Hey Everyone 

 

I need to create a supplement sheet for my G325a. I have a few questions regarding this. 

 

1. On the G325a should I use the first 4 rows and then put see additional sheet in row 5. Or should I just put see additional sheet in the box and put everything in the supplement sheet. Or does it not matter? I think I would prefer to put everything in the additional sheet so that I can fit in all of the addresses for everywhere I've worked

 

2. I can't see anywhere if there is a specific format I need to use for the supplement sheet. Does there need to be one? Or can I just make my own as long as it has all of the required information? 

 

3. I have attached the additional sheet that I've created. Could anyone tell me if it looks ok?

1. You can simply put "Please see attachment", and write all the answers on the additional sheet.

 

2. No specific format. As long as it clearly shows which form it supplements and the question/s to which the answers correspond to.

 

3. Format looks good. Btw, I don't think you need to say you're unemployed for a particular period. It only says to answer "None" if the applicant is never employed at all. :)

Hello All, 

 

I am preparing my packet to mail to USCIS and have a clarification related to the following.

 

Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. 

 

1) Should the Original statement include Marriage location or Marriage Date?

 

2) Is it just each written statement on word document by both of us?

No need to specify the marriage date or location. You just need to indicate that you guys will marry within 90 days of [beneficiary's] entry to US. The example Letter of Intent here in VJ is a good template to follow. See here: http://www.visajourn...ontent/examples

Was wondering the next step...

 

 

Does it go to her country embassy next? 

I read somewhere where it goes somewhere (NVS ?)  for a security check, then to the embassy???

 

 

She already went for a physical and has received it in a sealed package... 

 

any help would be greatly appreciated on the next steps and approx timelines

What uscis will mail is NOA2 or the Approval Notice, which is Step #4 in the flowchart. Next would be NVC, which would take about 2-5 weeks from receipt of NOA 2.

We're all on the same journey... some of us a little further apart from our fiance/e than we want to be.  Does anybody want to share any words of encouragement.  I know I'm loosing it.  I havent seen my fiance since October and hes a good ol 9000 miles away...  not possible to travel and see him as of now.  I guess you could say I'm reaching out to those who are in the same boat.  Thanks  :thumbs:

 

It is indeed a long-winded journey! The K1 process only strengthened my relationship with my then fiance and now husband. We didn't have a perfect relationship and being away from each other didn't help. Patience is truly a virtue in this journey and understanding each other's nature took time. 

 

We are very lucky that in this generation, we only need to do a couple of screen strokes, and our messages to our loved ones across the seas will reach them already in seconds. There's also skype and facetime to see each other for hours in a day. Imagine the agony years before just thinking if your letter even reaches your other half!  :lol:

 

I am very happy and thankful we are over that stage and now, living a happily married life here. Cheers and wishing you and your fiance all the best! Let me assure you that all those waiting is definitely worth it. :)

I was so worry. I didn't know that I should put my petitioners info in there which is my fiancé. And I know the fact that I cannot edit my application. What should I do? Should I make another DS-160 form?

I agree with you that it is somehow a tricky question indeed as fiance is not legally defined as an immediate family. So don't worry too much about it now. If it comes up to the interview and I highly doubt it will, just be truthful on why you answered so.  :thumbs:

Hey Jhammin. Just to add, do check if your fiance's most recent 1040 (This is the ITR.) line 22, which is the gross income, is well and above the poverty guidelines: http://www.uscis.gov...form/i-864p.pdf

 

Consider the 125% value of his household size, that is "him + dependent (if any) + you". If the line 22 value of his 1040 is a good high value, then you only need to bring his "2013 1040 and W2". IRS transcript would work as well. Then you are good to go! 

 

If the number on line 22 only meets it (say $20 k for a household of 2), you also have to ask for his employment certificate and recent paychecks (about 3 months),some Manila COs have been known to ask for this.There had been experiences months before that 3 years of 1040 + W2 was asked as well, if the petitioner's gross income is barely there.

Hello all. I work for a fortune 500 company and contacted our global HR for the employment letter. The letter I received isn't signed or stamped. Will this be a problem? It is on letterhead and contains all the other information required. Thanks.

 

It should be fine. Most big MNCs and big companies have a standard template for employment cert. As long as the pertinent info, such as the job title, annual base salary, hire date position, etc ... and an employment verification contact info are given, there is no reason for your employment letter not to be accepted. More so, if you have recent pay stubs as well.

 

In my case, it was not asked during my K1 visa embassy interview, but I did file my husband's employment letter (with no HR or employer's signature) as I-864 supporting doc for my adjustment of status recently, and I did not encounter any issue.

As mentioned above and basing from your timeline, you will need an I-134 for the K1 visa application. Forwarding 2 copies to your fiance would be a good idea plus the supporting docs. Most consulates would require the petitioner's most recent 1040 and W-2 or 1099, provided the petitioner meets 125% poverty guidelines.

K3 is practically obsolete, so forget that.

Your fiance visa petition and your son's CRBA are separate applications. They can be filed in parallel or one can be filed after the other. However, just be mindful that a K1 visa application may take 6 months to a year. So might be a good idea to get a headstart on this.

The approximate processing time from NOA1 to NOA2 is 5-6 months. I have read that some processed through TSC lately were going for 6-8 months for approval. This is without the NVC processing, medical and embassy interview. The latter 2 timing depends on how your consulate set interview schedules. It could take an additional 2-4 months more from NOA2, and this is without the extended (dreaded) AP period.

 

It's understable that you guys planned ahead, but you have planned for it too soon and without sufficient buffer. As Girl from Celebes mentioned above, the general advice here on VJ is to not book tickets or set wedding dates without the visa in hand yet. I guess, best to inform your guests soon that the wedding date will be moved before they book their own flights, etc.

As advised above, petitioners are not required in a K1 visa interview. If you intend to attend your fiancee's interview, do check out your consulate's reviews if you can even enter the embassy. Some embassies don't allow entry of non-applicants. Or maybe anybody who went through Montreal can chime in.

During my interview, the American CO did check out my ring, and asked when my [then] fiance gave it to me. However, most of the K1 applicants I met then didn't have a ring, and everybody was approved, except for one who had a 221g for recent paystubs. 

 

So I agree that not having a ring would cause a denial, but it would definitely help as an evidence of genuine engagement.

Just made sense to me that if your application goes to Texas that it would start at the Texas Service Center, than get transferred. OK, I guess not.  And those people that have been transferred, do you get a different letter later on or does that usually happen in the beginning of the process?

A transfer happens months after being assigned. Mine was transferred after 4 months in the Vermont Service center last year. It is highly unlikely though for a I-129f case to be transferred [this year].

Just wondering this, since when I went to file my K-1 the only address they give to file is the Texas service center. Did everyone else choose to file at a different location, and how did you chose where to send it. I had a friend that had a lawyer do hers a few years ago, and she said she thought it went to Vermont or something. I am just confused because if the USCIS had a different location to send it too on the website, I could've picked differently. Thanks everyone :)

 

I-129fs are only sent to the uscis Dallas TX lockbox (http://www.uscis.gov/i-129f-addresses), and NOT to any service center. This is not the same address as the Texas Service Center either.

 

Uscis will then assign the service center depending on the state of the petitioner.

According to http://www.visajourn...m/content/times the Texas Service Center is 5 months behind the California Service Center. Texas is currently processing I-129Fs from January while California's on ones from last month. Additionally, the graphs show a 30-day turnaround time in California.

 

I sent it to Texas because it's the address I found on http://www.uscis.gov/i-129f-addresses and I didn't even realize there were other places I could send it. My question is, is it possible to resubmit my I-129F to the California Service Center? I'd even be willing to eat the petition fee again if it means my fiancée can get here 5 months sooner.

Texas service center is not the same as Dallas Tx Lockbox. You are correct on sending your I-129f on the address listed in your link and knowing that, you can't send it directly to just ANY service center.

Thanks so much for the information!  Unfortunately Qatar does not require you to live in the country in order to get the clearance so it is obtainable, it just takes time.  Yes so many costs for this process but so worth it.  I hope they do not require the document.

 

Funny your wife no longer likes Sky Flakes, when I returned from my trip to Manila during Christmas the official in San Francisco who checked my passport was a US Filipino and he asked me if I had brought any Sky Flakes back and I said yes my suitcase is full of them and he was hoping I had some in my carry on :)  I have to sneak them as they are not on my official diet at this point :)

 

Hey Tom! Agreed with Caryh. If the Qatar Police certificate didn't arrive by the time of Michael's interview, he will only receive a 221g. The issuance of his visa will then be pending until the embassy receives it. But given the difficulty of getting an appointment with USEM now, I would also just hold on to that July 16th interview date.

 

Ahhh.. Skyflakes! It does give me nostalgic thoughts. It helped me survive hunger during thrifty college days! :D I don't see any here in the near Asian supermarkets though.

You will only need liquid assets or savings which equates to 3x of whatever is lacking from your gross income. 5x applies to sponsors that are not immediate relatives of the beneficiary. You fiancee is considered a spouse [-to-be].  http://travel.state....forms-faqs.html

 

But again, you really have to check with the embassy where your fiancee will be interviewed at. Some consulates don't accept assets/ savings and even co-sponsors at all.

 

Which country is your fiancee from? Maybe somebody here who have gone through that consulate may be able to give you more definite answers.

thank you for your response. a question on the income, though. you say "a key to the criteria is having 125% of the poverty level," but that is not what the website says. i understand it to say if you don't make the poverty level in salary, you have to show 125% of the difference in assets. i have that and more in savings.

if this were not the case, why would they state this? these are the tricky things that bother me about the process....it says one thing, then goes onto say BUT.....

 

 

It is indeed tricky and sticky. But as you know already, approval or refusal of a visa is always up to the consul's discretion, which again always relies on the embassy's criteria. Their goal is to make sure that an applicant won't be a public charge once they arrive in US. And to establish that, they have to see the petitioner's ability to sustain the beneficiary (and everyone else included in the petition). In your case, they have to make sure you (and your co-sponsor, if permitted) are capable of doing so.

Hello. I'm preparing my fiance's I-134 for her interview. Trying to double check a few things:

 

1. it says on the FAQ sheet that a "bank officer" has to write indicating when I opened my account, how many deposits I've made in the last year, and total deposits. Do I really need this, or would simply a series of Bank Statements from the last year suffice?

 

2. Income requirement: I will be a full time graduate student next year, only showing about 8,000$ worth of salary from a graduate assistantship stipend. Am I right in understanding: federal poverty rate for 2 is 15,700. I then need to show FIVE TIMES 7,700$ (the difference between the poverty level and my salary) of assets? I have closer to 10 times that amount. Will I have any trouble, or do you think a co-sponsor is required?

 

3. Any other suggestions for those who have gone through this? For instance, I don't have a copy of the i-129 fort my fiance to take with her. Is this a problem?

1. Agree with Vutran's advice. However, it still depends on the embassy and CO's discretion if whatever you submitted would be acceptable and sufficient.

 

2. Actually, the poverty guideline for a household of 2 is currently $19,662, unless you're from Hawaii or Alaska (http://www.uscis.gov...form/i-864p.pdf). You can use a co-sponsor if annual gross income is insufficient. Again, this highly depends on the consulate where your fiancee will be interviewed at, whether or not they will accept co-sponsors. Check the embassy reviews linked in the blue header atop any VJ page to see if they accept co-sponsors.

 

3. The consulate reviews will give you a good idea on how embassy interviews are done in each country. A copy of the I-129f is not necessary, but it would be nice for your fiancee to know the information you have written and submitted with it, like for example, the details of how you two met, as this is typically asked in an embassy interview. And of course, always follow the embassy interview instructions for the required documents which are specific to your fiancee's country.

 

Btw, when you have a chance,  :time: and profile, so people who are trying to help can give you more definitive response to your concerns.

Ours is first person too. Although on our I-129f, we used a lawyer who suggested third person voice in referring to the petitioner and beneficiary. We followed how we wanted the forms to be answered anyway.

My Fiancé and I have pretty much everything in order to send off for the K-1 Visa. He's from the UK and has gone about 2 years without filing (not sure if that's what they call it), his taxes over there. Would this be an issue that could possibly delay the visa process or even deny it? If so, we'd like to know in advance so we can remedy the situation sooner than we had initially expected to.

 

And as a side note question...for the medical examination, I read that they will look through your medical records. Is this correct? And if so, is this just to make sure the person doesn?t have a severe illness?

Please be advised that the I-797, Notice of Action sent with your inquiry is a Receipt Notice and not an Approval Notice. Please provide a scanned copy of your I-797, Notice of Action - Approval Notice indicating that your petition has been sent to the National Visa Center (NVC).

 

In that I-797 statted that my case was sent to Texas center... What does it mean? It got lost? I still have to wait for approval? How much longer? It was sent to with a date of April 22...

The first notice you received is what is commonly known here on VJ as NOA1, which is step #3 in the link above. This is just to notify you that they have received your payment for your I-129f application and that they have forwarded your files to Texas service center (TSC), which will then proceed to queue in your application for review. At TSC, it is currently taking 6-8 months for the approval (NOA2). So it is best to prepare and brace yourself for a long wait.

Is it ok to staple forms together that have many pages, i.e., passport copy, I-129F petition, phone logs, divorce decree?  I thought I saw somewhere that someone said no staples only paper clips.  Is that true?  I want everything to be correct the first time.... and yes I'm OCD.

 

Don't staple anything because somebody at uscis will be removing the staple wires to rearrange your files.

 

As advised above, use paper clips instead to bind those that need to be together and then slide everything in an envelope. Or you can also use a bigger paperclip or binder clip to keep everything intact inside the envelope.

Yes, sis. The doctor will check your body physically including the private part, but just visual. No pap smear.

Yes, I triple-checked the address before I sent it, and my receipt from DHL shows the exact same address that you posted. :/

It is indeed strange that the courier/ delivery guy wasn't able to locate it, considering this isn't their first time in delivering to the same address. We also used DHL for our I-129f. If it were me, I would send them the google map page (linked above). Or they can also contact the uscis customer hotline: 1-800-375-5283

I wasn't expecting to make my first post about a problem so early on in the K-1 process, but here it goes:

 

I recently sent an I-129F petition from overseas via DHL. I was informed by DHL that they were not able to make the delivery because "physical access was denied to the courier at the time of attempted delivery." They asked me to provide additional information, such as a gate number or at least a contact phone number for the recipient (USCIS). Has anyone had this problem before with DHL or any other shipping service?

 

The Lewisville TX address is a physical address. Note that it has a Business Suite Unit number. Can you check if you have copied the exact address as follows?: (http://www.uscis.gov/i-129f-addresses)

For the pictures, you can just ask your fiance to have a new picture taken on a white background and send you a soft copy or photo file by email. You can print it yourself in a photo paper (or have it printed) according to the specified passport size (2" x 2"), in anticipation of a potential RFE.  :thumbs:

Thanks for the information, 8-10 months is a really long time.

 

Do you think it may be worth having her come over in a few months on an esta visa, marrying here, and then applying for a status change? Seems risky since I know you arent supposed to be coming in the country with the intent of immigration.

 

That's currently the case and I agree that it's indeed a long time. Hopefully, the processing time at TSC will improve soon too.

 

I'm not from a VWP country but from what I read, if one applies for a visa and was refused, it makes it extremely unlikely that an ESTA application will be approved. The gf from sweden finished her au pair here in America, went back home for the summer and planned to come back this august with a student visa. After two attempts, she was denied both because she couldnt prove to the consulate that she would be returning home after her 4 years. Obviously being young, she didnt have a home or a permanent job after just returning from being an au pair.

 

My question is, will these two denials effect our chances of getting the K1 visa approval?

 

Im planning on traveling over there in September with a ring, I am just unfamiliar with how this all work. I would hate to spend all this money trying to make this work only for it to be denied.

 

Any thoughts on this situation?

Previous non-immigrant visa refusals won't affect a K1 visa application, so no need to worry about it. You guys just have to be truthful in the forms and whenever any information about her previous visa applications is asked.

 

Being your state is Connecticut, you will be assigned to Texas Service Center (TSC) and recent timelines for NOA2 approval are running for 6-7 months plus the NVC - consulate stage which may take 2-3 months more. Unless there will be improvements in place soon at TSC, better be prepared for a wait of about 8 - 10 months from I-129f filing.
