If you can wait a year or so and want your SO (significant other) to be able to work soon after arriving to US, and are concerned about the costs...

Logical choice is to get married (either in Germany or US) and apply for the CR1 visa while you are in the US and your SO is in Germany.
However, it is a long term separation which can be pain if you can't afford to travel frequently. whistling.gif

K1 will save you from separation after marriage, but will cost more. In the end, may be a cheaper option, if you consider cost of plain tickets smile.gif

So tell him to file the taxes for the last three years right away. He will not owe any tax as long as all his income was foreign income.
You will need his tax transcripts eventually, regardless of who's income is used to meet 125% poverty guidelines.
Right now... you need to file I-130 urgently, because it will take months for it to be approved.
CR-1/IR-1 is the best visa option possible and so this is what you should be going for.

If your work situation is convincing AND you had B1/B2 before, you could apply for business visa (or use a current business visa) to enter the US. Get married, leave, apply for CR-1.
You will have to convince the consular officer AND POE officer that you must leave the US after the wedding.
This is not likely to work, but not impossible either.

I have paid everything for the wedding date in April already, non refundable. And my K1 will expire in May.

I cant stay due to my job. I think the quickest time of advance parole is 2.5 months, right? or it could be faster? or it requires some kinds of urgency conditions?

I am struggling, since I need to reenter US in August for business again.

After marriage he can adjust status if he wants to (assuming they stay in the US).

This is definitely fraud and she should tell the bank to initiate the investigation immediately!
(banks normally make the stolen funds available right away, until investigation is complete)
But she should be OK. Think about it - it was not her, who initiated transaction (you said it was from UK). Why ANYONE else but her would be able to initiate transfer from her bank account? Bank clearly made a mistake when they did not double check the transaction.

$4K a year is what an average worker pays for work sponsored family health insurance premiums, with a full price of $14K a year ($10K on average is covered by the employer). Add to that deductibles and co-pays. For reference, median household income in the US is about 50K (in 2010).

If someone refers to their plan as crappy rather than average, it probably means that it costs more than 20% of their household income... IMHO, too much.

that's where you are wrong, and that is what needs to be closed off. Assume your health insurance your company offers costs $400/month. That's $4800/yr.

about K1 tips, like how much to provide as proof of relationship i am not a specialist but you may look around in the forum

maybe a tip is to provide key information but not overwhelmingly too much and bulky
imagine you were the guy having to look at all

you may keep some info for the interview instead of providing it with form.

pictures
also affidavits from people who know you documenting thir knowledge of your relationship

last big tip
read all 3 times again and again
make 1 scanned copy
make 2 hard copies one for each

you seem to be a plain K1 case sending its I129F as first form
so K3 vs CR1 is not your dilemma

Getting married first and sending I130 for K3 or CR1 is probably not a good option for you.
K1 tend to be quicker than K3/IR1


To send my form I used a zip for frozen food.
I indexed all the attachments with post its
and tabbed them in the cover letter/table of contents

about the 2 holes I don't think it is a good idea. It degrades your document by eventually removing key pieces of info.

also I decided to stapple I129F first and second page because they are so easy to get lost.

in terms of queue We am around 85. A k1 at the same date is less than 170, about 150

my timeline now says for I129F
"There is not enough data in the timelines to accuratley approximate when your I-129f will be approved"
with a recent rate of 0 statistics can even provide an estimate.

my advise is to have the uscis set as original unique set and do scans for copies
print scans for quality check but put them aside or even destroy them to avoid mix up

we got I130 rejected because my husband did not write properly the check
had a copy of what he had done and found out before uscis returned

practically all came back
and it is a rejection not a denial

we send it back again
lost about a month in total

I have no SSN
but I had a US account for years opened by my US company

then I have a US account opened last year by me during a trip
(just needed a US address for mail)

then my husband put me on a joint account last month
I had to be present for finalizing the opening
Good thing I have a credit card to do his groceries while on holidays
was getting tired of paying for them!!!


MAYBE THERE ARE GLOBAL BANKS that allow to open from the foreign country
where the foreigner is.

The number I got on the check was also invalid , a digit lower than the one I got on the NOA1
Showing they mess around with numbers...

but I have never heard about an invalid number on NOA1
I would call again spead with another operator and eventually the supervisor.

Hopefully also some other VJer have good advice for you.

I think Canada it is a positive variability because they process electronically and no translation
You can look at statistics too

Variability at first step (USCIS) is big
factor is more which service center gets the petition, Vermont or California, and what is their mood / activity at that time,
Service center depends on your state, see I129F instructions

i have a few questions about this all process,
we know our petition was received feb 05 , because someone had to sign for it.
my fiance sent a money order, so there is no way to find out if they cash the check lol
so my question is, how will we know that they opened our file at all? i know the approval takes a while but will they at least let us know if they have looked at it?


and who will receive the approval letter (well i hope it will be approved)
will it be him the petitioner or me the fiancee?

should i check my emails at all or should he?or the mail?
