If they are listed as dependents on your most recent tax return, then they will count in the household size. If you file your 2013 taxes without them as dependents and use the 2013 return for the I-134, then they will not count in your household size. If you use the 2012 return with them listed as dependents as your most recent tax return, then yes, they will count >. "..any other dependents listed on your most recent Federal income tax return.."

 

 

The OP stated that they support and claim no one else that they live with, so they are not all counted in their household size. Their household size is only 2, herself and her fiance.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ,

 

The income requirement is based on current annual income, not what you made last year and what shows on last year's taxes, unless you are self-employed. Your household member's income will not count for your affidavit. There is no combining of incomes with the I-134 for a K-1 visa. Your current income does not meet the income requirement, so you will need to find a co-sponsor or have enough in assets to make up for the shortcoming. Assets for a spouse/fiance(e) are usually counted at 3 times the income difference, though some consulates may require 5 times. There is no strict guideline for assets and the I-134, but in general, if you make $16k and need to make $19k, then you would need $9k - $15k in assets. Your foreign fiance's income/assets will not count, unless he has enough to self-sponsor and will interview in London. London is the only consulate I know of that for sure allows self-sponsorship.

Ok so basically in my case it would be myself and my husband seeing as to how I'm not responsible for anyone? Even though I claimed my friends children in my last tax return but they no longer live with and I'm not financially responsible for them right?

You would count in your household yourself, your fiance, and anyone you support...ie.. anyone you claim on your taxes. If someone else claims you on their taxes this complicates things a little. So when you file taxes next month how many people will you claim?

I'm actually glad that someone else has asked this same question, because last year a friend of mine lived with me.  She didn't work and I basically took care of everything therefore with her permission I claimed her children as dependent on me (she had no one here).  Since then she has returned to her country therefore I don't have any dependents anymore but they will obviously show on my tax return from last year.  Question is how or what am I supposed to do about that?  I'm not to this stage yet as matter of fact we're still at the NBC, but I'd like to get an in sight as too what would be the correct thing to do.

Hey there.  Trying to file for my K-1 next month but I have no idea how to go about printing my Facebook messenger and WhatsApp conversations between my fiancé and I.  People who have already filed: Did you just copy and paste? Take a screen shot?  Also, we have sent over 5,000 messages to each other. Do they want them all??? 

 

The other problem is almost all of our conversations are in Serbian... Does anyone know how I go about translating these?  Does it have to be professionally done?  Where do I find a professional translator? Do I submit the conversations in both languages?  I need some more information.  If you have been through this process before please help!

I know that the Whatsapp has like a button that says to email the conversation and it will send it to your email. you go to the main part where all your conversations are and hold your finger on the conversation to want and there should be a menu that pops up that says like delete, block person and email conversation (just did that myself a couple of days ago), I think that FB kind of works the same way since my husband did that for us (since I had deleted everything I voulfn't tell you for sure.

My CEAC status has been "ready" since the file was passed from NVC to the London Consulate; normal and expected.  I completed readiness 25 Apr and my medical is booked for 06 May.  It seems the case was touched on 29 April, but status is still "ready".

 

Is there another status ('case updated', or something) I should be looking out for pre-interview?  When can I ring DoS to find my interview date?  Having heard that interview letters have a habit of not arriving, I'd like to find this important date out for myself!

I was in the same boat as you are, and still am unfortunately. I am not done with school yet, we recently applied for removal of conditions ( which a lot of people have to do after living in US for 2 years?) They are now asking for more evidence BECAUSE we do not have enough financial evidence, because we live with my parents and dont pay anything untill I am done with school and ready to move out. . I actually just had my brother as a co-signer. Maybe you parents would be the best bet, somebody in your household. I did not have any problems... I was earning but only like 8,000 a year which was nowhere near what they were asking for ... you can mention it but they are looking at it NOW, not your future...hope that helps :)

No, I was talking about NON_REFUNDABLE tickets. Refundable you can just get money back. Non-refundable you can exchange them for another date with $100-150 fee plus difference in fair.

My bad on R/NR tickets, however even the difference between flight cost on non-refundable can make a big difference on international flights which is what we all are.

You're welcome. I do travel around the world a lot due to nature of my business, so it is pretty universal for all international airlines and thus around he world. Currently they are grouped into 3 major alliances. Prices in each (and thus for all world airlines) are pretty much dictated by its leading airlines: American, United/Continental, and Delta. These 3 alliances are competitive in nature and pricing is similar around the world. It is based on popularity of one or another route, competition on this specific route, distance, etc. However, pricing structure is very similar, so is increases in fairs based on the timing of purchase. Most of the income for major airlines come from business travelers like myself, not from tourists. Most of the time business travelers purchase tickets <1 week before he flight, so this is their opportunity to make money, so no matter what they will hike up the price even if they have plenty of space. By similar pricing structure I meant that % by which base fair in increased with time is about the same. For example, if base fair from Russia to LAX is $800, 1 week before it will most likely cost $1,500. If, in other instance, ticket from Algeria (base fair) costs $1,400, most likely fair price 1 week before will be around $2,000 or a little more.

Just a thought to add I did notice no matter when you buy the ticket it is always cheaper to buy a round trip ticket than a one-way. Like you say, for example, one way to Algiers is $2,500 and round trip is $1,250, it makes no sense to me. It is the same leaving Algiers as well, we are better off to purchase a round trip ticket even though he will not be returning. Can you explain or do you understand the logistics of this?

Actually, I bought my tickets before the interview and got lucky. I did buy tickets for date 1 week after the interview. We flew home together. Now, let's compare prices: If you buy after visa is in hand and if you want to fly within a week it will be extremely expensive. If you buy tickets ahead of time it will be MUCH cheaper. Let's say you did not get lucky and you have to change the date. Usually there is $100-150 changing fee... Still makes sense..

the last time I checked refundable tickets for an international flight are like double in cost. Its a no win situation and you are right YOU just got LUCKY.

Technically, you can include any supporting documentation including that of the foreign fiance's assets. Cash and savings account mean the same thing in this context. When using foreigner's assets for self support, they must be documented as being in the same name for at least several months. It's best if they are already in the USA.

Doing this, however, is a two-edged sword. Unless you have significant evidence the relationship is genuine, it tends to look like the foreigner is buying their way to the USA by using the US fiancee. They are going to consider the totality of circumstances, which we here do not know, so your chances of success are impossible to predict with any confidence.

I never even thought of them looking at it like he was buying his way in, omg, this really is a tough hill to climb! I was just thinking it would look better, a little cushion if you will, and even less likely to be a burden on our government. As far as meeting the necessary income I am good. I guess the old saying is true, never volunteer too much information, Sheesh!!!

It depends on the embassy. Most embassies would only allow it if the bank account is US based, and ideally in joint names (though the later is not absolutely necessary).

I own rental property as well and just finished my taxes. I use TURBOTAX and it allows you to fill in the appropriate information for rental properties. I printed it out after processing and will give this to my fiance for her interview. Try to include any income, paycheck, checks for rental property, anything you have to submit for your interview. Thank you for the info, I only began renting these properties in November so I was planning to just file them on next years taxes since it was only 2 months of income. Also they have been paying cash, do you think that will be a problem? I swear I didn't even think of that, the cash is so easy, although I do have copies of the receipts I write for them. We still haven't received our NOA2 yet, however I am trying my best to prepare for the interview. I am worried mostly about the i-134, I want to get it right the first time and have all my bases covered. Here is my dilemma I have not filed taxes in more than 4 yrs. There has been no need or legal obligation to do so. I have been able however to live quite comfortably with nontaxable income during this time. That being said, and bearing in mind we are always a year behind in the tax world, my 2011 bank statement is more than good to show support for my fiance. If I have to account for 2012 (taxes do not have to be filed until April 15) I might be in trouble. The thing is I own rental property, I did not begin renting until November 20, 2012 therefore other than notarized lease agreements,bank deposits and proof of property ownership I have nothing else to verify this particular income. If I can include it with these documents and file my taxes for this income in 2014 then I more than meet the guidelines for the i-134. Also my fiance is covered with health insurance which is paid for annually, so he is covered until March 2014 and if I go by the timelines I am hoping the interview will be no later than April.

Please if anyone can answer or knows, will I be allowed to include my rental property as income and will the documents that I can produce to verify this be sufficient?

I filed my papers for I-129f with this guy that has processed a lot of peoples cases. Only thing is its been over a month now and USCIS has not received anything. :blink: I think he may have just took my money because I paid him $340 in cash and another $300.00 also in cash for his services.. It's either that or he just didn't send my papers in yet.... :angry: gahh I'm so frustrated. The person who processed these papers told me he brought his wife here in 3 months flat. I feel like at this rate I won't be able to see my girl until fall or maybe even next year :crying: I just hope I receive some kind of notice soon to know at least they are starting to process my case. Hoping for the best..


Oh my, I am so sorry! Really try to find this guy if for no other reason but to keep him from taking someone else's money, yes and report him. I hope he didn't rob you but I'm thinking he did. Anyways take Gary and Alla's advice count this as a lesson learned and do it yourself. It is NOT hard, just time consuming frustrating and tedious. Hey there, I saw the USCIS link you were looking at. Yes, you still need this for the fiance visa. You will need the I-864 when you adjust status after getting married.

The information on that site appears to be about the I-864 affidavit of support. You need the I-134 at the K-1 visa interview, and you will need the I-864 after you are married and the beneficiary is filing for adjustment of status.

USCIS web site only shows 2012 poverty guidelines (that I can tell) but I noticed a post here in VJ where other sites are already showing an increase for 2013. Maybe they are basing this on statistics or maybe they bump up the rate if you use their services I really don't know. My question is, does anyone know if there are new guidelines for 2013 from USCIS and if there are will there be or has there ever been a clause of some sort for those that files before a certain time would fall under 2012 guidelines?

hi everyone! i hope you are all having a good day.

i would just like to ask few things (especially to the manila K1 applicants)

1. i called a travel agency (hoping to catch some cheaper flights) and they asked me if i have an immigrant or non-immigrant visa, i answered "immigrant" since the K1 visa was categorized as such, so they gave me a flight date and a somehow cheap air fare deal for it. (just around $600 +)
then i said "wow, that's good, since i don't want my fiance to worry about the money and i'll take care of it myself" then the travel agency respondent suddenly said that K1 visa have higher visa air fare charges...then they gave me a higher priced ticket! ($800 +) :(

now im back looking for cheaper flights, i need to schedule a flight ASAP since i want to be with my fiance before April 13.

is there really such a thing as higher air charges for K1 petitioned visa travellers?


2. can anyone give me an advice on how to handle the "point of entry" stuff at the airport? my fiance will be there to fetch when i arrive but should i bring anything more documents? (except the yellow envelope thing, passport and CD from St. Luke's medical exam) also if anyone can help me about the process at POE.

i'm sorry if these are dumb questions, i'm just too nervous right now. i'll be leaving outside the country (and will live there) for the first time in my life. though i don't worry about living at US too much since my girl is with me.

In a couple weeks, you can email the embassy and inquire with your case #, if they received it they will email a "packet" of information. It will give you instructions for what you will need (forms, documents,approved physicians for medical, etc) and for scheduling an interview.

It can be a long wait for an interview appointment to be scheduled though-- maybe they're moving faster now, but last year it took over 3 months from the time we emailed the embassy for them to schedule an interview (4 months after it left NVC).

Thanks for the information, I hope they aren't so backed up by now, but we have waited this long and others even longer, God willing we will all come out of this on the happy side.

OK so it takes money, I would gladly pay more money if they would just move these petitions in a reasonable amount of time. And how are the fee's that are paid and not refundable distributed and broken down? If you figure the fee's multiplied by the amount of petitioners that's a heck of a lot of money.
