¿Cuando les enviaron la NOA1 inmediatamente apareció el estado de su caso en la página del USCIS ó se demoró para poder ver esto en la página? 

 

Esta última pregunta la hago porque nosotros recibimos la NOA1 el 19 de mayo y hasta el día de hoy nos aparece en la página del USCIS que nuestro caso no ha sido encontrado. ¿ Conocen de casos que hayan tenido este problema?

 

When you sent the NOA1, did it immediately appear on the USCIS website, or did it take a while?  This last question I'm asking because we received our NOA1 on May 19th and as of today, it still doesn't appear on the USCIS website. Do you know of any cases with the same problem?

Just received our NOA1, the start of my VisaJourney begins today.

I sent everything mentioned by our fellow members, Intent to Marry (State of NY) from both of us and applicable house bill. Money (Obviously), passport stamps, boarding passes, application, dissolution of previous marriage, naturalization certificate and cover letter. I might have sent more but I can't remember.

Hi, we filed our I-129F on August 2nd.  I live in Massachusetts a state where same sex marriage is legal.  I know for sure on our letters of intent to marry within 90 days after entry did not mention Massachusetts.  But I do know in other areas I made sure to express that same sex marriage is legal in Massachusetts.  I did not include any hard copy of the Massachusetts marriage laws.  On 9/30 I received an email stating our I-129F has been approved and forwarded to the NVC for Visa processing.  I received the I-797 hardcopy in the mail this week.

 

We waited until AUgust to apply to give USCIS time to sort out their procedures in regards to same sex petitions.  To date the process has been quicker than I anticipated and hassle free.  I'm calling the NVC on Tuesday and attempting to get our case number.  

 

please update your timeline with your NOA2 approval so it can help others... thanks! and congrats!!!

When we filed in July, we included in our intent letter that we plan on marrying in California, but did not include any legal reference. We got our NOA2 with no RFE. That's odd that others are being asked to do so. Why can't USCIS just keep a list of states and check each letter against that?!

 

 

hey guys, just wanted to share our experience. we filed back in the beginning of august, received our NOA2 yesterday, after 55days, without any RFEs. we used the exact template for the letter of intent found on this website. we did not specifically state where we would get married. my fiance is from TN, but lives in CA now. that's what we put down as the address. maybe that clarified things enough.

 

so not stating the state in which you are planning to get married is not an automated way to a RFE.

 

alright, all the best to you guys. now on to the waiting game. transfer CSC - NVC. i heard, transfer times are at an all time high. might take longer to reach the nvc then it took the petition to be approved. 

 

 

 

Maybe since both of you are from CA, they did not request this.... I have seen the majority of these RFEs are being sent to same sex couples where the petitioner lives in a state where no same sex marriage is allowed.... Also, you are at CSC (again a state that allows same sex marriage)... maybe things are different with TSC.... as we know, there's a little bit of inconsistency with these applications and in general....

Sorry to hear this! But, at least your case is being looked at. That's a positive way to look at this and at least you know for sure you have an RFE, to me that's better than in my case sitting here waiting every day WORRYING about whether or not I'll get one. At least you know, now you can fix it and be done with it.
Goodness, it seems a few RFEs went out today. I checked my status at 10am this morning, maybe I need to check again. :/

 

haha... I know!!! what's going on... today is the national RFE day! haha.... also, relax with the alien number change situation... I was panicking too.... mine took like 3 weeks to say that online... I was a bit worried.... but everything is moving along... we must remember that there are also lots of petitions for same sex couples that people submitted before DOMA was struck down and those are being re considered now...


Well got the dreaded RFE notice today.  When I submitted our application in July I included the intent to marry letters from both of us which included where the marriage was taking place.  We have been together for 15 years and included dated photos, copy of my will, copies of passport pages, airline itineraries , apartment leases, joint bank account info, when I went to school in Taiwan.  What more could they want?  I feel they are processing same sex applications with greater scrutiny.  

 

let's look at the RFE in a positive way... they will be approving your case in the next couple of weeks as soon as you submit the RFE... good luck! keep us posted in what it is...

Can we, who haven't included this information, send an updated letter or do we have to wait for a RFE?

 

I would wait for an RFE (they might not send you one).....


So lets see if anyone can answer this. Let's just say our RFE is for not mentioning specifically what state we are going to marry in. If I reply to USCIS that I will marry in California, which is what our original plan was, but if as time progresses another state closer to us allows us to marry, do we still have to travel and marry in California or can we just marry somewhere closer that will allow it?

 

I do not think it will be an issue... if it were to arise at the interview for the AOS, then you would explain that you had intentions of marrying in California but then a closer to home state allows it and that's where you went to... I would not be worried... there's nothing that states that you must marry in a specific state... as long as that state recognizes same sex marriage, it is legal for USCIS....

Oh my God, this just keeps on getting better! I just updated our Timeline to reflect the RFE and now it added another month of estimated time that we will have to wait for our application to be adjudicated.

 

relax.... that usually the average... I have seen many applications being approved within 2 weeks after receiving the response from the petitioner... you will be fine... as soon as you get the letter, reply and you will be approved in a blink of an eye... at least your case was looked at... lots of other people have been waiting for months and months and nothing... so look at the RFE from the positive side dancin5hr.gif

Just got RFE guys, I'm a bit disappointed but oh well.

 

Since this same sex marriage is new to them, they are probably making sure everything is covered... the good thing is that petitions are being processed (even if it is for an RFE)... you should have an approval within 2 weeks hopefully... let us know what is the RFE exactly for....

Hello every one, 

we are same sex couple too and yesterday on the 30/09 we received RFE, USCIS said they mailed RFE to us so we dont know yet what they are asking us for until we get the mail.

but we did not include in our intent to marry in which state we are going to get married sad.png

i cant wait to see the hard copy of the RFE notice 

 

does any one know if we are going to get our NOA2 shortly after USCIS receives the required documents form us?

I have seen that the approval usually takes about 2 weeks after they receive your response to the RFE..... but for some people it has been less and for others it has been a little bit more.... do you know if there´s anything else that you think the RFE is for other than what TAB mentioned? maybe it is something else to do with other forms.... good luck and keep us posted... I am following your timeline and added you as a friend so we can keep in touch....

I cannot believe this!!!! I had actually sent you a private message asking you what was requested on the RFE.... wow.... I am speechless... I have read other same-sex approvals and they did not mention any of this.... they might have included it as part of the package... I mean, seriously? You can tell some adjudicators will need further training in regards to DOMA... according to USCIS´s website, it states:

 

I am a U.S. citizen who is engaged to be married to a foreign national of the same sex.  Can I file a fiancé or fiancée petition for him or her?
Yes.  You may file a Form I-129F.  As long as all other immigration requirements are met, a same-sex engagement may allow your fiancé to enter the United States for marriage.

 

Thanks for the heads up!!!! I guess I might get an RFE ugh.... I read about some people who included the state in which they where going to get married but I did not.... oh boy! well, at least if I get an RFE, it means it is closer to an approval :)

In my case, my girlfriend from the UK was always visiting me for up to 3 months on the visa waiver program.  In the 7 years together we never stayed over 85 days to give us padding in case airline issues.

I thought we could try a 6 month B-2 tourist visa, with my plan during that time to propose, and applied for it in July.

 

Much to my disappointment, it was denied due to lack of roots in her home country to prove she'd go back.  Trying to stay positive, we at least had the visa waiver program to look forward too...until I realized that once a visa has been denied, you are never eligible for the VWP again.

 

So now she can't visit me in America until we either try again for a B-2 or the K-1.  

 

Question though.  If we are in the process of applying for the K-1 visa, would that be enough proof she'd go home to the Us customs officer in order to get approval for the B-2 visa?

 

Would it be worth the gamble of another 180 dollars for the B-2 visa attempt, or do you all personally believe it would be a waste of effort and money and to just deal with the 9 months of her not being able to visit america and me only able to travel to see her till the K-1 is complete.

 

Thoughts?

 

Suggestion: just wait for the K1 visa approval.... it shouldn´t be long.... and you might want to update your timeline so you can update the process...

I email my embassy today.
On package 3 they asked me to collect all the papers they asked and then print sign and date the ds157 and send it to them with one picture and the ds160 confirmation page.
I still dont know if i did everything the right way. I sent only the one page of ds157 not the 6 pages. Only the one that they wanted me to sign.
And in the subject line i wrote " ds157 & ds160 confirmation page" and sent it, but then i resent it again but i changed the subject line to case number and my name cause on the instructions they say When communicating with this office either by telephone or letter, please provide your name and case number exactly as shown in this letter.

Do u think i messed up that i sent the email twice??? Should i call them or go there?

Till now i copy paste on Microsoft word from the day we sent the i129f till today small convo that we talk to each other per every single day... I have 58 pages till now... I ll make them 100 by putting convos from before see each other. Thats for whatsapp. I ll print 10 screenshots or 20 from skype from the beginning of the relation till now. I also have a small photo album with pictures together and our friends..

Anyway! Thats ur will not mine.. I cant tell u what to do!
So if u want to cancel k1 call uscis since u still wait noa2 and tell them that u want to cancel the process. Other thing u can do is email them with an explanation why u want to cancel the visa but first call uscis and they ll tell u again. Check here on the foroum too what other ppl say about cancelation

Today was my appointment with Dr. Doumazos at Iaso General.My appointment was at 11am but I was there at 10am. As i was sitting outside his office the doctor came out to print something so he was glad to call me inside his office so we can finish quicker the process. He was really polite and made me feel comfortable. First he asked for my passport and a picture and then he asked for my vaccination record. He checked everything and then he asked me if i take any medication or if i smoke or if i was ever under medication or in the hospital. Then he just checked my blood pleasure he said is really great and then he checked me with the stethoscope. He saw i have a tattoo on my back so he asked if i have more he looked at them and he was making fun.. Not a problem with the tattoo at all.After this he checked my neck and my belly and asked me if i feel any pain. Thats it. During this he was asking me about me and my fiance and where we ll go and the plans for the wedding... I felt so comfortable ...
When we were done i told him that i worry so much and I'm scared he told me i have nothing to worry im great and healthy. I gave him 50 as he asked and he told me to go pay the blood test and the X-ray but a vaccine and ask for the nurse on the first floor to do it for me. He gave me his best wishes for my wedding and i left.
I paid 97 for X-ray and blood test. The nurse at the blood test was amazing. She was sooooooo polite and funny ...and i didnt understand aaaaanything.... I was soooo surprised...then i did the X-ray and the lady told me is fine and at the end i went outside the hospital to buy the vaccine for chicken pox. That was a lil expensive 45 and i paid 10 the nurse at the emergency to do it for me and call the doctor and let him know that I'm done with everything.

The exams will go with a courier at the embassy as the doctor told me.

Thats it. Really easy ... No pain at all ... Was a really nice day... I know its weird to say that when u go to a hospital but it felt like i was out for coffee more than i went to a hospital. I made a lot of fun with the nurse that i really had a good time.
I totally recommend Dr Doumazos for everyone who will have their medical exams in Athens!! He is a great person and doctor.

If that was sent to you in an email, that could be a typo, possibly? The fee listed on the US Embassy (Athens) website for K visa applications is US$240 or 180 euros ---> http://athens.usemba...cation-fee.html
