the CR1 is definitely the best bet. I don't even know why they have the K3 process...it sounds good, like it will get you together quicker but the CR1 always gets processed faster...you see it all over this site in the timelines. The K3's are just clogging up the system and making everything slower. They really need to revamp their system...big time!!! K3 is Obsolete!!!

It is true that with the CR1 its better...because yes, your spouse will come here as a legal permanent resident...but if you have not been married for at least 2 years when the visa is issued, your spouse will be a "conditional" permanent resident. Once your spouse comes here and is in the US...90 days prior to the 2 year anniversary of entering the US you will have to file a form to have the conditions lifted so that your spouse can then become a legal "permanent" resident...period. As a conditional resident your spouse can work, get a ssn and card, etc....its the same...but you just have to do one more step to get the "conditions" lifted when you come near the 2 year anniversary of being in the US.

The K3 does not allow you to work, takes about the same amount of time, costs double, requires that you go through a complete Adjustment of Status Process here in the USA, cannot get a Drivers Licence etc, etc... I say dont even bother slowing down your I-130 application with the K3,just go for the Gold!

As far as visiting... You can visit but as they said, you have to prove a complelling reason to go back to Denmark (work, house, family) etc... Just bring this proof to the airport and when/if the border control officer asks, just explain to them why you MUST return to Denmark and cannot stay in the USA (they are afraid that you will come over here for a visit and try to adjust status while here)... But many have come and visited without any issues from VWP countries


Thank you very much for your response. It helps a lot. However, if the K-3 and I-130 are filed together the K-3 fee is waived. And correct me if I am wrong but I don't believe there is any adjustment of status because the I-130 is filed with the K-3 already. When the two files are sent together the K-3 is designed to just allow the foreign spouse to enter sooner and travel back and forth without hassle. But do you really think not filing the K-3 at all would be better? Because the clogging up the system thing makes sense and i don't know if it is even worth it? Or do you )or anyone else) really think it can hurt/slow down the process?

Hi,

I'm a Danish citizen and my husband is an American citizen. We just started the process of applying for a spousal visa and have a few.. well tons of questions.. but I'll start out with a couple of them ...

We were recommended by the embassy to submit a K3 a long with the I-130 - as the process for spousal visa alone can be very lengthy. Does any of you have experience with submitting both an I-130 and a K3? ... And do we in that case need to pay the fee for both petitions?

Also we looking for people who have experiences with in entering the US on a VWP while having an I-130 (and K3) pending... as we would love to be able to see each other during the processing time. (My husbands work doesn't really allow him to visit me for very long). We talked with the embassy about it and they said that it's up to the boarder control in the airport whether I'm allowed in or not. However they did say that it could help if I brought documents that proves ties to my home country to show that I'm not staying in the US but going back within the 90 days. Did anyone try this? if yes.. what documents did you bring? I have about one year left of my masters, so i have documents from my university.

Any help would be greatly appreciated.

K-3 Spouse Visa Process & ProceduresG-325A Residence outside US question
Hello All,

My wife (Danish citizen) is filling out the G-325A. For the question that asks for applicant's last address outside of the U.S. of more than 1 year...what does she do? She lives in Denmark and has been at her address for about 5 years and still lives there. The box wants a date and she can't write in "present time" on the computer? Should she write present time by hand in the box or should she just fill out the month that it is now?

Any help would be greatly appreciated!

My wife lives abroad and we need to file 1 G-325A for each of us. So what do I do about the signature? Can I have her sign it and then send me a scanned pdf file or does she have to sign it and mail it to me? Does anyone have any experience with this? Does it have to be a real signature or can it be a copy? Thanks!

Hi all,

Newcomer to the process - just putting together I-130 for IR-1, have been trolling the site for about a week now. You all seem very helpful and knowledgeable, so I'm sure I'll be on to ask lots of questions!

Husband (dual US/Can citizen) and I (Can cit) have been married 4 and a bit years, currently living in Canada. I have continued using my maiden name, didn't want to do legal name change, all of my current documentation has my maiden name. I presume I should use my maiden name on the forms, but do I put my married name for the question (#7) 'Other Names Used'? - It suggests maiden name.

Also - it asks for the address in the US where your relative (me) intends to live. We do not have a residence there yet, my husband was going to move into his parents' house until the visa gets sorted out, then we will find a place together. Should I write his parent's address?

Extensive abbreviation is common on the G325a. It's purely biographical. Just company and city, even if abbreviated are ok.

Hello all,

Please help me clarify a few things. I need more space to write the address of past employment on my G-325A form (as well as space to fit the city -- too long ex: the city is "San Luis Obispo" Can i just leave the "o" out so its "San Luis Obisp"? Anyone think thats ok?). How do you properly note that you are using another sheet and where do you note it?

Also, I moved back and forth between two addresses (for school reasons). Should I note the same address multiple times? Also, what if I moved around so much that the given space for addresses does not allow enough for the 5 required years? I know this sounds a little confusing, but trust me, im confused too. Anything will help, thank you! We are getting ready to send out our I-130 and we are very excited!

Hello All,

First of all, to those of you who have helped us out with advice and by sharing experiences....MANY MANY THANKS!

So the "additional documents" that they tell you to send along with your I-130 to prove a bona-fide marriage....is it absolutely necessary to send those? My wife lives in Denmark and is a Danish citizen. We just got married? If she lives in Denmark how the heck are we supposed to have joint accounts or property together? I feel like those are ridiculous requests.

So my question is? the only thing that would apply I guess are getting sworn affidavits. We got married in Denmark last week...so does anyone know how we go about doing that? We had some people from her family there and they can sign things if needed but a little guidance in how to do that would be nice.

Please let me know if anyone has any experience with this.

*Oh and is it wise to send along wedding pictures and things like that to prove a bona-fide marriage in the I-130 packet? Or should i wait til we are asked for those things?* THANKS!

OK 2 last questions, sorry about all the questions but i'm sure everyone understands. First, #15 on I-130 asks for "Name and address of present employer." I am the USC petitioning for my wife in Denmark....so is that MY employer or HER employer?

Second, #17 asks "List husband/wife and all children of your relative." So do I list myself as I am HER husband because it asks for husband/wife of your relative (which the relative is my wife) right? I know confusing but im confused too.

Yeah for Danes and Americans. My gorgeous WIFE, living in Denmark will hopefully be getting her interview very soon. I have a question for you danes/americans...

Lina (the Dane) visited me for about 2 1/2 months while her I-130 was pending and it even went to the NVCc while she was still here. She went back to DK but will be coming back June 16th. Do any of you know if you have had any trouble? Even though we didn't have any trouble before we are kinda worried that now that she is so close to having her VISA she might not be let in or something. Which would be really REALLY bad because we are having like a huge "celebration" with all our families and stiff in California (even though we married in DK in January)...

Please let me know if you have had any experience with this. Tthanks!
