First of all if your daughter has a green card, you can go to the Ukrainian consulate in chicago and get a stamp in her passport that she is a permanent resident of US and put her on (oblic). The consulate is able to ussue her a new Ukrainian passport. Do not take no for an answer, it is their job to renew passports of Ukrainian citizens who permanantly reside abroad as lond as they do it legally.

I understand that her father needed to give his approval for her to leave originally, but things have now changed. She is a permanent resident and should be afforded the rights of Americans.

As for this comment you should know that when you are in another country you are subject to the laws of that country. In Ukraine the rights of Americans don't matter (especially if they are not Americans yet and are Ukrainian citizens).

Ukrainian citizen may transfer as much money as they want. As far as the way to do it I would agree with Brad, make an ATM card account and you can withdraw money out of it anywhere in the world. It will only cost you 1% to do it.

I believe you mean I-94 form, it is a paper you will be given in the airplane on the way to the US. You have to fill it out and present at the POE, then you have to keep it for the AOS if you have to go through one.

Usually for a visitor's visa you have to show ties to the country you are living in: Work, Family, Property owned, however I have never heard of them giving a visitor's visa if an immigration petition has been filed for, however in your case I hope it will be different. Just bring anything that shows she would have to come back and could not stay in the US.

Probably because it is free to file I-129F, and then we choose whichever route we want to go. I chose the route of the first petition that would make it to the embassy.

I can't say for sure (not a canadian) however I think since these are separate petitions you can choose different consulates for each one.

He should put down either the amount of people that live with him (people he supports) or dependents that he lists on his taxes. So if he lists his children on his tax returns, and they don't live with him he still needs to include them as dependents on affidavit of support. At least that is how I understand it.

I want to do everything LEGALLY and not break any laws just to make sure not too have any issues later on with process.

As long as she did not enter US with an intent to get married, you can always get married file I-130 and when it is approved file for AOS, then she does not need to return back at all. However you will be subjected to a lot of scrutiny by USCIS.

From what I have read on these forums it is possible and people have done it, however you would have to pursuade the POE officer that you have ties in your home country to go back to, as he has to be sure you will leave US.

I-131 is mostly for K-1 visa which is a one time visa. K-3 visa is a multiple entry visa so you can safely travel to France and come back.

When you call the call center they will tell you that they have no slots opened and you should call back. This is NOT TRUE. I have been to the embassy and was told that they can't say that. The best practice would be to change the passport ASAP. It's much easier to do in Albania than after US arrival.

When you change your name, you change it on your vital documents. Otherwise, you really haven't changed your name, have you?


It would be easier if she changed it, however it is not required. You do have to carry proof of name change though and her US visa will be issued in the same name as it is in her passport.

They only are interested in petitioners income, that he/she can support the beneficiary in the US. Petitioner should send at least 2007 tax returns and w-2s however it has been sugested that 3 years be sent, depends on the embassy. Also a letter from the employer is helpfull and a few latest pay stubs.

My question is, Does she eveen NEED this new birth certificate (whats wrong with old?) and shouldn't she be able to get the police check going NOW, even if she doesn't have a NEW birth certificate

She is afraid she will never get this and i am wondering if she even needs it? What does one do if born in USSR and some Boris who doesn't like Ukraine requests NEVER sends you this certificate for ANY reason. I am thinking we could use old and attach letter from Belomorsk saying they sent it and then explain that it never came???

A couple of things: 1. Her original birth certificate should be fine ( it is a 2page green book which was issued by USSR). 2. The police certificate in Ukraine is only good for 6 months, it states so on the certificate. So make sure you get it at the time so it does not expire at the time of the interview.

It took them 48 hours to print it and we picked it up at the FedEx at the consulate. I guess it would have been delivered the next business day which would be tuesday, because Monday is a holiday.

A W-2 is what your employer gives you at the end of the year. I think what you give your employer is a W-3. It is accompanied by a very clear worksheet that walks you through what to claim but it sounds like, if it is just you and your husband, you would put "married" and "2"


Actually it is a W-4 you have to fill out. What you put down depends if you will have any deductions at the end of the year that will cause you to have a big refund. For example if you will claim a lot of interest on your house, you could add 1 more to the total number, or if you will drive a lot of miles for your job (not to and from work) then you could add 1. If you will not have many deductions then just put down 2.

That's correct. K1 isn't a "status". It's a "visa". You get it back in your passport and have six months to use it. Once you use it, you have 90 days to marry. From the time you enter the USA using the visa until you have advance parole, you stay in the US or start all over again.


However I am wondering if you are Canadian and just drive back you might just use your citizenship card to enter Canada and USA and they just might let you in and out, I would call US embassy and see if you might travel to and from Canada while adjusting status without advanced parole.

He will not need a visa to go to Canada, just his passport and the green card. As far as Peru if he is a citizen of Peru then no visa required, just bring the green card to enter back into USA

Thanks!! Is the cutoff date the same date as the GC expiration, or is that determined when you get the RFE?


It will say on your RFE paperwork by what date to send it in.

Actually I kept my expired card with me and when I came back from Germany I took out my new Green Card and the old one fell out of my wallet.( I totally forgot it was in there) The officer took it away from me saying "you should not have that".

Police certificate is needed from all countries you lived in after age of 16. I believe that the way to get it from another country is to go to that country's embassy at least that is where I would start.
