Yes, I used a table of contents. When I am assembling anything for immigration I pretend like I am reading it and I have no idea about the person who is applying. It's driving my husband crazy because he makes assumptions like "they won't need that" or "why do I have to do that" or "that should be good enough". LIke the others, I think that giving them more information is better than not enough. Use tabs, table of contents, anything that will make it very easy for them to find your evidence, to read your application easily and be able to go to your attachments easy. That's my theory. As a matter of fact, I am assembling my package 3 (even though I haven't gotten it in the mail yet) and I think I will use the tab idea. Thanks alot.

Does anyone know if I would have a better chance of crossing the border to get into the u.s. with my u.s. husband with me while my k-3 visa is pending. I didn't want to wait in Canada till my interview and I'm afraid of being denied entry if I try to cross by myself. What do you all think .... are my chances better crossing by myself or are they better if my u.s. husband flies up to Canada to get and then cross over with me.

Get it done now. Doesn't the Packet 3 checklist require you to arrange the medical? Ideally, you want to take your medical results to the interview but not absolutely required. If you dont have your results by the time you go to the interview, it could hold up the issuance of your visa.

You do not send any originals of your documents with packet 3. You simply check them off if you have them. You send back the checklist (given that you have everything on the list) AND the form they ask you to fill out on the checklist (not sure which form it is in Mtl but for Vancouver it was DS230). I just got my package 3. I have afew questions so here it goes and thank you all in advance for any help.

a) Can I speed up a police check in Hamilton? It will take 2 weeks if I mail in the request and the money order for it.

cool.gif do I send originals or copies with my package 3?

c) which documents do I need to notarize and/or certify with package 3?

d) can I get a medical done now or do I have to wait for interview letter?

e) will I need to send evidence of relationship with package 3 and if so can I send copies? Also my phones don't have a date on them. Will they accept computer copies (not very good)?

You've got two choices.

1. Change the name in the passport.
2. Notifiy Montreal and and include an explanation.

I recommend your passport bear your current legal name if it changed at marriage. It will make a lot of things simpler in the future.

you know what, I had the same question. I was visiting the u.s. and I wanted to get my medical done down there but I decided to just go back to canada and do it. I didn't want to be questioned at my interview about why I had it done there. You see, you are supposed to be waiting out your visa in your own country. I didn't want to take a chance. If the interview officer saw that the doctor wasn't in the country he may question you. I don't know if it is even an issue to them. I might want to call the uscis customer service line....although I don't think alot of them would even know. You have a good question and I hope someone responds to your question who did get it done in the u.s. Good luck.

HI everyone,
I came into u.s. with k-3. I decided to apply for EAD without the AOS application as my 2 year anniversary will be in April and I plan on filing at the end of the year (so I don't have to remove conditions on the AOS and I can get a 10 year green card). There was no A# on my NOA for EAD (I-765) and when I went to my biometerics apt. today she said that she wasn't going to submit an A# with my biometerics. Will that cause a problem for my EAD to get approved? Hope someone can help. Thanks

Hi there,
I traveled back and forth to canada while I waited for my k-3 to be processed. You might have a hard time at the border and you might not. It's all depends on the officer you get on that day that you cross. If you take along evidence that you plan on returning back to Canada and are just visiting the u.s. for a short visit...they might let you go in or they might not. I got pulled over once and was drilled and other times they just told me not to stay longer than 6 months. Just don't lie when you cross over. That is the only advice I have for you. I also think it is against the law to go into the u.s. and apply for AOS with that intend in mind. If you went into the u.s. for other reasons and then met your spouse and got married and then decided to stay and not return.... then your intend was not to stay when you left Canada. It's all about your INTENT. ONce you start one application I don't think you can abandon it and try another application so decide which way you want to go and stick with it. I went the k-3 way and kept visiting the u.s. till I got my k-3 visa approved. I hope this helps you.

t and it took about 100 days. Check my timeline. A K3 EAD expires with the I-94 or at AOS approval, whichever comes first.

You didn't make a mistake but I may be wrong but she doesn't have to go back to Thailand to file K-3. If you can prove that she didn't come to the u.s just to marry you and stay here and get her green card then she can stay and file for a AOS.

Hi everybody. I love this site. I get so much more info from here than anywhere else. God bless all of you are trying to help all of us. I am abit worried about my visits to the u.s. My husband just rec'd NOA 2 from California for both the i-130 and the i-129f (K-3). I have basically been staying here in Iowa with him since July, 2007. I have been back to Canada 2x's since July for 2 weeks on each visit. I am planning on going back for my interview. Will my lengthy stays in the us jepordize my k-3 or cr-1 being approved? I have been totally honest with the customs agents everytime I have crossed over to the u.s. The last time I crossed was Nov 10, 07 in Sarnia and they did pull me over and I had to prove that I was in the process of applying for my immigration papers. One word of advise to all who are going to be traveling back and forth to and from Canada and the u.s. while you are in the process.....TAKE ALL YOUR APPLICATIONS AND APPROVAL NOTICES WITH YOU!!!!!

From my experience and what I have read on here, being denied for something like lack of ties to Canada has not created a problem at all with the officer at the interview. It seems to have happened to quite a few people and the officers are used to it.

That was the time I was sent into secondary and grilled by this crazy lady in there for about 30 minutes. She asked me for ties, my return ticket and my first born. The whole time she was interrogating me, I was sure she was going to whip out the rubber gloves and order a cavity search on me. *shudder.*
The wedding was awesome though! My parents flew down from Canada and we were married on the beach with a bagpiper performing the wedding march.

Just remember when going through customs, only answer what they ask, and keep your answers short. Also, bring a clean pair of underwear incase you do get the crazy lady at Pearson, I really did get the feeling that she was rubber glove-happy.

Thanks for the advice....especially the clean underwear part......so do you get scare whenever you see a cleaning lady wearing gloves? Beach and bagpipers just sounds so good together.

It is hard to say, it depends on the people at Customs. I was denied again when I tried to go down for Mardi Gras. I brought as much proof of ties as I could but they felt it wasn't enough. I was already flagged in the system from being denied before as well- it was humiliating to go through but it was worth a try- especially for Mardi Gras smile.gif

That reminds me- when I was at the Airport waiting to check in for my flight (after I had my Visa) A guy was being escorted out from US Customs- he was screaming and swearing at them. Glad I didn't act like that smile.gif

At my Interview I was asked about and told him about both denials- he just giggled and said it happens often. I got my Visa.

As long as you don't accidentally overstay I don't see it being a problem at the interview. Although, I am not sure if A CBP Agent will allow entry for a stay of that length. Some CBP Agents refuse entry in general when in the visa process while others may allow visits provided they do not suspect immigrant intent. In their eyes, a 6 month stay for an intending immigrant suggests that you are actually living and working in the US prior to receiving a visa.

Our experience: my then fiance came to the States last May. He had taken a leave of absence from his job in Canada and had brought savings to live on. He came to help me move from Georgia to New Hampshire, to get me settled and to participate in purchasing our house. Our house we bought was a fixer upper and he ended up doing some work on it. We began the K-1 visa process in October. He then returned to Canada, went back to work. He planned to visit me for the Christmas holidays, but CBP denied him entry. They said that he had been in the states for so long, they figured he had been working illegally (which he hadn't) ... and also that he didn't show enough ties to Canada. The fact that we had begun the visa process was also an issue for that particular officer. He said that people are not allowed to visit during the visa process. That was erroneous, but really serves to illustrate that it does depend on each individual border agent's point of view. However, later on, my guy was allowed to visit ... the border guard at that time felt that he showed enough proof of ties and would really return, also said that visiting was not a problem during the process.

At the interview, it came up that he had been denied entry. We were honest and explained what happened and the officer said that was quite common.

You know what.....to anyone who is reading this.......HONESTY is the best policy. I have been totally honest with each border office and I'm so so glad I have been.

I'm getting the feeling that it is going to get tougher to cross. I will have to go back soon to get my package 3 sent (I have to do a police check in Hamilton) and I'm afraid they wouldn't let me back in after I do that. It sounds like I'm just going to have to take my chances. I am staying here more than I am in Canada (2-3 months at a time). They can see on my passport that I have crossed over approx 15 times this year (I live close to the us border and my friends and I go over alot when I back in Canada). What do you think?

Has anyone out there stayed in the u.s. for the maximum 6 months stay (from canada)? If so, did you have any problems at your interview about spending so much time in the u.s. during the visa process?

thanks guys. Well, my mom passed away afew years ago and if she were still here I sure wouldn't have this problem with my sister. I guess I will have to call uscis. She will do it out of spite. I feel sick just thinking about it. Thanks again for your help

Oh, about filing in my timelines. I thought I did. I'm not good with computers so I really don't know what I am doing. Can you advice me where to go to do it. I did fill out something on this site with my info.
