I wanted to restart school but their asking for my new green card... I just have to put it on hold. :(

Your expired GC together with the extension letter should surely suffice. If they really won't take that, consider making an InfoPass and asking for a passport stamp so you can prove your status to the school.

You may be in removal of conditions but you're still a perfectly valid permanent resident while it's pending, with every right to work, travel and go to school.

Again, this is an uneducated guess but I don't think that the IO would have asked this question in that way if she had any doubt that your marriage was entered into in good faith. From a green card point of view, I suspect you'll be ok in the end...

When you went downstairs for the passport stamp, what expiry date did they put on it? Until the date on your extension letter or something different?

I have no idea what to suggest or what should be done if your marriage situation changes between filing and approval but you can bet somebody here does. If I were you, I'd post a new thread so more than just the Feb filers see it (either in this forum or perhaps in effects of family changes?). The rules of VJ dictate that you'll probably get some unfriendly answers if you post it more widely but just ignore them and focus on the constructive answers.

Made the mistake to look at the Jan filer thread...50% of their CSC filers have been approved already and I think 2% of their VSC have been.
Come oooooooooon VSC :clock:

My wife (the most impatient person I know :lol:) is getting really agitated with VSC :lol: I'm pretty much chilled out and resigned to the fact it's going to take ages but she's getting annoyed with them :P

Did anyone else not get case update/touch after biomterics notice? Mine has not been touched since NOA. I know not to trust the online system, I guess ill periodically check the mail box if they send something =(

No, mine's the same, bio yesterday, no touch since NOA and plenty of others have asked the same thing so it doesn't look like the bio being done updates the touch date. IIRC, a touch is generated when somebody scans the bar code on the actual paper file when they move it or work on it so that's possibly why?

Definitely don't trust the online system though - I never got a touch or an email for either my EAD or my AOS - the first thing I knew about my AOS being approved was when I got my GC out of the mailbox :lol: (while sweating over why I hadn't had a touch after sending back an RFE :wacko:)

I would imagine it's just the same as the AOS interview because ultimately, it's the same test of a bona fide marriage. If you passed it once, you can do it again - good luck :) I went through some I-751 tracking threads from late last year and it looks like about 5% of people were getting an interview back then. If you submitted loads of evidence, perhaps it's just bad luck and you drew the short straw? :(

If I were you, I'd try and take an early bio because I doubt they'll be able to approve you there and then at the interview if you haven't done biometrics yet.

Once you're past this though, it looks like you should be on for a speedy two month approval :D

Hope all are well. I sent my I-751 application on the 26th of Feb 2011 via USPS and have confirmation that it was recieved on the 28th of Feb by USCIS. However my cheque has still not been cashed and no NOA. Just wondering how long it takes to get it. BTW I sent my aplication to VSC. Thanks

My timeline was like this: Received at VSC 18th Feb (I still haven't got the return receipt back :P), NOA1 date 22nd Feb, check cashed 28th Feb, NOA1 in-hand 3rd March (13 days after delivery to VSC) so you'll probably have to wait a week or so yet, assuming they're keeping to roughly the same schedule...

Do you know how I can get an early bio appointment after I get my NOA? I see a lot of people who filed in Dec and Jan are getting early Bio.

I'm pretty certain you can't go for an early bio until you have the actual bio appointment notice in-hand. The NOA1 says this:

In order to further process your petition, you will be receiving an Application Support Center (ASC) appointment notice with a specific time, date and location to capture your fingerprints, photo, and signature. You MUST wait for your appointment notice before going to the ASC for biometric processing.

If I remember rightly from AOS, the bio notice has a bar code on it (that's not on the NOA1) that the ASC scan when you go which is presumably why you have to wait until you have it?

yaaaay!! We got our NOA today from VSC!!!! The receipt date is 2/22, exactly the day it arrived via overnight mail in Vermont....WHY did it take them so long to send us this notice?? lol All I know is I'm very happy...and we're running to the DMV too, it's been SO inconvenient since my husband wasn't able to drive! Can't wait for the biometrics notice now!

Phew :) I had a easy experience at the DMV (in and out in less than 20 minutes :wow:). The woman didn't understand why I gave her the extension letter and didn't look at it. I guess she just ran me through SAVE to get the new expiry date...


I logged in to our account a couple weeks ago too out of curiosity and I noticed as well that the I-485 and I-765 were touched last summer! Wonder what that was all about??

I wonder if they just archived the files and they were touched because they were logged into storage? Probably something uninteresting like that :lol:

Am I correct in thinking that you cannot check for online updates until you get the NOA with your case #?

I read somewhere on here that the receipt number on an ROC NOA is no good for case status online :rolleyes: and you have to wait and use the one from the bio notice... (here's one - post #2)

Speaking of CRIS, I just logged back into my account there for the first time since AOS and it seems both my I-485 and my I-765 were touched last summer... :unsure:

VSC and I too am starting to worry since I'm filing so close to the later part of my 90 daysm and it's been almost a week they received it and still no check cashed... But Im sure it'll all be alright and will probably be hearing from them soon enough...

Your GC expiry date is one day before mine & we're at the same service centre. You should be OK - they cashed my check after 10 days so if they're working to the same timeframe for everybody, they should cash yours soon :)

Another question - those of you who have biometrics appts, did you do biometrics for AOS too? It seems odd that one would have to do it again....

I always assumed that was to make sure that 'you' are still 'you' - an anti-fraud measure to check the fingerprints match up at the embassy, POE, AOS and ROC stages?

I don't know but you could try asking the bank? (I'd go to the same branch where you got the check rather than calling the bank's own 'misinformation line') There must be a mechanism to trace them because they have to be able to credit them back to your account if they're cancelled...

Filed on February 16th, got my NOA today. (VSC) Awwwww yisssss.

Wow! That means that there is at least one person still working at VSC then :lol: I was beginning to think they'd all packed up and gone home for the month :P

Yeah, that appears to be what I've been seeing too. It would sure be nice to just get an approval for once, and not have to stress over another interview! But either way, we'll go with the flow.

If you've already satisfied an IO in person that you're bona-fide, I shouldn't think you've got anything to worry about in that respect - if the local office has already decreed that the relationship is legit at the AOS stage then why bother with the expense of doing it again? :)

Is there any indication of how many people actually get interviewed?

I've been flicking through the previous monthly filer's threads to try and work that out. Most of the tracking lists don't indicate whether people were interviewed or not but the June 2010 one does. Their figures are like this:

CSC:   29 of 31 approved, 2 interviewed (6.9%) VSC:   23 of 28 approved, 1 interviewed (4.3%) Total: 52 of 59 approved, 3 interviewed (5.8%)

It's obviously a very small sample but looking through the ROC timelines section seems to bear those figures out too. Of the most recently completed 150 ROC timelines, 6 had interview dates specified (4%) so it seems the likelihood of being interviewed, all other things (like amount of evidence) being equal is roughly 5% or 1 in 20.

I am tired of letting USCIS rule my life. We're turning this thing in, and just letting it ride!

I'm carefully monitoring the package tracking to make sure they actually get it but once I get my return receipt and NOA1, I'm simply NOT going to worry about it this time. No getting up every morning and checking to see if the case was touched (that sounds awful :lol:), no running to the box 10 seconds after the mail lady drives by... I am done with letting them stress me out :dance:

I do have a quick question, though, if anybody happens to know ;)
Back when we were all in AOS and a lot of us filing from K-1 were transferred to CSC and approved without interview, there was speculation that would mean more scrutiny and interviews at ROC time. Has this turned out to be the case or are they still approving the vast majority of I-751's without any complications?

Another way to get a live person (this is how I get though) is to go through the case status system. It'll ask you to enter your receipt number then read out exactly the same info as is on Case Status Online. After it's through reading to you, it'll tell you that the information you just heard is the most up to date available and that they don't have any further information, that they will write to you when a decision is made, etc, etc. After what will feel like an eternity of trying to persuade you to hang up tongue.gif you'll be asked to press a number if there is a 'problem with your case' (I think it's three). The annoying automaton will then read more options to you. Just pick the closest to your issue and it'll put you though to customer service. You can also just tell them that none of the problem options applied to you - they don't seem to mind.

If you want to prove that you're talking on webcam by actually getting a snapshot of the video in progress, there is a key on your keyboard marked 'Print Screen' (sometimes abbreviated). It's normally in a small row of three at the top-right, near the caps lock light.

Make sure that anything you don't want the consular office to see (!!! tongue.gif tongue.gif tongue.gif ) is off your screen completely and everything you do want them to see is visible (your other half's webcam, your own webcam, chat windows, etc) and then press the Print Screen button. Now go into your Start menu, find "Paint" and open it. When Paint opens, click the 'Edit' menu and then 'Paste', et voila! a perfect snapshot of your screen at the moment you hit the button. Save the picture, print it out (you might need to alter the printer setup to 'Fit to page'), whatever you like smile.gif I did a few of these over time to go with my printed IM logfiles.

Anyone with half an ounce of computing knowledge can throw together an authentic looking faked chat history in a few minutes. I didn't want to hear "Wwll I could make one of these too, how do I know it's real?" from the consular officer on interview day. I figured that some actual screenshots would add weight to my other printouts smile.gif

Given that most countries and airports these days require transfer passengers to clear immigration and customs then surely the bottom line is that, you could (read as 'probably will') be required to go through passport control in Japan. The passport control desk is technically 'the border' so you'd be crossing an international border and therefore out of the USA. Personally, there's no way on earth that I'd do that without an AP - it's just not worth the risk.

Moreso, you'd be required to clear immigration again when you arrived back in the USA (international inbound flight). That will definitely cause you problems with a single entry visa!

A K-1 is a non-immigrant visa, albeit a weird one because the holder is not expected to leave (assuming they play by the rules, of course).

You can only marry the person who petitioned for you. I should imagine that if any other person was named on the AOS documentation, the package wouldn't even be accepted. It would definitely be denied if they did accept it for processing and the K-1 would be accruing illegal presence if they then stayed beyond the 90-days.

I think it was just the CBP officer being a bit of a jobsworth, to be honest. He also did other weird stuff, like stapling the I-94 directly through the middle of it and my visa, saying "I make no apologies for attaching it like this". blink.gif rolleyes.gif

Well yes, of course but the 'K-1' on the stamp already shows that to anybody who looks at it. Likewise, USCIS know full well who I was entitled to marry. I get the impression it was just one of those quirks of the system where everyone handles a given visa type slightly differently. I also wondered if it was some kind of 'Anti-EAD'

I've pondered what this meant a couple of times over the past year. For some reason it didn't occur to me to ask if anyone here knew blush.gif

When I came in on a K-1 through Chicago last May, the CBP guard annotated the "Record of Changes" section of my I-94 with "TO MARRY ONLY: <full name>". I've never heard of this before and wondered at the time what on earth the point of writing it was. Does anyone else have that on their I-94 or know why it's sometimes written?

The letter of intent doesn't have to be an essay. I think ours were only a sentence or two long. Hand-written, hand-signed, not notorized, basically it just said words to the effect of:

It's the other stuff that goes in the packet, emails, Skype records, travel itineraries, bank statements (from the beneficiary, showing card use in the petitioner's home town), and so on, and so on that proves the relationship.

All they require is a statement by your own hand (signature at the very least) that you really do intend to marry the person stated on the I-129F. My wife wrote her own letter separately from me so that they wouldn't be identical but she didn't say any more than I did.

The basic requirements for a K-1 visa are:
1. That you have met in person in the past two years.
2. That you can demonstrate a genuine relationship.
3. That the beneficiary isn't inadmissible for other reasons (criminal past, medical risk, habitual drug user, etc).

There is no law prohibiting age-gap couples at any stage of the immigration process (such a law would undoubtedly be unconstitutional). If you tick those three boxes, you will be fine. Just make sure that you leave the consular officer at your visa interview with no doubt about the strength of your relationship.

To update my story posted further up this thread, the expected AOS interview never happened - green card received with no interview so once again, we were worrying that our age gap would prejudice our case for no reason.

My wife (US citizen) is 21 years older than me and I am quite young. We were very concerned going into K-1 interview that I would be questioned strongly about our age gap and given a rough ride. Truth is, I wasn't. The Consular Officer asked, sure, but didn't make that much of a deal about it. Nowadays, we're approaching the AOS interview within the next 2-6 months and are again worried. We're not expecting such an easy ride this time.

I think the thing to remember is that the world has changed in the last decade and nowhere is this more apparent than in the world's immigration systems. 10 years ago, the 'normal' way was that you met and fell in love with someone based on a physical meeting or introduction, a bar, party, work, etc. You saw someone, formed an instant opinion about them based on their age, appearance and personality and the relationship started (or not) from there.

These days, we have the internet and it's a very common way to meet new people. It takes away the physical aspect of that pre-judgement stage because all you have to go on are their words and personality. If you fall in love based on personality alone, age doesn't matter one iota wub.gif.

Yes, there can be other problems. Certain members of both of our families, namely one of my grandmothers and her father (who are both pretty much the same age) found it particularly difficult to understand. But they are children of a different age when things were done differently and if a relationship is strong enough, then nobody, not even a parent, can get in the way. In the end, her father came around and we now get on well, 2.5 years down the line. My grandmother has learned that she's the only person on my side of the family who cares.

The Consulates and USCIS realise that this attitude shift has happened and that people don't always get together with someone their own age nowadays. They obviously have to be careful of sham marriages but realise that they will be on the look out for - and see - all the signs that demonstrate a real relationship as well. If you have a real relationship, there should be nothing to worry about.

I think the bottom line is this - if you can picture the two of you X years down the line, as a little old lady and a somewhat younger little old man (or vice-versa), still together and just as happy then you won't have any real problems. Everybody else will be able to see that, too smile.gif

I'm wondering why the USC is able to cancel a K1 interview at all? Surely the beneficiary would be responsible for that? Certainly when I did mine (admittedly not in Manilla) all the appointment stuff was down to me and my USC better half had nothing to do with it.

In any case, I'd go if I were you. Even if you can convince the consular officer that you had valid reasons for cancelling, every time you do, you make it more and more likely that they will take issue with it. Furthermore, you do not need all your documentation in place to attend the interview. London almost dropped me right in it by scheduling my K1 interview before I had returned the packets and got all the documents. I accepted the interview anyway and went with what I had. In the end, all I was short of was the Affidavit of Support but that's quite a critical piece of documentation. The consular officer simply continued with the interview and gave me instructions for sending the AoS to the embassy as soon as I had it. I submitted it plus my passport a week later and my visa was then issued.

If you can, show evidence that you've at least applied for the missing documentation. The embassy won't issue a visa on grounds of a receipt, etc, but it should be taken as a show of good faith at least.

Bluntly: Stop messing with the embassy. Sooner or later, they are going to get fed up with it and you'll have a really hard time getting a visa from them.

Stop. Breathe. Read. Lots.
Especially read the guides here and the instructions for USCIS form I-129F. At first glance, they seem horribly complex, even contradictory but they're not really. Read once, take a break, read them again the next day and repeat until you understand exactly what's being asked of each of you. When the time comes, follow the instructions in the form literally.

It's never too soon to start gathering 'evidence of relationship' so start putting aside everything and anything that shows you are together. Letters, email records, phone bills/Skype records, travel itineraries, photos of the two of you together, etc, etc. If you're likely to have trouble obtaining any documents you might need later on (birth certificate, etc) then start getting them now too. It's better to have them way earlier than necessary than to be running about like a headless chicken with an embassy deadline hanging over you.

Most importantly, immerse yourself in the K-1 (fiancé(e) visa) forum here, learn from other people who are further along the line than you. Read about their successes as well as their troubles and mistakes and how to avoid them yourself. When you file, find the thread with other people who've filed in the same month as you - it's a great source of support to know there are others at exactly the same point as yourselves.

Depends on infinite variables, really but very broadly speaking, you can expect about 10-12 months from the day the petition is mailed to the day you get off the plane in the USA (including embassy processing time). It may be several months more, it may be several months less. It took us almost exactly 11 months from beginning to end but we had a few little holdups along the way.

Well the filing fees are well documented but don't forget to add to your projected total, things like travel to the medical exam/embassy if you live a long way away, the cost of obtaining any documents, fees payable to the embassy when you get there, the cost of your flights, etc, etc, etc. It's a good idea to sit and plan that out... I think all in all, we paid around about USD$1800 when you consider all the little incidental costs that crop up along the way... Remember though, the 'adjustment of status' process (to green-card holding permanent resident) once you're here is the biggest single expense - it currently adds another $1010 to that total and you need to pay it quite soon after entry, so factor it into the equation now.

I think they did know what they were talking about, they just answered the wrong question. They clearly said the documents go to the State [Department], which is correct (the NVC is part of the State Dept.). I suspect they thought you asked about the NBC - one letter different and your petition goes nowhere near it.

The fact that first-line people at the Misinformation Line rarely, if ever, make the effort to ensure they've fully understood what they're being asked is another very good reason not to waste your time with them. Just search/ask VJ instead, you'll get a better answer and without all that tedious mucking about in their phone menu system as a bonus smile.gif
