I received the same email. It basically means your case was reviewed/updated and it is giving you the current status. If they wanted more documents they would have told you that something is missing. Basically just pay attention to the last paragraph. I received two checklist emails. The first was a request for police certificate. After I sent it in, I received a second checklist. The second was exactly what you received, which means they received my paperwork and updated my case.

I was checking that online all the time until my wife kept pressing for me to call. My case was complete Dec 21 but I did not find out until Jan 3 by calling them. On Jan 9 I received the "case complete" email. The online status page has not said case complete. So I would call them daily to find out instead.

You will need a cosponsor. Do you know anyone at school who can be a cosponsor? Maybe post a bulletin or send a mass email. Does your fiance/wife have assets or knows someone who can co-sponsor? Without it I'm afraid you will not be successful unless you have significant assets that would not cause undue hardship if must be liquidated. Even with assets you may clear NVC but still be turned away at the embassy/consulate without a cosponsor.

Off course Tax returns for the last 3 years, paystubs, letter of employment and W2s. I am about to file..my question was: I owe money to the IRS for these 3 years that I have not filed..would that hurt my chanced of getting approved at NVC?

You will be fine on the AOS as long as you file and pay the back taxes. You will of course have to pay a penalty. It is 5% for each month it is late or a maximum of 25%. NVC only requires tax returns for the current year (2012). If you live in a country with strict requirements, then it would be best to have returns for the last 3 years paid up front and submitted to NVC. Otherwise you can file for 2012 now and take your time on the back taxes (and new AOS) that you would bring to the interview.

It is a good idea to have copies of everything you sent USCIS/NVC, including the I130, for the interview. Forms such as the I130, DS230, and AOS should be original/signed. If you don't have them on hand, just redo/reprint them.

That is where you put the city and county of the consulate you will interview in.

mostly beneficiary sending to petitioner but I have from both ways. We got married in Canada. Beneficiary lives in canada but is from Philippines. I sent receipts of trips, receipts of gifts, cards, money tansactions, web cam calls, text messages, receipts of wedding rings, photos of trips together, with fam, and wedding. If thats not enough for them then this process sucks. :(

Question I sent them, I guess called short form of marriage cert. Was i supposed to send the long form? I was kinda looking to see what it could be and that came to mind.

You've been in manilla for too short a time to file from overseas. Even if you do it, there's no benefit as you will not be expedited, plus you will have the burden of proving that you have a residence in the US (with school transcripts, tax records, etc) if you do choose to use your Manilla address. I would mail in your i130 from Manilla with your US address.

I have filed for 2011 but not for 2010. I believe I filed $0 for 2009, and since I didn't make enough for 2010 I didn't bother filing $0 again. I live in Vietnam and for 2011 made enough to qualify. The money that I had saved previously was enough to sustain myself for 2009 and 2010.

Now, the I864 has a checkbox saying "I have filed tax returns for the past 3 years. Enclosed is my tax return for the most recent year". Since I only filed for 2 years, is it ok to check the checkbox? Underneath the box is where you fill out how much you made. I only planned on sending in my most recent tax return, but the form apparently wants you to have filed 3 tax returns, regardless of how many transcripts you send in. What do I do now?

Which, for our purposes here is "self employed". That means line 22 is your income, current income and otherwise. Is that the number you stated as 2011 income where asked and again as current income? If so, you did it correctly. If not, you're going to get an RFE indicating your stated income does not match that on the tax return.


My income on the 2011 tax return is the same as my income this year. I also just read the revised requirements for i864 at:

It basically says that only the recent tax returns are required. Plus there is now no need to prove your current income, as the income from your most recent tax return (in this case 2011) is going to be the # that is compared with the poverty guidelines. So I guess I do not have to wait for my appraisal afterall and I can send in my i864 tomorrow. The appraisal I will hold onto for the interview. Can someone read the page and confirm that I came to the correct conclusion?

As for filing "unemployed", will I get an RFE since I stated that I was unemployed on the i130 package and "property owner" on my tax returns? I'm worried about making even more of a mess if I write "self employed" on my i864...that gives me 3 different job titles.

People with rental income are "self employed" for the purposes of the I-864. The only thing that will be considered income past or present is the dollar figure that appears on line 22 of the 1040. If you stated as income any other figure, you made a mistake. Today, line 22 of your 2011 tax return IS your "current income". If the interview is prior to April 15, you'll probably be OK if that number is high enough.

Alternatively, you could document the equity in your properties with applicable mortgage statements and current property appraisals.

I meant that I filed as unemployed on the I130 and planned to do so on the I864. The tax return was prepared by an agency and my job title there was filed under "property owner".

This is correct but the OP needs to understand that income from the 2011 tax return and "current income" are not the same thing, unless they are self employed. If current income is clearly sufficient, there is no need to state or document any assets. If you do state real property as an asset, then the appraisal or some other reliable documentation of value is required.


I filed as unemployed. My income comes strictly from rental income. That's what my 2011 returns reflect. But the 2012 returns may not be available by the time of my interview, as it's too early to even file taxes. Do I need to prove that I am actually getting income in the year 2012? If so then I will have a rental contract and money transfer receipts. So maybe I do have to wait for the appraisal after all, just to have as much evidence as possible. Thanks everyone :)

I'm putting together my I864. So far I have tax returns for 2011 which puts me above the poverty level for a household of 3 (we have a child). My returns for 2009 and 2010 were $0 and I will enclose a note explaining why (I've been overseas the whole time). I own property which is where my income came from last year and have ordered an appraisal, but it's going to take 1-2 weeks to get to me. Since I have everything ready to go (both I864 and DS230) should I just send it in as is or wait for the appraisal? As I understand it, as long as I'm above the poverty line that's all I need for AOS as it's the interviewer that's going to be more "picky" and so I will have the appraisal for the interview in addition to 2012 tax returns if they are filed before our interview.

I'm just worried about 1) the 1-2 week extra waiting time and 2) getting an ironic RFE on my home asset (I have the deed, proof of mortgage owed as $0, and property tax receipts (at least 1 year, I will have to recheck if I have 3 years). I'm also not sure if NVC will require that I show a business license for owning a rental home.

The only requirement is that you meet 125% of the poverty guidelines, depending on which state you plan to reside in. If your taxes reflect that amount, then you are good to go. If you did not file taxes but only gave them proof of current overseas employment, that's likely why they want more evidence. All property that you own is going to be considered liquidated in order to meet the minimum requirements. That means that if there's an emergency you would have to immediately liquidate all of your assets at 30% of the value. Say you own a home and you desperately need money. You're not likely to be able to sell it at market value within a few days, so you must liquidate it at 30%.

If you did file taxes and make enough money, it is still at the discretion of the consular officer to decide whether or not you're fit to sponsor your wife

Did you actually file the tax returns? If not, your explanation is a lie. If you filed and the income was zero, no explanation is needed. If you did not file, hand write in the space. "Not required to file. Income below filing threshold."

My plan was to file back taxes for those years, but after reading some old threads, it appears this is not necessary. I will write what you suggested in the bank on the i864 and will not include an extra sheet.

Women who have children with a USC are refused visas everyday.

Two people could be married, have a child together, live in two separate countries and never speak to each other. All that having a child together proves is that the couple slept together at one time. I purposely pointed this out to the op because of the 2 year gap in her timeline.

There is no 2 year gap. I have not gone back to the US since meeting my wife. We had originally decided to live in Vietnam for a couple of years so we did not file the I130 until recently.

We have a 2 year old daughter together and I am wondering if this would be a good or bad thing since I've heard a few stories where couples having children, and couples who have been married a long time, appeared to be scrutinized more than those who didn't. My friends tell me everything is going to go smoothly because we have a child together but if that is true, why do other people with children and those married for as long as 4-8 years still end up in AP?

We've mailed the DS230 and are now awaiting approval. A week ago we moved to a hotel where we plan to stay 2 months or more until our interview date. When our interview date is near we will move to a hotel near the consulate. Her mail to her old address is picked up by the neighbor. Do we really need to update her address? And will we have to do it once more when we move to near the consulate is at? So far we haven't even received anything in the mail, just through e-mail.

If you use your address in Cambodia, there's a chance you will get a quicker approval. But doing so requires you to prove your docimile in the US. However, lately most petitions, even those filed with US addresses are getting approved very quickly due to the rerouting of petitions to NBC

I got a similar email as you, only it was for the police certificate. Did you make a copy of everything you sent? It's possible that something was missing. I noticed that I DID NOT include the translated PC so that's why I got the checklist. I sent in the checklisted items which were received on the 17th and I'm still waiting for approval.

NVC may or may not have called. I would consider it unlikely but since the OP is in Vietnam, 10PM New Years Eve would be morning at NVC.

NVC does not require translations of police certificates that are in the local language where the interview will take place. So unless the PC was in a language other than Vietnamese, no translation was needed. NVC does not require police certificates for US Citizens regardless of circumstances.

To the OP. Just call NVC and ask them if they called.

I called and apparently my case was completed on Dec 21!! Now just to wait for an interview date. I wonder if they called me to schedule an interview? Or perhaps it was just a wrong number. It's just strange because in Vietnam the number showed up as 09090, which means it's from a switchboard from an overseas location. It was 10AM here when they called, which would be 10PM over there, so probably unlikely. Well, we'll see again at 10AM tomorrow.

2 days ago (NYE) I received a call from an international switchboard (I am in Vietnam). It's not from a direct line and it wasn't from a calling card, but from an internationally calling system within a company's switchboard. I've never received this type of call before here. Recently I sent in a response to a Checklist (rfe) from NVC. They wanted the police certificate. I assume that they wanted the translated police certificate which I had forgot to send in the original IV packet. This time I sent that and another original PC, which is my last original. I also sent a copy of the original PC, but no copies of the translation. Does anyone have any clue as to why they would call me? Is it possible that they want MY police certificate? I am a USC filing with my US address but have lived overseas for more than a year, on a tourist visa (non work related). They call was placed at 10PM EST. Is that even possible? I know the NVC phone # is open 7am-12am.

If they need anymore documents you will receive an email called a Checklist. Otherwise you would wait for an interview to be scheduled by NVC (assuming you petitioned CR1/IR1). You may or may not get a Case Complete email. It took us 19 days to get that email from the date of our case completion. 2 weeks after you submit all documents, you should call NVC to get a case status. From the date of your case completion, it can take anywhere from 1-3 months to get an interview scheduled. After your interview is scheduled you can book an appointment for your wife's medical exam at Cho Ray Hospital or IMO.

I called the NVC this week and my case is now complete. I looked at the visa bulletin but dont see any thing for US citizen sponsoring foreign spouse. I asked the NVC they wouldnt' tell me. So now I have no idea when the interview date would be.

I just want to know a rough estimate when that would be. It's not too much to ask, is it? I'm not asking for an exact date, i'm just asking for a rough estimate.

My priority date is March 20 2012.


The wait at hcmc for cr1/ir1 visas is 2- 3.5 months at the moment. so if your case complete date is 1/1 you would be notified around 2/1-7 with an interview date on 3/1-4/14
