Usually, Consulates and Embassies will have people speaking the local language. And if not, they probably have certified translators to intrepret the interview.

But more than likely they will have someone speaking your SO's language.


I am personally curious to know whether it would count against the intending immigrant if their English skills are limited and feel more comfortable doing the interview in their native language.

I have heard mixed reviews, though it is always hard to say - in the case of someone who did not speak English in the interview and was then denied the visa - whether there were other factors involved as well.

Any thoughts on this from anyone else?

I think that's about it for now. I also have a question regarding the I-864 in the immigration new thread that I am still seeking an answer for. I thank everyone here for the help and knowledge and can't wait to return my knowledge to someone else.

Thank goodness someone else asked this question! It seemed like everyone's spouses spoke English at the interview. I speak fluent Portuguese and my husband is learning English but I am not sure he will be up to par for the interview... having read some reviews saying that it may make a difference in the outcome based on whether or not the intending immigrant speaks English at the interview, I was getting a bit worried... but the answers that people have given here makes more sense, regarding the couple's ability to communicate, etc.

My personal relief aside, I would say that yes, the interviewer should always be bilingual (English and the national language in the given country). My understanding, at least for Brazil, is that any documents sent to NVC need an English translation, but anything sent to the consulate doesn't (since they should generally be bilingual there.)

Once you pay all your fees to the NVC, there are no more visa fees associated with a CR1 visa. Maybe a fee to have it delivered after approval but you're pretty much done.

We brought the X-ray to the interview but they did not ask for or look at it - so I would say that it is not necessary. Only the sealed envelope from the doctor is required.

We stayed at Hotel Itajubá, located at Rua Alvaro Alvim, 23. It is about 3 blocks from the Consulate and was pretty decent. They have a nice breakfast, which opens at 6:30, so you will have time to eat before you go to the interview. It cost R$130 (no added tax), which is the cheapest I found.

We only have five weeks until the interview and I am not sure when the package will arrive in the mail - so I would like to be prepared for the medical exam sooner rather than later.

Can someone please clarify the following?

1. Can the check up be done only by a Consulate-registered physician (i.e. from the list of doctors they give on the website) or any doctor?

2. What is a panel physician?

3. Exactly what tests are needed for the check up? Will the doctor know this or do we have to tell them?

We had the interview at the Rio de Janeiro Consulate yesterday; it was quick and painless and I will give you all the details here!

We got to the Consulate just before 7 AM. We were the second ones on line; about 20 people showed up after us. Around 7:30, a woman came by and checked off our names on a list and marked down where we were in line (i.e. put a 2 next to our name).

At 7:40 we went in, went through security check (you are allowed to take your cell phone as long as it is turned off). We went up to the second floor and sat down. A very nice young woman sat at a desk in the same room (all of the windows are in an enclosed cubicle) and was available to answer questions, etc. She came by and gave us a list of documents to put together. I told her that we had already sent most of the documents to the NVC. She said, no problem, just put the passport, one 5x5cm photo and the medical exam envelope together to hand in. After about ten minutes, she called us up (in the order that we were in line) to go to one of the windows. My husband handed in the above mentioned documents and the woman at the window took them. I also gave them my joint sponsor's tax return, since she had filed a tax extension and the NVC didn't receive the actual return. (I don't know if they were actually going to ask me for it or not, but the interview letter gave general instructions to bring the 2007 tax return if a sponsor had filed an extension.) The only other thing that the woman asked for was my husband's military card. We didn't send it in to the NVC because he had not actually served in the military. However, he has a card stating that when he registered for the military, he was excused from initial military service because they had too many people enlisting. So he went and made a copy of his card and handed it in with the original.

We sat and waited for about 45 minutes before they started calling interviews. The first people to be called in were behind us in line but I believe they were called in because they were missing something important in their application. I didn't hear the whole conversation but it sounded like the Consulate did not have a record of them paying the $400 fee (to NVC I assume, unless he had done DCF); the husband (American) had a receipt stating that he had paid it, but I don't think they were going to accept it. The next person that went in was the first on line; a young guy - he was in for about 10 minutes and came out with an approved visa.

While we were waiting, the young woman who first greeted us talked to us about what happens after the interview - namely, you will either receive the visa right away or your case will be determined as "pending" - if there are missing documents or evidence, etc. When you receive the visa, it will come with a sealed envelope (as we all know) and that the envelope must be completely intact when we go through the port of entry. She said that every week someone comes into the Consulate crying because their envelope had been ripped and POE would not accept it and deported them. She stressed that it is extremely important that the envelope is perfect when we get to the US.

We were called in next (about 9:30 AM). I had a bunch of documents and photo albums and evidence, but the woman didn't ask to see any of it. Actually, she moved through the questions pretty quickly, so I didn't even have time to offer them to her to see. She started out saying hello my husband in Portuguese. I entered a minute after him and said, in Portuguese, that I was his wife and asked if I could stay for the interview. She said yes, then said, wait, who are you? I said, his wife, and she said, ok, no problem. She continued the rest of the interview completely in Portuguese and didn't ask if either one of us wanted to speak English (nor did she speak English to me). She was American but her Portuguese was quite clear and good (my husband said so too). While she asked questions, she was flipping through our documents and stamping "Approved" on them, so I thought that was a good sign.

Before the questions, she had my husband take digital fingerprints and sign part 2 of the DS-230. (I figured that was already a good sign.) She gave me back the original documents that I had sent to the NVC. Then we raised our right hands and she swore us in.

Her questions:
1. (to my husband) Have you been to the US before? (no)
2. Have you ever applied for a visa to the US? (no)
3. When did you get married?
4. Is the first marriage for both of you?
5. When did you meet?
6. (to me) Are you here on vacation now? (No, I have lived in Brasil with my husband since Feb 2007)
7. (to me) Did you visit him between the time that you met and when you moved here? (Yes, twice)
8. Have you met each other's families?
9. Do you have any children? (Yes, my husband has one from a previous relationship)
10. Will your son stay with his mother or go with you? (For now, he will stay here and then we will apply for a visa to bring him to the US)
11. Does his mother mind him going to the US? (no)
12. (to me) You have a joint sponsor, (gave her name)? (yes, that's right)
13. Is she your mother? (no, my aunt)
14. Is she married?
I think those are all the questions though there may be one or two that I am forgetting.

Then she said, "well, Rodrigo, we have a visa for you. Go ahead out to the woman at the desk and she will give you instructions on receiving your visa." Wee hoo! The interview went fast - 10 minutes at the most - and felt pretty easy. I was almost disappointed (but not really of course), since I had brought so much stuff to show her. It felt like our visa was pretty much approved before we went in and she was just checking all of our information for validity, etc. I thought she would have asked me more about what I was doing in Brazil, what our plans were to go to the States, etc but she didn't ask.

We went out to the desk and the woman wrote my husband's name and case number on a green piece of paper. She then sent us downstairs to the TNT (express mail) desk, where we filled out a postal address card (for my mother in law's house, since we are visiting them in SP), and paid R$24. They said the passport and the immigration envelope (to be handed in at the port of entry) will arrive in 3 business days. We were out of the door at 10 AM. I almost feel silly for having stressed out so much, but there was no way to know that the interview day would be as easy as it actually was. kicking.gif kicking.gif kicking.gif

On the RFE I received, this is what it stated regarding affidavits:

You may submit an original affidavit to show that third parties have knowledge of the bona fides of your (I think the meant YOU) and your spouse's marital relationship. An affidavit should be supported by documentary evidence and must be sworn to or affirmed by at least two people who:

a. have known you and your spouse since your conditional residence was granted and have provided information about their relationship to you and your spouse;

b. have personal knowledge of your marital relationship and have provided a detailed explanation about how this knowledge was acquired;

c. may be required to testify before an immigration officer regarding the affidavit's content;

d. have provided their full name, address, date and place of birth.

I hope this will help you and anyone else looking for the affidavit information on the forum.


Did you send in affidavits and then they sent the RFE? Why do you think they sent the RFE? It doesn't sound like affidavits have to be notarized... unless you think that's why they sent the RFE? Thanks!

Hi! We sent our package this morning! uhm one question though. We just moved in to our new place like a month ago,do I have to do a change of address? Although I put the current address on the application. and attached a list of all the previous addresses w/ the application? now I'm worried. Anyway, I sent it via usps,priority and certified mail to CSC.


I am pretty sure you are supposed to file a change of address within 30 days of moving. I think you can do it online - I don't know the link, but if you google it, it will probably come up. I would do it ASAP so they don't get confused.

NOA 1 received today. Hope this process goes a lot faster than the original CR-1 app did!!

However, you listed my NOA1 as August 16, the same date as when I sent the I-130 to VSC. In actuality, I have still not received an NOA1 yet. My lawyer says to expect it in a couple more weeks -- which will make two months. Is that normal?

Hi there

I am new to the forum, though I have perused the site quite a bit. I am a US citizen living in Brazil with my fiance (husband, as of next week). I think that we will be applying for a CR-1 visa, but I am getting all of the information together before we get started (and, after the wedding, obviously).

If any of you would be so kind, I have a few questions...

* Do I really need a lawyer, or do you think I can get away with minimal legal assistance?

*Also, does anyone have an opinion on whether it is more or less difficult to get a K-3 versus a CR-1?

*What are realistic timelines for acquiring a K-3 or a CR-1 visa?

well, I would play it safe and just have it translated by a certified translator... you don´t want them to send it back to you later -- if you have the time, anyway; when I got mine done, it was only a couple of days.

Actually, I am confused, because the USCIS website, as I said, lists the I-130 petitions being processed now as only of January 31... But there are people on this list that have applied to VSC (like me) later than that date, that have already received their NOA2. Anyone have an explanation? Is there hope yet?

Oh and if anyone updates the list, please change mine to 8/16/2007... I typed it wrong and the board won´t let me edit it for some reason... not too savvy with these technology things. Thanks!

Adding myself on here.... I have to admit that I am a little bummed by the processing times listed on the USCIS website -- VSC is only processing I-130 petitions from January 31 now? wow. Guess we´re in it for the long haul, eh?

Hi all

I have sent in my I-130 (August 2007) and received the NOA1 (December 2007). I was just reading over the I-130 FAQs on this site and saw this:

--On the Affidavit of Support Fact sheet, it says that I have to be residing in the U.S to sponsor my relative. Is there any exception to this rule?
Yes, but the exceptions do not apply to most people. You should probably check with the CIS to see if you are one of the exceptions, but for people who do not qualify for the exceptions, there is no time limit set for you to re-establish your US residency. Basically, simply going back to the United States, staying a couple of weeks, and opening up a bank account, leasing/buying an apartment or house, or getting a job re-establishes your residency in the U.S, making it possible to sponsor your relative.

Now, I have been living in Brazil with my husband for the last year, and am intending to stay here until he gets the visa to return to the States with me. My lawyer doesn´t seem to think this is a problem, but does any one else have any insight or experience into this? I also filed directly through the USCIS, since I did not meet the Consulate´s residency requirements to file via DCF.

I realize I will need a co-sponsor and I have listed a relative´s address as our intending address for when we return - but does anyone think i will be denied because I am not physically in the States during this process?

I would appreciate any insight into this, because I hate to worry for no reason (or be ignorant of an important piece of information, if that may be the case)!
