IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Approved
QUOTE (Lucy Keeling @ Apr 24 2008, 09:13 PM) <{POST_SNAPBACK}>
Hi, get a email from CRIS stating my case is approved, and approval notice was sent on 4/23. There is no touch before approval. We did no expediate . No I-129F either.
I am excited now but also worry about my daughter's case, we filed at the same date in the same mail, but I did not see her NOA2 . Husband will call CSC tomorrow to check.
So, since CSC is handling on Jan. case, how can they put the timeline say they are in Aug.?
Hope USCIS moving quickly .

Lucy

In DS230, question 29 ask for Petitioner's name and address. Is this question asks for the USC's name and address? The sample form on VJ has the USC's name and address. But, I am a little confused whether the non USC, who is the beneficiary, is considered the petitioner for the purpose of this form.

Do you write down name and address of the USC or the non USC for question 29 in DS230?

Glitches on forms
On form DS230, question 25, ask for dates and residence in the previous visits to the States, the dates field indicate (mm/yyyy), but I kept getting error message trying to key in (mm/yyyy), but no problem with (mm/dd/yyyy). My last visit to the US was 8 years ago and I couldn't remember the exact dates, I want to put down the month and year only.

while filling up the DS3032 form, the Last name keep pop up in the space for "country"?

Do you experience the same? what did you do ?

DS230 is form for the beneficiary in this case beneficiary becomes applicant, petitioner (USC) stays as a petitioner. So on question 29 you have to put petitioners/USC name and address.
If you are unable to put the date/name while filling forms u can always after priniting hand write the same part.

Yes, I agree.

Can someone tell me how to write email regarding DS-3032 for a child? I have search the forums and the question has been asked before, but when I look in the search results I am not able to find it. Thanks!

Hi, I am in the same situation as you face . I have asked this question on this blog, it seems parent who is the leagal guardian should write email to determine who act as child's agent.
Child can not write email to NVC .

Lucy

Godo question. I think, as a petitioner, you can write NVC and tell them you want to be your child's choice of agent, since the child has no way of emailing NVC. Provide you and your child's names, addresses, date of births.

Hey Guys,

Wish you all the best. Actually I needed your guidance as I just checked my NVC message and it says that the "...NVC has received the DS3032, Choice of Agent and Address form on______. and will send further instructions within the next few weeks..."

Please advise what should I do now. Should I send the I-864 documents now. Also, how to pay the IV bill and when to pay.

I would be grateful for your help. Thank You

Not yet. Find out from NVC, if they have generated your affidavit of support (I-864) packet. When did you send them the AOS Fee?

I sent it last friday, but this weekend it stated that DS3032 Received. It does not state anything about receiving the AOS bill as of yet. Also you know if I should try getting the IIN number and pay the IV bill online.

Then it is too early to mail I-864 packet. They have to process the AOS fee first and then generate the I-864 packet after which you can send your I-864 packet. In order to pay the IV bill, try to get the IIN number from NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS3032 via email?

Just my 2 cents....

I did read few of our VJers friends sending an email for the DS3023- Choice of Agent. NVC is taking at least 7-14 days to respond to this request. I originally planned to email them, but since I got the feeling they are backed up, I sent them a trial email (not the DS3023, it has not generated yet)... this is my 14th day, but still no word from them. I have scanned an original document, which my husband signed and sent back to me. The barcode I generated following James' shortcut is already attached on the form, just waiting for the generated automated message to tell me so, and this DS3032 will be mailed next-day air. I can't take any chances, it's the BEST route for me right now.

I actually posted my concern on another thread... Good luck friends!

http://www.visajourn...p;#entry1085741

NVC will accept choice of agent email, if you email them after NVC generates choice of agent (DS 3032). If you email them before it is generated, then it will be ignored.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS3032 via email?

We did something very similar to that described in the NVC timesavers (see the link in my sig). Ours went a little something like this:

Dear Sir or Madam,

My name is BENEFICIARY and my visa case number is CASE_NUMBER

I have not received my DS-3032, but would like to appoint my husband as my agent of choice to receive all the correspondence from NVC. I have CCed both his individual email address and an email address that we jointly maintain.

His name and address is:

NAME
ADDRESS
ADDRESS

All mail from the U.S. Department of State concerning my immigration visa application for the case number listed above should be sent to him at the address above. Thank you for your help.

Sincerely,

BENEFICIARY

It was sent to NVCINQUIRY@state.gov and we received a response from the NVC in two days from the same address telling us to expect the IV Bill. Plain text, no attachments, no "real" signature. Seems like all you need to know is the case number and the name of the beneficiary. It probably helps to choose your spouse that's filed the petition. A bit scary in its simplicity... I guess that's why you need to keep your case number under your hat. Hope this helps. ttyl,

mich

I've noticed a lot of members send their Choice of Agent and Address via email. How do you do that?
Just plain text in the body of an email (and what do you write then?) or attachement with the actual filled out form scanned?
What about your signature if it's sent through email?
Is this the correct email: nvcinquiry@state.gov?
How do you know NVC recieved and accepted it?
I would appreciate your responses!

Phirephly,

I am waiting for my case number. As of today, they don't have any record for my approved petition. They replied me that they already received my approved petition and on the process of assigning a case number and putting it on their computer system. Maybe tomorrow (Tuesday) I will get a case number, as usually it is assigned on Tuesday. I will follow the same route that you did for Choice of Agent.

As the time gets closer i am really worrying...we are already expecting a rfe as we left a question blank on 3 of the forms and only answered the question on one of the forms...how could i be so stupid?

Do not worry. You can re-submit a correct G-325A with all correct imformation. Also mention that your father is deceased. You should write a cover letter explaining why you are re-submitting the G-325A and also include the photocopy of I-797C (Notice of Action) of I-129F that you received from USCIS.

K-1 Fiance(e) Visa Process & ProceduresG-325A

Hi everyone,
Yesterday you heard from my fiancee about the G-325A and i also have a question. In the section that shows examples of forms they show the same example for both the us citizen and the foreign applicant.... duh. On the form for the us citzen to fill out and the section that says Applicants last address outside the US are we to put any non US addresses there?

Thanks all, good day
Tina

It is more applicable for the naturalized US citizen who was not born in USA and for some born US citizens too. It simply means, if the US Citizen's last address abroad was more than a year, then the USC needs to put that address.

K-1 Fiance(e) Visa Process & ProceduresIn the middle of K-1 application, need to switch to student visa?
Unfortunately, your fiance won't be issued a student visa. The main criteria for student/tourist visa is, one has to convince the consular officer that he/she will come to the native country after study/visit. Since, you have already filed I-129F, the consular officer will simply tell your finace that he/she has intention for immigration and live in USA permanently. She consular officer will also mention that your fiance will be able to go to USA with K-1 visa therefore your fiance should come back for K-1 visa interview.

If your case is straight forward, if you dont have any unusuak circumstances, then you should be able to do the whole process by yourself. Lawyers would take your money up front and then they have other priorities than yours. I did the whole immigration process by myself and now doing it for my wife.

K-1 Fiance(e) Visa Process & ProceduresFiling for I-129F while in the US

If they have filed the I-129F marrying in the US is not an option anymore, 'cus even if they cancel that petition they can't prove they married in the spur of the moment.

You are right, if they already filed, then marrying now is not an option. In that case, the beneficiary has to go back to the native country for medical and interview. I thought, they have not applied for I-129F yet, but it seems to me, they have already applied for K-1.

HI,

I am on a F-1 visa and I live in the US. My fiance' has just filed a I-129F for a fiance visa.
Did anybody went through the same kind of process? I mean to file for it while in the US and not in your own country?

If yes how could you manage the interview with the consulate in your own country? Are they flexible in setting the interview date?

Thanks,
Raffy

Not sure about the fiance visa process while the beneficiary is in the USA. You can go back to the native country for Medical and interview when the time will come. But someone can advise you better.

Another Option: You can marry in the USA and then you both file I-130, I-485, and G-325A for adjusting your status. In that case, you don't have to go back to your native country for the medical and interview.

Police certificate is required only for the beneficiary (The non US Citizen foreign spouse/fiancee).

The current IMBRA requires all US Citizen petitioner of K Visa petitions (I-129F) to provide the criminal record, if the US Citizen petitioner was convicted of any crime. If there is not any conviction, then the US citien petitioner is not required to send any background check to the USCIS.

Any conviction (maybe depends on how serious the crime was) won't be a cause for any petition denial. Per IMBRA, the consular officer during the interview may disclose the convictions of the petitioner to the beneficiary. Not all arrests lead to conviction. Was he convicted of any crime?

CONCRETE, ACTUAL evidence, ie, an actual rejection or RFE, etc. because only the first page was sent is what i was asking for, not opinions, or "i heard from somewhere's". Thanks.

There has been RFE's for only sending the first page. There has also been members that havent received an RFE for doing same. All you can do is wait and see if you receive one. It's totally up to the adjudicator.

I think, you haev two options.

1. Wait for the RFE

2. If you sent it to California service Center, then email them that you only sent one page inadvertently and ask for their advices.

Should you fill out a new G-325A, you should include your current job from the starting date to "Present" and so on. You should fill the G-325A form out from the USCIS website, as when you type on one page, it wil automatically fill the blanks for all 4 pages. Then you can just print all 4 pages out at the same time. Don't forget to sign and date afterwards.

K-1 Fiance(e) Visa Process & ProceduresAny naturalized American filed for I-129F?
Jane doe,

As a US Citizen, you can pursue CR-1/IR-1, K-3, K-1. Only a married USC can pursue CR-1/IR-1 and K-3. As you know, K-1 is for fiance only.

The consular officer has the right to grant or deny the visa. Sometimes, the Consular Officer may want to ask more documents, if anything was not submitted properly, plus the consular officer may want to see additional evidence as well; therefore, issuance of the visa may not happen right at the interview. The beneficiary has to demonstrate that the marriage is genuine.

Plan on using tabs at the bottom of my petition to seperate sections. I bought sticky tabs, is it better to

[a] attach them to blank sheets of paper to break apart the sections
[b] make title pages for each section and attach the tabs
[c] attach them to the first official sheet in the section

Did people use tabs to seperate out the inidvidual forms (I-129f and the two G-325as) or just the evidence, proof, and attachments?

Danke! I swear I'll mail this off soon and stop asking so many questions. :P

:star: Cass (bebop the great)

As long as they are organized, any methods are fine. I stapled the I-130, did not staple the G-325, as I used James Clips. Then I put a sticky note on the first page of each document, like "marriage Certificate," "Naturalization Certificate," etc. You can include a cover letter where you can say what documents you are sending. Make sure, you double check your I-129F, G-315A, etc.

K-1 Fiance(e) Visa Process & ProceduresI-129F question

We're getting ready to file our second I-129F.

Part B, question 9 asks for an A# (if any).

She had an A# for her previous K1, which we used last year. She returned to Russia without marrying me after visiting me.

Do they want me to give them that A# -- or in the context of this new petition does she in fact not yet have an A#, since I haven't yet filed this second petition? I'll need to fill in the G-325A's consistently with whatever I write here.

Thanks for help.

I think, yes, if she had an A number, that should be entered. However, you can use an additional sheet to explain how she got the A number.
