Thank you everyone, It's really hard to believe it happened this quickly, seriously NOA1 on 9/23 and NOA2 on 10/17?!?! The only thing I can think of is that I was very meticulous about the I-129F petition, I put labels on every piece of evidence and a summary of how me met which referenced the evidence. I will have to post it on VJ.com for others to see and work off of. 

 

So happy!!! The Faience doesn't even know yet :P

I know this isn't an official NOA2 but I should have it in the mail this week, That means from NOA 1 to NOA 2 took less then a month!!

Mexico, Latin & South AmericaASC appointment in different city?

Hey everyone, I will be visiting my fiance this month and found an ASC location near her. My question is, for the K1 visa she will be interviewing at the Juarez Consulate does she need to have her biometrics done in Juarez as well? Also do they need to be done within a time frame to each other? I'm am going to dig around the website a bit to see if I can find any information but if someone has had experience with this I would love to know.

I have a question about the passport stamp, Ideally we would both want a stamp to show as proof, but when we went to mexico, of course only I got the stamp, I have included the stamp in my passport in the petition but wan't really sure what it proved. I guess it validates my trip.

August 7th Update:

 

So no doubt the most time consuming and frustrating part, other then waiting for my Fiance to send her signed G-325A and passport photos, of the I-129F petition is gathering "proof" of my fiance and I meeting. I have been researching vj.com and reading several RFEs and it seems, the number one RFE is the USCIS requesting more proof, even after the petitioner sends in the required and recommended evidence, pictures, conversations stating a meeting, plane tickets, ect. So after reading about primary evidence and secondary evidence and using them to prove your case I have come up with approximately 50 pages stating and supporting my case. Now 50 pages may seem like a lot but the more I read the more it seemed like the USCIS can for whatever reason ask for more evidence, so I figured I would make extra sure to have all my bases covered. Now I am not saying I printed out 50 pages of Facebook chats, that it self does not prove anything, nor does a few photos of us together. Instead, every time I supplied "evidence" I made sure to back it up, after all anyone can fake conversations, so if we made plans to meet, I would look for anything to prove that meeting took place, aka, receipts, photos, FB tags, affidavits. I also included a two page letter in front of the evidence stating my case that gives an narrative with dates and the accopaning supporting document that proves that we were together. Example: "On January 15, 2012 Dalia and I traveled to New Your City together and spent the weekend there, See Supporting Document #4." I felt the need to support every claim because, well, that is what they are looking for!

 

I hoping that this proof is enough It's amazing how after 2 plus years of Dalia and I meeting how it can be so hard to find concrete examples of us being together, we hardly took photos of together, I didn't save any receipts, and we hardly traveled together, at least in a plane or train. Our saving grace is that last month I flew with her to Mexico, and we took several photos, and I just happen to have a few original receipts with me and i hadn't had the chance to delete any of our boarding passes or itinerarieskicking.gif  

 

So my advice for anyone trying to put together their "proof" is that think about, how can you prove your proof? That and check every coat pocket and pants pocket as well as every drawer, because you never know what receipt or ticket stub you might come across!

The example forms here on VJ are outdated, but that is because most of the new versions just came out recently USCIS seems to be overhauling all their forms. The questions are mainly the same though, even if numbered differently. Also, the part about attaching an extra sheet was not a requirement of the old form either. Some people put only what fits in the few lines on the form and some people attach an extra sheet with a longer explanation. Attaching the sheet was just a recommendation and not something that was actually a requirement of the previous I-129F form version.

Ok so I am going to summerize what research I have done up to this point and where we curently stand with the K-1 process. 
 
So when my family found our that Dalia and I were engaged my cousins were the first people to tell me about the "Fiance Visa" with that phrase and google, I was able to wander my way on to the USCIS website and read about the I-129F form which would start the petition for the K-1 Visa.

Instructions for I-129F Form! <--- I read several times and highlighted everything important!!!

After finding these documents there were still a few questions that we had, mostly how long does this process take!!! I asked my uncle and he said 10 months, but then his wife said it only took 4!?blink.png  So off to google I went and searched something like, "Fiance Visa Time" and thats when I stumbled arcoss VisaJorney.com and their guides.
 
I found a nice flow chart:

I was a little upset that VJ.com's I-129F was very out of date, by about 7 years headbonk.gif  As well as their "example" I-129F form. The guide refercens several question numbers that are on the old form, but not the new one and also says, "4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it."[/size] This is incorrect to the current I-129F form. As required I wrote out about a page worth of how we met as "Proof that we Met" and our continued relationship with evidence backing it up, but it does not pertain to any question on the I-129F form, there is however a question on the form, Part 2, 34.a that asks you to "Discribe the circumstances under which you met." And I just wrote a brife discription on the three lines of how we met. This is just an observation that had me a little confuesed at first.
 
So after I read though all the guides I started filling out the I-129F from on my computer, I did what I could and e-mailed a copy to Dalia along with a G-325A Form USCIS Website, an out of date example of the G-325A Form VJ.com and the VJ.com Fiance Letter of Intent Example

I asked her to send the I-129F from back to me via e-mail, but to fill out, sign, and snail mail me the other forms along with a passpport photo and a ticket stub from the Broawdway Show Chicago that we saw together.

So thats pretty much it for now, I have been working on a "proof we have met" packet, trying to round up as much evidence as possible. I'd like to scan it and attach it to this thread so you can tell me what you think, but that wont be til next week sometime. If Dalia sends out her stuff Monday, I am hoping to get the I-129F petition in the mail by mid August, I hope... ClockWatch2.gif

Hello Everyone, my name is Patrick and I was born and raised right here in the USA, and like all of you my fiance was not wub.png  Her name Is Dalia and she is from Mexico. Dalia and I met, believe it or not, in the state of Maine. Over the past two years our friendship grew into a romance that contiuned to thrive and then in July, two weeks before her work visa expired, I proposed to her and she said yes!! We weren't really sure what to do next, she already had a plan ticket home once her visa was up, and she haddent seen her family in two years, so there was little debate on changing her flight plans, plus I was already flying with her to meet her family and spend some time in her native country. We tossed around the idea of doing a quick marrage right here in the States and not telling anyone, but we had little time to prepare, infact I found out after it was too late that in the state of Pensylvainia it takes about a week to finalize a marrage, which we didn't have. So we packed our bags and went to Mexico!

 

Now I am back in the States and my fiance is in Mexico sad.png and we have stated the process of the K-1 Fiance Visa good.gif  I have spent this week doing a LOT of research and to my pleasure have found VJ.com!! Which so far has been an incredible resourse for us! As well as several guides and the correct forms to fill out on http://www.uscis.gov/portal/site/uscis

 

Thoughout the whole process I am going to keep updating this thread and post as much information as possible for the comunity. I'm sure there will be plenty of ups and downs as well as lessons learned that can be shared with the next couple starting this journey.

What do you find to be outdated concerning the filing of the I-129F petition? And what are the other 'lot of it' that you find outdated here on VJ? I know that just last week the form requirements for the K-1 visa interview changed, so the guides have most likely not been updated to reflect that news as of yet. I was wondering what else you have found to be outdated. The admin is pretty good about updating and fixing anything that needs to be.

 

 

 

I shouldn't have used "a lot" I suppose, but I was referring to the example I-129F, which is an older form, the current form has an entirely different layout. And on number 4 of the the k1 guide states to write and attach additional information to question 34 for the form, which is the wrong question. So I guess when I thought about the guide and how the example is almost 8 years out of date, it gave me the impression that everything is probably out of date which isn't true, but it did give me an excuses to approach the entire guide with caution. 

 

Didn't mean to offend anyone Jay-Kay, I am very appreciative of the site and guide and both including yourself have helped me out with this whole process.

Even some of the stuff on VJ is outdated, in fact a lot of it is. What I did is print out the 129f instruction form the uscis.gov website and hi-lighted everything I needed. As I "built" my petition I checked off each thing on the list, at the same time, I was lucky to stumble across VJ, and then checked with some of there recommendations as well as the RFE thread, which is an awesome source of information and I quickly found what a common cause was for errors. 

 

But hindsight is 20/20, look at the good, you have a chance to fix it! Look through all the correct paperwork, read the RFEs and make sure everything is correct so that there are no more errors, and remember, the VJ community is here to help and answer your questions!

For my "proof of meeting" I typed up a two page letter with dates that refers to attachemst that support my claim. As for question 34.a. It is really confusing, I not really sure how I should answer that myself.

From what I have read you would be rolling the dice, if you do have your fiance sign it and send it electronically, don't fax it have her scan it in color and in the best quality and e-mail it to you, then take it to staples or somewhere that can print in high quality. 

 

but again, it's a roll of the dice.

Is this for the I-129F Petition? If so you only need to prove that you have met. I have been doing the same thing, gathering up the two + years of facebook chats and tags that we have but when it boils down to it all you need to do is prove that you have met, so I pulled fb chat that stated we had plans to meet and a conversation that said " it was fun hanging out with you" or something like that. I also printed out several "tags" we had of each other in the same location and matched them up with hotel receipts. I am also including plan tickets from when we flew together and some affidavits from family and bosses saying they saw us meet. 
 
Again don't confuse "proof of meeting" which is mandatory for the I-129F Petition with "proof of continued relationship" with is required for the interview by the consulate... sometimes....

Update on the Taxes, I did some research and found the form that she needs to fill out, its the IRS 1040NR and in her case it will be the 1040NR-EZ. This is a tax return form intended for "Certain Nonresident Aliens with No Dependents" I could not find anything in the "Instructions for Form 1040NR-EZ" that said she was exempt from paying taxes if she made under a certain amount.

So my fiance has begun to gather up the information she needs, turns out she doesn't have any W2s because of the way she was paid so hopefully we can get something together and get the ball rolling on this.

There is an interview with the head of the VT filing center on VJ.com and he said himself that when he use to be a filer he would just make sure the signatures were clear, but that it was his discretion and others might not be that lenient. The instructions do ask for originals and not copies, so really you are taking a chance when you send in copies. If you get an RFE you will have to mail the originals which will delay your process, if not, then you were able to sneak it by.

Alright, since these first two letters will be going along with the petition packet to the Dallas, TX lock-box, then I will just have both of them addressed there for now. When will the follow up letters of intent to marry be needed? Would we need to have these written up as soon as we found out that the petition was approved and she is filling out the paperwork for the K-1 visa on her end?

 

I have a good friend who also married a Chinese woman and they hired a lawyer. He told me that their process was fast and had no hangups. He recommends that I hire a lawyer, but he told me it will cost around $900 minimum and we both currently don't have the extra money to afford a lawyer. So that is why I am trying to make sure I have everything down, to avoid losing time over making mistakes.

 

The follow up letters are needed at the interview, so I would sign them as soon as you can before the interview, they will be looking for the most current proof that you still intend to get married. 

 

There is a lot to this process, some prefer paying a lawyer to do it so they don't have to worry about it. The process wont necessarily be any faster, having a your forms filled out by a lawyer doesn't put your petition to the front of the line, however the chance of an RFE is a lot less likely therefore the process could go faster. You seem like you're getting your head in the game, and your last few post seem like you are doing your research, there is certainly plenty of help here, if you think you have the time and diligence and are willing to accept that you might get an RFE, which isn't the end of the world, I'd say keep your $900 and do it yourself.

Hello everyone to those who got RFE.

 

My fiance received an RFE asking about affidavit from friends. what we did is asked our friends to write a letter and sign them. Whoever here has the same RFE like ours please share your experience. I need to be enlightened if we did the right thing. Thank you.

 

 

I have not got an RFE, but an affidavit is more then a letter, there are uscis guidlines here: http://www.uscis.gov...00048f3d6a1RCRD

 

And an example attached. The affidavit has to be signed and witnessed by a Notary.
