K-3 Spousal Visa Case Filing and Progress Reportsvalid proof for I-130 Interview
I use to send my husband money by western union. I am wondering if it would be helpful for him to take them to his interview. It does show the length of time we have been married. Or will the consulate see it as a bad thing. With the current situation with the economy we have done this to help each other.

I am not sure if I am in the right area or not but I need help. My husband is Syrian and was denied his k-3 visa. They told him that were sending it to the nvc and then to the uscis for request to review and addional proof. I contacted the senator and found out that what they are doing is a back ground check. they told me that they would have a decision in 120 days. the 120 days are up and they told us they haven't recieved the papers yet and I asked them for the number to track it and they told me that since it has been past 120 days we would have to fill out a form and it would take an additional 45 days to get an answer for the trace number. why are they asking for the additional 45 days? Who can I contact to obtain the tracing number? We can have the background check speeded up on the Syrian end if we can get that number. are we going in the right direction waiting the uscis or would it be better to drop this one and re-file another i-130

Can somebody tell me what happens or what can i do ??

am sorry for the problem now faceing sad.gif cause we have same situation except our not closed. What visa you and your hubby apply for? Did they give you an automatic denial? If the VCS told you that they had to review it and would give you an answer in 120 days then your in for a rude awakining. Cause they told us the same old ####### of 120 days and we have gone 3 months past with no end in sight. Start working on your rebuttal and contact a good attorney, and Marc Ellis is said to be the best in rebuttals.

K-3 Spouse Visa Process & ProceduresHusband to be needs some advice. My fiancee is a us citizen.
Don't go K-3. CR/IR 1 is your better choice. I know this from my experience. Also since your wife to be is there with you go for Direct Consulate Filing. You will avoid alot of problems and will be quicker. Also bottom line is you can not enter with your wife until you get that visa.

This was my first trip abroad and I didn't want to go to Syria, so I asked him if we could meet in Jordan as I had heard they had good relationship with the U.S. My flight was delayed 7 hours and when I finally arrived in Jordan he was no where to be found. Needless to say it took a lot of people to help me to locate the hotel he was staying at. We both were so upset about losing one another. We spent several days just enjoying each others company and the day I was suppose to leave was quickly coming. He asked me to marry him, saying he doesn't want to feel that loss again. I knew how he felt. So we hurriedly got married in the couple days we had left. So then I came back to the states and set about to find a way to get him here with me. I went to a woman who was suppose to be highly qualified in visa matters. This was in 2007 and she was suppose to file the papers before the fees went up, she waited to long and they sent the forms back. I was out of the country with my husband at the time in Turkey (Istanbul) so when I got back I had to re-file again. This was in jan. 08. We went thru all the required paper work and he was set for his interview on jan. 09. His interview was in Jordan due to the fact that the Syrian embassy was closed at the time. We got married on Feb. 14, 2006. The woman that was helping us told us not to take our proof to the interview that they would set up a second one to view the proof. So thats what we did. When the officer found out he did not have any proof with him he just kicked him out and told him that his visa was going back to the NVC then to the USCIS for further review. I went back to this woman and told her and all she said was sorry but i can't help you any further. a week later I did contact another lawyer and she immediatly sent out 2 requests to the embassy in Jordan to reinterview him before it was sent back. They told her that it was already on its way back to the NVC then to the uscis. It got to the uscis on march 23, 2009. Then this lawyer had to step down. So I contacted the senator aid and she told me that what they are doing now is a back ground check on my husband and it was up to his government to send it back in a timely manner. its been 120 days since the USCIS had it. Two days ago I found out that they have made a decision and we would recieve it in 2 - 4 weeks. We are hoping that they will give me the chance to show our proof but we are expecting the worse. I have left the states to be with my husband in Syria as 2 and a half years have been very hard and we are ready to start our life together and work on additional proof while we are waiting the USCIS to decide our fate. I have checked into getting residency here and it would take 3 - 6 months. We got married on Feb. 14, 2006.
    Do you know if they will send a NOID or NOIR?
    His form that he recieved at the consulate just said that it was being sent back for further review. It did have some numbers on it section 212(a) (5)(a) and 9 fam 41.81, N6.5 and when I looked it up it was about labor visa. I had a laywer to even double check and that is what it states. Do you have any suggestions if we could do anything with the fact they send it back stating the labor visa?

    Just have a lot of proof. Anything you do together make sure to get some proof of it. Also putting it in a time line for them. Did you already get your visa to the states?

    Yes it does matter to the consul who interviews your spouse. I just don't know if it would look worse changing religions.

    Thats what will be hard to do to get him repeat it. He is smart and has known every step to take to be legal. I had no clue this was coming. Things with him have always happened quickly.     He stayed home for the first year saying it would be cheaper in the long run. It did make me feel nervous but he never had given me a reason to doubt him. I have spoken with uscis and they told me what I already knew he is here and there isn't much I can do about it. I hope that what I am going thru no one else will ever have to endure. Now I am left with anger, hurt, betrayal and many more emotions. As well as trying to rebuild my life fianacially.

    I was in the same position as you. I am 25 yrs older than my husband and don't look my age. We have been married for 4 yrs with him finally arriving in the U.S. a jear ago. His first interview did not go well at all so I took a year off from work and went to Syria to be with him to prove it was ligit. His second interview I was there for and he recieved his visa to the states. When we arrived home I immediatly went back to work and we set out to get his 10 yr. green card. He got his green card 2 months ago. All this time he was saying how happy he was and how much he loved me and when he went to work he would help take care of us. Then boom 2 weeks ago he came to me and told me he didn't love me and he never did. All this was just for one thing and that was a gc.
    I am not saying your husband is like that. I never would have thought mine was either. (I met his family and he was not raised that way. They are some of the finest people I have met.)
    I am saying however to protect your self. I still love this man with all my heart even after all the ugly things he has said and done to me. I don't want to see anyone go thru the hurt and pain I am going thru now. And once a green card is given it will be too late.

    a couple days ago I called USCIS from Syria only to get ahold of a very rude woman and she told me that our case had been reaffirmed at the uscis on July 22 then sent back from DOS denied. I told her we have not recieved anything in the mail and she said that it is not their job to contact the beneficary or petitioner to tell them about it. I asked her what would happen with it now and she said it would not be sent out a 3rd. time I tried to ask her questions but she was not very helpful and in the end I just got frustrated and hung up. So been trying to do what I can to find out something concrete. I contacted both the DOS and NVC and the NVC said : Your inquiry has been received at the National Visa Center (NVC).
    The petition I-130 has been returned to the U.S. Citizenship and Immigration
    Services (CIS-formerly known as INS). Any further inquiries should be
    directed to CIS.
    The National Visa Center has received your inquiry regarding I-129f
    . After searching our records, no information was
    found regarding this case. Please contact U.S. Citizenship and
    Immigration Services (CIS- formerly known as INS) to verify the status
    of this petition.
    The DOS has said nothing...........my husband was interviewed on Jan.07,2009 for his I-129f and it was sent back for review and has expired. When it was sent back the I-130 got stuck with it. I have no clue as what to do next and hope there is someone out there who can give me some help.

    I don't understand why the embassy can't just let you come in and talk to you about your options. It's very discouraging to hear about this. They would really be trying to do their best to accomodate you. You are a citizen and pay taxes which in essence pays for their salaries....I will PM you.

    When he was at the interview he tried to get the consular to give him a chance and come back and I even tried and had a lawyer to try all of which just fell on deaf ears.

    He took the K-3 interview, and his I-130 got stuck in with it and sent back. I feel sure he can try again but we have to resolve this one first before we can re-file.

    Can you appeal without a written statement showing denial? What is a FOIA? I have gotten a lot of replys about how unfair the consulars are and from what I see it they are taking the laws in to their own hands for their own purpose. We have proof beyond a reasonable doubt. I will contact the senator about the FOIA. Thank you

    Once everything is denied and "buried" are you allowed to refile again?

    Are you in Syria now? Can't you refile via DCF? At least if you have to start over, it will be much faster than going through USCIS. Did you do a K3 or a CR-1/IR-1 petition? Maybe you can do the other if one was already denied.

    Not sure with the details of yoru case and all, but just throwing ideas out there????




    I am in Syria now and am working on getting my permanent residency, but it is a long process. I filed the K-3 / I-130. We have contacted Senators and State Reps and are now awaiting for what they can find out.

    Second have you contacted your state representative to get them to handle your immigration case and get some answers for you?
    Third have you read through the pinned 221g rejection thread yet for other ideas and contact with those who have also gone through what you are going through now?

    Can't do info pass cause I am in Syria. I have contacted everyone I could think of from the trash man to President Obama. Hopefully I haven't forgotten anyone. I have been reading all the information I can and see that I do need legal help.

    I called from Syria to the USCIS and just got off of the phone with a very rude
    woman at the USCIS about my case. Here is the whole details..........I
    had a woman helping us to get my husbands visa and we got his interview
    it was set up for Jan. 07, 2009. This was after she had caused us a
    years delay due to her not mailing our case before the rates went up.
    When his interview came due she told us not to bring any proof to the
    interview that he would be given a second interview to show proof. Well
    the consular was also rude made racist remarks to my husband and when he
    tried to explain what happen and that he could have the proof faxed to
    the office immediately all the man said was no, visa is denied, he was
    sending it back to NVC and then to the USCIS and they would contact me
    (the petitioner) for additional proof. I have contacted the embassy
    immediately after and also had an immigration lawyer to contact the
    embassy to try to get my husband another interview (a fair interview),
    to prove our marriage is bona fide. Both of us was denied this
    opportunity and was told it had went back to the states. I also know it
    had to go thru the supervisors hands before being sent back. The USCIS
    did not receive it until the 23rd of march so we could have gotten this
    interview reinstated at the consulate level.
    However we have been denied a fair interview and it is back in the
    states and at this point we have not gotten any letters or emails
    regarding our case. I called and was told that I would get an answer in
    120 days from March 23rd. and waited patiently the 120 days only to be
    told it would be 2 to 4 more weeks and they would send us a letter
    telling us the decision. It has now been more than 6 weeks without no
    letter, no call, nothing. I have however called to find out why I have
    not gotten a letter and this is what the woman at USCIS told
    me.......the case was reaffirmed and sent to the Dept. of State and was
    re-denied and sent back where it now sets to be just buried. I want to
    know why I have never been contacted and given the chance to show all
    the proof that I have. I have been married to my husband now for almost 3
    years and I want to know why it is thought that our marriage is not
    real?!
    The woman said to contact the NVC and try to get my proof sent in. All I
    ask is that we get our chance for a FAIR interview. I have proof out the
    wazoo! My question is why have we not recieved a response from the uscis or nvc to prove our marriage is bona fide???
    Also I would like you to know that I left the states to be with my husband because USCIS said we would have an answer by 120 days.     I can imagine how I would feel if I was in her place. I wonder if any of you that have responded (on both threads) can imagine being in her place, and in her shoes. Can you possibly think what a visa denial would feel like? I have read both threads and it appears there have been some short comments that to me sound rude with not a hint of compassion. I hope that those in the future that are desperate and need advice get advice and empathy vs. getting an extreme lack of compassion. Maybe the ones responding will need a shoulder to cry on or maybe I will, or others reading.... But I hope we can better support our vj members than this.

    I called from Syria to the USCIS and just got off of the phone with a very rude
    woman at the USCIS about my case. Here is the whole details..........I
    had a woman helping us to get my husbands visa and we got his interview
    it was set up for Jan. 07, 2009. This was after she had caused us a
    years delay due to her not mailing our case before the rates went up.
    When his interview came due she told us not to bring any proof to the
    interview that he would be given a second interview to show proof. Well
    the consular was also rude made racist remarks to my husband and when he
    tried to explain what happen and that he could have the proof faxed to
    the office immediately all the man said was no, visa is denied, he was
    sending it back to NVC and then to the USCIS and they would contact me
    (the petitioner) for additional proof. I have contacted the embassy
    immediately after and also had an immigration lawyer to contact the
    embassy to try to get my husband another interview (a fair interview),
    to prove our marriage is bona fide. Both of us was denied this
    opportunity and was told it had went back to the states. I also know it
    had to go thru the supervisors hands before being sent back. The USCIS
    did not receive it until the 23rd of march so we could have gotten this
    interview reinstated at the consulate level.
    However we have been denied a fair interview and it is back in the
    states and at this point we have not gotten any letters or emails
    regarding our case. I called and was told that I would get an answer in
    120 days from March 23rd. and waited patiently the 120 days only to be
    told it would be 2 to 4 more weeks and they would send us a letter
    telling us the decision. It has now been more than 6 weeks without no
    letter, no call, nothing. I have however called to find out why I have
    not gotten a letter and this is what the woman at USCIS told
    me.......the case was reaffirmed and sent to the Dept. of State and was
    re-denied and sent back where it now sets to be just buried. I want to
    know why I have never been contacted and given the chance to show all
    the proof that I have. I have been married to my husband now for almost 3
    years and I want to know why it is thought that our marriage is not
    real?!
    The woman said to contact the NVC and try to get my proof sent in. All I
    ask is that we get our chance for a FAIR interview. I have proof out the
    wazoo! My question is why have we not recieved a response from the uscis or nvc to prove our marriage is bona fide???
    Also I would like you to know that I left the states to be with my husband because USCIS said we would have an answer by 120 days. To the OP, I strongly suggest you ask an immigration attorney what they suggest. You can pay a small fee for a consulatation. It's worth it to take the advice of an attorney in this matter.


    The fraud marker will still be on her case, so I would assume that it would still need to be dealt with carefully. I agree about the lawyer. But make sure to get a qualified one. One that has experience with returned petitions. I can't stress that enough. I had contacted one when ours was denied. She had absolutely no idea what she was doing. She submitted a FOIA for me at the USCIS, not the DOS, and charged me $500.00. By the time I heard from her again concerning the FOIA I had already proceeded without her and my husband was already here. What a waste of time and money.


    Yes I thought that might be the case that if I withdraw it I would be doing more harm that good. Maybe we can file another i-130 at the embassy and have our proof stacked and ready for them coming at us about the first i-130. Anyways its a thought. I have been married now almost 3 years that should have counted for something when my husband went for his interview.

    Our case is at the Vermont Service Center and they are so slow it is beyond reason. I don't want to put our case in further trouble. I have been in contact with my senators and congressman and all they been telling them is it is returned for further review. And your very right about the fact you can't trust the uscis they have proven that. Will pm you.

    My husband and I filed a k-3/I-130 petition and he was interviewed on Jan. 2009. He was denied and the k-3 was sent back for further review. the denial letter states: section 212(a)(5)(A) and 9 FAM 41.81, N6.5. Since then the k-3 has expired but they have our I-130 still at uscis for further review and the uscis officer i spoke with told me it could sit there for as long as 2 years.
    I have been in Syria now for 3 months and was wondering what would happen if we decided to withdraw the petition and refile by DCF?
    Does anyone know if it would hurt my husband or can we front-load our DCF case and answer this I-130? OR can we just leave it and re-file an I-130 DCF?

    Kiyah has some wise words for you. Our case went as follow. First it was reaffirmed in Aug. They forward the case to the NVC. It took quite a bit of time at the NVC, but was finally forwarded to the consulate, and was received in then end of October. They scheduled the interview a week later. They didn't ask any further questions, but, and this for sure will apply to your case, they want updated documents. We had a new I-864, verification of employment from my employer, police report, and the medical. We had it all but the medical. We assumed that they could get it from the doctor since his last medical was within one year. The doctor didn't have it any longer, so he had to take it again. He was not put on AP. He received his visa in December.

    Keep in mind, this was our case. Each case is different. But hopefully this will give you something to use as a timeline.

    I am happy to read the process is moving along for you. I will try to answer some of your questions the best I can. You do however need to speak to your attorney and see if they are able to answer your questions as well:

    Does anyone know how long it will take to get an interview date? The USCIS will send your reaffirmed petition along with the response to the NOIR, and all supporting evidence to the consulate along with a recommendation to issue a visa. I have seen many get an interview date within 4-8 weeks of reaffirmation but it really does depend on the consulate and their schedule. For some consulates, the NVC handles the scheduling of interviews for certain visa types.

    For a reinterview will they ask for proof of sponsership again or ask questions about my job knowing i am at the interview with him? Personally, I would prepare for them to ask for this regardless. If you end up not needing it, no problem, but if they ask for it and you are prepared to provide it right away, even better. Have a new affidavit of support along with supporting documentation ready to bring to the interview. If you are on leave of absence, you may need to get documentation of this from your employer. Just a letter stating that you were promised your job when you came back may not be enough. If you need a co-sponsor, I would get that lined up. I do feel you need to discuss this with your attorney for sure.

    Will they allow me to be in the interview with him? This varies between consulates. For example, the US Consulate in Morocco does not allow the petitioner in the building during the interview process...unless they have been specifically asked to come inside. I had my husband tell them I was waiting outside in the event they wanted to speak to me. You may find information on whether the petitioner is allowed in on your consulate's web site.

    We also have heard that they put all middle eastern men on ap. does anyone know the time frame for this? This is quite normal for any MENA male of a certain age to be placed on AP (Administrative Processing). This actually happens in more than 1 step in the visa process, so even though background checks were being performed during the review for the return, expect for them to happen again after his interview. There is also no timeframe for AP. There are different checks they do, and each one takes time. Some get through AP quickly, some do not. Our AP was almost 8 weeks. Regardless, I suggest you wait one week after the interview, then call the Department of State once a week to ask them the status of your case. They will tell you whether it is still under Administrative Processing. You can call the DOS at this number: (202) 663-1225 - press 1, 0.

    Aside from the proof that will be asked for is there any other documents we would need to be ready? Prepare yourself by having a complete copy of the NOID rebuttal and evidence you submitted to the USCIS as well as a copy of ALL ongoing evidence of your relationship you have gathered while you have been together in Syria. Also watch for communication from the consulate, they may send you information regarding what you need to bring to the interview, but this also depends on the consulate. Some consulates call the applicant on the phone to inform them of their new interview, and some send a letter along with a list of things they need to bring with them.

    Will we need another medical exam and police report as before? Medical exams are valid for a period of 1 year. The medical exam expiration is exactly 1 year from the date the medical exam was completed originally. If 1 year has passed, you will be required to provide another medical exam.

    What questions can we expect to get from the consul? There is no way to really know this as each case if different, each consular officer is different. Prepare for the consulate to ask anything at all, they could ask you questions from the documentation you provided with your rebuttal. I would also make sure my husband understands exactly what a "leave of absence" from work is and what that means specifically for me and the employer I work for.

    Lastly the red flags we had before that we answered to the uscis will it be brought up again in the interview at the consulate? There is also no way to know this either. They can ask anything they choose to ask. Just be prepared to answer questions regarding the red flags you addressed in the rebuttal as well as any other possibility.

Make eye contact with the consular officer, show confidence and smile. Tell him to focus on not getting excited or nervous...it will all be fine Insh'Allah. One thing that really helped my husband before his interview was reciting Qur'an, he recited Qur'an in his head while he was waiting to be called to the window. He told me it really helped him relax about everything.

    You will be in my du'ahs. Insh'Allah you will be fine. Just try to prepare yourselves as best you can, be prepared for them to ask anything at all, but most of all remember that you have gotten this far together and you can get through the rest of it together as well. Definitely speak to your attorney regarding the affidavit of support so if you need to you can prepare what is needed before the interview.
