1. my husband's father does not have a date or month of his birthdate, he has just the year in his birth document. so should we put just the year? will this cause a hiccup in paperwork?

2: Evidence of a bonafide marriage:
- Affidavits sworn: should the persons showed in our marriage certificate be enough as Affidavits sworn? or do we still need some people from his family to write letters for us to prove that?

Is this enough to prove a bonafide marriage?

Should we ask a few people who were present at the wedding to write letters?

3. common residence: we stayed in the same house all the time during morocco, how can we prove that?
does that qualify as a common residence? or do we have to rent/lease/buy a home together for it qualify as common residence?

4. how can i file and send the form i-130 and I-129F together at the same time if everywhere i read says to wait for the NOA and send it with the I-129F?

5. Sponsor:

do they need to own their own home? or if their income meets the 125% do they need other assets?

which document should my co-sponsor fill out, and he is a lawful Lawful Permanent Resident in a different state... is that acceptable? or does it have to be a US citizen?

besides my spouse's affidavit of support how many cosponsors can we have.... just one other sponsor besides my spouse or is more allowed?
example: US spouse and 2 co-sponsors..... is that possible?

I am just beginning this... and these are the questions we have so far... sorry lol

First of all....Congrats on your marriage!!!! kicking.gif
I will be starting the same process very soon, so I dont have any input from experience yet. smile.gif
I do know that I have read that your spouse cannot be a co-sponsor on the affidavit of support.
Also, Im going to send as many affidavits from witnesses and family as possible.
Also, you dont send the 130 and 129 together perse, but as soon as you get that NOA, you send it in with the 129. Please read the thread in the ME/NA forum about a lady who just got her K3 kicked out because of filing times (she is now filing for CR-1).. I was confused by this and it appears that filing for a k3 isnt as easy as it appears. sad.gif
Good luck with everything and I wish you and your new husband a happy life together!
Lisa

.

Thank you!!! we were told on another post that we could file them at the same time.... but i dont want to risk a set back... so we will just do them seperately.... good luck to you also!!!!

Your sponsor needs to be able to pass the poverty guidelines by, I believe, 125%: either in income or assets I believe.
Your spouse will still need to submit an Affidavit of Support as primary sponsor, never mind how little money he/she has.

125% poverty line should be income (around $17200/year for 2 people, before taxes). The consulate at the embassy is more concerned about obtaining a fix monthly income rather than assets. Lets say you declare your car as an asset, and its paid off and say its worth $10,000. The question with Assets are, will the sponsor be able to sell the car at $10,000? and if so, will the person be able to go to work because of this sold car? Remember assets are only extra support to show that you can provide food, shelter and expenses for your beneficiary and not a substitute of income. The best is always showing proof of 125% income from taxes filed and W2 forms from the previous years and if you dont meet the 125% poverty line then get a co-sponsor. The consulate wants to make sure that the beneficiary will not be living off government money (food stamps, SSS, etc) .

Thank you!!! very helpful information!!! i appreciate the simple terms too lol i get lost in the big words sometimes lol

Middle East and North AfricaOne Year Ago Today
It was one year ago that i signed the last paper with yassine in front of the adoul.

we didn't have the ceremony until the 13th and it ended the 14th

So it is our first anniversary.

I miss him so much.
I just wish he was here already, although suddenly my patience is renewed.

He is leaving tonight on the bus to go to Casablanca and turn in our financial evidence. Last time it only took them one week to review... i hope it is that fast again.
I really would like to have him home before Thanksgiving. Inchallah

Middle East and North AfricaReturning Petitions to the United States via 221g
His interview was september 25

we did not get sent back to US we got denied and told we will get a second interview.
The short dark haired white faced woman with glasses refused to look at the small pile my habibi had with him.
she wouldn't look at anything told him he does not qualify (with no reason) for a visa and asked if he has any emails
he gave her one book (lots of printing!!) of chats (just a sample of 2 days per month for 2 years) and one book of emails (sample too)
when he tried to give her the book of handwritten letters and cards she said i dont want to see those.
she didn't look at pictures she didn't look at the support letters my family wrote
she kept the emails and chats and said they will schedule a second interview.

the 221g she gave said he was denied but they will review the documentation he provided and contact him for second interview when their review is complete.

she didn't even look.

i don't understand how they can lawfully do that. seems to just depend on whatever mood they are in that day.

US citizen/spouse MUST provide an I-864 as primary sponsor, and needs to provide an explanition why no IRS return along with financial evidence, many just file a zero return, or a return for what ever was made even if below the minimum, and provide this return as evidence of income.

Also will need a Joint sponsor, for this situation.

yes i know... our AOS was already accepted with cosponsor but they requested more info from me about not filing taxes...
will tax transcripts showing that i did not file be sufficient?

do i need to also write a letter of explanation of why i do not file taxes?

if so, any suggestions of what words to use to explain?

Letter of explanation needs to site the IRS rules that allowed you to NOT file a return, as well as financial evidence showing why a return.

Again many just file a late return even though you don't need to pay tax, and for what ever amount of income even if it was below the minimum required. and then provide a copy of that return.

Also did you know that by NOT filing a return you may have given up the stimulus rebate?

http://www.irs.gov/n...=177937,00.html

I did file 2007 just for the stimulus...

do you know where i might find the IRS rules that allow me NOT to file a return?

IR-1 / CR-1 Spouse Visa Process & ProceduresSecond Interview Results
Well I don't know much at this point. Just got a quick call from Yassine.
The same woman asked him a million more questions... He knew all the answers. When that part was over she said she doesn't think my mother's financial is enough for our family of 5... i don't get that because i have my own income.. She lumped me and my kids and Yassine in with my mom and her two kids but only used my mom's income... sounds like she didn't include my income even tho she included me and my kids in the count. I don't understand that.
So she said she is going to review my mom's financial evidence and call him for a THIRD interview....

Sounds to me like our relationship evidence is sufficient now tho... so I guess that is one more step ahead....
Now Yassine is not sure if he should go back to Oujda and wait for another interview or stay with family in Rabat and wait for the call.

I have another family member that is willing to sponsor, would it help if he has her I864 and evidence in hand for the next interview in case they say mom's isn't enough (which is ridiculous she makes over 3000 per month and owns her home with 40,000 equity in it)
One member of my family even said maybe the whole family should send their financial info and show we will all support each other.
Not to mention Yassine will find a job and work too.

I don't know

Anyways, I'll have more updates as I get them.

QUOTE (clairern @ Dec 14 2007, 06:33 PM) <{POST_SNAPBACK}>
I think it is best if you choose a Choice of agent with a US address. I do not know how the mail is in your country, but it Jamaica, it is horrible. NVC sent my SO the DS-3032 since 7/30/07 and he still has not received it. Luckily I knew about the e-mailing process from here on VJ and he is using me as his agent and things have gone smoothly so far.

As far as the DS-230 is concerned, you have to wait for NVC to send you the fee bill and after the bill is paid and entered in the system, they will send you instructions on how the proceed. By the way the DS-230 fee is $380.

Good luck

what do you think?

does it matter that they are not photocopies?

does the signature need to be a photocopy for the 2 copies i am keeping for my records?

First, I would not send anything unless you get an RFE. Second, everything you list in your post is not really required according to the Form I-130 instructions. It might have been ok to send in with the original petition (too much better than too little) but at this point, I'd just wait....i know...that's not fun. Just my opinion.

yes thats what i thought when i sent.... it does not request all the other information...

and we don't have joint bank accounts or joint ownership of anything so we just added a few pics...

but now the more i read about the nightmare that is the casablanca consulate i am getting so scared...

i do not want casa to deny us before he even walks through the door.....

I'm pretty sure you'll be given the chance to send in more info documents/proof during the NVC process. From my understanding, the NVC requests certain documents from the beneficiary...birth certificate, marriage certificate, police clearances, copy of passport, etc. You may have an opportunity to send such things in then. Keep researching!

Thanks so much!

We are feeling we did not send enough evidence with I130....

if wait for the first NOA reciept.... (so we have the case number)

can we send more information with the case number on it?

will they accept it and add it with our I130?

all we sent were a few pics...

but we have emails, chats, plane tickets, character reference letters, and witness to our relationship, even video from our marriage that i am thinking i should have sent too

what do you think?

I am uneasy because i have heard the Casablanca Consulate is difficult about interviews... and they will not look at much if any evidence he brings with him to interview... so i am thinking it needs to be IN the I130

any advice is appreciated

thanks in advance for all the help you guys always give.....
you are brilliant
