IR-1 / CR-1 Spouse Visa Process & ProceduresTax question about ITIN and nonresident spouse
I forgot to add something to my above post. If I do the W-7 form for the ITIN and she gets a number will that mess things up later when she does apply for a SSN?

IR-1 / CR-1 Spouse Visa Process & ProceduresTax question about ITIN and nonresident spouse
Hi Everyone,

I am in the same situation now. If I file married/joint on my 2005 taxes the amount of my refund almost more than doubles but my dilema is how do I file my taxes if my wife is not here yet and does not have a ITIN. She is not expected to be here until the end of March. (The documents arrived in Bogota Jan 27th)
Should I just wait till she arrives and then file my taxes being that I am due a refund do I still have to file an extension? If I file an extension it assumes that I will be paying taxes rather than getting a refund. (Who would file an extension if they are getting money back  ) I have read about this W-7 form but I don't understand all of it. Which way is better for me to proceed? When she does get here how long do I have to wait until I can apply for a SSN or do I just apply for the ITIN for her? She will be eligible for a SSN (she will have a CR1 visa) but I don't know how long she needs to wait to apply for one. I can do my taxes now and file single or wait and file married and get a much bigger refund. Is she considered a immigrant alien or a non-immigrant alien?
I am so confused... :P
I know I might be repeating myself and I apologize for this but I want to make sure I understand all this stuff!
:help: Help me all you tax professionals out there :)

thanks for all your help
Greg

BTW what does this mean: Certified by the issuing agency or official custodian of the original record...and how do I obtain documents with these certificates?

IR-1 / CR-1 Spouse Visa Process & ProceduresAnother tax question, sorry !
I have two questions for the board: When my wife arrives in the U.S. how long does she have to wait till she can apply for a SSN? (I need her SSN number to do my taxes this year)
How long does it take to receive her green card once she enters the U.S.? Her POE will be Miami
sometime in March.

Thanks and good luck to everyone out there :P

IR-1 / CR-1 Spouse Visa Process & ProceduresA few questions about packets 3 & 4???
Good Morning All,

I received my wifes packets 3 & 4 last week in the mail much to my suprise I thought they were going to go to her in Colombia.
Oh well at least I received them. Her appt. is on March 7th in Bogota, Colombia. I am reading all the instructions and I have a few questions. I have read about all the documents that she needs to present at the interview and for the most part she has them all in order but why does she need to fill out another DS-230? I sent one to the NVC back in December. The one they sent me in the packet is both in spanish and english. I already have an extra one filled out from when I did the first one. (I filled it out online...I love those fillable documents it makes things so much nicer and neater :) ) Can I have her just sign and date the extra one I have and submit this at the interview? It's exactly the same as the one I sent to the NVC in December.
Also it also asks her to bring $380.00 in cash or pesos for the application fee. As everyone knows we pay this amount to the NVC. (which I did in December) so what's this all about? Do I just ignore this? It also asks that she brings with her my I-864 AOS and all the supporting documents for it. Once again I sent all these documents to the NVC before. Do I have to get all these papers together again or I can just bring the copies I made of the originals? Don't they (NVC) forward all these documents to the embassy? The instructions also ask for a certified copy of her parents marriage certificate. Do she really need this? Her birth father died when she was very young. I am just trying to be all prepared for the interview process and I don't want anything to go wrong due to I didn't have the proper documentation with me. I have been waiting almost a year for this day. :)

Any help would be greatly appreciated. Maybe I am just worrying for nothing but its better to be safe than sorry!!!!! :D

thanks for all your help people...believe me I would have been lost without this forum to guide me the way.

suerte,
Greg

p.s. does anybody know of a nice & clean hotel near the embassy in Bogota, Colombia?

IR-1 / CR-1 Spouse Visa Process & ProceduresTraveling outside the U.S. with a green card!!!
Hello All,

My wife has been in the US now for 6 months :D and has her green card which will expire in 2008. I know I have to apply 90 days before the expiration date to have the conditional part removed.

My question is...can she travel to Spain to visit her sister using only her green card and her Colombian passport? She would like to travel next February but I am not sure if she can enter Spain with only her valid green card & passport. Does she need a special visa or no? I am under the impression though that she can re-enter the US with only her green card and nothing else.

If anyone out there has traveled only with a green card and re-entered the U.S. please let me know how it went.

Thanks in advance.... :)
Greg
