For K1, they dont require it except that you have to meet in person prior to the petition. Although it may have some value if both of you have a picture with your family. As with my interview, i only provided pictures (15+) of the two of us. However the CO asked if he met my family but didnt ask for any pictures to prove it. Id say that would depend on the CO interviewing you or how you answer the CO's questions and the supplementary documents you'll be bringing to prove that you have a relationship.

Nope, as per USEM DV and NSO takes 4-6 weeks. After that, you have to allow 2 weeks for the CO to review your case. My DV took 5 weeks and 1 week with CO before it was approved then they released it.

Its true, you dont need a lawyer to go thru the whole process. If you do it yourselves, you get to see, check and double check the docs firsthand.

Now you just have to find a way on how to get her requirements without her going home. She needs to acquire an Authenticated Birth Certificate and CENOMAR (Certificate of no Marraige) from NSO, NBI clearance (1 year validity from date filed) and Police Clearance (6 months validity from date filed).

Hmmm embassies ask for different requirements... is she gonna follow the list of requirements from US embassy in Manila?

I think it's the best that you personally cancel it and not wait for your ex (?) to do it. That way on your next interview when they ask you about your first visa petition you can say you broke up with that boyfriend and cancelled your visa because of the break up. For calls, we use Rebtel.

We both registered for the service and it works like this:
Person A calls person B on a Rebtel number. It's a local number.
Person B picks up, says Hi and hangs up.
Person A does not hang up.
Person B calls person A back on a Rebtel number. It's a local number.
Person A & person B both pay for the cost of a local call now. The international call is free.

His local calls are free, so the whole call is free for him.
My local calls are free if I call from a house phone. If I call from my cell phone, I pay as if I were making a local call in my country.

We BOTH get logs of these calls.


You can associate up to 5 phones to your account - like house phone, cell phone and work phone and when using any of those numbers, it works the same. One phone is the default one, so when you are called, that's the one that rings. For me it's my cell phone. If I am home, once I pick up my cell and hang up, I get my house phone and call from there. It works like magic.


This has, by far, been the best and cheapest way we found. Link is in my sig if you wanna try it out. I appreciate using my referral, but you don't have to.

I guess I just got lucky, because I did not bring any evidence of returning to my home country to POE. :D

I have been to the US 3 times on three B-2 (tourist) visas prior to getting married. Then I married the USC in my country and flew to the US not even a month after the wedding on my third B-2 visa which is valid for 10 years. We have not started the process for IR1/CR1 yet as it clashes with our current plans. I was frank with the ICE officers at POE and said I was visiting my husband, no, we did not file for my visa because I want to get a master degree in my country (for free), yes, we will do it at some point in the future, yes I will have a nice time, thank you.


With your boyfriend being from France, the whole experience should be easy for you guys. Just make sure both of you understand this process well and use VJ guides and wiki! Good luck!

The cost of this process was explained to you, so I will not go there. People are right, make sure you are both serious about it and discussing finances and how the two of you would support yourself is a part of that.

What I want to do is just add an idea. For the first time one of you flies to the other one, consider splitting the cost of the ticket. With both of you working and saving for one ticket, it will be achieved much easier and faster. If your parents allow the other person to stay at their place, the whole trip does not have to cost much more than the price of the ticket. I have been finding good tickets at skyscanner.com, but make sure you look around before you buy your ticket.

Since you will need to prove he has been visiting you to help you establish bonafide relationship, I would apply with the Spanish passport, but request the interview in Argentina as that is where he is living. He has legal residence there (being a citizen), so that should not be a problem.

The documents that you will need from him are: birth certificate, divorce decree (if he has been married), police certificate for every place where he has lived since he turned 16. Unless any of those occurred in Spain (birth, divorce or unless he lived there for over 6 months), I don't think you need anything from Spain specifically.

The hotel manager did not give legal advice, just simply that shopping in El Paso was more advised to shopping in Juarez due to my ethnic race. The advice to go to the bridge was given to me by the US embassy, but I know now that they probably meant that a "permit" is predicated upon already having a valid entry visa, and a "shopping permit" simply does not exist.


I think this is the most important part of your story. As you can see, even the members here misunderstood you, so that point should be made clear.

I do not know when a waiver should be filed, but if I may, I would advise you to shorten the story (it is too long, the breakfast, movie and waiting, etc. is not relevant). You can simply say you did not feel too safe in the city (which is reasonable) and were wondering if you could take her shopping to El Paso. To seek advice, you went to the US Embassy where you were told to ask at the border.

How you felt, what you went through and how much gas you spent driving back and forth is not important unless you're suing them for this. I doubt you could, as they have a lot of freedom in deciding what to do with people trying to enter the US, but maybe it is?

Anyways, stick to the point, explain the misunderstanding in the waiver and make sure you stress out where the bad advice came from.

I am sending a couple of photos specifically because they show us in front of the Colosseum in Rome and the Eiffel Tower in Paris. However, we can prove how we got there (stamps, bills from the traveling agency, boarding passes). I don't know if you can request this, but maybe ask at the border next weekend you meet to STAMP your passport? I would do that. Tell them you need it for your visa, they should understand. To the OP - I would go for the marriage visa, there are more advantages than the K1.

 

Your friend would only have to fill in a set of papers, your fiance would be able to work very soon after entering the US (otherwise, new paperwork for AOS, and a long wait - we have people on here that have applied in August 2012 for a green card through K1/marriage and havent been approved yet), and it is cheaper financially.

This is what I was thinking. With a child in the picture and one spouse in school, it seems very important that the immigrant be able to work asap to help out. This was one of the reasons we chose to do IR-1/CR-1 over K-1.

He meets the substantial presence test as he has been the US 15 months out of the last 24.  However, he is still a citizen of France and not a LPR of the US; so he does not have to pay US taxes.


I may be reading this the wrong way, the fact that he is "visiting" for so long makes him a resident alien as far as IRS is concerned  even if he is on a B-2 and not a GC. Here is what the IRS says about this, same publication

 

Resident Aliens

You are a resident alien of the United States for tax purposes if you meet either the green card test or the substantial presence test for calendar year 2012 (January 1?December 31). Even if you do not meet either of these tests, you may be able to choose to be treated as a U.S. resident for part of the year. See First-Year Choice under Dual-Status Aliens, later.

 



 

I am a citizen of Croatia and not LPR of the US, but I declared myself a resident alien for tax purposes for 2012 even though I did not meet the green card test or substantial presence test because my husband and I wanted to file "Married Filing Jointly". I noticed this bit when I was doing my own research.

 

 

Honestly, I do not know enough about this, but someone who plans to move and live in the U.S. might wanna check this out. I am sure they don't want any trouble, but saying he doesn't have to pay US taxed because he does not have a green card and regardless of the time he spent in the U.S. is obviously wrong. He might be exempt on another basis (not making enough money, paying in France, etc.)

However, I thought of something else. Make sure your fiancee does not pass the substantial presence test, if he does he is considered a resident alien for tax purposes and could be required to pay U.S. tax:
 
 

Substantial Presence Test


You will be considered a U.S. resident for tax purposes if you meet the substantial presence test for calendar year 2012 To meet this test, you must be physically present in the United States on at least:


  • 31 days during 2012, and
  • 183 days during the 3-year period that includes 2012, 2011, and 2010, counting:
    • All the days you were present in 2012, and
    • 1/3 of the days you were present in 2011, and
    • 1/6 of the days you were present in 2010.
Example.
You were physically present in the United States on 120 days in each of the years 2010, 2011, and 2012. To determine if you meet the substantial presence test for 2012, count the full 120 days of presence in 2012, 40 days in 2011 (1/3 of 120), and 20 days in 2010 (1/6 of 120). Because the total for the 3-year period is 180 days, you are not considered a resident under the substantial presence test for 2012.

The term United States includes the following areas.
  • All 50 states and the District of Columbia.
  • The territorial waters of the United States.
  • The seabed and subsoil of those submarine areas that are adjacent to U.S. territorial waters and over which the United States has exclusive rights under international law to explore and exploit natural resources.

Hey, do you have any pics? For example, if you went to an amusement park together, you may have two tickets with no names and then one picture of the two of you in front of a big ride. Try to match these things somehow to prove you actually used those tickets.

 

If he stays at your house, did he ever receive mail there? An order from Ebay/Amazon? Does he by any chance have a US bank account (I do in Bank of America, opened it with two IDs when I was there on my tourist visa)? He could have a US debit card that uses your house as the address so when he gets a letter from the bank with his card, that letter can be used as proof too. 

 

Were all of your bills paid with cash? If he came over from the UK and used a card (credit/debit) to pay for a lunch in your town, he can add the bank statement showing the card was used in the US at the certain time. Same for the grocery store bill or maybe gas?

 

Also, passport stamps. Make photocopies of passport stamps from every time he came over and match them with his itinerary, or, even better if you have them, boarding passes.  

 

As for the letters, we did not and would not send the actual letters. If we have to, we would scan the envelopes - they prove we sent each other letters. The content of those letters is nobody's business in my opinion and really does not matter. They wanna see communication, not dirty talk (or friendly talk or hate speech or whatever). Same for emails, I would not print out the actual emails, just do a search with his email address and show random pages of emails there with different dates. If needed, I would black out the email preview Gmail shows.

 

Do you talk on the phone? Show your phone bills calling his number (or the other way around). We use Rebtel (if you wanna sign up you should be able to get some extra credit with my referral: Ivy ;-) ) and I printed out the the summary of my calls for three months (one in 2011, one in 2012 and one in 2013) where one can see we call each other a lot. If you use Skype to talk, do you have any screenshots? You could add those too with dates.

 

 

We did not send a lot of relationship related things. We have all of the items I mentioned, but we sent just some pics, joint bank account and the phone logs. My husband was feeling optimistic about it being enough. biggrin.png Unfortunately I can not tell you how that went yet. biggrin.png You might wanna pick your evidence carefully, a few pieces from different categories, and that should be okay.

This is true. I entered the US after the wedding to visit my husband. We have not (even yet) submitted our application. The woman asked a lot of questions once she learned my husband was not only in the U.S., but was also American. I had to explain why we have not submitted our application, why I chose to do my master degree in my country, when we intend to apply, etc.

 

She buttoned it up with asking me nonchalantly, as if she could not remember "What was the name of that visa you will need?". Once I answered and could explain why I will be getting IR-1 and not CR-1, she let me in.

 

 

 

As for calling your fiancee "husband", we referred to each other as hubby and wifey well before getting engaged online a lot. We met playing a game and we married each other in that game (several times, with different characters and different servers). People on the game actually thought us to be married in real life, so I can see how that confusion could happen at the interview/POE. Be careful.

 

I doubt this will cause issues for us, as we are now actually really married and the Embassy can track my relationship with Aaron via my visa applications. My tourist visa was to visit my fiancee, the one before that said boyfriend, same person. However, this is should be something F-1 applicants should be careful with.

Hello fiance2013,

 

There is no requirement on your length of stay or the length of your relationship when applying for a K-1 visa. The only requirement of that sorts is that you guys met in the past two years (prior to filing the visa).

 

You should document your trip to the Philippines very well. Keep the boarding passes. Take pictures with her and her family. Keep bills from restaurants, tickets for museums and stuff like that. If possible, spend a couple of nights at a hotel and get a receipt that shows both of your names on it (I do not know if this is culturally acceptable, my father did not let us spend the night in the same room under his roof while we were dating biggrin.png).

 

I hope your trip turns out the way you want it.

 

P.S. Notice that you will need the following items for your applications and try to get them while you are there with her:

 

 

9. G-325A filled out by the foreign fiance(e) signed and dated (see example).

10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

The divorce decree thing might be it. They replied to our RFE within 6 days of receiving it. I am CR-1/IR-1, but here's how it went for us:

 

March 4th, 2014 - RFE: Email/SMS received

March 14th, 2014 - RFE: NSC received our reply
March 20th, 2014 - NOA 2! APPROVAL NOTICE VIA SMS/EMAIL!

We got our approval June 1st and we didnt bother to call NVC since we dont wanna stress ourself out with this waiting part again, instead we waited for the NVC Letter in the Mail which arrived yesterday (June 23rd) with our Case Number and telling us they are forwarding the petition to the assigned visa issuing post within a week. And reading from other posts, it does varies, can be a week... 2 weeks.. and we got ours almost 3 weeks...We actually dont know when our petition arrived to the NVC and depart since we didnt give them a call.. Now, we are gonna wait until we hear something from the Embassy (Packet 4) or check the Schedule Website once in a while for visa appointment. I think we're too stressed out waiting for NOA2 and we wanna calm down hehehe.

in 2007, i didnt really print all of our conversation as it is too much, all i did is select a few.. and then print screen the Logs or Message archives that shows we talk/chat everyday... i also print screen the logs on our call history at skype... and also if you do video call or something like that, i print screen some of that too... The CO didnt really care, all she look at is our picture together as i made it like a scrapbook and she had fun looking at each of them.. :)

I think it will cost more if the child will be left behind and follow within a year, as pushbrk said, u will have to make another trip within a year to get him from the PI, a roundtrip ticket for you, a one way ticket for the child, the expenses/fee to bring him to medical/interview and expenses while in the PI... plus his AOS by himself will be more expensive ($985 than $635 if filing with a parent) and i am not sure about removal of condition if you can include him with your removal or he has to do it by himself again since his conditional green card will be off by 1 year... maybe somebody here knows..

Even faxed copies will be accepted. Just make sure that you send the original I-134 Affidavit of Support with the notary public stamp & signature as well as your signature. So basically, if you're already sending the original I-134, just xerox your W-2, IRS forms, pay stubs, bank statements, life insurance papers, mortgage papers, 1099, etc. However, I would send the original employment letter and the original statement of account from your bank. (Keep copies of those for yourself).

Remember however, even though lots of people include it in their K-1 package (including us), that proof of relationship isn't required until your interview at the consulate. For the package you send to USCIS, the proof you need to supply for a k-1 is "proof of having met in the last two years". For this, we provided copies of my boarding passes and passport, 6 photos showing us together with the dates and locations written on the back, copies of credit card bills showing hotel accomodation & dinner/date purchases and some other stuff too but I can't recall.


I agree. The USCIS is mainly wanting proof that you have met over the last two years, which is the information like Passport Stamps and Photos. The proof of ongoing relationship information is really needed for the embassy interview.

I agree with jrmjia. Sometimes you have to give it time. I know early on in my relationship there were some cultural things that I did not understand, but I gave it some time and it worked out.

I was just wondering how long everyone knew there fiance before filing for the K1 visa? I was going to post this as a response to another post, but I just thought it was an interesting question.

I just find it interesting the different lengths of time it took for people to file. I a sure for various reasons. I am thinking that it did not take long for people to wait in countries that were far away from one another and took a great expense to travel to, like the U.S. and China. On the other hand I would think that people from places where traveling to see them might not be as difficult, like the U.S. and Canada, might take longer. I hope that made sense. Probably not.

I think this info is in some peoples time lines but not in every ones.

My fiance and I met online and knew each other 8 months before I filed for the K1.

I would personally take care of my fiance first. You two have waited so long to be together and made your plans. I don't think it would be a good idea to not keep moving on with them even without your father. Is there any harm in having a private little ceremony there among family and close friends there and with your father present where you do not legally get married and then do it for real later on. Just a suggestion.

We are still waiting on the NOA2, but I wanted to start getting the proof of continuing relationship evidence ready for the embassy interview and I had some questions.
First our chat logs. We use skype to chat back and forth, but I have not found a good way to print out the skype logs. IS it OK to just copy and paste them to a word document and then print them that way. This loses a lot of the color and the emoticons (like little hearts) that we send though.
Second is our emails. Besides talking on the phone, emails are the number one way we communicate and I have kept every single one. There are well over 1000 of them. The main thing I worry about the emails is that some of them contain content that I do not want someone else to read. Is it okay to copy this to a word document as well and cut out the parts I don’t think would be a good idea for someone to see. Or if it is better to print the email directly from the email window (I use hotmail) can I just click reply or forward and then edit the parts I do not want to include.
Also should I keep the emails that I send to her separate from the emails that she sends to me or should I just throw them all together.
