I am 7.5 months into a K1 visa application . It is at the Vermont Service Center . They received my application April 11th of this year. In October I was sent a Request for evidence . I promptly responded , and they informed me they had received the requested evidence on September 7th of this year . Now , I am stuck in this "Request for evidence response review " hell, and just waiting and stressing out . I have done a service request, and just today filed another with a tier 2 officer , as well as directly wrote the Vermont service center requesting information as to why I am almost 2 months outside of normal processing time. Today I contacted my Congressman to see if he could get a answer . What could be the reason this is taking so long ? I figure if there was a problem then they would just deny it , or if information was lacking ( which I am almost certain it is not ) I would of been contacted . Has anyone experienced this before ? What reasons could cause this long of a delay for approval ?



We are with you in this RFE hell. We got our RFE after 5 months of waiting. The document they requested took 3 weeks or so to acquire. We have made a service request as well as the congresswoman inquiry. All she was told is that they have 60 days to process after they receive the RFE evidence. So where are all of us..WAITING until THEY make up their minds to process our files.

Ok so this is just me playing the devils advocate.. Not any thing to be misconstrued as a judgement call.

Would there be any issue for their ages if they... you know had sex? Isn't there an age that is still considered a minor?

I'm just asking because they are young and financial support comes into play and the age to apply for the visa.

I would loved to know the answers to these questions out of curiosity.

just for the record, I was 15 when I got engaged to my first husband and 17 when we married. When things hit the toilet they were going to charge him with statutory rape .

That's all I'm asking about.

I'm over in Victoria and will be doing the same form for Woking. I know about when I had chicken pox so I'm putting in that year . Logically because my sister got them when she was in school and I had yet to start school. They won't check because they have taken off checking for a couple others things as well. A verbal is all you need to give. (well on the form) lol, you will be fine.

Really other than the fact that we believed the divorce final order was enough but found out they wanted the certificate. Our petition was well organized and had all and a tad more information. neither one of us are youngsters..lolol..

We just want an answer to why it is taking this long as others... well many have filed after with RFE's that were received before ours.

We have spent months together since being a couple.

Hi Everyone
So I have been on here awhile. I'm an April filer. Have not received NOA2 yet.
We have had a congressional inquiry and got nothing more than we can read online.
Service request put in Nov. 14, was told to call back on Nov. 29, did.. they said nothing more that what's online and that they are just a call centre. Even asking for a tier 2 person.
Fiance set up an infopass appointment for next week.

My question is really "who does what?
Who makes the judgement calls in the adjudication process. For the record so we can get some honest feedback here, I have been married 3 times before, He has also been married once before.
I have a squeaky clean record.
He got arrested for having to much fireworks set aside for our wedding reception.
He makes WAY over the required amount for financial issues.

Who or what could be holding all this up?

Hello everyone!

Firstly my fiance is from the US and i'm from the UK we met in Sydney both of us on a working holiday visa! She was a student before leaving the states so we have to use a sponsor her grandmother is lovely and she wants to sponsor us, she does meet the 125% from her pension but she is 80 years old will this be a problem?? she is our only option!

Also should we hire a lawyer we want to make sure everything is done rite and willing to pay if needed, but i'm not sure if we need to spend all that money does a lawyer help that much is it worth it?

In my opinion the lawyers have been proven to do no better job than any of us. This site is your saviour. All you need to know can be found right here. Save your money for the cost of this process. AND lawyers don't try to cheer you up when the process gets you down as it is a lengthy process.

For my fiances medical he checked off the box that he had not misused or abused drugs. He thought that he was answering honestly because he considered abusing drugs as currently using them and relying on them. In the past he tried ecstasy experimentally, once, when he was 17. From previous medical records that we also sent in for his medical it does state on there that he has tried drugs. He got a phone call today from the Medical office asking why he lied and that could cause us not to get out visa. He explained everything that I just wrote above. They said that they would keep in touch, but according to my fiance the lady on the phone didn't seem very happy.

Will this keep us from getting our visa? I read somewhere about a life ban from the US is this true? For something he did once when he was 17? I'm just confused. Does anyone know anything he could do to possibly help the situation?

I had a thought... what if you had a blood test done to show he hasn't used any drugs and have it notarized.. And have the statement say when the last time he used anything. Have it ready to take with him to interview or to have it ready if they require more information.
Not sure if that would be suitable or not. lying is never the best way to go into this.

How does the NVC communicate with the petitioner? Will I need to call to find out if my case has been received or do they e-mail? Does a K-1 Visa Petition receive a case # at NVC? If so, how do I find out what it is? THANKS SO MUCH!

Hi VJers

I'm confused! I know the K-1 is supposed to be sent to the NVC after NOA2, but I called NVC and they don't have my case. My NOA2 says that my case has been forwarded to the listed consulate, except there is no consulate listed. The operator at NVC told me to call USCIS and figure out where they sent it. I can't do that until tomorrow, so now i'm just wondering if anyone knows what could possibly be going on with my case? Is it possible that the case could be sent straight to the consulate?

Hi.. Im preparing to submit a fiancee visa petition for my fiancee who currently works in saudi arabia for almost 4 years now. He is a filipino citizen. He will be going home to the philippines on february. The question are:

1) With the G-325 there was a question for his last residence within the last 5 years. We are not sure which to put. is saudi arabia considered his residence?

2) Since he is currently in saudi arabia and will be going back to the philippine on feb. can i go ahead and file the petition right now so by the time the petition reach the manila, philippines consulate he will be home?

just a heads up.. he will need a police certificate from Saudi, as well as from the Philippines when he has to be interviewed in Philippines. You need to really read through the guides as you will be needing forms signed by him.

I think we're talking about two different "local offices" here. The OP indicated he went to the congressman's local office to sign the authorization forms that allow them to inquire on his behalf. Others are talking about an Infopass appointment at a local USCIS office. So, let's address both of those.

The only difference between an inquiry from a congressional representative and one from the petitioner is that they are required to respond to an inquiry from a congressional representative, whereas they can simply ignore an inquiry from a petitioner. However, they aren't required to provide any information to a congressional representative that they wouldn't or haven't already provided to the petitioner. Some people have reported movement on their case soon after they contacted their congressional representative. Others have reported no change. The only thing we can conclude from this is that there's nothing we can conclude from this. We have no idea whether contacting a congressional representative will result in any action, or what circumstances are more likely to result in action. Judging from the number of VJ members who say they've contacted their congressional representatives I would guess that this tactic is used a LOT, and probably doesn't have much impact anymore.

As Gary mentioned, local USCIS offices don't handle I-129F petitions. These are handled at only a couple of USCIS regional service centers. You can make an Infopass appointment at your local USCIS field office, but neither your petition nor the adjudicator who is reviewing it are there at that office. There's nothing the people at the field office can do to make the adjudicator work any faster on your petition.



So what you are saying that this trip up to Hartford will result in squat being done. Who then can actually give us information on our petition?

Boy I hear you loud and clear. We are now at 7 1/2 months. My fiance is going to the Hertford office on Tuesday for an infopass appointment. We got nowhere with the service request or congressional inquiry. In fact they told Glenn (USC / fiance) that with the service request they buy themselves 90 days to LOOK into the matter.
We even went over every piece of information we sent and there is NOTHING to give a delay (other than the RFE for a divorce certificate. The RFE was issued after 5 months of waiting.

I know patience.. well screw patience now, we want action.

My NVC receive date was Nov 23rd. I called and got a case number, and on Thursday Dec. 1st I called again and they told me the case had finished processing and was waiting to be sent off to the embassy; the guy on the phone explained that they try to batch them up to save courier fees. This all made sense to me.

I called again today to see if it had been sent off, and now the phone rep tells me it is still undergoing additional processing. I asked if there was a problem, she said no, this was normal.

What do you guys think? Why would it go from "finished processing, waiting to send to embassy" back to "additional processing"?



just a thought. maybe they consider "additional processing" as waiting in the pile to be sent. ???

so i dont know how but i locked myself out of my old account and cant get into it even with the new password they provide :(
anywho, my case is already at the consulate(ciudad juarez).it got there nov.30th. since then,i filled the ds260,paid the mrv fee,and scheduled my interview appt.
only problem is that i have not recieved packet 3(invitation letter).so ive called the consulate,to check if thats ok.ive called 6 different times,gotten 6 completely different answers.i did pay a lawyer to help me out with all this and he advised me to cancel the interview that i have scheduled until i recieve the invite letter..but hes been wrong about some things so far as well.
my interview appt is for dec 28th,so i dont have that much time to wait :/
what should i do??any advise??


I could be way wrong, but I would not cancel the interview, I would go the the consulate page for your consulate and see what forms and fees need to be done. Also need to know when to get your medical done. There are many people who will have the info you need though. Lawyers are not always correct.

Am awaiting the community liaison to make an expedite request on Thursday other to that I had a really nice rep today on the phone give me the email to get further details from the Vermont Center ...Email:vsc.ncscfollowup@dhs.gov of course ull need to provide all your info as well as the beneficiary's and your case number. You should try that route....also try getting your local congressional's office involved!

I did read a couple of post today of a couple of folks getting emails from USCIS VSC saying their cases were being expedited to being long in processing time. lets hope were are next in line.

My InfoPass appointment was equally less than spectacular. Drove two hours to get there. Hand them my bar coded appointment letter. Ask them what's the status? They print up a page off the website of the processing times (that we can see ourselves). Told me to check back later. I drove two hours home--banging my head on the steering wheel the whole way. At least they did highlight the line that said 129F, so that was worth the 4 hours travel time.

sorry I just need to find a happy thought today.

I did see a post that two people from VSC got an email saying that their case had been expedited to due being outside of normal processing times... heres hoping we get the same.

oh my goodness I'm really sorry! I remember crying so many times. I started calling and contacting my congressman at 5 months and was told I had to wait until a month outside processing times. At 6 months we finally got the approval. I'm pretty sure that the congress person is what pushed things through for us. the vermont center was completely incompetent...the day I found out about the approval, the first tier customer service at the vermont center told me I'd have to wait an additional 30 days for a response, even though the congress person said I had already been approved. They transferred me to a "second tier" customer service person who said "oh yeah, you were approved 2 days ago, you should get the NOA2 in the mail really soon." I was like, seriously?!?!? I don't know what is wrong with these people. I noticed you said your congress person was useless...it might be that your case was given to a useless congressional aide. try the again... this is their job to help us, especially if they want to get reelected! Good luck with everything!

Well as a few of you know our case seems to be stalled. You can see our timeline. This morning my fiance drove up to Hartford for a 7:30 appointment. What happened was:
Asked for appointment confirmation
Fiance explained the reason he was there
The customer representative said yes indeed ours was outside of processing time
They would be sending an email to the supervisor to check into our case and they would send us an email reply.
It is at the supervisors discretion as to when they approve/deny our case.
if we get the slow person, well we got unlucky. But that each adjudicator has a designated work load to get through in a certain amount of time.

So in summary..... no further ahead in information after the appointment than before.

Good luck to everyone and I think by the time we are approved there won't be any names I know on VJ...sigh..
had myself a little cry and then got on with my day. I broke out with shingles on the weekend, brought on by stress... WHO ME?????? STRESS......... nah how could that be?..

Hello everybody!

I am really frustrated. We send our Petition in May and got a RFE for totally stupid reasons... They recieved our RFE respond on October 7th and the 60 days are over since yesterday. We are almost calling the service center daily! You probably know how much they really know of the work they are doing!!... Nothing! They just send an service request and now they have another 15 days to answer!!!! Is that possible I mean they already had 60 days is that not enought. We have a 12 weeks old baby and we are going insane :((( My fiance is in the Navy and already tried to email his senator but hasnt gotten an answer yet. Does anybody have an idea???

Had in infopass appt. yesterday, was told they would send and email to supervisor, then we will receive an email back on their response.

Yes they do checks on everyone. Name and background and FBI.

No real reason to be concerned about any of this.



So then ex's names aren't important? Ok I need to know because my first ex is now a woman and goes by a different name but obviously when we were married he was a male. I know I'm a little anxious as time goes by and doubt sets in.

Hi guys, it's Amy writing...I'm currently trying to get USCIS to put a service request in for my I-129f petition to bring my fiance, Victor, here. My petition was filed on June 30th, and it's now been more than the usual 5-month processing time. Victor and I called on November 30th (I was in Russia visiting at the time :)), and received the answer that since the Cali service center is experiencing a delay and are currently processing I-129f applications from June 16th, the agent on the phone at the time was unable to put in a service request. That particular agent recommended calling again in 1 or 2 weeks. Today I called again at two different times to two different agents, and received the first time a reply that they were still processing applications from June 16th, and this one told me to call back in 30 days! The second one told the same information, but actually explained that the system they use blocks the phone reps from putting in a service request because of the CSC's delay, and to try and call back "in a week or two." She also said that USCIS occasionally updates their processing times, and that they were recently updated. It still says that CSC's processing times are 5 months, according to USCIS's website.

The agents I spoke to said that the service center being delayed extends the processing times and that's why the system doesn't acknowledge that our petition is outside of processing times despite the fact it's been more than 5 months. :( It's very upsetting at this point, and very frustrating and depressive to deal with this bureaucracy. Some of the info they give is consistent, and some conflicting, like how long to wait before calling again to inquire. On another immigration forum, some people have said that occasionally if you keep calling over and over again, you'll get someone who will put in the service request, and it leads me to wonder, is it actually true that the system "won't allow" them to put a service request in at this time, or are they just not doing it? Furthermore, when I requested a supervisor, I was told that the supervisor would just tell me the same thing. The only way I can get more info is to make an appointment with a local USCIS office to speak to someone in person to receive a little more clarification. Have any filers from June or July been able to talk a rep into putting a service request in, or is it genuinely *impossible* for them to do it? Also, do they ever willingly put their supervisor on the phone for you? I just want to hear some honest feedback from others to see if they'd had any success obtaining this illusive service request. Thanks in advance and I hope this inquiry makes sense...I'm a little flustered at the moment!


After I checked the processing time for CSC it does indeed state that the processing time is back to 5 months. So yes if it is outside of that time and yours is, then you call back and ask for a tier 2 rep. They should be able to put in the service request. Just keep in mind that after it is in they have 90 days to respond to it. They will send you an email that states the details of the service request. It is all a painful process.

Hi VJers !!!

I am patiently impatiently waiting for my NOA2, which will not arrive until probably Spring 2011 :wow: Anyways, my question is the following: Can he go NOW to see a doctor and get his exam and all his vaccines in order, or does he have to wait until we have recieved the NOA2???
Just thought if possible, that would be something to get done and out of the way. But not sure if that would be acceptable.

I started my vaccination quest ahead of time as the beneficiary will need to have several for the AOS anyways. Some are done in a series and for some he/she may need to have some blood work done. I say you can get started on those right away. I also started familiarizing myself with forms and timeline flow charts so I knew what was going to be needed and to feel comfortable with the process.

You are waiting longer because you made a mistake. You would have had an approval by now. The RE would have been an approval if your petition had been complete. You are waiting even longer because other people made mistakes and instead of denying incomplete petitions they spend time to review them AGAIN.



Just for the record. We purchased a guide and followed it verbatim on what was required. Including the divorce had to state when the divorce was final and when I was free to marry. The document CLEARLY stated those issues. So you don't know everything about everything. Must be nice to live in your perfect black and white world.

I don't understand why it takes so long for VSC to approve petitions after an RFE. I have been looking at some different people's timelines and it seems that almost every person with an rfe for a K1 has had to wait close to 60 days for an approval. That is ridiculuous! I know they get a lot of petitions, but if you have already had to wait 4 months to get a response like I did, and then get an RFE. I returned the requested information to them within 10 days. I would have had it to them sooner but they sent the original RFE to my lawyer, so I had to wait for him to send it to me. I only hired him for the petition. I plan to do the rest of the immigration process myself, thanks to VJ!



It's true for most of the latest RFE's and the 60 day wait. We received our RFE 5 months into the waiting. The document requested took 3 weeks to obtain. USCIS received it October 18. We know what the RFE says...

We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response

Wait, wait, and more freakin' waiting.

Hi There
So when they (USCIS) changed the timeline from March 15, 2011 we phoned that day to put in a service request, as well as contacting congresswoman. The congresswoman's office got nothing more than what is online. (that was useless). The email generated from the service request stated they will basically get to ours when then can although ours is most definitely outside of their processing time (their words not ours). They told us to call back on the Nov 29, tomorrow so we will see. Our petition is at 218 days. I did find out that ours is taking longer due to the RFE and the fact we both aren't new to marriage. So extra checking on names etc.
I say most definitely call and put in a service request.
that's my opinion.

My fiance' is planning to visit next June and stay as long as possible - like the 90 days allowed. What if the call for Interview comes during that time? Will he have to go home for the interview? I just mailed the packet finally - had to wait for one little piece of paperwork I didn't realize I needed until the last minute. We don't have a lot of extra cash for plane tickets but hate to delay his visit. It's so long between as it is. I may have missed this post somewhere before. If so, I apologize. Thanks for any advice. :wacko: :help: :thumbs:



On my last visit state side the very nice man who asked me many questions asked me what I would do if I had to do my interview. The answer is... they go home and complete the process. plain and simple. And he better have a lot of documentation giving a tie to his country or he will be sent home.
