Hi guys,

 

A couple of quick questions. Any advice would be greatly appreciated.

 

#1 With respect to the evidence to support the petition to remove conditional status, from reading the instructions on the USCIS website it seems that the evidence "should" include affidavits. Are affidavits recommended?   

#2 The example forms here have spaces for a notary to stamp/sign. Is this necessary? Is a letter format with just a signature/date (with NAME/ADDRESS/SSN) of our friend to accompany their affidavit adequate?

#3 This one is stupid but, my card says "Card Expires: 07/03/14". I presume this means July, 3rd yes? I am a little confused because my DOB is in a different format with the day coming first (i.e. XX-MAR-19XX).

#4 I would like to travel in the fall. I understand that I will be sent a reply to extend my privileges for a year.  Is it a big deal if I was late to attend a biometrics appointment?

Yes you do. I'd call again and ask what the case number is so you can track it. This whole your bio is current when its two years old is really surprising me. Something must have changed just in this past month. Or USCIS customer service has taken to lying like rugs.


I spoke to a Tier 1 person and she said that my case number would be the same as the receipt number (on the NOA) and that it would eventually be searchable on the website.

What format are people's case numbers in? The receipt number on my NOA is in the format: EAC-XX-XXX-XXXXX.

The Tier 1 person was actually pretty helpful compared to other experiences with Tier 1 personnel. I did ask to be put onto a Tier 2 person, but then she explained what I mentioned above. I am not convinced that she is correct.

Update!

I rang the USCIS after 30 days of receiving the NOA and the Tier 1 person put in a request. The next day I got an e-mail saying that my Biometrics were current and that it is not necessary for me to appear at an ASC at this time.

That is good news, I think.

I don't have a case number to check the status online though. From reading this thread it seems that you get that number with Biometrics correspondence.

I submitted my I-751 and it was delivered on the April 11th. However, I have not received an NOA yet. It is taking longer than I would have thought. My check has not been cashed either.

 

It looks like others typically receive their NOA in less than week.

 

Does this suggest there is a problem?

I remember our immigration attorney saying that when the sponsor initiates the process, the beneficiary is not to be in US at that time. The sponsor is ultimately petitioning for the beneficiary to enter the US with intent to stay (i.e. excluding the VWP). I have not researched this aspect of the process too much, but I thought once you initiate the K-1 process, the beneficiary is not supposed to enter the US until the case has reached its conclusion. I am open to correction on this.

Today, I used a Kodak kiosk in Boots and I could print US sized photos. I had the choice of eight Irish passport-size or six 2" x 2" on one piece of photographic paper. Select ID photos and then choose your desired size.

Both i put disk in 1st in 2 shops and when I cold not ge anything for 2 x 2 i asked member of staff and both said they cant do 2 x 2, its quite annoying.


I see. I will go investigate the kiosk at my local Boots soon enough and I will let you know if I have success. If you don't think you can find a place to print them off at that size, you could just e-mail the file to your fiancée and have her print it out over there and then mail it to you.

I will have to do this soon. What I plan to do is take the photo with my own digital camera. Make sure the photo conforms to the criteria of the USCIS (e.g. white background etc...). Upload it to your computer and crop it to the desired size (do not change the aspect ratio). I think 2" X 2" is about 600px X 600 px. Once you have the picture edited save onto a USB key or memory stick. Then go to Boots or somewhere with a Kodak (or similar) kiosk. Insert USB/memory card and follow the instructions. You can then pick the photo sizes that you want.

I have not tried this yet for a 2" X 2", but I presume you can. You pay per piece of photographic paper. So for passport-size photos you can fit more than one of them onto one piece of photographic paper. Make sure you fill up the template of that one piece of photographic paper with a many of the same photo as you can. You will see what I mean when you look at the preview before pressing print. You will probably need them later on (e.g. interview, medical).

Hi guys,

My attorney is on holiday at the moment. We originally began the petition under the supervision of the attorney. We filled out the G-325A biographic form with her. One section of the form is as follows "Applicant's employment last five years, if none (so state), list present employment first". I was (and still am) studying for my Master's and not working. So, we included as the first entry "STUDENT from X to PRESENT".

All with me so far.

Now, in DS-230 item #32 asks to "List all employment from the last ten years". It does not explicitly state to include the present situation (i.e. not working, student), even though it is not described as employment of the last 10 years, as was the case with the G-325A.

Q1: Should I include it anyway, as I have a space to spare? Or should I be a stickler and not put it in?

Q2: I need more space for item #35, so I must attach an extra page. Can this page be a blank white page, which I have numbered the item I am supplementing? Or do I have to re-print another page 2 of DS-230 part I?

Hi guys,

My fiancée will need to co-sponsor me with a parent(s). How does one indicate this with the I-134 form? The issue being namely that there is not a box to tick to opt for co-sponsorship. As you all know the affidavit of support is brought to the interview at the US embassy. So is the correct procedure in this instance:

a) My fiancée fill out an I-134 with supporting material. The parent fill out their own I-134 form with supporting material. Then present both to the CO?

or

b) Have my fiancée fill out the form. But supply her supporting material plus her parent's supporting material. Then explain to the CO that it is a co-sponsorship arrangement?

Lastly, do I have to bring any of my own financial records? I don't recall being explicitly asked for this, but I guess it couldn't hurt to bring such.

In my case in Dublin, the Embassy sent Packet 3 over to our immigration attorney in Boston instead of sending it to me in Dublin. That packet 3 was sent on the 10th of August and arrived in Boston on the 16th.

Hi guys,

I got married the weekend before last after entering the US on a K-1 visa. :dance: This forum has been most helpful. We are gathering our documentation for the AoS forms.

We will be sending off my application within 12 months of the medical I did for the US Embassy. I have the vaccination form and the overview letter about my medical from the doctor who conducted that medical. It does say in the guidelines (for AoS) that if I apply within year of the that medical, that I will not be required to take one.

Is this the case in practise? I intend to include my copy of the standardised US form for the required vaccines and maybe the letter.

What are people's experiences with this? I am only concerned because: a) I don't want to spend even more money on something I shouldn't have to and b) I don't want the process delayed.

Hey guys,

I have a question or two on behalf of another with respect to filing the I-129F. He and his American fiancée are currently living in Ireland.

#1 Does the US citizen have to be living in the US when they file the I-129F? Does there address have to be an American one? I would think yes.
#2 It should not matter if the I-129F is mailed from a country other than the US, right? (i.e. before the US citizen moves back from the foreign country).
#3 After the US citizen files the I-129F, can the alien visit the US on the VWP? I was advised to not visit. However, if you genuinely are not intending to stay more than 90 days on that visit, then I would think it is probably not a big deal.
