Do I understand it correctly that the I-130 is filed right after the marriage, and the AOS is filed within 90 days of her arrival in the US?
AOS can be filed up to 2 years after arrival to the USA, the I-94 for a K-3 will expire 2 years after entry.

Many on K-3 simply wait until they are close to 2 years of marriage and then file AOS, in this case if the AOS is approved AFTER 2 years of marriage the resulting GC will be a 10 year unconditional Card. This will save the added cost of removal of conditions.

Again my standard reply to K-3 is dont do it, the CR-1 costs less and allows the immigrant the ability to do things like TAKE a JOB, get SSN, and even apply for a driver's license. K-3 has the added burden of AOS, and is NOT work authorized, they need to apply for EAD, and wait up to 90 days or longer to get the EAD.

PLEASE compare the timelines, you will see that K-3 tends to not save you much time, and has the added headaches, of AOS.


That is very true. I filed for K3.. Between filing and waiting took me 6-8 months to be approved. For CR1 it takes a bit longer like 8-12 months but i guess its worth the wait. My friend is under CR1 and after a year and 2 months, got approved, came here in the US and after 3 months got the 10 yr GC. For me, coz i waited till our 2nd wedding anniv... stii have to file for AOS this month. More than a year now without SSN and of course work. Glad that hubby is very good provider, lol. I cant wait to finally have my papers and get back to work!



Can any one help me out with where to find info on the CR-1 on the USCIS website? Like I cannot find it under the immigration forms section?

sorry, I am just rather confused! maybe I am asking for advice from to many different people!, but I ve heard every
side of the visa s(or at least so I thought), and had finally figured out that the K-3 was the one for me! If this helps you out in your advice for me, I am far more concerned about us being together than whether or not she can work once here, I have a good job and I not gonna plan on her working anyway, I just want her to get here as fast and legal as possible!

I think there are a lot of personal relevancies that apply here, however there are several pros and cons of taking out US citizenship. You are the best one to decide if they are important for you or not.

Pros:
-can vote in all elections (nice to have a say in the government where you live)
-can hold political office (if you wish)
-has more beneficial tax situation if spouse dies
-has more beneficial tax situation if inherit from overseas (out of the US)
-eligible for certain governmental benefits restricted to US citizens
-eligible for certain educational benefits/scholarships at Colleges and Universities
-some jobs are restricted to US citizens only
-can't be deported
-children under 18 automatically gain citizenship through parent
-still receive full SS benefits if you retire abroad
-don't have to renew green card every 10 years
-can live anywhere in the World and still be allowed to return to the US without going through the immigration process again
and the biggest benefit for most - don't have to deal with USCIS again!

Cons
-have to file a tax return with IRS wherever you live for the rest of your life (tax treaties generally prevent double taxation)
-eligible for jury duty
-may not be able to retain citizenship in birth country (some countries allow/recognize dual citizenship; some don't - Canada does)
-children's children may not have claim on citizenship of your birth country (some countries restrict derivative citizenship to 1st generation - Canada does)
-swearing allegiance to another country may bring conflicting emotions
-agree to join military or to assist military action in non-combative role if called upon by US to do so

Those are the ones that come to mind. I became a US citizen from pragmatic reasons as much as because I really believe that if you are living in a country you should participate in the governance of that country and I want to have my say by being allowed to vote.






So Canada does still recognize dual citizenship? I heard they had quit? That is prob one of the big factors of her keeping a greencard and for the children to be able to have claim to eithier country, because we do plan to travel ALOT in between and keep strong ties to her family there.......hmmmmmm, lets just all be one country and forget immigration to/from Canada. :rofl: :whistle:

It depends on which work visa:
  • if H1-b, the visa can be renewed in US prior to wedding, and you can then have wedding in Canada
  • if R-1 (she's teaching in Religious-oriented school), as with H1-b
  • if TN-1, you'd be playing with fire as the TN-1 is (supposed to be) non-dual-intent; the marriage should then be done in the US


Notes about TN-1; the holder (if not in a state of having I-485 filed, or in "hurry-up-and-wait" mode for priority-date to enable I-485 filing) can renew the visa at POE/PFI[*]with approved I-140 (labour GC) prior to filing I-485 or Consular packets (whether able to file I-485 or in "hurry-up-and wait" mode) TN-1 can be renewed in the US by mailing I-129 to NSC (I actually did that between 1997 and 1999 when I was in "hurry-up-wait")[/list]





I believe it is R1 that she is currently here on right now, Religious tradition is that the wedding will be in Canada(her hometown),

Ok so maybe I was misunderstanding you - since her visa is expiring before the wedding - the question is why would she be going back to the States after the wedding - for your honeymoon? Is she renewing the visa?




The wedding and honeymoon will be in Canada, the reason for coming back to the states is that we plan to live in Missouri, if she wants to continue to work in the U.S., and she just renews the temp. visa, will that effect the filing of a
K-3 visa? from what I understand, it would, but maybe I am wrong?

O then we already screwed up because we are already working on her paperwork for the US, and I was talking on a diff topic about our children having dual citizenship, but I would rather talk about it here any way since we are all dealing with Canada/US. A friend told me that if my wife becomes a US citizen, our children could not have dual citizenship, the reason I ask this is because that is what holds us from getting her citizenship papers. We want travel to/from US to be easy as possible as we will be doing it quite frequently, and I want to be able to work when I go there if we are there for an extended amounts of time. to decide between K3 and CR-1, obviosuly CR-1 is a more superior visa. you can read the benefits on this website. in terms of paperwork, there is a lot less paperwork involved with CR-1 and is less costly. they both are taking about the same time to process these days (in some cases CR1 is faster). so my vote is for CR-1.

and no, you cannot apply for either K3 or CR-1 without a marriage certificate. by petitioning a I-130 for your spouse you have to prove that you are legally married to your spouse.

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of a bonafide marriage
More questions! Sorry if I am asking alot of dumb questions, but just trying to research before I actually get started with paperwork! I am wondering about the need for evidence of a bonafide marriage, obviously if we get married and the day after I apply for a CR-1, there will not be alot of other proof than a marriage certificate, the form suggests, lease, ownership, kids, we would have none of this, does anyone know what else would be approved? I have question, If my spouse to be is here on a R-1 visa, can she go back home, I go there, (Canada), we get married, will she able to make it across immediatly, and then once over here she could just file for adjustment of status, without filing for a CR-1
