At this point, I have no idea where my petition is. It went from Vermont Service Center to National Benefits Center and then from there transferred to a USCIS Local Office. Now I have to call USCIS to find out exactly which local office for sure and where it has really gone.

Also look at a lot of the other threads in this message board. A lot of people are with you on this.

One thing people have been doing is calling the USCIS, getting an ISO (Tier 2) to figure out if their case has even been assigned to an officer yet. That will help ease your mind tremendously, I bet.


Also if you update your timeline (underneath your picture to the left), you will be a part of the statistics on this site that help us figure out how long it is taking everyone!



Thank you for your input. Perhaps they did get expedited. I live with my husband abroad so I was expecting to get expedited as well. God knows what's happening. I don't think VSC has my petition anymore because it was transferred to a USCIS local office. I will do what you said. I'll look to see where my local office is located and I will also update my timeline. I will also call USCIS and try to get a Tier 2 on the line because it would definitely like you said help me ease my mind if I can find out that info. Thank you so much. You responding does help :)

I've been hearing that VSC has been claiming to be working on May 14th, 2012 files however I came to find out that a September 2012 filer just got approved on Nov 8th, 2012. Just 44 days between the NOA1 and NOA2. Their petition was sent to VSC. I am a August filer and I am still waiting for an approval. They talk about how petitions are looked at based on the order it was sent but that's a lie. This is just unfair. I am very tensed and upset.I am planning to call USCIS and complain to them about this and they better do something about it and I even have proof that they approved a Sept filer before a Aug filer. Please leave some feedbacks about what you think about this. Thank you!

How often does a person get put into AP at the Mumbai Consulate? My husband's interview will be held there so I thought I'll get a heads up. Our case has gone through USCIS and NVC without any RFE's. Also when I opened the DS3032 form, I noticed that on top it asks for a barcode. Now does that only apply if I'm sending the form via mail? I don't see it being mentioned via email.

Since you have no income for your father to combine incomes with, then you should fill out your I-864 and he should fill out his own separate I-864, not the I-864A. The I-864A is for a qualifying household member that resides with you to combine their income with yours to meet the 125% requirement.

The petitioner is always the primary sponsor and will always fill out their own I-864. Fill it out and provide your supporting documents. If you did not file taxes for the past 3 years because you do not work, then provide a statement explaining that you had zero income and were not legally required to file taxes. Your father will be the joint sponsor and fill out his own I-864. He needs to provide his own supporting documents: most recent tax transcript, letter from employer, most recent pay stub(s) and proof of being a USC or LPR. No I-864A needed.


Thank you! That was very helpful. So let's say I did work and have taxes filed for the years 2009 and 2010 but I have no where near the income I need to qualify. In that case, does that mean I still fill out the I-864 but the co-sponsor fills out the I-864A?

I was asking this because I ran into some forums about the I-864 and certain people say both the petitioner and the co-sponsor needs to fill out the I-864 and the co-sponsor also needs to fill out the I-864A (parts 1 and 3) and part 2 the petitioner has to fill out. So I wanted to get the confusion out of the way. I trust what you said so I'll go with that.

My husband lives in Coimbatore (Tamil Nadu). Could anyone tell me where his interview would take place? I was assuming Chennai because that would be the consulate location we would be near. However I have been noticing that a lot of interviews are scheduled at the Mumbai consulate. My husband received his Police Clearance Certificate from Malaysia on June 2012. Then in September he went to the passport office and applied for a new passport. The reason to why is because his passport had his old home address so he had to change it to the current address he is living in(INDIA). So he got the passport with a new number. He hasn't traveled anywhere with the new passport however the Malaysian PCC is in his old passport number. Is it still valid to send in the PCC or would I have to get a new one in his new passport? He stayed in Malaysia for 3-4 years under his old passport. What should I do? If anyone can answer this, it would be really helpful. Thank you!

Peter7: It's great that you got both of your bills invoiced on the same day. However, every case varies. Some may get it on the same day and some get it days apart. But you're lucky because you saved a little bit of time :).

GandA5510: Did you check to see if your DS-3032 was accepted? Once it is, the IV bill will be invoiced. Otherwise, you have to wait until it is.

It hasn't been long since your AOS bill was invoiced and paid. Give it a few more days. Don't drive yourself crazy. It will be there by next week or so. If not, call NVC. Good luck :)

My petition was received on January 7th also. I've been calling everyday since and I still get the same response. "It takes about 10-20 business days to get the case number". You just never know when it will be given so as annoying as it is, calling everyday is the best. I hope everyone as well as me will get the case number soon. Waiting for the petition to be approved was hard enough. Best of luck to everyone!

Hello there! The number to NVC is 603-334-0700. They ask for your USCIS case number. Once you give that, they will tell you when your petition was received and if your case # for nvc is available or not. If not, they will tell you it will take about 10-20 business days to get it. So just keep calling everyday until you get it.

You have 2 options.



1. Amend it for "Married Filing Separately" and write "NRA" (non-resident alien) in the foreign spouse's Social
Security Number box. Not recommended because your refund will be smaller. Yes this is a legal method and is listed on form 1040's instructions, page 13.



2. Amend it for "Married Filing Jointly". You need to send in a form W-7. The form and tax return (amendment) needs to be sent to the address in the form W-7 instructions. This will get your foreign spouse an ITIN. Follow the instructions for form W-7. You need to send in more evidence documents also.

I just finished filing my federal return using the W-7 option. It will take 1 to 2 months longer to get processed, but you'll get a much larger return. (unless your foreign spouse made a lot of money)

Hello VJ Members,

Recently, my father filed his taxes as well as mine. Because I don't have a steady income and haven't worked since living aboard with my husband, my father is the co-sponsor. I worked from 01/2012 - 05/2012 and I was engaged at that time. I am sure when I get my interview scheduled, the embassy will ask for both my father's and my recent taxes. I filed as single since my husband doesn't live in the US nor has a SSN. Is that the right route to have gone? I heard about the ITIN but I didn't really look into it until now. What do you VJ members think? Feedbacks will be appreciated. Thanks!

My husband's interview has been scheduled for April 17, 2013 at the Mumbai Consulate. Our case was completed a week and a half ago (9 business days) and we received the email just a few hours ago. You're welcome! No they don't email you to let you know they received it. The IV Packet will be entered into the system once the reviewing has finished. But you must call them once everyday to know the status. For my case, everytime I called them regarding the IV Packet, I kept being told that it wasn't recieved. I called everyday from the first day it reached the building until the 6th working day and was finally told my case was just completed. Every case has it's own pace So hang in there. Keep calling them everyday.

Also once the case is complete, an email is sent to both the Petitioner and Beneficiary letting them know of the case complete. I didn't recieve mine yet. I was told it takes a few days after case complete. But anyways, I hope you get a case complete very soon :)

Peter7: I sent my DS-230 package on February 12th and it was received on February 14th. I got case complete on February 23rd (6 business days). I'm pretty sure your package is in the building but still being reviewed so I would either call them for the next few days to check the status because that's what I did. When I called on the last day before the weekend (23rd) the lady I spoke to told me my case was just completed that day itself. Don't worry your case complete will come very soon if all the documents requested are there. Keep me posted.

It depends on how busy they are. Responding back with an email might actually take longer. The best would be to call them everyday. I hated calling them b/c for a good two weeks, I had to hear the same thing "No we haven't put it in the system yet. It will take 15-20 business days". Argh lol so annoying. But you're getting closer and you will get it soon. My case is complete so no more calling them. If you need help with anything, you can message me.

Yes it does take about 20 business days. It could be less or more than that. I suggest you call NVC everyday. Before you know it, you will get it. At NVC, you have to always call them to get information on your case whether it be about your DS-3032, AOS and/or IV Packets. Best of luck :)
