We received our NOA2 two weeks ago and now my beneficiary wants to continue with K-1 VISA but wants to come to US and marry first week then return to China for two year's to finish her retirement with government. In China retire at 50 years old. My answer was no because I provide our income and I am only one with home and I live and work in US. I am 65 and two years is a long time. She has been called by embassy to expect a package and I received NOA2 letter. If she gets VISA in Guangzhou how long does she have until she must marry me.

She has 6 months to enter USA once she gets the visa. After entering USA, you both have 90 days to get married. After that, file for Adjustment of Status AOS (conditional permanent resident receives a green card valid for 2 years). In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status.

I will not marry her and be in US for two years while she is in China for two years. If the case is that we must marry then how do I stop the VISA process now. I have not paid any fees and I have not received anything from NVC. If I do nothing will the process just die or am I liable for anything at this point. I have made several trips to China for a month at a time and this was a surprise. Some advice from wiser than I am would be appreciated. At this point I do not know if I can trust her so I really just want to cut my losses and stop this K1 process with me being the beneficiary. Her English is very poor and I got an interpreter to help but I still hear she wants to come back to China after marriage in US.

If she goes back to China after marriage without AOS, you have to file IR-1 / CR-1 Visa for her to come back to US after that.

To stop the K-1 Visa, prepare a letter explaining that you'd like to withdraw/stop the K-1 Visa. It wouldn't hurt to have your signature on the letter notarized. Send / Fax the letter, along with a copy of the NOA2, to the US Embassy in Guangzhou.

I would suggest you guys to officially cancel the petition, to avoid any future problems, should any of you want to file petition / apply visa in the future.

 

You never know if you will meet someone else and intend to pursue immigration visa again.

 

Also do keep all the paper works for references.

 

The petitioner could email the US consulate that you are not intending to continue the process anymore.

 

Send a letter of cancellation with copy of NOA2 to USCIS too.

We have discussed this at length. My house is paid for, I have worked hard to build up my 401K,I have an account set up for my infant daughters college. We agree that what was prior to marriage - she has no right to. After marriage, I give her life residence in the house, but at her death - the house goes to my daughter. If I die and she remarries, then she must leave the house. What goes into my 401K( start new 401K) after marriage is half hers (state law) as is half ownership in anything we buy , invest, or acquire. She has a small daughter and I am setting up an account for her college fund, that I will match what ever my future wife puts in. I fully plan to provide for her daughter, as I would my own. Marriage is a joint venture!

A pre-nup protects you AND him. You should go over it with our own lawyer. Determine what you would want if the relationship were to collapse. Would you want alimony for a certain period? Would you want him to pay for your flight back to your country? Would you want physical custody of the kids? It's not pleasant to think about a relationship breaking down, and things do change over the years too so make sure it protects you as well. Then live secure in the knowledge that you'll never need to use it but i you do, remember it came from a time of love and remember why you loved each other.

Why did the consular officer request a DNA test? March 30, 2009

For certain categories of residency visas, the consular officer may request a DNA test to prove the required biological relationship exists. I did read from some Singapore forums, that it is possible for muslim and non-muslim to get marry at ROM (maybe they didn't declare their reglion in the application form).

 

They referred you to ROMM probably because they want you to consult your religion organization, make sure that you understand the issues your non-muslim husband-to-be would face with your muslim family and to convince him to convert.

 

Oh well, you are applying for K1 visa, it would be better for both of you to get married in US, less scrutiny, and pressure from family about religion conversion.

It is no big deal for couple with different religions/faiths to get married in Singapore.

In fact, it is getting more common, right? According to the shitty times newspaper whistling.gif

 

Remember that Singapore is secular country, not a muslim country. I am sure that US consulate is familiar with the social norms of Singapore culture.

 

And you are getting married in US, not under ROMM (Registry of Muslim Marriages) in Singapore.

 

During my interview,  religion or parental support topics never came up at all.

They are more interested in the bona fide relationship with your fiance.

 

The mails sent from the US consulate will not indicate anything on the envelope that it is for K1 visa but it will have the US consulate Singapore title and address on it.

 

 

As for informing your family about leaving Singapore and getting married, you probably should have a heart to heart talk with them after getting the visa.

 

It is always nice to have your own family to fall back on, should anything happens in US.. (Touchwood! tongue.png )
