We are in the same boat as you it sounds, ours was approved NOA2 on Nov. 4th, and we havent heard a word since then.

 

I have no idea what type of order they process them in, but it doesnt seem as though they do them in the order they were approved for NOA2.

 

Kinda wonder if the clean-up crew comes in at night and plays with them by throwing them into different receptacles from a distance ,then USCIS picks one receptacle the next morning to process  while all the others go back in a big pile so the clean-up crew can do it all over the next night. Just wish whoever is throwing ours, would hit the pile that gets processed! 

 

I think that USCIS must forget that they are affecting so many peoples lives, or else they just dont care, or are incredibly understaffed, dont know which.

I cannot give you any definitive answers, sorry, but you are dealing with the Philippine Govt. and this is just the way they operate. Logic, is a foreign  word there it seems, cause things that seem perfectly logical to you and I, will have no bearing at all to them. I know it's hard to do, but try your best to always be polite and calm when dealing with officials there, it actually can help quite a lot, rather than to loose you cool and start yelling as I have many times myself wanted to do. I would first do as Darnell said, and make an appointment to talk to as high-up the ladder as possible. an officer in that dept. that governs the ruling in question, but that will mean a trip to Manila for your fiance if she is capable of handling and arguing the point by herself, or better yet, you should go if at all possible. Second, I think you will need to hire a lawyer that specializes in this field. It is the Philippines, so lawyers there are not that expensive compared to the US. Another BIG savings tip if you hire a lawyer, would be to let your fiance hire them and not you. Once any Filipino, discovers that they are being hired by a foreigner, the price goes way, way up.  As another person said, counterfeit documents are rampant there, and can easily be gotten, so many times they will require extra documentation to prove that the documents submitted are actually real. Yes , there are things THEY could do to check out the documents and make sure they are real, but they put that responsibility on the person submitting the documents instead. Most likely, if you meet with the officials in person, they will come up with a list of things that they will want you to supply them, (notarized of course) in lieu of a death certificate, but be prepared for it to be complicated, and possibly take time.

We are currently going through the slow process ourselfs, of proving that annulment papers are actually real, from back in 2009 before I met my fiance. That could easily be proven, by someone at NSO picking up the phone and calling the Judge that signed all the papers, but remember what I said about logic, logic does not come into play there, sadly. The NSO (National Statics Office) must verify and stamp all legal documents there before they are considered final. We are ready to book our interview now, but we cant because we are still waiting on NSO approval, we started that back last March, and figured we would have it long before we got to the interview stage of our K-1, which we didnt even start til Sept.

 Is anyone else having any problems trying to send an email about a K1 visa to the US embassy. I go to there site, click on contact us, then click on by email, then try to click on the for general inquiries address, but nothing happens or opens. Down at the bottom of the page where it says if I am not the petitioner, to click here,,,it works. We are having a problem with the NSO, and I need to notify them and bring them up to date, so they will keep our visa application open, and not think we abandoned it or something, since we have been at the point since Jan. that my fiancee could book her apointment. Anyone know of another way to send them an email that works.

We thought we would be ok with our time frame but things are moving faster than expected so far. All of the papers were submitted to NSO a little over 3 months ago, and we were told that the processing time was 3 months. She is in Davao, but if it would actually accomplish anything I could get her to go to Quezon City, but the problem is, it will take time to get more copies of the official annulment papers in order to do that, so not sure which would be faster at this point.

Hoping someone that has already gone through this could possibly help us.

 

My fiance got her finalization of annulment papers, signed by the court back in 2009, long before we ever met. For whatever reason , the papers were never sent to NSO back then for her Annotated Certificate of marriage.  Now we have started the K1 process and have passed the NOA2 stage. She had here lawyer send all the papers to the local civil registry back in July and they forewarded them to NSO in Manila we are told. From what information I can find, it typically takes about 3 months for NSO to complete them and return them to her or her lawyer, not sure which. Can anyone tell me how long NSO takes to issue the Annotated Certificate of Marriage. We must have this for her interview, but we are getting kinda worried, that if we keep going with the process, we wont have it by the time she goes for her interview. I don't want to send her all my papers yet, since they are time sensitive also, pertaining to her interview. Am expecting that we will get NVC approval soon, and not sure what to do.

Unless its recently changed, the travel tax, like the airport tax, is not included in the ticket price.Upon check-in for your particular airline, you will be escorted by someone, who will take you to an office where you pay the travel tax, then you will get a receipt for it, you will then be escorted back to the airline check-in to finish processing of it. You will also have to pay an airport use fee, before you will be allowed to board the plane, it seems to vary in cost by different airports. Every other country or airport I have ever been too, includes this in the ticket cost, but not the Philippines.

I refuse to bank with the big banks, I have my reasons, but I dont like the way they have changed the banking industry, so I refuse to use them. instead, I use smaller local banks that still offer most of there services for free, but because they are small, some choose to not offer international banking, they do not have many requesting it , but my credit union does. When I transfer money, I transfer US dollars from USA to a US dollar account in the Philippines. If I transfer $10,000 dollars from USA, I get $10,000 exactly in my account here in the PI, and I pay my bank $15.00 per transaction. Now when I do convert to pesos, there is a small difference in the rate of exchange, I am aware of that.

There should be no restrictions on using online banking, regardless where in the world you are.  I use USAA. and can access my all my accounts and pay bills from anywhere in the world.  (Most are set up automatically, but I can xfer money from anywhere).

 

What I am getting at is that banks typically "charge" you via a exchange rate decrease from the given bank rate, and usually it's around 1php.  So if the online rate for that day is 43.5php to 1usd, then the bank will move your money to the PI bank for $15, plus their exchange rate will be 44.5php, so you will lose about $23 in the transaction.  This will be totally invisible to you, unless you call them and compare their transaction rate against the daily LIBOR rate.  

 

WU does it, Xoom does it, and I'm sure most banks do as well.  I know Metrobank in the PI does it.  Their exchange rate is normally 1-1.2php lower than the daily rate.

 

If PFCU does NOT do it, I would be surprised, but you'll never know unless you call them and ask about it.

What bank are you using in the US?  Because I don't know of any banks that don't charge a wire xfer fee for the service, or at least a usd-php exchange fee, which is typically 1 php, or around $23 per $1000 sent.  PLUS any associated xfer fees.

 

 

As I said, my bank charges me a flat $15.00 transfer fee, regardless of the amount $100.00 or $100,000.00 same fee. I have used 2 different banks before, Virginia Commerce Bank and Pentagon Federal Credit Union. I prefer to use PFCU, because they are set up to do international banking. When we are in the Philippines for extended periods of time I can pay bills from there, move money around as needed, all online. Other banks I have attempted to use from there to do online banking, or anything other than to use an ATM , have not worked for me, because they want me to come in person to the bank in order to transfer money, so they can verify who I am in person,,,well that dosnt work too well when I am 9,000 miles away from the bank. PFCU, I always notify them before I leave, and have never had any problems using there online banking from there at all. If you are there for long periods (Philippines) you can also write a personal check at and cash it, with no charges at all from either bank,,,,,but it does take 24-30days for the check to clear, but if you plan ahead, thats not a problem.

I have never had a problem changing money at a reputable place such as in malls, but if you attempt to use the street changers, they can be very picky not to mention will try to cheat you on exchange rate. Another way that I use is to do EFT (electronic fund transfer) Either open an account yourself, which can be done but you may have to go to some different banks before you find one that will open one for you,I use BDO, or transfer it to your wife or girlfriends account. Then transfer from US bank to PI bank. My bank charges a flat $15.00 fee in the US regardless of the amount transferred, and the Philippine bank has no charges at all. You can either transfer from US dollars to pesos, or set it up for US dollar to US dollar. Xoom charges the $4.99 rate plus they also get a small percentage of whatever you send bu not paying the full rate of exchange. I usually send larger amounts because we are building a house there,  but it all depends on how much you send vs what your bank charges to send it, so for small amounts xoom may be cheaper, so you might want to look into it.

PhilippinesCalling Pinays: what to bring?

I cant speak for the Columbus area, I am kinda close to Washington DC. In this area there are quite a few Filipino stores, but like danrb said, they dont seem to advertise. I was just driving along  in a town near me one day, and happened to look to the left and saw a store called the Pinay market. I had driven that way hundreds of times, but had never seen it. so I figured it was new. I stopped to check it out, and found out they had been there for over 5 years, ever since they had built the shopping center. I talked to one of the owners, who was very nice and very friendly, and found all kinds of places in the area that I never knew of, and all kinds of Filipino gatherings that happen, they do Balikbayan boxes from a number of different shipping companies. So once you just find a Filipino in your area, you may be amazed at how many other Pinays are close to you. Even if you cant find a nearby source for foods that you might want to bring, you will be able to find almost anything you could possibly want and order it off the internet from someplace here in the states. I would bring clothes especially, and not worry too much about food and drugs, you can find almost anything here if you look hard enough. You will be needing winter clothes though, and the time you will be getting here will be perfect for sales, especially if you wait til about Feb. or so. 

 

Enjoy your trip, and hope you will learn to like snow, and cold.

Its totally dependent upon the airline. I have flown on Saudia and Korean Air, from VA. to Cebu , and have always been allowed 2 -23kg bags every time. I always book on Kayak website and you can access from there, what each airline charges per extra bag and weight limits also. When returning from Cebu there are always lots of people carrying what I would call the large size Balikbayon box and checking them. I asked a lady once how much they charged her for the box, and she told me $150.00, that was last year on Korean. Saudia has been having some great rates for travel, less than $1,000 round trip, if you happen to be able to use one of the cities they fly to.

I am not sure where you are bringing the cashiers check from, but I am assuming from anothet country. Not 100%, but I have a feeling it will take as long for a cashiers check to clear, as it would if you wrote a personal check, which takes about 30 days to clear. If you are transferring from another country to the Philippines where you have a bank account, I would have it done as an electronic funds transfer, it will cost some money, nut its quick and easy. Check into HiFX website also,or XE. XE will work from most countries except the US.

PhilippinesAnyone recently sent balikbayan box to Tacloban or nearby?

I send 3-4 boxes a year to Davao on Mindanao. I use Manilla Forewarders, but you pretty much have to use whatever is in your area. They usually take about 3 months to actually get what I send, if there going to Manila or areas around Manila, its about 2 months, because they have to transport them by container from Manila to Davao or CDO, it takes about 1 month extra. I have never had one item that I have heard about anyway, that was damaged in any way at all, but if you send glass, pack it well, and if you send any kind of liguids, put it in something that would contain it, should it leak. There is no weight limit on the box, so you can put as much as it will hold. Remember also that it will be in high heat for long periods of time. I always send lots of chocolate, but it is never been damaged that anyone has told me about.  For Christmas delivery, we send it in Sept. so it will get there in time. One thing to remember though, customs can and does open boxes at random sometimes, and they could care less what damage they cause, because they are not responsible for anything,, in there eyes, I have read from others that if customs opens the box they pretty much destroy everything in it, cause they just dont care, and the shipping company will take no responsibility either, since its not there fault. I think it a very small percentage of the boxes that get opened though, but it can happen.

Ours was sent to DOS on 12-4-13. So I sent an email to  NVCInquiry@state.gov  on 12-8-13 asking them to let me know when it was sent to our embassy, and to send us the case number. So yesterday we got the standard form letter saying it would take 6-8 weeks. Then today we got a new message from them saying they had received the pkg. from USCIS and that they would notify the appropriate agent, (me the petitioner) once they assigned it a case number, and would notify me once it was mailed to Manila. So it seems that maybe they will actually keep us posted with emails, rather than me calling them every day. In our case, speed in not quite as important as to others here, because my fiance cannot leave there anyway until early June at the earliest.

Once that dates comes, they will extend it automatically if she does not have her Visa yet. The only way that I can personally see to do want you want, would be to delay her interview, until she graduates, or come here, get married, go back and graduate, then start the whole process all over again as a K-3. I was told,(dont know how reliable the info is, you will need to check into it more) that you have up to one year to complete the visa process from the time it was received at USCIS. We are going to have to delay our interview, for 3 months because because of complications with getting my fiance her annotated certificate of marriage papers from the Philippine govt. who it seems is even more screwed up than our Congress, if thats possible. Since you are responsible for choosing the date avail. for the interview from whats available, we will just reschedule it a couple times, and still stay in the line.

Depending on the country, vaccinations may be cheaper, than here in US. But if anyone needs to get vaccinations once they get here, try your local Costco Pharmacy. No Dr. prescriptions are necessary, and they are done on a walk-in basis. Also they were a fraction of the cost my Dr's office was going to charge me.

I didnt want to go into too much detail in what I wrote, by asking the questions earlier.

 

Yes, the pre-nup has been discussed in the past, in fact my fiance was the one that first brought it up, and we will definitely be doing one through my lawyer.  

 

As I said, we are older than most of the ones on VJ I think. We have both discussed things, such as if things didnt work out as we hope they will, and what we would do to accommodate each other in such an event. My fiance has already said she would want to return to the Philippines, since thats where all her family is, and I told her at the very least, I would take care of that, plus more. 

 

We plan to move to the Philippines to live, at least part time after I retire anyway, hopefully to stay there most of the time if I can adjust to the differences there, as I do love it there, but living vs going there for a month at a time on vacations are 2 different things, so only time will tell on that adventure. 

 

We do plan to stay here until she can get US citizenship, in fact, that will determine our future schedule for the most part. We plan to travel a lot, and with just Philippine citizenship, its hard to travel to many places from what I understand.

You don't sound like a jerk to me, don't worry ... there are lots of people in your situation and finances can be really complicated.  Especially so for well-established individuals who are marrying less-fortunate fiancees -- it just means you're aware of the disparity in your incomes/assets, but that is a good thing, not a sign of distrust.

 

Your first question is simple: if you make well over the poverty guidelines, then you do not need to list ANY assets on the I-134 or the I-864 (used later when filing for adjustment of status after your marriage).  That's easy.  Use your tax returns/transcripts to show your income, and leave the assets blank.

 

The harder issue is protecting your assets in the event of "things not working out".  Be aware that you are pledging that your fiancee will not receive means-tested benefits from the government -- and that the government could (in theory) sue you to recoup that money if she did try to get benefits.  In practice, this rarely happens, but it is what you're promising with the I-134 and I-864.

 

Even though you don't list your assets on the forms, you are pledging that you will "support" your fiancee and that she will not get mean-tested benefits from the government.  In the unlikely event that she does try to that and that the government sues you to recoup the money, you would need to repay them, whatever your assets or income, no matter what you actually listed on the form.

 

The I-134 and I-864 are not in any way connected to divorce or things "not working out".  In order to "protect" your assets in the event of a falling-out, you'll need to look into a prenup agreement, signed privately by you and your fiancee and lawyers.  That's not something the government is involved in, and in most cases, the I-134/I-864 don't really deal with division of assets after a divorce.  (There are rare exceptions from especially vicious divorce lawyers who try to use it as a way to get a larger divorce settlement, but that's a civil issue and not anything to do with the government.)

 

Please do inform yourself about what you will need to sign once you are married and filing the I-864 -- that is the more legally binding document, and you'll need to be comfortable with it.  But your larger question about protecting your assets is not affected by these forms -- you'll need to look privately at prenuptual agreements and discuss that with your fiancee.

We are getting close to the time where I need to fill out and send my fiance my  I-134 paper along with everything else for her interview. 

 

We are an older couple, and I have had my own business for over 25 years. I pay myself well over the minimum amount needed for the poverty level part of the I-134, and well send my most recent years tax statement to show that. My company is set up as a corporation C , and I am the only owner of it. I have a fair amount of assets and money in various types of bank accounts. I own my home and have no mortgage, or owe any loans.

 

1. Is it necessary to send my tax records for my company, wont my personal  tax returns be enough evidence.

 

2. Must I disclose all my assets on the I-134.

 

3. Once we are married, I will add my wife"s name to a joint checking account for the 2 of us. 

 

Since I am nearing early retirement age, and plan to retire at 62, I am just trying to make sure that if our marriage didnt work out, I wont loose everything I have, as is many times the case here is US. We have known each other for close to 3 years, and have spent much time together, but even so, a long distance relationship is not the same as being able to spend time together on a daily or weekly basis like we would if my fiance was close by. I know that by asking this, I probably will sound like a very cold person, but sadly, over 50% of marriages here do not work out for various reasons, but I do pray ours will work out. Since everything I have, was earned before us getting married, I am trying to lookout for myself, cause once I retire, I will not be able to get my business back ever again, if our marriage was to not work out. As time goes by, I will most definitely put things in both our names, but am trying to not put my future wifes name on everything right from the start. 

 

I dont know how to ask this type of question without sounding like such a jerk, cause when I read it, thats how I sound to myself. 

 

Hope I will get some answers, and not all insults, but I do understand how this sounds.

I personally would not try that. Since your fiance is from the Philippines, most likely she is Catholic, and they do not allow ceremonial weddings there, but you could have a big party there and pretend its a wedding reception. I mean the main reason for doing this is so that her family can be there for it, just omit the actual wedding part, and have it here in the US. You can always have another wedding in the Philippines at a later date, once she can travel. 

 

Am just afraid that if you did as what you are proposing to do, it might get you in trouble. After waiting this long so that she can come here on a K1, you sure wouldn't want her to be refused entry, and sent home, and then have to start a K-3 or something similar and be apart for over a year would you.

We were notified by mail, from the embassy in Manila on the 27th of January (date I actually received it, but was sent on the 28th of Dec.) that my fiance could now book her interview. In the Philippines the recipient petitioner can select there interview date from whatever dates are avail. But, we have 2 problems preventing us from doing so at the present time.

 

My fiance got her annulment finalized (she thought she did, anyway) back in 2009, before we ever met.  We discovered that her annulment papers were actually not fully finalized, they still needed to be sent to NSO (National Statistics Office) to be signed and make completely legal and finalized, which her lawyer should have done back in 2009, but didn't for whatever reason. Back in March of 2013, she contacted her lawyer, and had her send in the papers to NSO. My fiance had a copy of the annulment papers, that would let us proceed to start the visa process, and the NSO signed papers wouldn't actually be needed til her interview. We were told it would take 5-6 months to get them back from NSO, so in Sept. of 2013, we submitted all the paperwork for her K-1 visa, figuring we would have the NSO papers long before we would actually need them, well almost a year later and we are still waiting for the NSO papers to be returned to her, and no way of getting any info from NSO as to how much longer its going to take them to process the papers.  About 6 weeks ago, her lawyer did receive something from NSO, stating that they wanted to verify that the Judge, and Clerical officer, were who they actually say the are, because they did sign the annulment papers. Seems as though there have been many counterfeit annulments coming from this area in recent months, and they currently want extra proof at NSO as to who signed the documents are actually a real judge and clerical officer. So I figured, no big deal, NSO could pick-up a phone and call the judge in his office and confirm it that way, but no,,, that would be far to easy, instead the want the Judge and the clerical secretary to go to another Judge and sign an affidavit stating they are who they say they are. I couldn't believe it when I heard it, but that's what they want for proof. My fiance's lawyer knows the Judge well, so he complied with NSO demands, although he that it was absurd also, but thats the Philippines. 

 

The other problem, which because of NSO being so slow, seems as though it will work itself out, just not the way we had hoped. My fiance needed to  have a major surgery, but we wanted to try and wait til she got to the US, but because of the NSO delay, her local Dr. said she should have the surgery ASAP, so we opted to have it done on the 27th. of January, in the Philippines. The surgery went fine, (thank God) and she is healing well, but wont be fully recovered for apx. 2 months or so, so seems as though this part will hopefully no longer be a part of the problem. 

 

So now, to my question. Does anyone know how long we can wait to do the interview before all our current paperwork will expire, and we would have to start the K-1 all over again.

The US allows dual citizenship (it allows octo-citizenship frankly) but as others have mentioned it is normally the lawful way one must enter the US to use an American passport. Everything else is up to the other country and their rules. Some older residents in the P.I. have claims to be US Nationals even, from back in the US colonial days. You will be fine.

Yes I was born Filipino citizen.If that is the case, obtaining my former citizenship is not a problem. My kids , my grand children, my parent and my whole family still living in The Philippines. The only thing that my problem if i do not have my dual citizenship I may no longer own a property in the Philippines which is I have to transfer all my properties to my children. another thing is: My husband wants to retire in the Philippines.

I listened to the CD while I am driving back and forth to work after 2 weeks I can answer correctly all 100 question , you can do it too. Yep. I had my police clearance done Jan 6, 2014. My interview was Jan 28th, 2014. The police department dated it completed Jan 10th, 2013. So with my signature/date on the clearance and my receipt, it was enough to prove I had it done in 2014 and not 2013.

First, make sure your police clearance is dated for 2014 (if you got it done in 2014) not 2013 like my local police dept. did.  Second, make sure the letter of intent is the original.  A print of it won't do.  Third, don't watch the people who go  up before you.  It can make you pretty nautious.  I saw six interviewees head for the elevator in tears. Fourth, don't take bags to the building.  I saw roughly 10 people removed from the line to enter the building because they had a bag with them.  Fifth, don't leave cough drops in your pockets.  They really don't like organics showing up on their scan of your stuff.  Six, you can take your cell phone.  They'll give you a ticket and keep it stored, off, in a mail slot.  Must have your ticket to get your phone back.

I had a great time with them.  The nurses, doctors and receptionists were all very pleasing.  My only complaint, which isn't a complaint and has turned in to a great embarassment story, is that one of the doctors spoke pretty softly and I'm hard of hearing.  So, I thought he said take everything off except for my socks and come out for my x-rays.  The nurse told me not to bother doing up the gown so  I didn't.  I walked around that area pretty nude.  Turns out I was only supposed to take my shirt and necklace off.  Good times.

K-1 Fiance(e) Visa Process & ProceduresPacket 3 check-list and signatures

Hello.  I'm going through the K1 process.  Fun times.  I've completed the required forms but I have a few questions about what is needed of me.

 

The first one is signatures.  The US visa people want the forms submitted electronically.  Do the forms need to be signed?  The one has a complex barcode and I'm not sure my scanner is going to reproduce it.

 

The second is the checklist.  It's not very clear.  Most of it doesn't apply (adoption, military service, etc) but some of it is just vague.  "Evidence of domicile" - Will a few pictues of my fiancee's house do? "Two photographs (In colour)" - Two photographs of what?  "Evidence of relationship petitioner - beneficiary" I don't know what to make of this one.  And what is a police certificate?  Is it a records check?
