Please wish us luck....I'm a nervous wreck right now. Leaving bright and early tomorrow morning to go down to London for his interview. Taking all four kids with us.... :blink:

Here's what we're taking for the interview:

6 passports, the ds-230, his birth certificate, his children's birth certificates, our marriage certificate, both of our divorce certificates, his military records, his police certificate, his photographs, my I-864 for him, my parents I-864 for him, and emails printed out showing our intentions to move (moving company quotes, new school registration, etc.) I've made copies of the birth certificates, marriage and divorce certificates, and his police certificate.

Anything else I should add? Thanks for any advice!!


Hi Darcy, I haven't followed your posts so maybe you've covered all this before. You say "his children's birth certificates" Are they your kids too? If not, does he have to have something showing he has permission to take them out of the country? Also, do you have supporting docs to show domicile?

I can think of a few maybe.
Get copies of all your prescriptions (meds & eyes if you wear contacts or glasses) Get refills before you leave for as long as they will allow you until you can find a new doc in the US.
Transfer utilities out of your name and give forwarding address for final bills
Get your hair cut, etc. so you won't have that to worry about for a bit
Same for nails--manicure/pedicure
Stock up on the treats you love and you won't find easily in the US (marmite/cadbury,etc)
Having your UK bank account is good but ask them if you decide to close it, how can you do that from overseas? (We asked our bank here in NZ and they gave us a form to use if we decide to close later)

United KingdomLondon Embassy REFUSED to notarize copy passport for ITIN

Hello all,

My hubby just made the trip from Manchester to London to get a notarized copy of his passport so that I can obtain ITIN for my income taxes. THe man there refused to do it, was very short with him and stated that it was NOT needed for my taxes. He told my hubby that I am supposed to send him the form for the ITIN, he then fills it out, and then sends it on to the embassy by mail, the ebassy notarizes the form and sends it back to him (hubby)... THEN he is supposed to send it back to me. Is this right? The same man told my hubby, "I don't see why your wife has to put you on her taxes." We married in Nov., he was here for 5 weeks, returned to the UK, we are waiting to start the k3 process in a few months.

I need some help. I have been to the IRS web site, and thot I had it all sorted out. Anyone run into this at the embassy in London?

Hi Gotz. I'm the USC and I filed my taxes from NZ with the W7 for my husband. What we did was get a copy of his passport ID page notarized by a NZ notary which is acceptable according to the Instructions for the W7. Then I sent that and a photocopy of his birth certificate with my tax form & the W7. He got his ITIN back very quickly. I don't see why that wouldn't work for you as well.

Also reading the W7 instructions for what documents can be submitted for proving your husband's ID, you can see that if you submit a notarized copy of his passport you don't need anything else, but if you don't have that, IRS will accept copies of two other forms of ID, which can be: National Identification Card, Foreign Driver's License, Foreign Voter's Registration Card or Foreign Military Identification Card. Also, please note that Foreign Notaries are acceptable as outlined under the Hague Convention (this includes the UK) So your husband could get a UK notary to notarize a copy of his passport (get a couple while he's at it) send it to you and you send in to IRS your tax form, the W7 that he signs and his UK notarized passport copy.

Now to the issue, I am a LPR and I will be going back to the US in the end of July. My sister is a Pakistani national (just like me) and I want her to come and visit me. Could anyone guide me as to what the I need to do? I have downloaded the form DS-156. And will take the pictures in a few days, she needs the side pose correct?.

Could anyone tell me what other docs are needed. How much it will cost and what is the processing time. And how do I contact the embassy regarding this issue. Thank you.

I don't want to start a new thread for the same subject so I hope you don't mind if I add on a Q here.

I have found two references on VJ that said you had to mail a copy of your marriage certificate WITH the W7, the passport copy.

Is this true? I cannot find anywhere in the instructions on IRS.gov saying you have to send in your marriage certificate.

I wouldn't normally care, but my husband has the certificate in canada and I want to mail this puppy off pronto without waiting for Canada Post to get the marriage cert.

No, You do not have to mail your marriage certificate (or a copy of it) to IRS with the W-7 and your 1040 or whatever form you file. I mailed my 1040, the W-7 for my husband, a NZ notarized copy of his passport (ID page) and for good measure a copy of his birth certificate although according to the W-7 instructions if you send a notarized copy of the passport, that is all you need. Otherwise you need two pieces of ID like a foreign voter card and a foreign driver's license. Got his ITIN in apprx. 4 weeks. HTH :)

I spoke to another person from the IRS today who said that an ITIN is not needed if your status is "married, filing separately" AND you're not claiming your spouse as an exemption. If I don't claim him as an exemption (or for any tax purposes) he wouldn't even be eligible to apply for an ITIN. The IRS woman said all I have to do is attach a letter stating that my husband is a nonresidental alien and that I am not cliaming him as an exemption.


:huh: Interesting isn't it, how many different answers you can get. I filed my 2005 taxes as "married filing seperately" (I did NOT claim my husband) and I sent his W-7 with my 1040. Obviously IRS thought he was eligible for an ITIN as he got one in about 4 weeks. :yes:

I thought that was the case. Someone else posted the same thing on this forum and that's what I would rather do. But I called the IRS at that number and the lady I spoke to said I had to fill out form W-7 regardless of whether I file jointly or separately. She says that on the actual tax form, I would need to provide an ITN number in place of the SSN for the spouse. It's conflicting information. I don't know what to believe. Have you sent in your taxes yet? Did it go through ok?

Also, please read the instructions for submitting the W-7 form to IRS. You do not have to send in passports. They accept notarized copies and alternative means of identification as well, e.g. Foreign Drivers Licenses, Foreign Voter Cards, etc. We sent in a notarized copy (NZ notary) of my husband's passport to get his ITIN, took about 4 weeks if I remember correctly (from NZ).

What kind of visa do you have that will allow you to stay in the UK while you file your petition for your husband's visa?
My understanding is that in the UK, you cannot file DCF unless you are a "resident" there, if you are on a visitors visa (VWP) you would have to file in the US. I'm sure someone will correct me if that is wrong. :)

Just take a Photocopy of your marriage certificate and send it. USCIS just needs a copy for filing -- the copy does not have to be certified or notorized.


If the Consulate/Embassy asks for a certified copy, I would be getting a certified copy for them. Your state's vital records office will be able to issue it for you if you are not in the city where you were born. I ordered mine online from Florida, some states allow this. Why take the chance of having them tell you that a photocopy is not sufficient?

When we got the initial package from the NZ Embassy that contained tons of instructions, forms, etc. the Embassy instruction sheet for the Affidavit of Support I-864 requested three years of tax transcripts. However, when we filed the I-130 petition and DS-230 Immigrant Visa Application and were given the interview letter and another instruction sheet, it only asks for one year tax transcript, 2005. Also, you may have a reason for not having the other two years that would be acceptable to the Embassy as you have a good job and current income that can be documented.
Looking on the Ankara Turkey Embassy website, they allow contact by email for questions about Immigrant Visas. I would email them and ask if they now require only the latest year's tax transcript.

I know sweetie, it's hard to be suddenly with nothing to do and a lot of hours to do it in. When I first came here to New Zealand, it was the same for me. I didn't have anything to do and no one to do it with when my husband was at work every day.
One thing you might be interested in doing is some kind of volunteer work until you get a work permit. Where are you? Most places have animal shelters that are desperate for help, churches too.
Don't be discouraged, you'll get there. It seems like to me that every day brings a new problem but I try to keep the end goal in sight (getting back home) and solve them as I can.
The problem with working illegally is the possibility that you might get caught and be in big trouble.

Hi, I read about that happening to someone else and they took the envelope back to the POE. I believe Immigration at POE is supposed to keep it as it has all your immigration records. I would be calling USCIS and asking what to do as it's been two months since you entered and you probably don't live close to Chicago according to your profile.

Well, after almost exactly 6 months from the time I mailed off the I-129f application, my girl had her interview with the Vancouver consulate at 10am this morning and she just called me a few minutes ago with the good news that they told her to come back at 2 to pick up the visa. :dance: :D :dance:

I just wanted to thank everyone here for the information you have given me directly or indirectly (through reading your past experiences). I'm sure I'll be learning more about the next stages of the process but for now I can't stop smiling. I can't believe my baby's finally coming home.

A curiousity question here as have been reading posts where one doesn't need to submit 2005 tax for affidavits of support until such time as the deadline for April 15 when returns are due. USCIS and DOS appear to of not yet officially released the 2006 Poverty Guidelines yet.......but at least one US Embassy (that I know of) is effecting it March 1 and I imagine it is across the board.... Wondering will they enforce it or will one definately be given grace until after April 15.....or even have visa put on hold until one submitted 2005 if having interview prior to April 15

AW, it's an interesting question. As far as being in effect March 1, are you talking about the Georgia Embassy? It seems to me from what I can gather from reading on different embassy sites & the posts here on VJ & other places, that Embassys & Consulates have quite a bit of discretion in what they do and what they require. It does seem to me that it would not be required to have the 2005 tax documents until after the deadline of April 15th but it might depend on the mood of the CO on the day. :rolleyes:

Yep, it's been a royal pain dealing with them over this. Will let you know when it arrives. One thing I was thinking about last night was wondering if there is a different Customer Service address for each state depending on where you opened your account/or live in the US. I opened mine in Florida and my Customer Service mailing address is in Tampa. Could it be different for other states? :unsure: That would be interesting to know as well because if that is the case you would have a different address to write to to request an Account Reference Letter depending on where you opened your account/or where you live currently in the US.

I was going to give them copies of my bank statements. The problem with this is that the wording on the information sheet I received seems to imply something much more complicated:

Statement from a senior officer of a bank showing present balance of applicant's account, date account was opened, the number and amount of deposits and withdrawals during the past 12 months, and the average balance during the year...




Just FYI I have been trying to get this "letter" from Bank of America since early March & finally wrote BOA Tampa, FL in April (I'm USC living in New Zealand and have a savings acct. in the US at BOA). I've called, written, emailed and it's been one of the most difficult things I've tried to get. Many of the Customer Service people don't have a clue what it is. One rep just put me on hold & never came back and this was at international rates. :angry: I finally got a definitive answer online. It is called an Account Reference Letter. I got mine from BofA and its called a verification letter or something. It does not give all your deposits but states when your account was opened your average deposits(?) and your current balance.

Aha, different scenario--they were trying to help. Since he has an interview, more than likely he already has a case number, A#, etc. so it shouldn't be a problem as they will know who he is. Let us know what happens at the interview on Monday. Good luck :thumbs:

My fiance has his interview Monday, May 22nd at the Consulate in Frankfurt, Germany. When he ordered his police report it was accidently send directly to the Consulate. Has anyone done this by mistake or is this the way it should be done? I am so worried...... any feed back or personal experiences shared will be appreciated.

Here in New Zealand, the police report from NZ goes directly to the Consulate. The form was attached to the DS2001 and the DS230 Part I and the instructions said to fill it out and return it to them, that they would order it. I would imagine different Consulates have different ways of doing things. How do you know your fiance's was sent to the Consulate?

If you can fog a mirror and write a check that won't bounce, you can apply for employment authorization.
