My brother is the petitioner and is sponsoring his wife for a visa and is in the NVC stage. He is currently 16 years old but will be 17 in November.

I read in the instructions for the i-864 Affidavit of Support the following:

"A sponsor completes and signs Form I-864. A sponsor is required to be at least 18 years old and domiciled in the United States, or its territories..."

Has anyone tried to complete and submit the I-864 while being under 18. It is clear in the instructions that you have to be 18 to be a sponsor, and from what I understand the petitioner must be a sponsor even if there is a Joint Sponsor. Is that correct? Are there any ways to get around this rule?

What will happen if my brother fills out the AOS form and signs and sends it to the NVC even though he is only 16. Will he recieve an RFE? or will they just let it pass since hes almost 18? Will they tell him to wait until he's 18 then submit the form? What do you guys think?

Any input would be greatly appreciated.

The only time recently I can think of anyone doing this without being a resident of another country was when the Embassy in Sanaa was closed during 2011. Some interviews got moved to the Embassy in Jordan but their cases couldn't get completed there because they were missing mandatory drug tests (qat) in their medical exams. I don't know what ever happened to those folks because they never updated their timelines. Don't chance it. Your wife is just going to have to wait it out.


Can anyone provide proof that you have to be a resident of the country to be interviewed?

Hello Everyone!

I would like to ask you guys, has anyone successfully changed addresses before i130 approval to a different country in order to avoid a long interview wait due to problems the in beneficiary's home country that delay the US embassy?

My wife is from Yemen, and other people on this forum have waited around one year or more after case complete at NVC in order for the US embassy in Sanaa to schedule a visa interview. I am thinking about changing my wife's address to a Saudi Address where her uncle lives in order to avoid the long wait and have her travel to Saudi Arabia on a visitor visa right before her appointment.

Will this cause any problems for my i130 process? Has anyone tried this before? Do you have to provide proof of residence after you update your address with the USCIS.

I would appreciate any help from you guys. Thanks!

My I-130 was approved on May 23rd, and now it has also completed the NVC stage which was finally complete on September 3rd.  It takes a while for the USCIS to send your case to the NVC, around a month, and it takes around two months to get done with the NVC process.  My wife is now just waiting for an interview in at the U.S embassy in Sanaa.

Before calling the NCSC please have available
-your receipt number:
-type of application filed: I130 for Spouse of USC
-date filed:
-Online case status
-Have all relevant correspondence with USCIS

What to ask them?
During your call take note of the following information:

About them:
-The name of the NCSC representative:
-The id number of the NCSC representative:
-The date and time of the call:
-Any service request referral number, if a service referral on a pending case is taken:

About our case:
-When calling, ask them for a service request. (Expedite Request)

once they give u a service request they will give you a ticket number and tell you to check back with them using that number in a few days.

In case they refuse or tell you that they cannot answer your question, then ask to be transferred to a Tier 2 ISO (Immigration Service Officer) supervisor, who will have more privileges to access detailed information about your case. Once you get an ISO, be very polite, and take notes for your records. Ask them for their badge number. That way you can reference each conversation by date and the badge number of the ISO.
Also ask them to review case status - THEY can - it's on their screen.
If the NCSC doesnt issue a service request, please make sure the NCSC representative tells you the reason why he did not issue the request. (This information you'll need to follow up)

I believe Sana'a Embassy allows the petitioner (USC) to be with the beneficiary at the interview but realize you will be standing at a booth talking to the CO behind glass the whole time. They may ask you questions directly but you can't assist your wife in answering her questions. I personally plan on being there and even if they turn me away at least they'll know I was there to support my fiance.


So they only interview beneficiary right? Also do u know how long it takes for the NVC to schedule a visa appointment at the embassy in Sanaa after the case is complete at the NVC?

Hello, this is my first post on VJ and I really hope you guys can help me.

On April 5th I made an Expedite Request over the phone for my i130. Then on April 10th I received this email:

Type of service requested:
-- Expedite

The status of this service request is:

Your case is currently being adjudicated. You should receive a notice of action* within 30 days.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice, Request for Evidence, Notice of Intent to Deny or Notice of Intent to Revoke.

At first glance I thought my service request was approved, and my I130 case was being adjudicated, but then I thought maybe they're talking about my expedite request?

Does this mean that my service request is being adjudicated or my actual i130 case is being adjudicated?

I called the USCIS many times and each time they give me different information. One lady said "they just disregarded your expedite because it isn't needed, your case is being adjudicated" and another representative said "your service request or i130 will receive a reply in 30 days" I asked her which is it my service request or my actual i130 case she said either. CONFUSED

Maybe you guys can help me understand their email response? Any help would be greatly appreciated!

NVC Case Complete- January 2014
Good news is I have a CRBA appointment for my daughter next month. Anybody have any advice for me? Like how much are the fees all together?

congratulations! The fee for a CRBA is 205 all together, cash only no checks or foreign currency. just make sure you have all your documents that are required.

I did a CRBA for my twin boys back in October. I didn't get their passports until January.

That fee is for CRBA and first Passport.

What was the most recent case that has gotten an appointment scheduled? For example, my wife's case was completed at the NVC on September 3rd 2013, and my wife got an appointment in November 2013 (very quick, I know but our case was an exception because it was expedited due to medical emergency/high risk twin pregnancy).

Who has gotten case complete later than September 3rd and has received a visa appointment? I just want to know so people have an idea of how long on average appointments take to be scheduled at the Embassy in Sana'a.

Can you guys post your NVC case complete date and date of visa Interview appointment if you've gotten an appointment date yet, if not just post your NVC Case Complete Date.

Hi Missyemen, nobody really knows how long the embassy will take to schedule an appointment for an individual case as it varies greatly. It could take as little as 6 months our as long as 1 year or more depending on a lot of factors like whether you're husband is put on Administrative Processing.

My brother's case for his wife was completed in January 2014, it's now July so is been 7 months and no interview appointment scheduled.

I pray for all of those waiting for their family to come to the US, the Embassy in Yemen is very very slow, but Allah grant everyone patience.

She did get a small piece of paper that said to come pick up her visa. My kids took about a month and a half to get their passports after submitting all the paperwork. I had to contact my congresswoman to make an appointment. For my children's passports.

only people in her district can ask for immigration help. but can u tell us how she helped u. wat did u tell jer and what did she say to the embassy and what was the outcome right after. also how many times did they change ur case status on the ceac website before they gave her an app.


I told her my wife was pregnant and I needed an expedited appointment for her. Two weeks later I got a call from Debbie stabenow's office saying my wife's case was transferred to the embassy. She didn't ask if I was in her district I could have been living in another state and she wouldn't have known. About two weeks after that my wife got a call from the embassy and they told her she had an appointment. I didnt check the ceac website. The outcome was just what I had hoped for. My wife's case was expedited. And only two months after case complete at NVC my wife had her visa in her hand. Alhamdulillah.

Yes it is as easy as that. My wife went to the US Embassy for our children's CRBA/Passport Appointment last week and she just told them "hey can I pick up my passport since it says issued on the website? ". They said no at first but she pressed on and pushed the consular officer to do it and he let her take it day :) she just showed them her passport copy and they have her her original passport with the visa inside.

She is going to the embassy in a couple of hours because our kids' appointment was rescheduled since they asked for the original affidavit of consent, and new 2x2 passport photos for my kids.

How long did they say you will receive the passports for you kids after your appointment




The Consular Officer said that they needed the ORIGINAL DS3053. It is a Notarized Document that states my wife has my Consent to apply for my Children's Passports. I sent it via DHL directly to the US Embassy, it will be there on the 24th, her appointment is on the 27th (not in two days as I previously stated).


They did not tell us how long, but they will tell my wife when to pick up my kids' passports when she goes to her appointment next Wednesday.

What happen with the kids


They said we were missing one document, idk which one, but my wife is gonna send me the paper they gave her that states what we were missing. Also they said the kids' passport pictures were not good enough so we have to retake them, and they told my wife to come back in two days once we get that document and retake their passport pictures.

My wife's Visa Pickup Date was on November 25th, she went in today for a CRBA/First Passport appointment and she was given back her passport with the Visa In it :)

It's unbelievable at the Embassy in Sanaa wallah. Do you believe my boys were scheduled for an appointment on Novembet 4th, and when my wife went they let her go inside the embassy and then they sent her back because they said my boys' names were not on the appointment list.

Then I contacted my senator and they scheduled her for an appointment for November 18th,

Hey Guys my case was completed by the Nvc on October 24, 2013 when do you guys think they will schedule my husband an appointment
And I have been in Yemen for 9 months now do u guys think I should go back to the u.s.a if its better for the process

My wife's case was completed by the NVC on September 3rd, she was schedule for an appointment on October 7th. She will pick up her visa on November 25th inshallahI One more week :)

My wife's case was an exception, it was expedited at the US Embassy because of an "emergency" (she was pregnant with my twins :)

I would guess according to what I've seen on this forum, it could take anywhere from 4-12 months for someone to get an interview at the US Embassy in Sanaa, with the average around 8 months.

I pray that everyone is united with their loved ones ASAP inshallah. The US embassy in Sanaa is REDICULOUS.

you don't need to be in Yemen for them to issue a CRBA or a passport for your child, your wife can be there with them and that will be fine.  You just have to fill out a paper of consent called Passport Issuance Consent Form and have it notarzied, you can download it from the website I provided you the link to.   the online appointment system for the embassy in sanaa DOES NOT work.  You have to email them directly.

The email to get a CRBA/Passport Appointment for your child is SanaaACS@state.gov

 

The documents my wife took to her visa appointment were the following: 

 

Original Marriage Certificate and Translation

Her Original Birth Certificate and Translation

Police Certificate with Translation

Her Passport

 

Also the complete I864 Affidavit of Support packet and supporting documents, and all evidence we had of our relationship like western Union money transfer receipts with both of our names on it and Pictures of both of us together.  

 

They asked very simple questions.  The interview was very short, less than five minutes.  Questions like, "where did u guys meet?" "when did u guys meet?" do "do you have children,"  "when is your husband's birth date?"  just basic quesitons

I tried that with my children.  My wife gave birth to them on October 3rd and had her Visa Appointment on October 7th, she took the babies and all the babies' filled out paper work and they would not accept the paperwork.  The consular officer told my wife, "this appointment is for you not for the babies."

 

You can try it, but I doubt they will process the child's CRBA without an appointment.  That's how they are at the US Embassy in Sanaa.  It's ridiculous.

The hard part is getting the appointment, otherwise the documents just have to be filled out, and some have to be notarized in the U.S.

Alhamdulillah after a couple of weeks of harassing the US embassy with constant emails, my twin boys were scheduled for a CRBA/First Passport Appointment for November 18th. So my family will reunite some time in December inshallah!

Hi all,
 
Good news, my fiancé finally got a call to come to the Embassy after being on AP since June.  His appointment is on October 21st.  Hoping that they will issue his visa on that day because we have been waiting so long!  Finally seeing a light at the end of the tunnel....

Then you have nothing to worry about. If the embassy is open on that day, then more than likely she will receive her visa. Congrats.

Did they give you a small ticket that says Pick Up Visa on November 25th?


Yes they gave my wife a small pink piece of paper that says "Dear Petitioner/Applicant for Case Number SAA-------, please come back for visa pickup on November 25th. Please bring ID or a copy of your passport"
