To answer your questions: It will take approximately 5 months for the first stage of the process. Look up Loto's EZ guide to the process, it will tell you everything you need to know. You're in the queue, just sit tight till about March of next year before getting antsy for your NOA2. Your I129-F is likely not valid because from what I understand that is for a fiancee visa and you two are already married.

For your main question, as long as she brings proof of ties to Spain (lease agreement, letter from job stating when she is to return to work seem to be the best proof, not to mention a return ticket) she likely won't have any issues getting into the US. She may be asked for it by the customs official, she may not, it all depends on them. There is always the possibility that she will be denied entry.

File copies or transcripts of your most recent tax return with the AOS form (can't recall the numbers right now). (Transcripts are free to get, just have to fill out a simple form with the IRS.) If you need an additional sponsor because you can't meet 125% of the poverty level, that person will also need to file copies of their tax returns, plus I have heard you will need to provide proof of your relationship with that person.

What to do while waiting? Get prepped for the next stage: NVC. Read Loto's guide, and figure out what documentation you will need, and what you will need your spouse to get and send to you. You can find all forms here. Check to see if you're going to need a co-sponsor for the I-864. (you have to make 125% of the poverty level if you're only going to be supporting your spouse and yourself; if you have any dependents, the percentage of the poverty level goes up with each additional.)

The US Government doesn't care that she's a permanent resident of Canada, as long as she is still a citizen of the US. Her residency of 5 years however means that you are eligible for DCF processing; and since you have been married for more than two years, you will be getting an IR1 visa which gets you a 10-year green card without having to adjust status after two years in the US.

Hi again all,

I have my portion of the K-1 complete, and I am now waiting on my fiance to mail me her portion. During my discussions with a friend that is in process of K-3, he says if your passport will expire in less than five years, I man have to get another passport.

When he told me this, it sounded like normal visa rumor and misinformation, so I knew where I could get correct information...here! I searched the USCIS website and didn't find any info that would help.

My passport expires in 2010, is that an issue?

Yes, others have stated they were approved even with criminal background. It depends on the charges. From what I understand by reading the form: No sex crimes. No domestic violence. No violent crimes.

And then I purchased a round-trip flight ticket from Taiwan to San Francisco. I did not have a letter from a company since I didn't work, I did not have a lease or mortgage in Taiwan, I did not have any strong ties to Taiwan excepted the return flight ticket.

When I arrived at the SFO Int'l airport. I stayed calm and confident. The POE officer only asked me 3 questions with smile:

1. Are you a student? No, I am a visitor.
2. Who are you visiting on this trip? My boyfriend.
3. How long are you going to stay in the U.S.? 2 months.

The POE officer did not know anything about my K1 visa. He looked at my passport, asked me questions and said have a fun trip!

So for those who are wondering if you can visit the U.S. while waiting for the K1 approval. My experience might be able to cheer you up a little bit! It's okay if you don't have strong ties to your own country. Just don't be panic and be polite when going through the customs. They won't eat you.

We were approved 8/29 and I called the NVC automated line today and put in our EAC number. The system said we were not in the system, call back in two weeks.

I think others say that the system is very slow to be updated. I sent a email request after the call. One poster here stated they had a return email in three days with their NVC number.

That is good enough for me.

Drivers licenses are dependent on the state where you will live. All states have different rules. Usually if you go online and try looking up (example: DMV California) and you should be able to find the requirements.

I am new here. I just filed my I29F for the K-1 visa. Thankfully I found this great website about 2 months ago and I have to say that the information and help found here is outstanding. So, I got my NOA 1 about 2 weeks ago and now the waiting game begins...

Anyway, I have a question regarding proof of the relationship. I only visited my fiancee once every year since 2009. I normally stayed one month with him. I wonder if this is enough or should I be worried?- I can't visit him more times because of my work and school (working toward my PhD). What do you guys think?

Documents such as birth certificate, and divorce documents NEED to be translated. However, you might get lucky and not get a RFE requiring the documents to be trasnlated to English...

If you're planning on getting married in Peru anyway, you could wait it out and do the DCF for the I-130 through the embassy there. You won't have to go through the extra hassle of the Adjustment of Status process then, and your future hubby (or hubby) will have his greencard & authorization to work immediately.


I totally agree with you. The OP already lives in Peru. I think it makes more sense to get married in Peru and files for the I-130

You need to contact USCIS and find out about your case. Since a tourist visa is only given to individuals who have strong economic and family basis in their country (so they are not trying to stay in the US illegaly), I think the K-1 visa will affect your fiance's chances. My take is that the embassy MIGHT think that he is going to stay with you in the US and marry you there, so he can stay longer. I could be wrong. All I know is that the embassy in Lima is very particular about giving tourist visas.

I will check the county and state regulation for applying for a marriage license. For example, in Athens, Georgia, you apply for a pre-marriage certificate, which last for 6 months until you get married, then after you r married, you get the certificate the same day. Some counties have discounts (about 50% of the marriage certificate) if you take a pre-marital orientation class. Each county and state is different and have their own rules. I think it is important to do a little research to have an idea about this
