Yes, US Citizens and LPR's can go through the line together.  However, it may not be the US Citizens line as some airports (Seattle for example) have LPR's go through the visitor's channel.

That's baloney as long as you are not outside of the US longer than 6 months.  If you are outside of the US from 6 months to 1 year, then it's possible you may get extra scrutiny.  If you are outside longer than 1 year, then it becomes challenging.

Hello,

             I need advise. This long journey has devastated me mentally. My wife and step daughter are in India. I had initially filed a fiance visa in June 2012 that was rejected in March 2013. Following that we got married in June 2013. I filed an IR1/CR1 for my wife and step daughter in August 2013. I received an RFE in April related to my relationship which I successfully answered. I am going through the check list of documents needed for the interview. One of the items in the checklist is for Marriage Certificate. I have my marriage certificate for my marriage to my wife. However, I read the checklist item in detail now. The check list item states that I need a marriage certificate for all prior marriages. Both me and my wife were married before. I do not have the marriage certificate for my previous marriage and neither does my wife. We both do have divorce certificates for our past marriages indicating that we have legally ended our earlier marriages. 

 

What should I do? Is this a deal breaker? Aren't the divorce decrees sufficient ? I am planning on going to the interview with the documents I have because I am at the end of my wits. I cannot stay stuck in this limbo of paperwork and bureaucracy forever. 

 

Has any one encountered this situation before.

I have asked the admins to move to your countries forum. I have not heard anyone mention they needed pass marriage certificates.

 

You have t realize alot of the things listed on the website is old and outdated. You supplied your divorce decree to USCIS and NVC.

 

I am sure others from your country will chime in.

You have got some pretty good info already, but I just want to add my personal take on it.

 

I am American and my wife is Indian, I have a PIO due to marriage. The PIO route is better because for tourist visa you need to apply and you don't know for how long they will issue you the visa.

 

As a PIO, you don't have too much travel restrictions, you can fly there back and forth for as long and many time as you want.

I called the NVC 2 times and they told me that for mumbai consulate it was not required


I was very worried about it cause my husband could only get a date for the pcc on the 19th so thats why i called

Sometimes they can complete your case without PCC, and would require you to submit at the time of interview.

At least four working prior to your interview, you're supposed to submit your medical report as well as photocopies of all the documents you sent to NVC along with another set of original ds230, current dated, to VFS. Also pl make note of the fact that your x-ray is not required at the interview. It's to be hand carried with you to the US, where at your port of entry you'll hand it over to the immigration officer.

Yes it is important to send in your police clearance certificate along with the ds230 packet. If not, you'll just be delaying your process at NVC.

I'm surprised they wouldn't accept a Packet 3 or 4 letter along with a print out of the appropriate "Instruction package" as all of these ones clearly state the requirement: (Package 3 - K1, Package 3 - K3, Package 4 - K1, Package 4 - K3 ).

We have not filed K-1/K-3 petition, so can't really say for sure if Ahmedabad PSK office will accept Packet-3 or Packet-4 for K1/K3. Because anyone can print this package from consulate website and does not say beneficiary is asked to appear for an interview and bring PCC. We have filed I-130 application, my wife was told by PSK officer to bring a letter from USA Immigration/Consulate office which states that you have filed an immigration petition and they do want PCC for further processing. In I-130 application, if you do not send PCC in your IV package to NVC and forget to mention that you will submit PCC at the time of your interview then NVC may send a checklist indicating PCC missing, and PSK in Ahmedabad will accept that checklist document. Otherwise they ask for Interview letter from Mumbai Consulate to issue PCC. My wife has applied for PCC from local DSP office in Ahmedabad for NVC processing, and we will get PCC from PSK when Mumbai Consulate has issued an interview letter to the beneficiary.

Not sure about Ahmedabad PSK, but Bangalore PSK didn't require any proof that it was for immigration purposes. You just had to apply / schedule from the Passport Seva Project site. If you had already had police clearance done when your passport was issued, and it was issued by the same regional passport office (RPO) they may be able to finish things the same day as your PCC appointment; Otherwise the may ask you to come back after the police have completed a check.

Since my fiance's passport was from another RPO they had to do the full check. This involved the PSK forwarding the request to the police station near where we live (took 2 days for station to receive). They contacted my fiance and asked for a couple local references. After the local police station was done they forwarded it to the Bangalore police commissioners office who did some final check before forwarding the clearance on to the PSK. For us it took 2 weeks to get the PCC after the original appointment at the PSK.

PSK office in Ahmedabad has their own rules. They strictly ask an evidence which states that PCC is required by an immigration office or provide an interview letter issued by Mumbai Consulate to apply for PCC certificate. So We are going to provide PCC issued by local DSP police office which requires only NOA2 to issue PCC for NVC application.

I would rather prefer to ask Admin to create one Sticky thread on "India" region about Police Clearance Certificate. It's a very common issue where many people including myself are in dilemma about how to obtain and when to obtain Police Clearance Certificate. I will be more than happy to volunteer to create Sticky if regular users allowed to create one, but I need to know instructions to do it.

Dude all u have to do is that register on passportindia.gov.in, then fill online form for PCC or offline e form for PCC which ever u find convenient..make sure u have adobe 10.5.1 version otherwise u wont be able to get the form open ...
After that u submit the online application using apply link...u will get an Application Reference Number (ARN) .
after that u need to take appointment which will be either in next 30 days or next month...but u need to take appointment as soon as possible as appointments r not available on date which we desire...we have to book before 15 days to 30 days in advance....and appointment is only available for 15 mins per applicant...
It depends on which area u live..if u stay at Vadodara, Anand, Nadiad, Kheda area u r supposed to go to PSK Vadodara or else Ahmedabad PSK depending upon the area....
I live at Vadodara but i haven't obtained PCC but i have read all these stuff thru their website...n i will be applying within 2-3 months...
For passport PCC, u will definitely need original passport, local pcc , 1-2 residence proof...and 500 Rs/- fee...
U can take one or 2 Photo ID of yours if they need that...

My spouse lives in Ahmedabad. PSK in Ahmedabad said that they need an interview letter or a letter from immigration office to indicate they have officially requested PCC for immigration process.

This thread was just posted this morning saying NVC will waive PCC requirement if your file will be sent to Mumbai consulate.

I will ask NVC once my file has reached into their system. If you have already got your NVC case number, then I would definitely suggest to call them and verify this information and see all operators are giving the same information. Also share your findings on these thread so others will benefit from your query :)

Oh are you saying that In IV (Immigration Visa) package that we need to submit to NVC it's not mandatory to submit Police Clearance Certificate? Please confirm, as I am about to get my file reached to NVC in few weeks.
Based on your reply, I assume that NVC will waive to submit PCC if your file is going to be forwarded to Mumbai Consulate. But you need to get PCC original document when you go for an interview at Mumbai Consulate, is that correct?

Hi ,

I am an permanent resident of US ( unconditional green card holder) . My wife is USC. I got my permanent residence due to marriage to my wife. We are planning to visit India by Jan,2015. I am also planning on applying on US citizenship due to some talks from my friends and relatives.Here are  some queries:

 

a) Travelling to India from USA and back - Travelling as a permanent resident with US with with Indian visa VS travelling as US citizen with usc wife . Which sounbds better to you guys ? my friends and relatives told me to get US citizenship before making international travel .... that travelling as permanent resident may not be safe and may not have a easy and safe entry back to USA... also the CBP in USA POE and Indian immigrations treat US citizens and permanent residents differntly. Is there any chance like that ? I was planning to apply for naturalization next year but not before the trip.

 

b) If i get the citizenship , I need and OCI card to travel to India and wife would need either Indian visa or PIO card . Right ?

 

c) we have plans of retiring in India in future. In that case what are the options for me ( in case I take US citizenship) and for my USC wife ?

 

d) Do permanent residents and US citizens have different lines in Indian Immigrations ? what about in US immigration ?

So I googled and found out OCI for me ( Indian born just becoming US citizen) and PIO for my wife ( us citizen born in USA) . Now OCI fee is 295 and PIO is 385.

 

Now my question is can i just apply for tourist visa to india for both of us instead of PIO and OCI ?

 

tourist visa for 5 and 10 yrs is $171 and 6 months is $81 only , as per CKGS. WE are planning to cut off the cost for PIO & OCI and get tourist visa and get OCI and PIO later when we come back.

My wife recently applied for tourist visa of 10 years duration and we got her visa just a week ago. Its very easy process. You can do the process via mail, you don't have to go in person. Your wife needs to get US passport 1st. Also if she applies for visa, she will have to apply for renunciation of Indian citizenship.

Well I am still an indian citizen. I hold an Indian passport and US permanent grenn card. If I am right neither me nor my wife ( US Citizen ) can get PIO ....any insight on the visa part ?

Teah we can send full IV Package with all original and photocopies of docs for our application...No need to send PCC just mention in the cover letter that PCC will be submitted at the time of Interview at Mumbai consulate...All will be fine..

These are the list of Docs we sent to NVC. We were divorced previously and did not send previous marriage certificates. We got a false checklist for PCC and thats about it. 

 

Did you send the "present" marriage certificate to NVC? Did you call them up and talk to them? Did they confirm that they have your present Marriage Certificate? 

 

Documents for the Petitioner:- 

1) NVC Bar code page for Affidavit of Support Processing & proof of payment fees (Original + copy) 

2) Form I-864, Affidavit of Support (Original + copy)

3)Petitioner's Permanent Resident Card (Copy + copy)

4) Petitioner's Employment Verification Letter ( Original + copy)

5) Petitioner's Recent Pay slips (copy + copy) up to 6 months.

6) Petitioner's 2012 or latest year  federal Tax Returns ( copy + copy)

7) Petitioner's W-2 for 2012, 2011, 2010(copy + copy)

 

If applicable: Petitioner's Divorce Decree (Original + Copy)

 

 Documents for the Beneficiary:-

1) NVC Barcode Page for Application for Immigrant visa and Alien Registration & proof of payment of fees (Original + copy) 

2) NVC Barcode for completion and submission of form DS260 (Original + copy) and 2 passport photos. 

3) Applicant's Marriage Certificate (Original + copy) : This is the marriage certificate of present marriage not previous one.

There is a status updated date right below where you see ready or Issued.  for example, under Issued for my wife's case it says below. Last updated date was Feb 13th. What is it for yours? track that.

Did you log in to CEAC to check the status of the approval there? If its "Issued" then nothing to worry about from a consulate perspective and  should be in transit between Consulate and the VAC. 

 

If its in Administrative processing for more than 2-3 weeks then it could be due to lots of reasons.
