K-1 Fiance(e) Visa Process & ProceduresForeign Names
QUOTE (CraigCam @ Feb 29 2008, 07:24 PM) <{POST_SNAPBACK}>
First, I want to say 'Hello' to everyone. I just found this site yesterday and I can't tell you all how relieved I was. I spent yesterday researching the guides and forums and found answers to most of my questions.

One question that I wasn't able to find an answer to was, how my fiancee's name should be listed on the Fiancee Letter of Intent to Marry? She is Vietnamese and the custom there is to give the family name first then middle and finally the given name. Should she use this form or the American form of given name first and family name last?

Finally, good luck to everyone here. I'm sure you will be hearing more from me in the coming months.

PS-Vietnamese is a crazy language with the letters having so many variations, but it is still an alphabet based on Roman letters, right? I mean, it's not necessary to fill in question 16 on the I-129f(write her name and address in the native alphabet), is it?

I think you are just over excited tongue.gif .. Just fill everything as it is and you will be fine.. put her given name in the given name field and her surname in the surname filed and how ever she spells her name in her native language.. just follow the instructions biggrin.gif

K-1 Fiance(e) Visa Process & ProceduresGreencard
QUOTE (agnesmarx @ Mar 6 2008, 06:53 PM) <{POST_SNAPBACK}>
I came to US last Febreruary 7, 2007 and I have a greencard, I am married to an American and I came here through Fiancee Visa.
But our marriage is not going work because we both have a lot of differences in life, like of having a child, he dont want us to have children, and he is not willing to have one, Before I married my husband I have someone I talk 5 years ago when I was in college on that time, We both found out that we still have feelings for each other, He is willing to give up his life for me, He is willing to marry me and he is very much willing to have us children and he is an American too. Why should I do so that I can stay with him and separate my husband? And If I go back to Philippines, Can I still comeback to the US since I have my Greencard until it expired? I want to divorce my husband and go with him, And if I let my Greencard expired and stay in Philippines Do you think someone can still petitioned me eventhough I was already been petitioned before by my husband? And when my greencard already expire How long it takes before someone can petitioned a new visa for me? Please help me, I dont what to do, Hope that you can answer my questions, Thank you...

I think there is restrictions on your Green Card for this purpose. To see if the marriage will last and to prevent fraud, I don't know what will happen, but good luck to you and hope your next fiancee have a good lawyer.

K-1 Fiance(e) Visa Process & Procedurescover letter for evidence?
QUOTE (caityrose @ Mar 6 2008, 08:14 PM) <{POST_SNAPBACK}>
Hi everyone,
I am in the process of putting the I-129F packet together, and I have plane iteneraries, photos, receipts from purchases I made while in Mexico, emails, etc... to use as evidence. I feel like I should include some type of a cover letter before my evidence explaining what I have included as evidence. Is this unnecessary? I just want to make sure the packet is clear and organized so it's easy for the adjudicator to understand.

Thanks for your help!
Caity

You should write a cover letter and summary of how you two met.
I made the mistake of no cover letter and received 2 RFE's.
Just explain how you two met and I think your petition will be approved faster.

K-1 Fiance(e) Visa Process & ProceduresPregnant beneficiary while doing k1 process
QUOTE (frank_rhoge @ Feb 7 2008, 11:49 PM) <{POST_SNAPBACK}>
Hello,
I'm just new here but we had started our K1 process.

We submitted this January 22, 2008 and received NOA1 last January 25, 2008.

My situation is that, I'm now 5 months pregnant...
My due date will be on June 22, 2008.
We haven't added the baby to I-129F Petition as he/she is not yet born.
Will it affect our process?
If the whole K1 will take 6 months I'll probably be giving birth before my interview.
I want to know if the baby can go with me to the US eventhough he/she is not included in the petition, although we have stated in our I-129F evidence that I'm currently pregnant with my fiance.

Want to know more about our case.

Thank you so much!

My Fiancee was pregnant at the time of our petition and she gave birth on Dec. 13, 2007. We are still going though the K1 process. I was able to go and file the Consular Report of Birth Abroad (report of birth for US Citizen) for our child at the US Embassy. After we got our Packet 3 we added him as child accompanying.

I have been working out of town for the last month and a half, and the USCIS sent me a letter on Jan 30,2008 asking me a question in reference to convictions by court or court marshals (I have neither). The response was to be sent before March 3,2008. I got back in town on March 7th..I'm sending the response out ASAP, but I noticed it says no extensions. Am I screwed here or is there hope? Thanks in advance.

Sorry to hear that. You should turn it in and then call them and see what they say.

K-1 Fiance(e) Visa Process & ProceduresMarriage not annulled before filing K-1
QUOTE (Dogwood_Poet @ Mar 6 2008, 09:34 PM) <{POST_SNAPBACK}>
I am asking this for a friend of mine, his fiancée was in a brief marriage 10 years ago and the man walked out after a couple of months and has not been heard from since. She never got an annulment due to the cost and never thought she would marry again. In fact, she was not sure if the marriage was ever filed.

He started the petition and now she has to get an annulment or her lawyer said the husband could be declared dead since no one knows how to contact him or have heard from him in several years.

So, is the current petition now trash since she was not legally available to marry?

Should he just withdraw the petition and wait until everything is done and start new?

Thanks for everyone's advice!

That sucks.. how can anyone get married and then not know if it was filed or not??
They both had to sign papers to be registered. I don't think just 1 person can do it.
Either way she have to be not married to file tongue.gif

Ok, so I understand the basics of why you need to get a medical exam at the embassy as part of the visa approval. What I don't understand is why the Beneficiary needs to sometimes undergo such tests as ECG, breast exam, ect.....Very strange. What is the reason behind such tests, since I thought the exam was to check for infectious diseases that could be transmitted to others, such as TB, ect... blink.gif

I don't know why, but some of the things they did to me were WEIRD and the nurse has told me that she doesn;t know why she's suppose to do that but thats what they require. They have even checked if I am really a Girl!!!!!!!!!!!!!!!!!!!!! It was embarrasing, but we do IT ALL for love!

I think since your there for a medical exam and paying for it, might as well get the whole works .. your Fiancee maybe happy knowing he is engaged to a real girl.. haha.. biggrin.gif

My fiance has his immigration interview on the 12th but his medical is not until the 20th. He called the Embassy and they said that it was fine to still have his interview and the medical can be sent in later, but they will not issue the Visa until they have the medical. However, we just noticed that he has to have his passport for the medical, but the Embassy will probably have his passport after the interview so they can put the Visa in it. Do you know if the doctor will accept the passport color copy if he explains that the embassy has his original passport, OR will the embassy let the doctor send in his passport with the medical exam?

Why don't he go and have his Medical done earlier?

I see, so does this means that there is only 1 medical facility that can do his medical exams for him??
any case I don't think the embassy will issue a visa until they see his medical results. You may have to make another trip to the embassy for your visa.

I have read on the internet that once a US citizen and a foreign fiancee have applied for and received the K-1 visa for the beneficiary, if they don't get married and the foreign fiancee returns to her native country, the US citizen can NEVER AGAIN petition for a K-1 visa for the same foreign fiancee. I have ALSO read that the exact opposite is true.

Does anyone know which is correct?

The government can not stop people frombeing with and marrying the persons they love. If the couples don't give up, there is always a way to go around their problems. If you first don't succeed try again.

You *MUST* have met your fiance(e) within the last 2 years at the time you file your K-1 petition. If not, your petition will be rejected.

Isn't that "you must have SEEN (visited, been together with) your fiance(e) in the last 2 years"?

Yes, you must have met her/him in person within last 2 years from the date you file your petition.

I had a similar situation. I started a new job and moved after I filed my petition. I just called the USCIS to change my address. They informed me since my application was already approved and I was able to get my mail from my previous address still, they informed me I didn't need to report my address change with them unless I wanted the NOA2 re-delivered to the new address, which will take about 1 month for them to resend. So they just gave me the number to the NVC to change my address with them since they are now handling the process. I called the NVC and changed my address with them. It was a quick and easy process. A week later I got a letter in the mail stating they have forward my application to the embassy for further process.

Hi-
I have a quick question for any of you whose fiancee has recently been to their medical interview in Bangkok or Chiang Mai... Do you know exactly which vaccinations they were required to get (aside from the HPV one, my fiance is a guy so that won't apply!)??? From what I've found and based on his age (32), I think he's going to need to get Tdap, MMR, and Varicella, but I'm trying to confirm that so that we can get started on the series and maybe even complete them by the time he has to go to his medical interview. Any help would be appreciated! Your fiancees should have been given a copy of the sheet that lists their vaccinations after they had their medical...

Congrats to all those recently approved and traveling to the States! We hope to be not too far behind you all!!!

-Jessica

I think if he doesn't know what vaccine he have taken already they will give him the standard required shots. The cost should be about 3000 baht for the shots and medical exams.

Ooops, I'm a bonehead. The "new" packet-3 is the standard packet 3, there's a different link for the K Visa Packet 3 which is the same as what I had before. Sorry for the false alarm.

But I figure I will confirm with everyone here:
1. K Visa's submit a I-134 still, correct?
2. The Visa fee for K applicants is still only $131, correct?

Also, where on the Embassy is the text that says the Police Certificate should be provided free? I don't see any mention of cost. Also, I thought I had read somewhere my fiance needs to bring a certain size photo to the police office in Bangkok for the certificate. Is that correct? What is the size? I assume she just needs that, her id, and her house registration?

I gave a notarized I-134 with a letter from my employer and copy of my passport to my girl,
She went to the post office and paid $131 for the visa.
For the Police record I think my girl paid 2000 baht, and just needs to bring a 2 visa or passport photo 2inch by 2inch size, original and copy of her passport,id card, household registration, name change certificate if any and divorce papers if any. You can see the Police Certificate instructions in the packet 3 website.
