K-3 Spousal Visa Case Filing and Progress Reportsfinding out where we are in the process of approvel at on USCIS
OK I have been to the USCIS site and found check my status it just says in Initial Review is there anyway to find out where in this part we are at right now or is it a sit and wait thing? I am beginning to wonder were I will go from this point and if I can fill out some of the other forms that will be needed for me to fill out and what those forms are?

And are these the forms that have to be filled out along the way for the visa to be approved I-485, I-589, I-751, N-400, I-90, I-821, I-131, I-130 or I-765 or are they just on the status site?

My wife is in the Philippines and we have been waiting for the national statistic office to send our copy of the marriage certificate. We have the one from the Hall of Justice is that one good enough to use with the I-130 and the I-129f for the K3 visa?

You can request electronic endorsement from the civil registry... it will take 1 month.. coz if u will wait there time line to give u a NSO copy of MC. that would be 3-6 months..

but if u sent it together with I-130.. certified tru copy is acceptable from civil registry.. that is what we DID..

Thank you very much that helped a lot so with the one of our questions

It's true that you'll have a shorter timeline through NVC and things will be more convenient with regard to paperwork etc. if you stay in the USA until NVC complete but it's up to you to weigh that against the value of your time together during the 4 or 5 months between filing the petition and NVC complete. If you're retired or otherwise will continue to qualify financially and maintain your home, bank accounts and driver license (Why wouldn't you?) then I would say let practical matters rather than immigration matters guide your decision process. If I did for a living then, what I do now, I would have spent most of the time in China instead of the USA because I could. I didn't because I couldn't.

Thank you, No I am not retired, I have a job here in the states but have the opportunity here to have been at the same job to for so long that I have a lot of Vacation time accumulated that they have been wanting me to use it up lol
As for domicile have lived in the same house for 20 yrs here just have to have the monthly bills paid

The K-3 is effectively dead.

Strongly suggest you forget about the K-3.

For now - study up on domicile issues, and maintaining your USA residency whilst you live as an expat abroad - it'll be an issue on Interview Day.

IMO, the best time to 'make the jump to the PI' is the day after NVC has forwarded the casefile to the PI.

The two of you coming back together is not any issue.

Good Luck !

Thank you very much

As long as you can qualify as sponsor while living abroad, there's on US Immigration issue with you living in the PI.

Be aware that the K3 visa was effectively killed by the Dept. of State effective 2/1/2010, so all filing that I-129F will do for you is take your I-130 out of its place in line and put back with the I-129F. Just don't file the I-129F. K3 is dead.

OK we have not filed for the K3 yet was asking questions about it I guess I didn't make that clear thank you for telling us before we did

I have sent in the I130 packet and we received the NOA1 letter we will also be sending in for the K3 visa. My wife and I have been discussing me coming back to the Philippines and waiting with her for the visa to be approved and us coming back together will we run into any road blocks that might slow us down?

Also are there any forms that I fill out other than the affidavit of support and the I130, G825, and the I129f forms that I have to fill out

QUOTE (Bulex @ Dec 26 2009, 03:12 AM) <{POST_SNAPBACK}>
hi to all,

I need your help and advice! my fiance and I planning to get marry in Feb 2010, he only stay here for about 3 weeks. First of all what are the requirements he need or documents he will be bring here in the Phil? and how long it will take to have our mariage licence will be released? thanks!

If he has been married before he needs to bring his divorce decree, his birth certificate, passport, and he has to stop at the U.S. Embassy to get a legal affidavit of marriage. My advice is since you have applied for the K-1 visa is to do that because there is lot less paperwork to fill out and will get you to the U.S. quicker to be with him and get married here

US Embassy and Consulate DiscussionWhat is 1040?

Hi,
Apparently I submitted the IRS reports to the embassy instead of form 1040. Now they are asking me for my fiance's 2008 form 1040. What is this form? Does he need to fill out the form or does the IRS send one? I am guessing he should have the form when filing for his 2008 taxes?

Please Help!

It is the income tax form that taxes are figured on for the past year.

PhilippinesA strange airfare question

Not your typical airfare question.

I want to find a pair of seats for us from MNL to PDX (Portland, Oregon) which will be two seats alone, instead of two seats out of three or four. It seems awkward to explain that. What I mean is: Many planes have seat layouts of 3 + 4 + 3 or 3 + 3 + 3 (across the width of the aircraft). But, I'd like to find an airline & aircraft combo which flies from Manila into Portland (or Seattle) and has seats in pairs. Since all flights from MNL to PDX have stops somewhere, It would be fine if only the one long flight has paired seats like this.

I know I can somewhat figure this stuff out over the internet, but I must manually plod through the lists of flights and check each flight's listed aircraft at seatguru. Sometimes the flight will just say "767" and seatguru will list 8 different 767 configurations for that airline. So hopefully some of you remember the seat configurations from your flights over here :)

Delta airlines on there 747's has a 2 person seating in the back of the plane it is in coach class but it is cozy to next to the wife there and they offer good prices also they are not fancy but service is good

PhilippinesMY UNFORGETTABLE INTERVIEW EXPERIENCES

To all Vj members,

I apologize to all of you my vj friends for the LATE posting/sharing my interview here. I hope you understand me guys :innocent: but i know you all understand

As I'm done with my interview last Dec 15, 2010, I want to share my unforgettable experiences.

4:00am arrived at USEMBASSY manila

5:30am the guard informed us (all immigrants that scheduled 6:30am) to get inside

the guard took my 1st appointment letter (emailed by NVC) together with my new appointment sched which I did online

Then I waited 15 mins to get inside..we lined up inside the immigrant section. The lady asked me if I have ds230 printed then I said yes then she took it and give me my number. (6016) unforgettable # hehehe

As my number appeared on flashboard I go to window 22…

Pre-screener (she is Filipina) she is so nice. I felt comfortable talking to her. She asked me the following:

  • Who is your petitioner?
  • How old are you?
  • What is the name of your petitioner?
  • How old is He?
  • Is this your first to be married? How about Him?
  • Do you have any kids? How about Him?
  • Do you have any photos together?
  • Do you have a copy of your Certificate of marriage?
She is so nice. She said her good luck for my final interview.

I waited 10 mins for my name to be called to fall in line in finger scanning in window 15. The lady asked me to state my fullname and my date of birth. After that the lady that assisting us (doing the finger scanning) told me to go to waiting area for final interview.

After 15 mins my number flash on to window 44. She is American, I think her age is 26-30 yo. She let me raise my right hand and swore that all i will be stating is true. There are the questions that she asked me:

  • Who is you Petitioner? His name? His age?
  • What is your name? Your age?
  • When did you get married
  • Are you living alone? (in this question she asked me took me for another interview) which took me almost 4 hours (coz there are some questions concerning my nephews.
She told me to wait outside for my name to be called. I was so worried coz I'm expecting the magic coming from her "visa approved" I didn't heard those words. But I thank her instead.

My name was called at window 33 (If im not mistaken) the guy told me that I need to have another follow-up interview. So i went to the office that the guy instructed me to go. There are lots of offices inside in the corridor I saw the lady approached me asking my name. And she let me go inside her office..she gave me 2 pages of questionnaires (back to back) all my hubby's infos and mine too. It focuses on my information about me, my parents, my sisters, brothers, nephews etc.

The lady forwarded me to a guy in the next door. He asked some questions about my nephews which I answered and defended. At around 2:30 he forwarded to American Consul (guy) for interview. He let me swore that the statements that I made is true and correct. Then he told okey "tapos na tayo" (We're done). Then the guy that facilitated me took me to exit door. While we're on the corridor I asked him if hows my interview and he told me its okey I'm sure you'll do fine and I think your visa will approve soon just wait for the a call from embassy to informed you. I was not happy enough I left the embassy not sure of the status of my visa. Finally my day is done at 3:30pm. As I went home I told to my husband about what happen in the whole day of my interview day. The following Monday, Dec 20, 2010. My husband called up usembassy manila to know the status of my visa. As I saw him (in webcam) smiling while talking to live operator. Then after he put down the phone, he said its approved! Thanks God!!! The operator told him that my visa is just printed as of today, December 20, 2010 and need to wait for 7 to 10 days to be delivered. Yehey!!!!:dance::dance::dance::dance:We're finally done with our visa journey.:dance::dance:

I'm so thankful to vj site as well as vj members. Thank you so much guys. You're all part of our journey. God bless you all!!!:D:D:D:whistle::whistle::whistle::whistle:

Well looking at this part of the forum here on self-employed sounds like I am not the only one with questions on which line from the 1040 and deduction work sheet to use. I just took my amount that I made this last year and put that in the amount made on the I-864 and sent in the two IRS transcripts for the previous 2 years.
