Ok. This is a little complicated. Lets start with the facts:

Me: US Citizen from Father with Certificate of Birth Abroad/Consular Report of Birth Abroad (Germany) Original Document Lost. My Mother does have a copy.
My daughter: 2 years old. No Passport. With her Mom in the Philippines. My name is on her Birth Certificate.
Actions: Filed for K1/K2 Visa 12/27/2007

Ok so I filed for K1/K2. I included my daughter's name so she will be able to get the K2 and come with her mom.
Now we want Aeisha(daughter) to become a US Citizen.
If I go ahead and start the process, would it interfere with the K1/K2?

It would be pretty difficult to do her citizenship(register her at the embassy/Report of birth) for the following reasons:

Aeisha was born out of wed-lock (of course she was, since we were not married at the time and the U.S does not recognize marriage in the Philippines anyway!!!And if we do marry in PI, I cant use the K1/K2!its silly!)
So she has to be legitimized first.
Then, I do not have the original of my own Report of Birth Abroad. Which is required to prove I am a US Citizen, (despite having had a passport since I was young,served in the Army,am attending a US college, being a registered Voter and being a FLorida Resident, and oh yea I just filed for K1 which can only be done IF YOU ARE A US CITIZEN!! Very Very Silly!)
So I would have to request a new Consular Report of Birth Abroad(CRBA) from Munich,Germany. No Idea how long that will take!
Then, they may require a DNA test. Which doesnt happen overnight and costs around $500.


The 2 questions I have:

1. So FOR EXAMPLE I get this all done within a month or so, would it interfere with K1/K2 since she is a US Citizen from that point on?


2. If I wait for my daughter and fiance to come to the US on a K1/K2 and get married...That would legitimize Aeisha and make her a US Citizen. Wouldnt it?

OK,FIRST OF ALL THANX FOR ALL THE HELP EVERYBODY!
After a lot of research I finally called Manila Embassy and was lucky 4 a change! The lady was friendly and had a personal desire to help out and answer my questions. Very refreshing, compared to previous calls I made.
Anyway, I was told that I do not need my CRBA as proof of citizenship
IF MY PASSPORT HAS BEEN ISSUED B4 MY DAUGHTER'S BIRTH AND IS VALID AT LEAST ANOTHER 5 YEARS!
I pointed out that this is NOT on their website! I actually directed her to the said page and had her read it aloud!he he!
She said "Oh" and immediately went to her supervisor to verify. Done. So I do not need to provide my CRBA.I always had a passport my entire life so Im good on that. The only thing I didnt like was that she said I should send in my passport. Dont know y certified copies dont do the trick here! I may call again about that!

Then I asked about the issue of US Citizenship interfering with K2. I was told that there would not be any problem because 2 different departments handle them. (of corse). So I pressed a little more and she explained that
IN CASE MY DAUGHTER GETS HER CITIZENSHIP PRIOR TO THE K1/K2 APPROVAL, MY FIANCE NEEDS TO BRING NOTARIZED COPIES OF AEISHA'S PASSPORT (mite as well bring the passport and notarize them at the embassy) TO HER INTERVIEW. THOSE WILL BE ATTACHED TO THE PETITION AND THEREFORE THE K2 BECOMES IRRELEVANT.

I called up Dawn(Fiance) and she ordered the package from Fedex immediately(PHP 250). It came the next day. I was able to find all the documents online so if any1 wants to know whats in the package, let me know or ask Dawn. --> her ScreenName on VJ is "bluemist".

Mike and Elisa yes you are correct that she is a US Citizen automatically, just like I was when I was born.
And yet, if I dont complete the process..there is no proof of it. Thank u for pointing that out. It is very important to be aware of that fact. I tried to explain that to more than 1 person in the past and they did not quite get it! Knowing that little fact solidifies one's position when arguing the case - any case! Catch my drift??

That is troubling news to me. I did plan on using fedex to send my passport to PI. Maybe not. I do know that Fedex in Cubi is about to be closed or moved. SO who knows what people do when they are about to be out of a job(Im just saying. Dont know if that is correct)
I may try DHL they have an office in my fiance's city and I havent heard anything bad about them yet!

WHEN I SENT ALL THE PAPERS TO MY FIANCE ....HE SIGN IT ALL AND HE NOTARIZED THE OTHER PAPERS THERE IN US.the consul never ask anything to sign....my fiance was not there on the interview....jus follow all the instructions in the paper and its gonna be ok....goodluck to you

Ok,
So we are working on our Daughters US Citizenship and she needs to be legitimated. Method 2 applies:

Legitimation Method 2 - The person can be legitimated if:

1.
the father (unless deceased) has agreed in writing to provide financial support
for the person until the person reaches the age of 18 years and,
2.
while the person is under the age of 18 years -
1. the person is legitimated under the law of the person's residence or domicile,
2.
the father acknowledges paternity of the person in writing under oath, or
3.
the paternity of the person is established by adjudication of a competent court.

I'm not 100% clear what these three mean

If any1 could explain that would be great.

At this point we are about to go for Option 2 (2. the father acknowledges paternity of the person in writing under oath)

I know The Affidavit of Acknowledgment/Admission of Paternity can be done by signing the back of the Certificate of Live birth or on a separate document

I know here in the states every state has its own version of the Affidavit of Acknowledgment/Admission of Paternity, but I didnt find any OFFICIAL form for PI yet.

I found a few sample forms people made for other countries.

I was wondering if anyone knows if a Form exists for this or is it something that is written up by myself and/or an attorney?

If you know where to get the form (if there is one) , pls post and if anyone wants the forms I found online, I can post them for u!

talks about how the Manila US Embassy has some kind of issue when folks need Co=Sponsors!

This stuff got people freaked out and it needs to end!

Apparently some1 in the past had a virtual (VIRTUAL!!) interview at Davao and the Consul did not accept the Co-Sponsorship for whatever reason.



Now, I dont know the details about this so SOMEBODY PLEASE speak on this.

What I do know is simple:

The USEM in Manila is the UNITED STATES EMBASSY...That means that it follows the same U.S. laws and rules and regulations as any other US Embassy around the world. There are no special rules about Co-sponsorship in Manila as far as I know and it would be ridiculous!

It is a US Embassy, not a local public office of the host country. The Consul cannot decide at his or her convenience when and when not to accept a Co-Sponsor.
They CAN deny or freeze a Visa when they suspect foul play and there is some sort of evidence to support the claim.

You are not at the Consul's mercy! You haven't done anything wrong!
The U.S. is not the country it used to be, but certain things still stand.


Do your homework and be honest and you have nothing to fear at your interview. Yes, of course everyone gets nervous and worries, but there is no need to be scared.

So I called the USEM yesterday to ask questions.

I asked if the CoSponsor has to be my(Petitioner) relative...?

Answer: CoSponsors are not allowed with I-134!

Now, in previous threads it was said that USEM in Manila does not allow cosponsors with K1....
This is not really clear. I think the USEM chose the wrong words to describe the issue.

They explained to me that a CoSponsor is NOT REQUIRED with the I-134.
They also used the words "Not allowed", which is confusing...

Aaaanyway.....
The reason why a CS is not allowed/required is because:

""125% above the Poverty Line is required for the I-864! Not I-134!!!""

So she asked me what my household size will be. I told her THREE! She said the Income Requirement would be $17.600!
I replied: "Wait a minute, I thought thats for members of the Military....."
She said Yes, but only with the I-864.
As far as the I-134, 100% is required. Not 125%. If you are in the military or not does not matter on I-134.

So, in other words. If you look up the Poverty GuideLines here:

125% is meant for the I-864 non-military. And the 100% is meant for I-134.

If all this checks out to be correct...I do not no0pb.gif need a CS after all.
I dont make $22.000/125%. But I make more than $17.600/100% !



I will call them again 2nite and hopefully talk to another person and see if he/she will confirm this.

If any of you can confirm this here, please do so.
I think there are a loooot of people who think they need CS, but really dont according to Grace, USEM Manila, 28 July 2008.

But I am excited, concerned, relieved and stressed all at the same time. And yet, I have to sleep a little bit because or new furniture will be delivered in the morning.

Ok so anyway, I just wanted to share so all the people who are still waiting can get a feel for how it is when things are starting to really sink in.

You should go to Philippine Consulate with your child's Birth Records and whatever else they require and get a Philippine Passport. We will go to the one in Jacksonville. Not sure where the one is in Georgia. Google baby, Google!
Also, you want to do that ASAP, while you are still a Filipino citizen.
That's what we were told by Immigration.



FOR THOSE STILL IN PI. GET YOUR CHILD'S PHILIPPINE PASSPORT IMMEDIATELY. THAT WAY YOU WONT HAVE TO PAY PENALTIES FOR YOUR US CITIZEN CHILD "OVERSTAYING"!

Yes, we paid that as well as Exit Fees and some other mess.
The officials conveniently told us about that AFTER we paid already! They also so said there is no more fee to be paid to get a Passport. I'm not sure how true that is. Probably not at all.
Immigration and emigration IS a business. Especially in PI! But u knew THAT already,lol!


Was your child born in the Philippines? The way I understood it is my son is a dual citizen and can apply for a Philippine Passport.


YES she was born in PI and thats how I thought about it too. And yet we had to pay.
Bottom Line is, some people never pay anything. Like I said, immigration is a money maker and there are a lot of double standards and a lot of Red Tape!

I paid 2 get it over with, rather than to argue my point and have more problems than its worth.

I was under the impression that it was unlawful to have multiple passports. Please correct me if I'm wrong. My son is still in the RP with my wife. He has his CRBA/US passportIf we can get out of paying the "overstay" screw-job that would be great.


Not sure what u mean here. If you are a dual citizen, y would you not be able to have both passports?! I mean, if you cant, whats the point? lol And yes, I have seen many people at NAIA with both passports. Im sure you have too if u think really hard about it. But don't take my word as fact. Find out at USCIS Website or Google it until u find a site with official info. (.gov)!

OK,FIRST OF ALL THANX FOR ALL THE HELP EVERYBODY!
After a lot of research I finally called Manila Embassy and was lucky 4 a change! The lady was friendly and had a personal desire to help out and answer my questions. Very refreshing, compared to previous calls I made.
Anyway, I was told that I do not need my CRBA as proof of citizenship
IF MY PASSPORT HAS BEEN ISSUED B4 MY DAUGHTER'S BIRTH AND IS VALID AT LEAST ANOTHER 5 YEARS!
I pointed out that this is NOT on their website! I actually directed her to the said page and had her read it aloud!he he!
She said "Oh" and immediately went to her supervisor to verify. Done. So I do not need to provide my CRBA.I always had a passport my entire life so Im good on that. The only thing I didnt like was that she said I should send in my passport. Dont know y certified copies dont do the trick here! I may call again about that!

Then I asked about the issue of US Citizenship interfering with K2. I was told that there would not be any problem because 2 different departments handle them. (of corse). So I pressed a little more and she explained that
IN CASE MY DAUGHTER GETS HER CITIZENSHIP PRIOR TO THE K1/K2 APPROVAL, MY FIANCE NEEDS TO BRING NOTARIZED COPIES OF AEISHA'S PASSPORT (mite as well bring the passport and notarize them at the embassy) TO HER INTERVIEW. THOSE WILL BE ATTACHED TO THE PETITION AND THEREFORE THE K2 BECOMES IRRELEVANT.

I called up Dawn(Fiance) and she ordered the package from Fedex immediately(PHP 250). It came the next day. I was able to find all the documents online so if any1 wants to know whats in the package, let me know or ask Dawn. --> her ScreenName on VJ is "bluemist".

I tried to explain that to more than 1 person in the past and they did not quite get it! Knowing that little fact solidifies one's position when arguing the case - any case! Catch my drift??

Ok. This is a little complicated. Lets start with the facts:

Me: US Citizen from Father with Certificate of Birth Abroad/Consular Report of Birth Abroad (Germany) Original Document Lost. My Mother does have a copy.
My daughter: 2 years old. No Passport. With her Mom in the Philippines. My name is on her Birth Certificate.
Actions: Filed for K1/K2 Visa 12/27/2007

Ok so I filed for K1/K2. I included my daughter's name so she will be able to get the K2 and come with her mom.
Now we want Aeisha(daughter) to become a US Citizen.
If I go ahead and start the process, would it interfere with the K1/K2?

It would be pretty difficult to do her citizenship(register her at the embassy/Report of birth) for the following reasons:

Aeisha was born out of wed-lock (of course she was, since we were not married at the time and the U.S does not recognize marriage in the Philippines anyway!!!And if we do marry in PI, I cant use the K1/K2!its silly!)
So she has to be legitimized first.
Then, I do not have the original of my own Report of Birth Abroad. Which is required to prove I am a US Citizen, (despite having had a passport since I was young,served in the Army,am attending a US college, being a registered Voter and being a FLorida Resident, and oh yea I just filed for K1 which can only be done IF YOU ARE A US CITIZEN!! Very Very Silly!)
So I would have to request a new Consular Report of Birth Abroad(CRBA) from Munich,Germany. No Idea how long that will take!
Then, they may require a DNA test. Which doesnt happen overnight and costs around $500.


The 2 questions I have:

1. So FOR EXAMPLE I get this all done within a month or so, would it interfere with K1/K2 since she is a US Citizen from that point on?


2. If I wait for my daughter and fiance to come to the US on a K1/K2 and get married...That would legitimize Aeisha and make her a US Citizen. Wouldnt it?

I suspect that our petition took a while becoz of UPS!! Well, I cant really blame them but here is the story so YOU can avoid this issue(if it is 1):

When I got ready to file the 129F I got all my papers 2gether and went to my LOCAL UPS store. When I say local, i mean that its owned and operated locally. Well they have computers,printers,xerox,folders,stickies,etc.....all i needed basically.
I spent almost an entire day in the store assembling everything, checking and doublechecking evrything from spelling to the type of paper im using.........Yea i was a little paranoid.lol!

To the Point:

I bought a POCKET-FOLDER at Walgreens the Accordion type...


Made perfect sense to me at the time since it has plenty of room and tabs to easily organize and find everything in a flash!

Ok so after hours of getting my sh.t 2gether...It was time to mail the thing.
So I am trying to fit the folder into 1 of the ENVELOPES UPS has in store.....
That doesnt work. So i ask if they hav some other sizes......Nope.
I had already spent the whole day away from work, plus I promised that I will send it that day....Now is the time!!!
So UPS told me if I want to mail it, I can use a box. No not a "square" box. I guess it is made for documents but it still is a box!
So having little choice I went 4 it.

Now I dont know if that fact has to do anything with anything, but I'm imagining my "box" coming into USCIS and since 911, boxes are not very popular................duh.
If its not that then maybe it looked kinda intimidating to whoever does the paperwork(if they didnt get rid of the box).

Like I said, I do not know if that really matters
. But if u r unsure about wot material to use to send the documents......u can use my experience to make ur own decision.

We got approved despite the "Box".
The MOST important thing is that ur paperwork is complete and correct. I hijacked the store for several hours. I checked everything about 10 times and at the same time used the net to compare it to other folks stuff. Dont underestimate the power of the Net!!!!

My Fiance pointed out to me that ppl who filed 129F in January 2008 are now receiveing NOA2 this month (March). I would of corse like to be 1 of those lucky people.We filed December 2007!!! So anyone has any clue why or how this is happening?
I expected 6 months at least .... and now i see ppl gettin it after barely 2 months....? I'm happy for them. But I am concerned since they did file after I did.
I called USCIS and got the same old "Case Pending and our customer service department does not have any more other news about your case....,bla bla!

Can anyone clarify what is going on? I know they hired more ppl recently but still...can we catch a break too?

Any sponsor's household size for the affidavit of support is the sponsor, his dependants and any intending immigrants to be sponsored. In this case the number is 3.

Just disregard the fact the sponsor lives in the same home as his parents. For this purpose they are roommates.

hmmm. a lot of folks point out your mistake and they are not wrong.

But I can understand that u lied out of desperation and maybe a little lack of knowledge and research. Now unless you are really trying to do something illegal....isnt it possible to say that you simply mistyped the date? Or did you invent a whole story line for 04 and 05?
If thats the case...I dont know if they will consider you to be credible at all.

So I called the USEM yesterday to ask questions.

I asked if the CoSponsor has to be my(Petitioner) relative...?

Answer: CoSponsors are not allowed with I-134!

Now, in previous threads it was said that USEM in Manila does not allow cosponsors with K1....
This is not really clear. I think the USEM chose the wrong words to describe the issue. headbonk.gif

They explained to me that a CoSponsor is NOT REQUIRED with the I-134.
They also used the words "Not allowed", which is confusing... blink.gif

My point was to encourage people to go ahead with their petition even if the petitioner does not meet the 125% or the 100% for that matter....!
That does not mean you dont have any chance of getting the visa!


I know from reading other posts here and from my own experience that this is a common misconception and should be clarified. There is enough to worry about with filing anything with immigration as it is!!!


UPDATE:


I called USEM again and everything was confirmed. Unfortunately it was the same person on the phone, but as you can see from the replies here in this thread...it checks out after all.

So, to sum it up:

If the petitioners overall history looks shaky to a CO (Bouncing from job to job every other month, Unemployment benefits,etc.........) a decent CS would be a great thing to have in your back pocket! But not having a CS does not mean you cannot get your Visa approved!

My income and history should be just fine. We will have a CS (" hand carried and separate from other documents!"), just in case. I doubt they will ask for it!

Ok VJers,

I got great help here when we went through the K1 process(and still are).Just do a quick check on my and my wife's history here..
So I know it is absolutely worth it to post here. Thank you all in advance.

This is about my brother in-law:
He is half filipino but he is a US Citizen living in California.Unlike my wife,his sister, who has filipino citizenship.
He and his filipina girl(who is in the Philippines) are ready to begin the K1 Visa process and ask us how to go about it.....!

Jon, my brother in-law suffered an injury in mid-2009, which put him on disability. He is receiving disability pay from the state
called SDI or CASDI since July 2009.
His combined income(disability+salary) was just over $20.000 in 2009, which would be enough to meet the income requirements.
However, we are not sure if he can include the SDI income since it is not taxable and therefore would not show on a tax return as I understand it.
We are also not sure whether SDI would fall under "State Means Tested Benefits" or not.


If anyone has a solution or just any info or if this has been answered previously(I searched without success..), please share here.
