From the link above "The ability to submit fingerprints electronically to the RCMP is not currently available outside Canada".

However http://www.pacificfi...rintservice.ca/ seem to suggest they can do international via cardscan which is what I did albeit within Canada. Electronic prints are your only method of getting faster results so I would contact these guys or another accredited service to inquire. Electronic prints get results within 1 week.

I suspect you don't qualify as you're not a resident. I would do as you suggest and send it back with a letter advising of your US residency.

I hope you don't mean you need a concrete case to ask for one?

No, more along the lines of if you don't the super will just side with their agent anyway. But you provide some interesting insight. I was always under the impression that once you were refused entry, it was actually illegal to even try again or is that only if they tell you a waiver is required?

Setting up a business---and visiting are two very different items.

FULLY agree! Strictly provided as evidence that supervisors can effect change.

Does asking for a supervisor really work?

I spoke with a Canadian citizen setting up a flower shop in Washington and she was harassed by customs virtually every time she crossed during the process. She was inside the one time and broke into tears. Someone came along and asked what was wrong. After explaining the situation, he handed her his card and said if you ever have issues again, let me know. It was a Supervisor and she was carefree after that.

So yes it "can" work but you would need to provide a concrete case in your favor.

As Flames pointed out, it's a good idea to carry with you whatever evidence you can to prove your intent to return just to be safe. Employment letter, cell phone contract, etc. But given your initial post I suspect you're crossing at PR which leads me to believe you'll have no issues. There is another member crossing there close to completion of the process.

My wife and I also live in border towns. We dated for about 1-1/2 years prior to being wed this past May. We also crossed back and forth every weekend during that time. After having been wed I phoned the closest US border office and inquired on my status in their eyes. Due to the fact he didn't believe I had strong enough ties to Canada he advised that he would refuse me entry. Having received that info I never went down for about 4 weeks but rather my wife came up every weekend.

Finally I decided to try the next closest crossing and being completely honest with them I had no issue and have never had an issue since. I have also never had to provide any documentation at all however I do carry a copy of my DS-260 confirmation. In my mind, my history of travelling back and forth every second weekend for over the last 2 years should be enough to have any border guard with common sense realize I am coming home. Unfortunately it seems some seem to lack that attribute and you never know who you will get.

Ultimately, yes, tell the truth! Do not lie as that can potentially come back and bite you. Will it make it harder? You may initially encounter a slight increase in scrutiny but if you have history of crossing regularly I suspect common sense will rule and you should not encounter issues. The career also helps.

I currently use ING to swap CAD to USA with rates better than your traditional bank although I don't yet know if I can maintain that upon moving state side. Seems like all the big banks with CAD and USA entities are on the east coast. Anything over here on the west coast?

Thanks for the info! Million dollar question....I don't have an actual passport. Because he's only 7 hours away, I drive so I just have a passport card that is like my driver's license but it allows me to go to Canada and back. Is that going to work or do I need to get a passport book thing to be able to go to the embassy?

Good question! My wife may only have her enhanced DL as well so I would be interested to see what you discover. I suspect it should be sufficient.

CanadaURGENT!! DHL opened DO NOT OPEN envelope with VISA information

I called POE and they do not have any internal numbers for the embassy. They looked for like 15 minutes and tried to think of ideas.

I assume then the POE advised they would not accept it as is?

Here's a response from the MEXICAN consulate with an identical situation. Maybe you can do the same and have DHL send it on their penny!

"Our records indicate that xxxxxx was issued a visa on xxxx. If the visa packet has been opened before it was presented at the port of entry, xxxxxxxx needs to return her documents to our office in order to provide him a new visa packet. Your client may bring the opened packet to our information window . Otherwise, she may submit the packet to our office via courier as per the instructions below.

Please note that the process to submit documents to the consulate has recently changed. Applicants must visit http://mexico.usvisa-info.com to register. They will need to log onto this website using their Passport Number, Date of Birth and Nationality. When prompted to select a Trip Purpose, they should choose 'IV Administrative Processing' and then indicate that they needs to submit additional information by courier. This will allow applicants to register with DHL and choose the DHL site at which they wish to send and receive all future correspondence. After that, they should follow the instructions to submit the requested documents via DHL.

Once the documents have been received in the consular section, the case will be reviewed and the applicant will be notified of the officer?s decision via courier at no extra charge."

You may also try call the DOS to see if they can't help in some way.

BTW when I activated my visa a couple days ago, the border agent informed me I DO NOT have to activate the visa my first time across. I can use my passport as it is for regular crossings but I just need to activate the visa before the expiry date. I believe this is contrary to what I have read on VJ. So the good thing is at least your hubby has his passport back. Not sure if this helps you or not.

I am ready to file my DS-260 albeit I am still waiting for police/court records which I expect to have within about 2-3 weeks. Would it be prudent to wait until all documents are available and submit everything together or submit the application now with documents to follow? I don't want to cause any delays.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat does "Receive Instruction Package" mean?

 .Amen Too me the Case# assigned, when you sent in the IV Bill and AOS package is becoming something that needs to really be tracked.

The Receiving Instruction is the IR1/CR1 Packet 3 (when you get your interview letter with your checklist and stuff).

Yup, tracking through the NVC could use some improvement. No response from the admins as of yet.

Receive Instruction = Packet 3? Really? Cus there is a Packet 3 Received field AFTER Case Completed at NVC.
CanLeeMaleCanada2012-10-17 14:24:00
IR-1 / CR-1 Spouse Visa Process & ProceduresWhat does "Receive Instruction Package" mean?
I "believe" Receive Instruction Package refers to the communication from the NVC advising you what supporting documents you need to send. The same one I received 2 weeks after submitting my documents.

There is no "Send IV Package" so you are interpreting correctly. I just yesterday sent a request to admins to modify the NVC aspect of the timeline.

My guess is the main thing they want is the type written case number from the government to ensure a concrete connection between exam results and applicant. The interview date should not matter. Like reese1 said, you can simply check with the doctor if any government document with your case number and name is satisfactory.

No, AOS is not free, the bill for AOS is $88 which must be paid to the NVC before the applicable forms and documents can be submitted.

You are not charged the $88 if the I-130 is filed abroad, only when filed domestically. http://travel.state.....html#forms_fee

IR-1 / CR-1 Spouse Visa Process & Procedureshow long DS-3032 ????????
12 days to receive an email acknowledging submission of my DS-261(electronic DS-3032). 3 more days to receive the IV invoice. With regards to the I-864, even though we received confirmation of receipt upon submitting Sept. 8(not just the automated response) just today we were advised they did not receive it. So my faith in their communication is somewhat diminished as I've read other occurrences of the same for others.

IR-1 / CR-1 Spouse Visa Process & ProceduresTime Between First and Second Payments

Hello,

I'm wondering what a rough time frame between paying the first $420 and then the next amounts are?
My company backed out of paying anything but the $420 so I have to time this all with my tax return.
If I file on 11/1, is it safe to assume I won't have to shell out any more cash until around march?

Thanks.

Even if they're ready prior to March, it won't hurt to not pay until you receive your tax return.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp with I-864

. . . and Item 21c states to enter "1" if the sponsor is married.

It is not worded the best but is only populated when married and sponsoring kids or relatives, not the spouse. Leave 21 as 0 in your case.

Finally Item 21h states to add up the lines together and this will give the household size. Since I entered "1" on Item 21a, "1" on Item 21b, and "1" on Item 21c, my household size is "3."

This doesn't make any sense, though, since my wife and I are the only ones in the household. I'm trying to figure out if Item 10 should be left at "0" and why?

Line 10 should be one. You have it correct. Line 21c = 0, Line 21h = 2.

Secondly,

Under Item 25 it states:

"I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year."

I know my spouse didn't make anything in 2010 and was not required to file a tax return that year. Therefore we didn't file one for that year. Am I still able to check off this box without committing fraud or material misrepresentation?

I have transcripts from 2009, 2010, and 2011. It's just that 2010 states she didn't file. This is because it wasn't necessary.

Thank you.

If I were in your position I would not check the box but add an attachment identifying it as a Line 25 addendum, indicating your situation such as "Filed in 2011 and 2009. No income in 2010 and did not file. 2011 transcript attached, 2009 transcript available."

From http://www.uscis.gov...00045f3d6a1RCRD

Filing Fee :
$505. (Add $85 biometric fee for a total of $590, where applicable. See the form instructions for payment details.)
Special Instructions :
Note on Filing Fee: Please include the base petition fee plus $85 biometric services fee for all conditional resident applicants. Each conditional resident child listed under Part 5 of this form who is a dependent seeking to remove their conditional status, is required to submit an additional biometric services fee of $85, regardless of age.

Yes there is a fee to file the I-751 Petition for removal of conditions but it is not required until 90 days prior to your 2 year anniversary or green card expiry date. I believe your kids will also get the CR1 however you only pay one group application fee of $505 as well as a $85 biometric fees for each applicant.

So in the case of 1 parent and 2 kids the cost would be $505 + (3*85) = $760.

I would call a local POE and check with them. They can surely answer the question. http://www.cbp.gov/x...contacts/ports/

You should also check the DMV site of the state you intend to live in as to their requirements. I just checked Washington and new residents have 30 days to title and register your vehicle. So technically, after that you would be driving illegal.

Thank you all for your help.

I'm guessing he will have to bring his car across? He has the intention of selling the car in Canada and thought he could perhaps not import it but still drive it back and forth for awhile. Doesn't sound like that's realistic?

My "guess" is he can still take his car across but would not be able to insure it in the U.S. once Canadian insurance expired.
