in a different part of the city. The Extention Clinic is very close to the US Embassy. The Embassy is on Roxas Boulevard. Here is the information for the clinic:

SLMCEC is the U.S. Embassy's accredited medical facility. This is were medical examinations (Physical Examinations) for U.S. Visa applicants are done. Located at 1177 J. Bocobo St., Ermita, Manila. It is open Monday-Friday (except on Philippine holidays) from 7:30 AM-11;30 AM and 1:00 PM to 4:30 PM. Please call 521-0020 and 521-8647 for more information.

I went to my county courthouse and paid for an official copy, and I'm pretty certain that is required; although, I can't say its required for sure. Normally in any legal proceeding you must submit official copies, since you can do anything with your own Xerox copies.

I am still waiting for NOAH 2 (NOAH 1 was May 27), but based on timelines from this site my guess is we will have it within the next week. The average time between NOAH 1 and 2 for Vermont and applicants with a Fiance in the Philippines seems to be about 100 days, and September 4 was 100 days for us.

My problem is planning a plane trip, since to get reasonable fares I must order tickets at least one month ahead of time and preferably more. Once I get Vermont approval I plan to order tickets five weeks out, since the average timeline numbers from this site for Manila seem to be 10 days from Vermont to Manila Embassy receipt, and about 25 days from Manila receiving until the Interview Date. That is 35 days or five weeks. If average figures hold, my plans will work.

The questions I have for anyone who can help is this:

1) can we find out immediately after the interview if the Visa is granted;
2) can I ask to wait overnight and pick up the Visa the next day at the Embassy, or must we wait for it to be mailed;
3) can I sit in during her interview?

The answers to questions 1 and 2 are critical to the date I plan the return flight for her and I.

PhilippinesMay Vermont Approvals
My I-129F was received in Vermont on May 27, 2008, and today is 143 days with no action. My online account at USCIS shows last action taken as July 1, 2008. I'm wondering if there are any other May NOAH 1 out there who still have not gotten approval. I have followed the "Similar Timelines" from my timeline page, and it seems like every other one listed from May for Vermont has already gotten NOAH 2. I've even seen a few from early June who already received approval. Am I the only one? Can anyone give me insite into what is happening? I'd appreciate input.

I see you vacationed at a beach hotel in a place called Bohol. I'm not sure where that is, but I went back to visit my Maria last April for two weeks, and we vacationed on Cebu at a place called Plantation Bay. We had a great time for a week, after a few nights in Manilla/Makati. The place we stayed at in Manilla is called the Dusit Thani, and it was spectacular. After Cebu we went back to her home town of Tarlac and I spent time meeting her whole family, and building a photo album. While we were at Plantation Bay we met a couple who went through all of this a year before, and the husband told me he went with her to the interview and felt it was an assist to the approval. I thought he meant he sat in the interview, but maybe he felt just being seen was a good thing. He said they were able to stay overnight at a hotel close by and get the Visa the next day.

I'm wondering about a few things you can likely answer for me at this point. When the Vermont Center approves you, I've wondered if I will get an email notice (I set up the online account) before a certificate in the mail. From your timeline I'm thinking that is the case, since you mention a hard copy coming on 09-06 and an approval notice on 09-01. Was the approval notice the email? One thing that confused me from your timeline was approval notice on 09-01 and Arrived NVC 09-03. What does that mean? Isnt NVC Vermont Center, and aren't they the ones giving approval? If so why would the notice be arriving in Vermont on 09-03 after it was granted 09-01? What is the letter from NVC on 09-08? Isn't that the hard copy received on 09-06?

The other big question in my mind is whether we have any choice in the Interview date. Once you get NOAH 2, can you call the Embassy in Manilla and schedule an interview date?, or do we need to wait until they send a notice of the date via regular mail. Do they send the notice of the interview date to the Fiance with that package they mail? Will I get a notice of the interview date, or do I have to find out from my Fiance.

Did you keep phone logs and copies of emails. I was doing that until many months ago, but stopped because the attorney firm I used to review my petition told me they dont ask for those anymore.

Thanks for your help with information, and again I'm rooting for you big time on October 20. I see you are from Georgia. I'm not that much further South in Boca Raton FL.

I heard from another petitioner I met while vacationing with my Fiance that he attended the Interview. He told me he thought it might help in the approval process, and he also said they waited overnight to pick up the Visa the next day.

Can any of you verify whether or not the American Petitioner is permitted to sit in on his Fiance's interview in the Manila Consulate? Were any of you able to stay overnight near the Embassy and pick up the approved Visa the next day, or must you wait for it to be delivered by mail.

If your case takes as long as mine did, you dont have to worry about being at an interview in January. Your papers went to USCIS in April, and there is a very wide range of time for approval with them. Some seem to fly through in three to four months, and that would put your NOAH 2 sometime in July or August. Then the NVC seems to take with most people about one week, so perhaps by the end of August or beginning of Sept. you will have your papers get to the Embassy in Manila. They you call Manila and schedule her interview, and it is purely up to you when you schedule it.

My USCIS took ten months and then the NVC played with me for almost two months, so it was about one year from when I filed that we finally were able to get an interview scheduled. If you unfortunately end up like me, you wont have to worry about flying here until next Spring.

In any case, it is you who picks the interview date once the NVC gets done with your papers.

Chris introduced VJ to me some time last week of April and from then on, I became a VJ addict :=). And since i resigned from work after I received my USEM packet, i had the luxury of time to come online anytime I want to. From the time i wake up, till bedtime, on wee hours VJ was on. Few days passed I came across a post that prompted me to fly to Manila ASAP.(I am from the province) .I learned from the post about the need to bring an annotated MC on the interview. Originally, I planned to fly to Manila 2nd week of May to have my medical exam at SLEC, but for what I've learned, I quickly hurry myself to Cebu Pacific ticketing office to buy a ticket for the next day flight. The fare cost twice the amount of a regular fare, but i have to buy it anyway smile.gif. (Fare is way much cheaper if booked early).So, April 30th, Thursday in the morning, I bought my plane ticket hoping to catch NSO's next last working day (Friday) just to realize later in the afternoon that May 1 is Labor Day! No office. I tried to rebook it for Monday, but the rebooking fee cost almost half of the amount I paid on my ticket. Something I am not willing to pay. So, I found myself towing my trolley bag, running around Manila on May 1st. I head straight to San Pedro, Laguna at my aunt's and since it was an unexpected trip no one knows I am coming so they were surprised to see me. 'Twas a wonderful reunion after 10 years....

May 4, I went to NSO Office to process my request of annotated MC, BC and CENOMAR. The annotated MC waiting time was 17 working days starting on the day it was requested. The papers that I handed to have my annotated MC processed were: Court decision, finality of judgement, and certification from LCR. CENOMAR was 7 days, while the BC was ready for pick up later that day. May 6 and 7, had my SLEC medical exam. On my first day,I arrived at 7AM. I could have been there earlier than 7 if I did not head straight to St Luke's Medical Hospital hehehe.. Oh well, I want to call it adventure instead of katangahan :=).

Things to bring in coming to SLEC for Medical Exam :

1. Interview appointment confirmation letter .In my case, I printed the e-mail sent to me by the call center agent who placed my interview appointment
2. The letter received from USEM
3. Passport
4. Colored 2x2 ID picture with white background.

The security guard took the appointment confirmation letter, checked my passport, and put a stamp on my USEM letter. My last chest x-ray was January '09 as per work requirement, I told the receptionist of this, she asked me of the film but I only have the reading or the result with me. She said, they only take the film not the x-ray reading. So, i have to go through another chest x-ray. Note: Be prepared to fill-up DS 156K form. Have your fiance’s address in your notes in case you can’t memorize it yet, as you have to write it on the DS 156K. Take note of the date of your first day of last menstruation. This will be asked from you all throughout the process. The most awaited phase in the whole medical exam process was the physical exam. I was asked to wear the gown. I asked the doctor if i have to take everything off, she said yes. Without questions, I took the gown laid on bed, covered myself from the curtain and changed. I did not wait anymore for the doctor to ask me lay down on bed as obviously the next thing that she is going to do is to check our anatomy ?. If scars are noted, the doctor will ask how you got that such. Scars on the wrist are checked. This could be an indicative of previous suicides in which they take it as a serious matter to take into account as suicidal individuals may pose probable threat and harm to their citizens in the US. Around 11AM, my 1st day medical exam was completed. My second day appointment was set to 10AM. I arrived 8AM. I greeted the security guard posting right on the doorstep,with a smile and showed my claim stub and receipt, and he let me in. Then I showed the said again to the next security guard posted inside. He pulled my file up from their computer and verified from me if the picture i was looking at was me, I smiled and said yes!He smiled back and said, "congratulations! you passed! you may now have your immunization and get ready for your USEM interview". With a grinning smile, happily I said thank you! When I was interviewed for the immunization, the Doctor told me that I have the option to have the immunization from them or I may opt to have it in the US. I opted to take the immunization from them since it has been paid for already. I was done around 10AM. Before I left the building, I went to the security guard again to check if indeed He was sure I passed (makulit! hehe.. just making sure). He explained that once an applicant is instructed to have its immunization after the 1st day process, it means that the PE, laboratory and x-ray result are all good, and medical exam is successfully passed.
May 26, 2009 – USEM interview. My big day! The most nerve -racking ordeal I’ve ever had in my whole life! I resigned from work month before my interview date to be able to prepare the papers I need to bring with me during the interview. I’ve been running around almost everyday.
My preparation. -? was no joke! ? My NSO birth certificate was blurry, so last minute I asked my sister in Leyte to request a copy from my hometown’s local civil registar to back-up my NSO BC just n case they ask. I have to make corrections on my birthdate too that appears in my school transcript of records and the year I graduated. I attended 6 colleges/universities and i have to workback my TOR from the school where I started my 1st year and then on. These schools are from Leyte, Iloilo, and Negros. (btw, the instruction given to me by my immigration lawyer was to bring these on my interview as proof of identity.. who knows, these might be asked.?There’s nothing like being prepared.) Every day I was sorting pictures to pictures that seemed to be endless but fun. I’ve meticulously mounted them on a nice light green paper, one by one, arranged in chronological order. On the bottom of each picture was a caption describing the captured moment along side with it was its corresponding plane tickets or receipts. I put them in one folder. I included Chris’ passport printed on a 8R glossy paper showing the dates of travel here in PI (very important primary evidence!) This is what I did in my “proof of a meeting prior to petition”. In my proof of “ genuine engagement” I just simply put pictures of us with my family, picture of us in our engagement day with resto receipts and and our funny picture on IMAX with its tickets and Western Union receipts. Day before my interview, I found myself along the street of UN carrying one heavy bag that hurts my shoulder so much, and another computer bag on my other shoulder ,crossing the street as early as 6:30AM way to NBI office. I found out night before that my NBI clearance doesn’t have a dry seal! Supposedly the idea for the day before my interview was to stay in a hotel , so I will not be travelling early from San Pedro Laguna all the way to USEM, relax and unwind whole day. However, alarmed that the dry seal may be the cause of getting an RFE or whatever, I went to NBI UN to have my clearance dry sealed.However I find out from the NBI guys posted at the front gate that processing of NBI Clearances is now done at Carriedo. I explained my situation and one NBI agent offered to have my clearance dry sealed inside their office. Moreover,on the embassy instruction, it says “ NBI clearance should be in the applicant’s current name, birth certificate name, maiden name and any aliases or nicknames used, including different spellings you have used of those names” which I have not fully understood on how my name should appear on the clearance since I have an annulled marriage. I have always used my maiden name, never used my married name. All my records (school records, etc) are on my maiden name. However, the name that my lawyer used when we filed the presumptive death case for my ex was my married name. No one at the NBI could tell me how my name should appear on the clearance. So I went to the US Embassy hoping to get an accurate information but to find out, May 4th was Memorial Day in the US. They were closed! I spoke to the embassy guard and asked. He was nice, but then I wasn’t convinced of his advise to just have my interview the next day and find out if it is accepted or not and wait for their instruction. Huh?? No way! I want a pink slip! It’s what I was saying at the back of my mind. I thanked him and left. I went to NBI Carriedo to process again a new clearance, this time, my full maiden name on it. There are several people there that offers help for a fee which I took advantage. In less than 1 hour, I was done amidst the long endless line! For me, the fee was worth it than wasting my time being on the line waiting for my turn. Besides, I have to have my beauty rest that day. ?

to be continued....... got to do something very important. I am going to write my interview experience next time and to those who have PRESUMPTIVE DEATH cases as way of terminating previous marriage, my experience might help you ease the anxiety somehow... smile.gif See yah all in a bit!

My memory in all this reading the other day speaks of some Philippine Emigration Form that will be needed too, but now I can't find reference to it anywhere. Maybe that is just a bad dream.

Aside from the Visa which is soon to arrive from the Embassy with Air 21, and the CFO Exit Seminar she must attent and pay for, are there any other procedures or forms she needs to do before they will let her get on an airplane with me. Is there a Philippine Emigration Form we need to complete and get notarized etc?

Thanks once again for any advice given. VJ has been a god send for me, and I've been going on daily now answering questions for others.

The I 134 and 1040 you chose from your list happen to be the two most important documents on the list. The I 134 actually is the main document for the whole list, since it is the application forms your Petitioner fills out that is called the Affidavit Of Support. Without that document you would get refused a Visa. The 1040 is his annual income tax return, and it must be submitted as supporting document for the I 134. He doesnt need W2s if he is self employed, since a W2 is a document an employer gives to an employee reporting their wages. If he is self employed, he is the employer himself and his 1040 reports his earnings. The Tax Transcripts you refer to are the 1040, and you only need his most recent year; not, all of those years. I used only 2007 because I haven't filed 2008 yet and they were fine with that. When you say Bank Statement be careful. They want a letter from the bank, on bank letterhead, signed by an officer of the bank and notarized; instead, of a copy of a Bank Statement. Hope this helps.

You mention the Guidance and Counseling Form, and that is another one I can't find on any web site to download and fill out. I'm guessing that form is provided at the Smef-Cow center for the counseling session; am I correct?. Am I also correct in my guess that after the Guidance and Counseling session as Smef-Cow, which is located in Quezon City, she must get to the CFO Center in Manila to show the Certificate and get the sticker put in her Passport?

I've been living here with Maria my Fiance for about six months now, while waiting for USCIS approval then NVC and finally the interview. We will go home to FL on June 28, and I will look forward trendously to food I really like. I've managed to get used to some of the dishes, and I even like a few very much, but there are some I just cant stomach:

1. Kari Kari - like your fiance I wanted to vomit;
2. Dangus, Bangus, or whatever its called.;
3. Balot - of course Balot is on an internet list somewhere as the first most horrible dish of all world cuisines;
4. The dish that is basically boiled whole blood. I forgot the name, but i wont even go near the pot;
5. Dillis
6. That awful smelling pinkish red stuff used as a spice or seasoning made from ground fish and shrimp. The day I had it the family was putting it on some sliced fruit from a tree that was hard and round and pear shaped. I think its a Mango, but I thought Mangos were very soft. Anyway that stuff is worse than Balot.

No hotdog on spaghetti (but he likes sweet spaghetti, he even tried Jollibee spaghetti). They don`t use spoon to eat rice but they use fork instead.

PhilippinesCFO EXIT SEMINAR
I could use some help and advice with the things we need to do next, because I just found out about something called the CFO Exit Seminar and it is very confusing. Apparently we can’t just get her Visa delivered and get on an airplane to go back to the States. I have been told by other VJ members that Maria will need her Passport stamped with a sticker by the CFO, proving that she attended the Exit Seminar. I’ve been on the CFO web site and now am more confused.

There seems to be two different programs. One is for Philippine people going overseas to work, and the other is for Fiances and or Spouses. The first one appears to be held in the CFO building in Manila or on Cebu and the other one in a place for the PRISM Program in Manila (Fiance and Spouses seem to go to the PRISM program). The PRISM program seems to cost 250 Pesos, but if I am reading the web site correctly the Fiance still then has to go to the other location to get Verification and the Sticker, and that is another 400 Pesos. The other program at the CFO building appears to be scheduled by appointment at least five days in advance, but the PRISM program appears to be held without a need for appointment. I think she can attend PRISM without an appointment and pay the 250 Pesos, and then go to the CFO building without an appointment (since she is not actually attending a Seminar there). Since the Seminar at the CFO building is by appoinment five days in advance only, I'm worried that after attending the PRISM we then have at least another five day wait to get the Verification at the CFO building. I've got airplane tickets coming up in late June, so I'm worried.

This is so darn confusing. What can you tell me about it?

I follow what you are saying, but I'm wondering if a required procedure was bypassed before the child left with the Mother for the US. I find it hard to comprehend that a question wasn't raised regarding who had custody of the child in the Philippines, in the Embassy interveiw in Manila. If she told the truth that the child lived with his Father, I would think the Embassy interviewer would have asked for a signed release by the Father. Since the Father never gave a signed release, it is likely some other fake story line was given. If the Embassy doesnt require a release by whoever had custody of the child in the Philippines, and they go strictly by an approved I 130, then I guess a signed release by the Father wouldnt have been required. If in fact a release was needed, if hey knew of the Father having custody, then the fact that the child is here and the Father is there doesnt eliminate legal rights. Getting away with something improper is not the same as being free and clear.

I read through the sections you suggested, and I'm wondering about how authorities in the Philippines would interpret who actually had parental authority. In this instance the birth Mother registered her child in the surname of the Father, even though they were not married. The Father had been living for a number of years with his son, and caring for him, prior to the Mother getting an I 130 approved by USCIS and coming to the Philippines to bring him back to the US. The Father thought he had to give the child up, based on the legal document the Mother produced from the USCIS. He sadly let him go with the Mother, but he never signed any documents showing agreed to give him up. My question is whether the Father truly had legal rights to his child, since the child was given his surname at birth by the Mother and since it was the Father who was raising him and not the Mother.

The Son resumed a role as Father two years before the Granmother left for me on a Fiance Visa. The biological mother has a history of financial crime and indications she is a Sociopath. The Step Father has shown pictorial reason to think he may be a Pedofile. The biological mther has reasons from a vengeance standpoint to have brought a son she couldnt care less about to america, only to hurt the Grandmother who raised him and the true biological father. The Step Father of course has his own motives. They cut off all telephone or skype visual communication ten days ago, after the child begged his Grandmother (Mamma) to take him to be with her in america. The true biological father never signed any documents to permit his son to leave the philippines. I'm trying to find out if the mother possibly violated some part of the I 130 process, including the interview in the US Embassy, to get her son here. She admitted to my wife, when seeking her help to get documents for bringing this child to the US, that she originally claimed he had died in childbirth on the Petition that brought her to the US in the first place. She brought another child with her, and told my wife she was afraid to admit her first child was alive and being raised by his Father. We know she lied to USCIS on the Petition that brought her here with the younger child, by saying her first child was dead. Then she petitions to bring the first child to the US, so I'm thinking she had to violate some laws or procedures. The Mother never had anything to do with the childs upbringing. My wife raised the child from birth. The only contact the mother had was on his first birthday party. After that she never saw him. I have been a member for a long time,and advice on this site helped me to get through the Fiance Visa process. So once again I thank this entire community for the help we all give to one another.

I need some advice, and hopefully from an attorney or someone who knows the rules.

My wife raised her Grandson in the Philippines from birth through close to age 5 when she came to the US in July 2009 to marry me. We filed a Petition I 130 to bring her unmarried son over age 21 and his two minor children to the US. It was approved immediately, but the wait or an available Visa for this category is a disgusting ten years. We are now about two and a half years into that ten year wait. The childs birth Mother, who abandoned him at birth to my wife, is now livin in the US and married to an American. She did an I 130 to bring her son here, and somehow managed to do that without my Wife's Son's approval. My wife's Son had moved into my wife's house in the Philippines in 2007, and he resumed a role as his Father at that time. When my wife came to the US to marry me, her Son remained in custody of his Son.

Her Son told us he never signed any document that gave his approval for the birth Mother to take his Son from him and out of the Philippines. I looked at anI 130 , and no where does it ask who the father is and if there are any custody issues. It appears as if the USCIS will simply let a Mother petition her child on an I 130 and bring him here, whether or not someone with custody in the Philippines agrees or not. Is this possible? I called USCIS and they said they do not deal with custody issues, and that it is the role of the US Embassy to deal with Custody concerns. Is it possible that when my wife's grandson's mother went to the interview in the US Embassy in the Philippines, to complete the I 130 process, that they dont care if the child is currently in someone else's custody; namely, the true Father? Would the US Embassy have a normal procedure that asks who has custody and if they agree to moving the child out of the Philippines? From what I have heard about this birth Mother, she has a history of pathological lies and might have told the US Embassy the true Father was dead or disappeared. Can anyone shed some light for me on how she could have gotten her son wihtout my Step Son's approval.

My advice is to file a Fiance Visa, and yes the I 134 is still required.

When I went through this whole question of how to get my Fiance to the US, I was told that it is more difficult and takes much longer if you marry her in the Philippines first. For some strange reason that I do not understand, it is easier to bring her to the US if you are not married to her. The K1 or Fiance Visa will be processed much more quickly than the one to bring a Spouse (I think that is called K3)

It has been a very long time since I went through all of the paperwork (started in May of 2008), but I'm sure I recall that the Affidavit Of Support is mandatory. You need to be able to show enough income and assets to prove to the government that you will be able to support your future wife, but I also seem to remember that you can qualify if your parents are listed on the Affidavit of Support to enable you to meet the minimum criteria. I assume they would have to produce the same documents to prove their income and assets that you would otherwise have to provide. Each document such as the 129 and the 134 has two seperate PDF files. One is the actual application and the other is a detailed set of instructions. Just read the set of instructions for the 134, and you'll probably find the section on listing others who will provide the support if your data isn't sufficient.

My Wife came here from the Philippines on a Fiance Visa in 2009, and her unmarried son over the age 21 was approved two years ago on her I 130 Petition. We are now waiting the ten or more years the US Government has as the waiting period for an available visa.

This week her son was approved for a two week travel visa (B1) for a court appearence here in the US. We are waiting the five to seven days it will take for its delivery to his home in the Philippines. When my wife came here on the Fiance Visa, we had to have the Medical Exam at St. Lukes in Manila. I also remember a course she had to take and then forms approved from the Philippine government for her travel out of their country.

Does my Wife's son need anything other than the Visa that the US Embassy just granted, or can he just get on a plan with his Philippine Passport and the B1 Visa?

I received the 797C and set up an online account for email notices, and it is that form which shows the May 27 date. The Timeline page of this web site allows you to view other similar timelines, and that is where I have been charting the number of days from NOAH 1 until NOAH 2, then number of days from NOAH 2 to date received in Consulate, and finally days from receipt in Consulate until Interview Date. I've charted not only those from a month or two before my NOAH 1, but all of those in my month of May and some new ones in June. What is so disturbing in my case is every couple from my "Similar Timelines" from the month of May have alreay received NOAH 2, and one or two from early June have already received NOAH 2. The USCIS web site claims they are always processing those with dates received prior to yours, so it makes no sense to see those with NOAH 1 in June processed before mine which is NOAH 1 May 27. The only thing I can think of is mine is sitting on the desk of a processing clerk who is always out sick or just plain incompetent. There is no question that things slowed up right around Labor Day, because I noticed my chart showed the average days till NOAH 2 for the ones from early May jumped to 120 - 130 days from the earlier average of 100 days. My May 27 is as of today 143 days, so to me this is significant and sets off an alarm. Who knows, maybe today is my day.

Hi Carl,

Did you ever receive any paperwork from USCIS? After your petition was accepted at VSC, you should have received a confirmation in the mail from USCIS (form I-797C). It would have your case number on it (beginning with EAC). If you go to the USCIS website, you can enter this number to get updates on your case. If you DIDN'T receive this paperwork from VSC, you can also check the back of the check with which you paid and you can find the case number there (assuming you paid by personal check). If you don't have the I-797C or the case number, you need to get in touch with VSC to find out what is going on.

There are still other May filers waiting, though--it seems like VSC slowed down considerably and thus timelines are much later.

If it makes you feel better, my application was received in Vermont on May 27, 2008. Another guy I communicate with had a May 23 receipt date and finally got his NOAH 2 in the mail on December 13. It showed he was actually approved on December 9, yet the USCIS online web site account he has still does not show his approval. The USCIS is the most incompetent group of ####### alive on planet Earth. They don't ever update the web site regarding your approval, and they really sit on your papers for over six months. Don't believe the nonsense you see from other posters on this web site, since it will drive you insane thinking you are being descriminated against.

The fact is that a huge number of people show a NOAH 2 only 90 days (three months) after their NOAH 1. This is total horse ####. The US government isn't processing some people in only three months and most others in over six months. My belief is that many of the people who post on Visa Journey dont have a clue what they are doing. They file their NOAH 1 with numerous errors, get requests to send more information, go through six months to a year of waiting to get it right, and finally then count their NOAH 1 they report on VJ as the date the USCIS finally accepts their paperwork as valid. Then because they have already been in the system for nearly a year, the USCIS gets their approval within ninety days. The truth is actually on the USCIS web site, not here on Visajourney, and the fact is they are taking currently almost seven months to process an I 129. Based on all of that, my May 27 NOAH 1 should finally result in a mail notice of approval to me in the next week or two. If you are August, do yourself a favor and forget about things for anotther two months at least. These incompetent fat morons from USCIS won't get to your approval until February, at the earliest.

Sorry for the negativeity, but I've been misled by the nonsense reported here on VJ for the last half year. Just think logically. Why and how would the USCIS be pulling the applications of only certain people to approve in ninety days, when they report on their own web site over six months. Why would so many honest people like me be admitting they are still sitting here over six months later without an approval? Are we being selected for descrimination by these mindless government idiots? No way Jose. The fact is that it is taking over six months at the present time for Vermont to act on a first time submission of an I 129 F.

I have a question for those of you who have gotten the NOAH 2 but still read this thread.

How will I know when my paperwork is received by NVC and then leaves NVC? The NOAH 2 was reported by Vermont to me by email, but I was registered online with them for that. Will that same online system now work with communication with the NVC, or is the NVC communications strictly by regular mail? The follow up question to this is how will I know when the Embassy receives the paperwork? Will I only know that once Maria receives the package they send to her home?

Anyone who can help me understand what is happening will be greatly appreciated.

Maria and I were one of those unfortunate souls who ended up in Wendy and Gregor's Six Months and Waiting thread, and after ten torture filled months we finally got our USCIS NOAH 2. At first I was elated and thought it was finally over, because everyone else on Visa Journey seems to fly through the NVC in three days to at most two weeks. Our USCIS NOAH 2 was on March 27 and we still are lost in the Twilight Zone called the NVC. May 27 will be two more months of torture by these people.

Are we the only ones who have this horrible fate? Are there others like us who are mired in the labrynths of the NVC beyond the typical one week. Every Timeline I have read on Visa Journey when I click to get others similar to us have roared through NVC in just a few days. At most the long ones put in their timeline a week or two. Please tell me we arent some strange situation, and that there is hope this will end soon.

Hey everyone

I haven't visited in a while, so I just wanted to stop in and say hello and update everyone on our progress. It was heartbreaking to see that you are still imprisoned in this room Sara, and my prayers are that one day soon you will be out of here too.

For those of you new to this room, my message is to Keep The Faith. Our NOAH 2 was ten months in waiting, but we finally received it on March 27. My first thought was Thank God and now we will blow through the NVC like everyone else seems to do in three days. That was not to be, but just like with USCIS we were moved on when it seemed hopeless. On May 8 the NVC finally woke up and passed us on to Manila. I guess some of us just get alot more scrutiny from these approving entities. The only thing I can figure with us is it could be the number of times married and our age difference. It is also possible that my son got a Fiance Visa three years before I applied, and that got their attention. I dont know, but I'm just thrilled we are finally on our way to interview. I called the Manila Embassy a few days ago, and they quickly gave me a choice of between June 10 and June 29, so I took the first date offered June 10. This Sunday we will drive to Manila to stay overnight and then park ourselves at St. Luke's for the Medical exam at 7 am on Monday morning.

I pray that my first two experiences with time delay with USCIS and then NVC doesnt hold true with the Embassy; meaning, I hope they dont take months to let us know they have approved us. Its time for me to finally bring her home. We'll see.
