My hus has file I130for me and my child (in my previous marriage ) , i have a court order giving full custody of my child, someone told me that during interview they might ask for a letter from my ex to take her along with me, do you know anything about this?

I had a little different situation, because i dont have a full custody of my child,so i had to get this consent letter from my ex husband. In ur case, since u have full custody i think its will be better to check and call US consulate in India,or write them an email ,if they are quick to respond.

Anyhow we solved it without sending anything back to the NVC, they just found it ...
You can try to call to the NVC and ask for a supervisor. Also its probably would be helpfull if u made a copies of everything u sent to the NVC b4 so email it to them ( dont forget to put ur case number and name on subject line).I f its cant be fixed this way , then all u can do is to send them urgently whatever they ask .

I sent email to the USA Embassy in Kiev, asking them the same question, and this is what they wrote me back:
"The notarized permission from the father of your minor child is for the Ukrainian border patrol to let your child out of the country without any problems. As for parental custody documents for the child, the Consular Section is not in the position to recommend any particular documents here. You should explain to the National Visa Center the procedure of divorce in Ukraine and the documents, which are obtained afterwards."
So i sent to the NVC only notirized consent letter from the biological father of my child, with photocopy of the 1st page of his(father) passport included.

We called a several times and spoke to an NVC operators,they said we do not have to have our docs apostilled for NVC(none of them even knew whats an apostille is! blink.gif ),but it have to be originals or certified copies (we sent duplicates of originals, obtained by RAGS/ZAGS - the issuing entity in our case,plus original of police certificate). We apostilled only originals- for use in the USA for later(going to take them to the embassy for interview-just to be on a safe side).

For me its toke 10 days ( the shortest time they offer).Cost about 16 dollars. Form name IP-1.

I got police certificate from Russia ,being in Ukraine , its takes several months.Mine took 3 months because it was holidays times ( christmas... etc) , urs might take less smile.gif
All u gotta do- is to go to the russian consulate/embassy in UK and tell them what u need.At least this is how it worked for me. I know nobody in Russia can help u to get it, unless u will give to that person notarized letter, that u want this person to obtain it for you. Also u can go to Russia and get it ursellf, its takes a month and its free.
A few options, i hope its helps. You can call russian embassy in UK anyways ,just to make sure they do it same way there, and also they might have specific hours for this kinda papers.

As we rapidly approach the final steps of the CR-1 process a question plagues us. The embassy in Kiev requires all the forms on the KEV-1 document be provided for the interview. Because we have already submitted all the forms therough the NVC must my wife take additional copies to KIEV for the CR-1 interview???

My husband (in the USA) called NVC to clear this question on documents for them.NVC operator said , that for appointment packet (for Ukraine) they need either originals, or the certified copies of the originals (certified by the issuing entity)-which is called duplicate in Ukraine.
Personally I have already received necessary duplicates, I am going to translate them into english and then send to the NVC. And to be on a safe side i will bring originals for the interview too,because they do not guarantee returning documents ( duplicates) from the NVC. :blink:

Dont trust the operator, trust common sense and what the instructions say; the KEV-1 specifically states what forms you need to bring that are to be the originals and also accompied with certified ( apostilled ) translated ( by a certified translator ) copies. If you choose not to do this, you can be put on admin hold or need to rescheduled due to not having all the appropiate documents.

Olechka - its ok to send certified copies, they donot ask for orignals, it would be foolish. For example, you can get a certified copy of an american birth certificate from the county who issued it, this is what you would send, not your original that you were given at birth. In Ukraine, you would get a certified copy from the Ministry, then get it translated by a certified translator, then get it apostilled, then submit this, not your original. You need to bring your original to interview and they may compare it with copy. I have friends who immigrated through NVC and none have sent orignals nor were asked. You will lose the documents.

In Ukraine, duplicates is the same as originals, they are usually given out if u lose the original or damage it.
Why i have to certify it from the Ministry if i got it at the issuing entity? Im a bit lost here...

No, I believe she is wrong and advice, be safe!!!!!!!!! OVERKILL the documents. Sonya and I were not required to show three years of tax returns, and I make well over the 125% poverty level, but, they asked for and luckily we had it.

If you are to use your documents in any country and have any legal value, they have to be apostilled to be recognized under the Hague convention or whatever it is called :) At the embassy, it is a US territory, and it will not recognized a document that is not apostilled, well legally. I have seen while there they have been very flexible will illed prepared applicants, but, I would be safe, and you need them for the US anyway. If you want to work, jobs, mortgage, loans..........

i have my originals apostilled, i will take them to the embassy with me.
As i look at the NVC site, i dont see anywhere them asking for the apostille too http://travel.state..../info_3195.html . Going to look for more info and call the NVC.

I was wondering, when you filed your I-130, did you also file the affidavit of support? I forgot to do that but am not sure which form to submit. I just sent the I-130, the Bio data and my pay stub. What other forms or documentation should i have filed? Any advice is deeply appreciated. :whistle:

Since then I have not received any thing from CSC, Immigration Officers in customer service line had told me to contact them at the end of the first week of July if I have not received anything by then. :crying:

Yes,they ask to send them police certificate and it have to be original (dont forget to translate it ). Police certificate is good for a year.
I sent mine to the NVC,but im going to obtain one more for the interview,in case they will lost the first one.
Its better to be over prepared !

To be honest i never asked them to proceed two at the same time. But im sure u can do one, and next day another one. I would suggest u to get the second one closer to the interview date,so its will be fresh.

It is not apostilled( NVC operators said we dont have to have it apostilled). So the question is...did u sent the duplicates , as long as they have lost ur originals? -OMG! they lost it!!- mad.gif
What is the second original copy from the court u got? Is it parental custody papers?
If i have a consent letter from the biological father of my child, i dont need no court custody papers,right?

The second original we got from the court was the custody documents. Unfortunately my wife's "X" abandoned his child and was not cooperative when we found him. So we went to court. The letter of consent you received is all that is required. If there is anyway to have it notarized it would be better because it reduces the possibility of forgery.

Documents Apostille seals are not required from the Ukraine based on our journey this far.

In our case the NVC did not accept documents that were certified or notarized. Only original documents were accepted. Which was contrary to our instructions. And this caused a delay in our case completion. (I do not know if it was the option of the case worker or an actual rule). And now we have been notified that our lost documents are actually in our case. Too many papers.

We now believe everything is in order and we have notarized duplicates going to the embassy, Oct 17th, with my wife of everything we have submitted. I believe we are over-prepared.

Yes, speaking about notitizing the letter of consent. Be aware,people, that according to the Information Packet from the USA embassy in Ukraine(which can be obtained anytime on their site-http://kyiv.usembassy.gov/visa_iv_forms_eng.html) " If the left-behind parent is not in Ukraine, s/he should have his/her consent letter notarized at the nearest Ukrainian or U.S. Embassy/consulate in the country where s/he is located, and then submit that notarized statement with a photo-copy of his/her passport ID page. The parent should send the documents to the visa applicant. "
Just happened that my X is from Moscow,Russia,so i contacted the Ukrainian consulate in Russia,asking for such action and been told that they never did it b4 and they dont do it now - so dont waste ur time,ukrainians.
You have to go straigh to the US embassy in Russia to the citizen section (theres no lines at all,just dont forget your passports, X husband/wife have to be presented).You show ur passports to the guard and say u need to meet a US notary to certify the letter of consent.Then u go inside and talk to US consul,explaining what u need,he will give u a blank to write the consent letter and ur X will have to sign it in front of the consul .Also he will scan the ID page from ur X's passport and stamp the copy , then stamp the consent letter . You will pay like 50 US dollars and its done.
Im not sure if it works the same way for other countries, its better to get Imformation Packet from the US embassy in your country - if its possible, or call US embassy to ask.
I still wonder, if any of you,ukrainians, have done this letter like i did? Does anybody used a letter of consent,notirized by civil notary, is it works?

I did a huge research myself and we made a alot of calls to the NVC looking for the answers,but still,i think theres not enough information provided on this forum about kids/stepkids, or its really hard to find.
As u can see by my signature- we already sent the Ds-230 forms and docs, but its not yet entered into the system, so im worried and being paranoid about RFE's wacko.gif

Whoever will update the timeline, please put Olechka back. We didnt came back to update it,simply because we are stuck at the NVC and waiting for our case approval since october.
I dont know if anybody have/had the same situation as us: NVC sent false RFE in october,saying that our docs missing one paper, but its NOT, they just overlooked it! (how do u like it?) .They made correction and so,since october all we get to hear is :" ur case is under review, wait 6-8 weeks" . We are not under AP or something like that,so i wonder what is going on. We spoke to a supervisor- didnt help much too and nobody can really explain why its take so long if all the papers is correct and they are pretty much satisfied with AOS.
