K-1 Fiance(e) Visa Process & Proceduresinternship possibility on a K1 visa

If you are receiving money for the internship the answer would be no , unless the money was paid by University into an account not in the US. As to leaving right away , if you are gone for more than 6 months then you need a re entry permit before you leave.

re-entry permit required for stays outside for 1 year or more... not 6 mos.

K-1 Fiance(e) Visa Process & ProceduresIs Flu Vaccination Needed for Entry on K1 Visa?

Hmm it won't let me edit an earlier post.

The website for the Russian Embassy only says,

"9. Results of Medical Examination in a sealed envelope. The medical must be taken at one of the embassy-designated medical centers. It takes 2 days to complete the medical examination."

Nothing specifically about flu shots. On the panel physician (not CS  ) page it just says,

"When you go to a clinic, please be sure to bring the following: 2 color pictures 3X4 cm in size, travel passport and an extract from your medical history with the list of vaccinations you have received. The document should include a doctor's signature and stamp."

I think I'm twisting myself into a pretzel here. But are any vaccines required for K1 since it is not technically an immigrant visa? I guess we will have to wait and see what the panel physician says.

Technically the K-1 has no vaccination requirement, however, some consulates treat the K-1 as if it is. Not sure how Moscow looks at it. My guess is that they do not.

K-1 Fiance(e) Visa Process & ProceduresIs Flu Vaccination Needed for Entry on K1 Visa?

Sorry about another vaccination thread. My fiance would rather not get a flu shot. I looked but I didn't find the answer for our situation. Am I correct in understanding, the flu shot is only needed if AOS is filed within the flu season (10/31 to 3/31)?

We are hoping for NOA-2 any day now. We anticipate the medical in January and PoE in February. We would file the AOS after the end of flu season. We are planning on getting a copy of the DS3025 from the CS and file it with the AOS.

Will the CS require a flu shot if the medical exam is during the flu season? Will the CS mark form DS3025 as all vaccines current if she does not have a flu shot during flu season?

Will she need proof of flu shot if she arrives at PoE during flu season?

Thanks in advance.

Civil Surgeons are US based doctors who are authorized by the USCIS. Foreign doctors authorized by the consulate are panel physicians

K-1 Fiance(e) Visa Process & ProceduresTraveling while pending K1?

Okay, thanks for the info so far, but being that he already has a tourist visa, will he lose that once the K-1 has been submitted? Can he still travel using his tourist visa while it's pending? I understand that he could be turned away at POE but just curious if he can still travel or will he lose it?

he will lose it once he is issued the k-1 visa at the consulate, not when the petition is filed

K-1 Fiance(e) Visa Process & ProceduresTraveling while pending K1?

Even if visa was granted, officers at POE can ask direct questions for his visit and might not grant entry.
It is not forbidden or banned to have a tourist visa while K-1 is in process; but anecdotal evidence here suggests that citizens from some countries are more likely to get visa and be allowed entry. Unfortunately, Haiti is not one of those countries. If a tourist visa is denied, it normally has not effect on the application for K-1.

A Brit or Canadian will be treated differently than a Pole or Filipino. Right or wrong, it is what it is
payxibkaMaleUkraine2011-12-11 20:29:00
K-1 Fiance(e) Visa Process & ProceduresTraveling while pending K1?

Its unlikely he would be able to get a tourist visa under any circumstances but with a pending K 1 there is zero chance. All people with tourist visas are considered intending immigrants. They must attempt to meet the strongest ties rule which means they must prove they must return to their country. Doing that coming from Hati is about as difficult as it gets. Exposing the fact that he intended to visit you as a fiance would result in a denial.

maybe more difficult but certainly has happened. Consulate is not aware of petitions that are pending and only become aware of the beneficiary's situation after approval and petition has been submitted to nvc.

Hello to you all and this morning I am having some stress concerning money. I have 3 children and wanted to know how much money would I have to make in order to bring my fiance here. I know that its 18,000 per year for two but would it have to be 18,000 for two more plus 9,000 for the extra? not sure how to calculate it. So, if you know how this works please let me know. I really don't need this extra stress on tip of everything else.

K-1 Fiance(e) Visa Process & ProceduresEngagement ring

That's a good point. But there is a section in the i-129f instruction in regards to the "Letter Of Intent". It says to also provide evidence of intent to marry. Since I am an American citizen, a proof of intent would be an engagement ring. I'm just worried that when she shows in Moscow for her interview they are going to see her without an engagement ring and don't know if that will raise some red flags.

How did you answer this?

I'm planning on giving my fiancee her engagement ring when she gets here in the U.S. for good reasons. Had done this before 2 years go with a prior fiancee and the wedding was called off and I never got the ring back. My current fiancee is going for her interview next month and I don't know if there are going to be any red flags that might prevent her from getting Visa. What are your experience with this?

K-1 Fiance(e) Visa Process & Proceduresquestion about I-129F question 12

Hi
I am filling out the I-129F form and question 12)If your fiancé is currently in the US, complete the following

It asks for the arrival and departure record and the I-94 number.

I entered the US on VWP and I got ESTA ( electronic system for travel authorization) online. The CBP told me I did not need to fill I-94, if I travel on ESTA. He just stamped my passport with 3 months expiration date.

What should I do for the question 12) in the I-129F?

I am afraid, that If I leave it blank, I will get an RFE..

K-1 Fiance(e) Visa Process & ProceduresNOA2 Received... Now what?

I received my NOA2 hard copy in the mail on 12/12/11, dated 12/9/11. It's been about two weeks now and the K1 Process Flowchart states that the NVC receives it next, then shortly thereafter, forwarded on to the US embassy in Canada. What should I be doing now? I know my fiance needs a hard copy of our I-129F package, but does he need it before he receives his paperwork? Where does my I-134 come in?

Also, does anyone know what kind of paperwork he'll get to fill out? What fees are associated? When does he need to schedule his medical exam? I want to make sure I get him everything he needs from me before his paperwork arrives.

Thanks everyone for the consistant support! Wouldn't be able to make it without y'all!

K-1 Fiance(e) Visa Process & ProceduresCost of this process

I'm trying to gather all the costs of this whole party...Am I missing something?

1. I-129f petitition, $340
2. Medical exam, not exactely sure, but have seen somebody write $600. (Anybody know the fee for the medical in Norway?)
3. Immunization, don't know
4. Interview/visa, how I read it I will have to pay about $400350 dollars for the visa at the embassy.(Probably something for the child too..) $350
5. AOS for me, $1070
6. AOS for child, $635
7. Employment Authorization,$ 380
Total: 3425+immunization
And to add things up, the American Embassy in Oslo doesn't handle immigration visas anymore so we will have to travel to Stockholm, Sweden (transportation and hotel) for the interview....

So, I hope I'm not missing something:)I just don't want to be facing costs we didn't think about.

K-1 Fiance(e) Visa Process & ProceduresK2 Question

My 3 year old daughter is an Ecuadorian citizen can she come under a K2 visa even if her father is a US citizen and he will not do her citizenship, someone just told me this: "...and you represent her as NOT American that is visa fraud and you could be barred from the country in the future." I just dont understand because she is ecuadorian she is not a US citizen and I dont even know how to contact her father he does not have anything to do with his daughter and I have sole custody.

you need to address this with the embassy directly... if she has a claim to us citizenship she IS a us citizen, as well as ecuadorian.
payxibkaMaleUkraine2012-01-02 23:50:00
K-1 Fiance(e) Visa Process & ProceduresK-1 and K-2 question

If you are a US citizen and can show 5 years physical presence in the US your child is also a US citizen from birth no matter if the US parent is the father or mother.

You were given incorrect information.

Your child is therefore not eligible for a visa of any type if he/she qualifies for US citizenship for birth.

Here is the link for determining whether a child is a US citizen or not:

http://travel.state....iving_5497.html

When you file all of this information the same officers at the embassy who issue the consular reports of birth abroad for children of US citizen parents are going to review your case file, address history, everything, and at that point your case will be all snarled up in paperwork while the officer goes back and forth trying to issue a visa to someone who is not actually qualified to get one. At the end you will end up with a CRBA and a US passport on one side (child) and a non-immigrant visa on the other (father).

Please familiarize yourself with how to handle a birth abroad before you have a non-immigrant visa issued for a US citizen. Our daughter for example, was also born overseas, is a dual citizen and does not illegally enter and exit the US as anything but a US citizen.

You owe us. You just saved (1) visa application and (1) AOS application for the $100-200 cost of a CRBA and US passport.

Please fully understand the OP's situation before you give information that might simply be more than wrong for the OP's situation.

If NEITHER parent was a USC at time of birth, then the child is NOT either under ANY circumstance. This is the situation the OP appears to be in.

The US government does not care if you want him to be a citizen or not. He is either a citizen or not. In your case he simply may not.
