There was at least 1. She was at 4 months when she sent in a service report. She got a letter saying she had no time frame, but then she got approved shortly thereafter.


That's 4 months after transfer. Her case was from October 22, 2012.

Yeah , I questioned them about that and they told me they were working on Feb. 2013 , which was not helpful. If I go over 60 days, I'm putting in a service request.

Hi everyone. Just received second email.

Can someone be so kind as to tell me why

we get 3 emails that say the same thing?

Got first email last evening. Second email

today. Why did the first say, On Dec. 16 we

transferred your case and the email from

today says on Dec. 17 we transferred your

case? Anyways, thank God there finally is

movement!

The last email appears to be generated when your case is either signed into the new facility, or assigned to an adjudicator. (Their lack of transparency makes it unclear which is the case.)  Why we're getting 3 emails? Governmental inefficiency? Aliens? Magic? No one knows.

YEAH I have been approved!

 

Post Decision Activity

On December 13, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

 

 

To keep the stats accurate: our case was expedited and it hadn't yet been transferred to a local office. I'm in the Netherlands and my husband and 2 kids are in the US.  PD = May 7

CSC is super quick in comparison to any other service center. Seems like most of them are going through in just a few weeks... I'll see if I can find those spreadsheets for you.

Yes, I called the misinformation line. The tier 1's can't see much, but she could see my priority date. :P

No expedite as I don't live in the area (very far actually) hit by that typhoon. I do know that my husband contacted the State Senator and asked for help - guess that worked

 

I don't think that they're making much of a difference for those people who were directly effected or not. I actually doubt that all of the Philippine beneficiaries that we've seen pushed to the front of the line were directly effected. To me it really does look like they're just looking at the petitions that say they're for the Philippines, and pushing them through.

Where they send it to has nothing to do with your location. They're apparently trying to balance the workload. So where you get sent to is really just the luck of the draw.

She just said, that K-1's processing dates are starting to line up with CR-1's.  Earlier, no, but anyone recently that has been putting in K-1, will expect a much longer wait now.  She only said this, when I asked her why so many other Visas are getting processed so quickly...  She stopped me in the middle of my sentence to say that it wouldn't be much quicker now.  Cause now the backlog of CR-1's is catching up.  She said that lately, the average processing times from Spring time filers (March, April, May) is about 11 months.  I wasn't showing any disrespect, but I felt I had a point in asking what was the deal...  I was with my wife for almost a year, and we even lived together for over 7 months...  The first person I saw every morning, and the last person I saw at night...  Every day...  And now, the person I talk to every morning, every break, every lunch, and every night, sometimes more, EVERY DAY.  So why now I have to wait over a year to be with when others are doing it in just 3-4 months TOTAL without even half as much contact.  It really blows my mind...  And angers the heart.

 

 

So they're just going to switch the backlog to another group of people? Are they retarded? Instead of transferring everyone out of a particular immigrant class, why not take some from the different ones so the impact on any one immigrant class is minimal, and then HIRE MORE PEOPLE? How is that going to be fair to the K1's? They need to actually FIX the problems, not just move it on to a new group of people. 

 

Ugh.

PhilippinesTraveling to US with an Infant

This past year I moved with my 2 US Citizen children back to the states. All they needed was their passports. If the mother has a K-1 visa, then there should be no problem, and no need for immigration clearance from the Philippines as far as I know. A US Citizen child does not need a visa to come into their own country.

Ok, I have a friend that moved to the Philippines with her American husband last year. (They've been married well over 20 years and living in the US. Everything was done properly on the US immigration end, just to be clear.)  Now they had started the process to have his residency permit over there when they moved back there, but it's a year and it's been dragging on.

She just got a list (I'll be getting a copy of it tomorrow.) of documents that they're requesting. One problem that they're having is getting a copy of their marriage certificate from California.  I don't know at this point whether they're just asking for a certified copy or an apostille, but apparently they're having some kinds of issue with getting it because of California's privacy laws.  

 

So my questions are the following:

 

1. Has anyone here gone through this process already? If so, would you be willing to help me tell her what she needs to do and whom to contact?

 

2. Does anyone else have experience getting copies of a US marriage certificate for the Philippines from outside of the country?

If you're past 5 months, I suggest you start contacting everyone you can to help you. Get a service request opened. (You can probably do it online as soon as you're actually past 5 months.) Senators, Congresspeople, Ombudsman. If you're past your processing time, then it's theoretically possible to engage all of these people, and I suggest that you do so. Don't wait until you've been waiting 8 months. People are always going to tell you that you should just be patient and accept whatever the USCIS tells you.  I waited 9 1/2 months for my IR1 petition approval, and most likely won't see my husband again until it's been over a year. 

 

You might have to wait, but you don't have to be quiet and happy about it. If they're not meeting their 5 month goal in a large number of cases, they will not be held accountable unless people complain about it and bring it to the attention of the Ombudsman. Average processing times are easy to manipulate. 

 

I hope you get an answer soon, either way. Being separated from the one you love for so long is a truly awful experience.

Yeah, rehearsing kinda just means that you're both remembering the dates correctly and stuff like that. No story to come up with if you're legit.

 

And it's probably a good idea to rehearse a little bit. I mean, I was trying out some of the interview questions on my husband (We've been together about 10 years.) and he didn't know what my favorite color is. LOL. He's like "Well, it's never been important to know it, in all the years we've been together!"  Okay, but I know his favorite color. So yeah, probably a pretty good idea.

Nope. The VMP is not going to help that. You could apply for a K3 visa. It may or may not be available or worthwhile depending on whom you talk to here.  My husband is also from a VWC, and there's a good chance that he'll be turned away at the border if he tries to come for a visit because of his pending I130.

Good luck Faatima. I hope that do what's best for you. If you want to leave your husband, then you probably have a very good reason for it. That's a decision that only you can come to. But honestly, if you're having these doubts and problems right now, moving to the US where you'll be isolated from your family, friends, culture and entire support network might be a really, really bad idea.  Only you can tell whether or not you feel comfortable with the situation, and luckily, you have several months to figure it out.  

 

I really, honestly, wish you all the best, and hope that whatever you decide, it's the best thing for you.

Hi! I'm just getting my ducks in a row for the next part of this process, and I was wondering the following:

 

My husband and I own a house in the Netherlands. By Dutch law, I'm entitled to half of everything we own, but I'm pretty sure I'm not on the deed. Can it still be listed as my asset or does it have to be my husbands? I ask because they're assessed at different rates. If I can list it as mine, then I don't need co-sponsors. If I can't, then I will need them.

I lived with my husband in the Netherlands for 8 years before we applied, so I don't think it's a trick question.  I guess you just want to compile as much evidence as you can and submit it, and don't worry about the stuff you can't compile. 

 

Also is it true they really ask "When did you know you were attracted to the same sex?" in the interview? I really hope not...also here they ask "Have you ever dating the opposite sex?". And in general, does anyone know what type of questions they ask at the interview?
 I've heard that they ask all kinds of crazy and invasive stuff to heterosexual couples as well.   If they asked my husband and I those questions, they'd get a few interesting answers as we're both bisexual. :P

We just fill up ds-260. Online but and we update and change my address to manila and US but I don't know how it goes... I'm not resident now in kuwait I only file my application there because I was living there before and now I can't go to kuwait cause I don't have kuwait visa..... yes I understand my friend file an adjustment visa but on my case I need to change my case number cause I'm not resident now in kuwait. I'm resident of manila now but I'm in US for vacation till april so if its not possible in US I rather wait interview in manila and contact nvc to change country consulate jurisdiction..... I dont know i dont have interview schedule yet but i think it will be on december or january ... we working my visa since august 2012 .... thank you

You need to call the NVC and tell them your situation and get them to change your country of residence. You're not going to be able to do your interview in the US to my knowledge. But you can always ask them when you call them.

What you mean no??? I cannot change the country interview or I cannot held my interview. In US? I know someone who interview in US but in her case she file spausal in US ... in my case I wish to change country interview location from kuwait. To manila or in US since I'm here already for vacation...

Your interview is with the consulate or embassy in Kuwait. Which is where I'm assuming you were residing when you applied. Did you change your address before you got to the NVC portion? Are you originally from Kuwait? I believe that your file is probably already in Kuwait if they've scheduled your interview. And your police records, etc. will be from that country. If your friend got an interview while in the US, she was going through a different process than you. She was having to adjust her status. You won't be doing that if you're going for a IR or CR visa. My understanding of the subject (which may be woefully incomplete) is that they expect you to wait outside of the country until you get your visa to immigrate. The fact that you're currently in the country on a tourist visa doesn't effect that at all. And they expect that you will attend the interview in the country you stated you were residing in.
