Yes I have TWO NOA1- just got the (2) I-797-C notice of action today in the mail--

 

The only questions I have are regarding the affidavit of support at this point-- and order of events a little bit too.

 

I do have children from Previous marriage- but they are not children anymore--  they are currently 18-23-and 29 years old--

 

My 18 year old lives with his Mom and she claims him on her taxes--

 

Does that effect my affidavit of support in anyway ( I would think not )--

 

When I was living in Honduras- my income was below the minimum required to warrant a Tax return- so I did not file for several years-- last years tax return is right on the borderline of required income but now I am comfortably over the requirements- can you put me at ease that this is a situation where I would NOT have to seek a CO-sponsor-- I do not want to have to do that--

 

so the NVC will not review the affidavit before sending her for interview?  I am hoping that when she goes for the interview all or any of my concerns would have been put to rest.

ADDING....  I just took my time and READ CAREFULLY the instructions on filling out the I-864 Affidavit of Support-- and I answered some of my own questions- BUT HAVE other questions--  

 

My 18 year old son will be 19 June 2014- He lives in Florida with his mother.  I know Florida law (or I think I do) and in Florida he is considered reaching the age of majority at age 19.  But actually that should not make a difference BUT it does make CLEAR that I need to report him  and I quote the instructions for PART 5 item number 4, "........who are under the age 21"

My total in PArt 5 box number 8 will be (5) Five.--  here are my questions-- and I will be specific...

IN PART 6 - I have the opportunity to list my CURRENT ANNUAL INCOME-- and IF I attach all of my paycheck stubs for this current year I could document that my income is $82,000.00 a year.   I will also be able to back that up with a LETTER FROM MY EMPLOYER.  This current income is more than enough to meet the poverty level for a family of 5 described in the 2013 HHS Poverty Guidelines (form I-864P effective 03/01/13 of $34,462.00  BUT THIS IS WHERE MY QUESTION(s) are--  in 2011, 2010, 2009, 2008.  I did NOT file- I was living in Honduras and working as a SCUBA INSTRUCTOR and just making enough to support myself (UNTIL I DECIDED TO FALL IN LOVE)--  in MARCH 2012 I was back in the USA working and in OCTOBER 2012 I started my current job ( I had one other job when I first got back)--  My 2012 INCOME TAX is just at $28,000.00 and BELOW that poverty level for a family of 5--

 

Do I have a problem?  or with ALL of this years paycheck stubs, and being able to document my income alternatively with a letter from my employer - and maybe writing a looooong cover letter explaining my situation WILL THEY APPROVE MY SOLE SUPPORT?

 

this is my question in a nutshell.-- and I am getting very personal here but am seeking answers- to questions that have not been asked yet--  IS there someone I can call and talk to for an official answer?  WHEN AND WHO is going to be looking at my affidavit for support?  the Consular office in TEGUC know me and my family form when we processed my biological daughters Report of Birth abroad to a US citizen and I also applied for the simpler TOURIST (B) visa for my wife on two occasions (unsuccessfully I add)---

 

so IF they are looking at this- I think they already know me and my story and it might be smooother??  --  

 

I would sleep MUCH betternot worrying about this for the next several months. and your informed answers are GREATLY appreciated and anticipated.

If I just got my NOA1 today 8-23-13, WHEN will my affidavit of support need to be completed, or in other words will my "current" tax year be 2013?-- making MORE money in 2013 than I did in 2012 - and could be the difference in qualifying without a co- or not.

 

ALSO can real estate owned jointly in my beneficiary's country qualify as an asset? and what documentation do you need to show for establishing a value?--

2. I AM SPONSORING THE FOLLOWING FAMILY MEMBERS IMMIGRATING AT THE SAME TIME OR WITHIN 6 MONTHS OF THE PRINCIPAL IMMIGRANT NAMED IN PART 2.  DO NOT INCLUDE ANY RELATIVE LISTED ON A SEPERATE VISA PETITION.  ( VERY MUCH SO NOT CLEAR-->??)

Thanks everyone, I'm expecting USCIS to request I-864 in March 2014.

 

Does tax return 2012 counts as the most recent one? since April 15th, 2014 is the deadline for 2013 and not everyone have their tax return by then. 

 

 

I AM PRETTY SURE-- that would be your "option", first of all IF you could get your 2013 return prepared BEFORE you are asked for the Affidavit of Support, BUT it would not be required for any petition made BEFORE 4/15/13.

 

I am in a similar position and understand your worry- I do NOT want to be in a position to ask for a co- sponsor and qualify but like your affidavit there is room for interpretation.

 

To elaborate- they are looking FIRST for your current ability to provide support and secondly the stability of your income- and obviously the last three years represent the stability, I BELIEVE a well written cover letter and documentation explaining your situation and the ability to demonstrate the ability to support SHOULD be enough- at least I am counting on that.

AS a precaution- I called the Missionary father who is listed on her birth certificate- and spoke to his wife.  We have kept in touch with them over the years.  I asked her to have her husband write up some document saying that he has no objection to my petitioning for her emigration and or future adoption or something to that effect and will follow up and try to get that in my hands in the meantime-- any other suggestions? - again thanks

YOu are correct - I went back and reviewed the papers I filed- I only completed the ONE G325A but had two I130. one for My wife and one for stepdaughter--

 

FROM WHAT I UNDERSTAND-- and it sounds like I will have to discuss with the embassy directly- NO ADOPTION was ever completed- his name was only listed as the father on the birth certificate- for whatever crazy reason- SHe was never married and had the daughter without any contact with the biological father before during or after pregnancy-  gets awful personal here but in fact it was non consensual when she became pregnant --

 

all that said - ALL I am trying to do is make sure that WHEN that time comes I am PREPARED- and all of the questions and issues raised here are appreciated...

 

UNFORTUNATELY - it is NOT CLEAR CUT--- especially when it comes to HONDURAS - they make mistakes ALL THE TIME on all kinds of documents- with the little experience I have in this area -- it is actually common and trying to wade through this is both frustrating and stressfull.

 

Thanks for your help-- I AM trying to use my time NOW I read some other posts where people try to get documents AFTER the appointment is set and that would be a nightmare for sure. not to mention impossible.

As I patiently wait for my Petition to be approved ( 4months and two days now )- I prepare and read and prepare some more both mentally and gathering documents.  Once my petition is approved and transferred to the NVC- I want to get through the NVC process in record time.  (AS I am sure we all do) - and get ready for our interview.  HOPEFULLY this will be taking place MAR and- APR 2014

 

Today I reviewed and updated all the forms that I have - and also making preparations and plans to get what I do NOT have-

 

I want to have NO SPEEDBUMPS in the road to being RE-united with my family.

 

I MUST ADMIT - I am NOT 100% clear on what I will need for my Step Daughter---

 

I filed a G325A and a I130 for her along with my wife.  NOTE** nothing necessary for our biological daughter because I have already completed the Report of her birth abroad and she has her USA Passport in Hand. --  which by the way still blows me away that with that evidence and documentation we cannot get a VISIT from my wife while we go through this ridiculously L-O-N-G-

 

MY WIFE has documentation of her relationship to her daughter of course- but there NEVER HAS BEEN A DAD in her life-- 

 

I HAVE FEARS that this is going to be an issue or am I just worrying too much--

 

TO COMPLICATE THINGS --- BEFORE I met my wife - she had met some American Missionaries who had a school in Honduras and they "attempted" to help my wife an offered to adopt her daughter-  there was NEVER a relationship - but he is listed on some documents as the "adoptive" father--  since that time he has fallen ill and no longer is doing any missionary work and is back HOME in THE USA.

 

Anyone have any REAL EXPERIENCE in these types of matters?-

thanks for your prompt reply ... yes she and her husband working out all the documents needed for her immigrant visa application.... does it need that her husband should be present during the interview? or is it ok that she can go alone as long that they have all the documents needed for her cr-1 documents...

It is NOT compulsory that he attend the interview, it is a personal choice- That said, I FEEL that it speaks volumes for both partners to be there for such an important life event.

Hi everyone. I'm confused about the proper steps to the NVC. I have paid the AOS fee and IV fee. I'm wondering if I should submit AOS along with my wife's immigrant visa application with her civil documents. Also I'm confused about the DS260. It says in instructions that she should fill it out online but I also read that only certain applicants can fill it out online. Has the requirements for that changed? Hope someone can help me out here.

As soon as your AOS fee is paid you print off the receipt with the bar code and use it as your cover page- they should send you directions as well to follow.  and the DS-260 is online now and must be filled out online.

Hi everybody! Today NVC approved my case for expedite and sent it to the embassy. YAY!!!

 

I was wondering if anyone has had their case expedite at the NVC level and how that works from there? It was sent to the Chilean Embassy, but since I don't know what to expect from here, I would appreciate any help or information. Like for example, how long after the case is forwarded to the embassy does it take to schedule an interview? How payment of fees and sending  of documents work? Do they simply ask for me to take these documents at the interview

What was your reason for expedite?

 

My wife is in Honduras with our two daughters ONE of which has had her birth abroad filed with the consulate office and is a USC.  I am not quite clear on what your reason was --

 

I requested an expedite more than once both directly and trough my congressman and having a USC with my wife was NOT an acceptable reason.  There must be more to the reasons they granted an expedite.

I tried to copy/paste on here..On the form from embassy for the interview..there is a list of documents if NVC hasn't sent to the embassy...and there are codes besides each item...2 items say...petetioners original Birth and marriage certificate...The code is F..stands for...the NVC has not requested this document...doesn't matter..Ive sent him my original birth and marriage certificates..I can always replace them..Im Not gonna take any chances on them Missing or asking for anything..we have waited over a year to be together...

Thank you all!..I cannot believe whats happened...over a year ago I..USC..gave all my divorece papers to USCIS..well I guess the embassy says that My Hubby will need to bring Them..origianls or certified!..Im LIke WTH....I thought my part in this was over..Nope..UGH..So I been crying and Ive just spent $50 JUST to get  my divorce from Michigan ..and that's gonna take till next week..I cannot believe what we have been thru...a Note..if anyone is going to go thru all this?..get like 4 copies certified of EVERYTHING you ever need!..My god..I cant believe that till the end of our journey Im still having to do this..m 50 yers old and married 3x before this marriage never have I dreamed I would have to go thru this....My Danish hubby is also upset..he said he cannot believe that America is this way to get a spouse in :(

He just has to call the courthouse..they will tell him to send a $5 fee and he just has to write on a piece of paper with the check enclosed..I would like a certified copy of my divorce..VERY easy and fast//he can request more certified copies if needed..just $5 each..I had to do this as well..I got 4 certified copies JUST to be safe

I agree with a lot of other posters. It does sound like years of tangled up, shaky relationships, all swirling around getting visas for the U.S. I think you're going to have a pretty hard time, but just an opinion.

I agree with some earlier posters: if your case is relatively straightforward, I think using an attorney takes MORE time, because 1) even though you pay them, they're still not ever going to be quite as motivated to get things done fast as YOU are, and 2) having another person in the mix means you have to add time just to deal with the attorney. And then there's the expense; many of these visa forms have a fee attached to them anyway. Why add a lawyer's fee on top of that, basically to get someone else to interview you and fill out your paperwork for you? And they can make mistakes, too; just because they're attorneys doesn't mean that they can't screw up.

 

Like the ad on TV about taxes goes: you know you and your situation better than anyone else. It would be my advice to read these VJ guides, read them twice, then search for any questions you have and get some answers BEFORE you start the process. Then you'll know what you're dealing with.

 

If you can follow directions, and your case is pretty simple (no criminal convictions or denials or any wacky stuff) I see no reason why you couldn't just do it yourself.  We did ours ourselves, and got an RFE for something, but it was my not asking a question and reading closely enough that earned it. If I'd read and followed the directions on VJ, I probably wouldn't have gotten that RFE.

 

Take your time, read carefully, and save yourselves $2500 you'd spend on a lawyer to use instead for your spouse's trip to the US!

"Ready" on the status means they've got all the stuff ready for your interview. It won't change until after the interview, maybe a day later. Then it will say "Issued." At least, that was our experience.
