The same thing has happened to many of us at HCMC consulate. The best way to overcome a blue slip is for the petitioner to be there at the consulate to deliver any documents needed to convince them the relationship is real. I haven't heard of any one keeping the case there after a green slip. The case is sent back to NVC and then to USCIS where it will most likely expire and you can file a new petition. That is what happened to me.
CSC told me it is returned from the consulate as expired and they would not re-open it or send me any notification. There are some recently denied visas from HCMC that have had an NOA sent to them from CSC that stated they received the returned petition and it would be adjudicated in the order it was received but I haven't seen any action taken on them yet.

The best way to gather information on your case status is to contact your Senator or Representative.

I am learning as I go. My old case was touched at the same time my new case left NVC to the consulate. I don't know what the relationship is between them. I called both NVC and USCIS and ofcourse I got no answers. I contacted my Senator for help.

Yes, you can. The rest is irrelevant. No one sees your medical bills. All that matters is your 1040, W2, and letter from the employer.

I was just reading the I-134 instructions and it only mentions a copy of your last tax return if you are self-employed, other wise you only submit in duplicate, a statement from your bank and employer. I am believer of never having too much evidence but I was curious where info about submitting the 1040 and W2 comes from? I am presently helping someone through the visa process and it has been a few years since I went through this. Thanks!

Good Morning,

 

Maybe I asked a dumb questions. However, a few days ago I posted a question about what will be needed for the DS-260 for my step daughter who is under the age of 16?? I have filed the I-130 for my 3 year old step daughter to come here and live with her father and I. We are now at the phase to complete the I-864ez and the DS-260. I have the I-864ez and I will be sending the packet to the NVC tomorrow via Fed Ex. I am also working on completing the DS-260 for her and gathering the required documentation. It is not clear to me if I will need to provide the ORIGINAL FINAL DIVORCE DECREE for my husband previous marriage?

 

Can someone please confirm if I will need this to file the DS-260 for my step child?

I have also starting gathering what I will need for the DS-260 phase. I am the step mother filing for my step child. I am wondering if I will need to provide the original FINAL divorce decree for my husbands divorce?

Yes, it is one of those unfortunate situation.  What makes it worse is she was one of my closet friends and he is my husbands best friend for over 30 years. We all thought it was a match made in heaven and it was, until he got here and she changed and drastically!!! I feel very bad for him, he has never left his country, thank god he has us and thank god we only live about 3 miles apart and we have managed to keep him sane. We have him over as much as we can or go visit him. We also make sure and share any food and products we buy or bring home from Jamaica.

 

My adjustment has gone very well, a few bumps, but we have overcome them and it was pretty minor issues! My husbands daughter will be coming soon, at least we hope, we are currently waiting for our case to be complete at the NVC :).

I am trying to do some research for a friend of mine. My friend entered the US on a IR-1/CR-1 visa, he entered on 1/16/2014. However, his wife did not pay the new green card processing fee until after entry. She says that she has paid the fee on Feb 25, however he is still waiting to receive the Green Card. It seems too long and I feel that he should have already received this.  Anyone have any idea how long it should take for him to receive the actual green card in the mail? Also, shouldn't there be a tracking number for the green card?

Yes, it is possible. He has been issued a visa because he is the Spouse of an American Citizen. What you get after your interview is your visa number to go along with that visa. He has a visa ready in his name but cannot travel to the US yet because he does not have the visa number and it is not yet stamped in his passport. This info came directly from USCIS.

 

Sorry, he has not been issued a visa yet!! That is done at his local embassy, If he had a visa, your process would be COMPLETE!!! FYI, he can go all the way to his interview and still be denied the visa. Being a Spouse of an American Citizen dose not guarantee a visa either...

In my personal experience, I had filed for my ex to come from Jamaica to the US back in Nov 2004, I answered that yes I had filed for someone before, I also provided a separate sheet with an explanation. So far we have been lucky and received our NOA2.

I think if you are honest with a written explanation you should be fine, however as they say on VJ, no case is ever looked at the same or by the same officer. Honesty pays off in the long run.

Good Morning all - I am wondering if anyone has ever heard of requesting a date sooner than what the embassy had scheduled for you. My fiance and I were just give our date by the DOS and it was 8 weeks away - February 22nd. That is rather far away...so I was just courious if anyone had done this and had been successful.


From what I have read, they schedule appointments as they have availability. The only way to know is to try and send them an email. I am not sure if they will or not. Typically, from what I understand, there needs to be an emergency situation or a strong reason as to why you are requesting an earlier date. I will tell you, what my friend told me a few weeks ago "A closed mouth never gets fed". I sent an email and had a very, very positive response from the Kingston Embassy...

This was refering to naturalization but I think it will be applicable to I 130 as well.


This is not the same situation.

The site talks about transferring naturalization cases from one office to another. After initial processing, naturalization is handled at an applicant's local USCIS office. When a person moves while an application is pending, their file often has to be transferred to the local office closer to their new location. And, as noted, that movement of one individual file can cause delays, for a variety of reasons.

In the case of the CSC-TSC transfer, you are talking about multiple file transfers, all at once, with the transfer being generated by the service center (not the applicant), and the actual transfer moving between service centers (not local offices).

Y'all should be okay, and it should speed up the process compared to staying at CSC.

Yes. You could be correct. It might just be the five-month goal. I have acknowledged that, and because no one has received similar information, it is probably true. I just had to change the address of my fiancee after NOA1 (and before NOA2). Before I did, I called the USCIS help customer service line twice:

1. My first call was before the move. The agent told me to just call back, give the address, and they would send the update to CSC. (The agent during the second call told me they do not do this.)

2. During my second call (when I thought I would be providing the new address), the agent gave me different information. I told the agent about my first call, and he confirmed the approach with his supervisor.

Based on the second call, I actually did the following: The agent told me to write a letter to CSC at the address listed on my NOA1 (US Citizenship and Immigration Services, California Service Center, PO Box 30111, Laguna Niguel, CA 92607-0111). The letter should clearly indicate the new address for your fiancee (the beneficiary). I also stated in the letter the date of the move.

I asked the same question to both agents about potential delay. I was told the update would not cause any delay.

In another thread, I read that, when a fiancee changes her address, we should later double check with NVC (when your application/file is there) to make sure that the address change actually occurred.

Based on VJ reports, CSC appears to have approved an I-129F (NOA2) on 10-14-10!!! And the original NOA1 was from June, which means it is not just an old application finally getting approved:

Great! So now I wonder if the better road would have been to get married and file a I-130 since they seem to be processing them faster now :wacko: Too late for that! I have chosen my poison and need to stick to it.



For the most part, it is my understanding that neither is necessarily faster. If you look at the timelines for CSC's processing of I-130s overall, they have a larger gap of time between the NOA1s and the NOA2s compared to the I-129Fs. That might be the reason that CSC seems to be trying to catch those up a bit. I still think the I-129F was an acceptable choice.

The other non-strategic issue for me is that I do not really want to spend the first six months or so of my marriage living apart. I definitely want to live with my fiancee right after our marriage.

I check the progress several times each day to try to determine what CSC is doing.

Based in VJ reports, it seems CSC is focused on I-130s (IR-1/CR-1) applications, with up to five or six receiving an NOA2 each day.

Meanwhile, the 1-129Fs are having little or no movement. You can watch CSC's processing of I-129Fs here:

I cannot wait until 1-129Fs pick up again...

This info seems a lot more detailed than the table of "Approximate Processing Dates" that you find when you click on "Immigration Timelines." I don't really understand how that table is put together. The dates for CSC change by several weeks at a time sometimes on that chart, even though little seems to be happening on the more detailed reports based on the links above.

I hope that what is indicated for VJ K-1 petitioners is not what is actually happening at CSC. In the past three days the time from NOA1 to NOA2 has gone from 99 days (just like VCS) to 132 days. Maybe that is why they are moving so many IR-1/CR-1 and K-3 to TSC. Just hope that they get it under control and get the process time back down to where VSC is at.


Although VJ updated its estimate significantly sometime during the past three days, it is a development that has been happening over at least a couple months. It has been clear from August or so until mid-October that VJ statistics revealed that CSC was not really processing many I-129F applications at all. Now there is movement, but I keep hoping for even more. I watch these statistics several times a day hoping to get some insight into what is going on, hoping for a big jump in numbers.

The transfer of a healthy number of marriage applications to Texas is interesting, and I hope that it means that more CSC staff will be processing I-129Fs.

When I filed, I saw that the VJ stats seemed to indicate that the NOA2 took a little more than three months (even though CSC's official goal is five months). I have to admit, I really hoped for that three months (or maybe less). Now CSC's time seems to be up to almost that five-month mark. May it quickly move back down to three months (or less). I know some others have expressed that we should just be patient, at least during the first five months, but the waiting and the unknown of it all is draining.

Wishing all of us strength, patience, and--best yet--a speedy process.

As Heather says, it's good to carry a copy of the NOA(s) to show you are going through the process legitimately. Welcome to VJ!


It's interesting to me that for those with fiance(e)s from countries in the visa waiver program, the POE officers seem to consider the K-1 process as an indication that a visit while the K-1 is pending will not be abused/overstayed.

Based on information from Embassy staff and people on VJ is that the analysis of the pending K-1 is the opposite for those from countries that actually need a tourist visa (such as Russia). In these cases, it seems that the K-1 process is viewed by the embassy staff as a disadvantage. Apparently they think that someone who is an "impending immigrant" is supposedly more likely to overstay on a tourist visa.

I agree much more with the POE analysis than the Embassy analysis. Why would we put the K-1 process in jeopardy by overstaying a tourist visa? But what I think apparently does not necessarily matter.

I sure wish my fiancee could visit during the holidays...

Let me start with a lil' background story.My fiance,a USC came to live with me in Nigeria in Feb 2008 and we got married in August 2008 and because we didn't know much about immigration we didn't start the procedure until September 2009 about the birth of our daughter.We sent off the I-130 in September 2009 and we got an approval in Feb 2010.All the while my husband was with me here in Nigeria,but his parents and younger sister were in the US.We decided he would return to the US as soon as our case got to NVC cos it's was really hard to decide to live apart.While he was in Nigeria he wasn't working and so we relied on just my income but we were comfortable as long as we were living together.And so in July after paying the AOS fee online my husband headed off to the US.He filled the AOS forms already and got his dad and mom to both fill the I-864A cos he's living with them.they will send off the AOS on Monday.But what we discovered is that we only filed 1 I-130which we assumed covered our daughter and i but apparently we were wrong so my husband sent off another I-130 on the 26th of July for my daughter which the post office confirmed that it was received at USCIS on the 1st of August.But to our surprise my husband hasn't received the NOA1 till now.He called the yesterday and the person he spoke with said they do not even have it in their record cos the money order he sent is not in their record.What can be the problem?I really want our applications together so we can have our interview together cos shes just 18mths old

Hello jsar13, I believe once the NVC process your case and they send u the letter your case is on the way to manila, that is the last time they do any with the medical or appointment making. I could be wrong but i believe the Manila, Philippines embassy is the one to schedule the medical and interview since they are the ones sending out the packet to the foriegn fiance.

Hello Rusty ash, My suggestion would be to book your flight with open return(no xtra cost), then after visa is in hand , call the airline/ travel agent and have them book your return flight with a second one way ticket of the same intinerary. Depending on what airlines this is very possible, but beware sometimes it can be a week or 10 days before a flight is available for your open return date, depends on season.

Kyd, she will not be asked to show a copy of petition or documents, but it is a good idea to send a copy incase more documents are required (or lost ) by the embassy at some point in the process then she will already have them there in philippines, saving time of u sending them to her then her sending them to Manila. But u will be sending her the Originals of some documents at some point unless u yourself are attending the interview with her in Manila. Atleast make the copy of the petition and certain documents then keep for yourself and if u need send something they request or lose u have it.
