K-1 Fiance(e) Visa Case Filing and Progress ReportsVermont Service Center frustrations...
QUOTE (rockhouse @ Jul 23 2009, 10:34 AM) <{POST_SNAPBACK}>
Has anybody here had to wait over 140 days from NOA1 to NOA2? We are at 143 days right now and getting a little upset over this sh*t.
The clowns over at the Vermont Center seem to just randomly pull cases to process, which is unfair.
I'm just curious how many here had to wait over 143 days for their NOA2.
Thanks.

I am sorry you are having such a long wait time. Maybe they are upgrading Vermont. It looks like so far this year Vermont has had more petitions than California in some months. God bless and a speedy interview.

Great news!!! Next up..Interview, Visa in hand, CFO and a safe flight to the States.

Thanks. I will be bringing Pat into the Minneapolis Airport. I will drive from Marion, Iowa to Minneapolis to meet her and welcome her to the USA. The Minneapolis Airport is so huge compared to the Butuan Airport or even the Manila Airport, it will be a big change for her. This way I can meet her right outside of the customs security area.

QUOTE (Allie and Nigel @ Aug 22 2009, 05:28 PM) <{POST_SNAPBACK}>
Got the k1 NOA2 already, however I got nosy and called the NVC to check status....the young man said the case was received Friday 14th Aug but it is in Additional Processing...I was like...ok.............then I called 2 times this last week and neither said that, just that its there and in processing....then TODAY, Saturday, I got that so called standard letter dated Aug 20th stating that they have the petition and a new CASE# and will be forwarding it to the embassy within a week. So do I go with that or do I still think I'm gonna be the "STUCK IN THE NVC" bunch and have to WAIT who knows how long till they process me? I'm totally confused on that, part of me thinks I should just think NORMAL, till otherwise noted. But then others have probably got that notice and are still in genuine AP.
So i don't know what to think now!

Congrats, the long wait is very near. The next things will be the 3 rd package, which I discovered does not exist at least for the US Manila embassy. There was a URL address on the NVC letter; the one with the case number. I opened the State Department's website and found that by selecting the MNL embassy and clicking the consulate specific information there was a link to a document that apparently replaced the 3rd package. At this point the fiancee can call the embassy for an interview appointment once all the forms and I-134 documents are ready. In the UK the US Embassy may still be sending out a form that is packet 3, which needs to be sent back. Good luck and God bless.

Hello Friends

My petition for a K-1 sent beginning of this month (around 8th or 9th) to CSC. INS has cashed my ck for $455 on Monday (April 27th). I have yet not received NOA1 or case number. How soon I should expect this information? Is there a any other way to find out this information? I have also found typo on #15 of I-129F is that critical at this time?

Thanks in advance

Good luke to you. I sent my I-129F package in on April 17 and it was signed for on April 20. I have been waiting for my NOA1 ever since. I hope to see in today's mail.

I do not exspect to hear from them for awhile but my check has not been sent to my bank and this does concern me. Any other time I have delt with the Feds my check to them gets posted to my bank account in 48 hours. Do they sit on an I-129f check while they process the petition? I have tried to call the assistance phone that is listed in the Gov't site but it only leads to endless choices for recorded information never a choice to speak to anyone (even though I know the wait time, like for the IRS, would be very long) Any advice? other experiences? It might be a couple weeks before they cash your check. My petition was sent on either 8th or 9th of April and check was cashed on 27th. No NOA1 either for me. Hope this helps.

Good luck

That seems so odd how the check is cashed so you know they has to open the I129F package. It is so hard to wait.

K-1 Fiance(e) Visa Process & ProceduresPetitioner's Interview
QUOTE (pRetTy_aNgeL @ May 11 2009, 07:21 AM) <{POST_SNAPBACK}>
For K1 Visa, the petitioner is not required but they are encouraged. But still it is 100% the consular officer's decision to allow petitioner in the interview room. In all cases petitioner's participation is not required or desired unless the officer asks you something in particular. The purpose of these interviews is to judge the fitness of the foreigner for entry/residence in the US and to satisfy the examining officer that the foreigner is entering into the arrangement with full knowledge and free will.

Thanks. That is why then that in one post where the petitioner appeared with the beneficiary there were odd questions like what each other had to breakfast and what the favorite foods are. I keep telling Pat that it is important to me that she feels fine with the whole process and at any time if she feels uncomfortable things can be put on hold. It is good that the embassies or consulates assure the beneficiary is doing this by free will. I told Pat that if at anytime after she arrives in Iowa that if for any reason she feels it is not for her I will see that she gets passage back home. She is my best friend and I want the best for her. Thanks for the perspective.

For the visa, NO. Generally, even if the petitioner goes to the beneficiary's interview at the consulate they will rarely, if ever be asked any questions. Some consulates "de facto" require the peittioner to be present, though it is not "official" I have not heard of this for Manilla. The Petitioner will (usually) be involved in the AOS interview, IF there is an AOS interview. My involvement was to be called in and told the green card was approved and what forms to file next (I-751) but many AOS interviews get quite in depth.

Thank you. Maybe it makes a difference with the local office where it is done. I talked to someone that had his in Des Moines, Iowa, which is where mine will be. He talked like it was not much.

Thanks again,

I know how waiting seems to take such a long time. I have read in some posts how Califiornia was so slow. Maybe after the number of service centers was reduced to two both centers had to expand their capacities. I sent my I129F to the California center on April 17th and no one has signed for receiving it as of Friday 24th 2009. Some seem to get the NOA1 in just a matter of a few days. I know it is hard to be patient, but it will come for you.

My friend entered the US on a K-1 to get married - the relation soured. He saw his old girlfriend who now lives in the states. They used to date back in his country. They are now talking about getting married before his I-94 expires (90 days) and he needs to leave the US. I told him that on the K-1 he needs to marry the person who petioned for him or leave within 90 days. He said that his old girlf friend spoke to a lawyer and that it could be done if they can prove it is a bonafied relationship. I told him I don't think it is possible. Any help would be appreciated. Also I was looking for other treads on this topic but didn't locate any.

That scoundrel, you are supposed to be the love of his life. Maybe he was using you to get to the USA. It is was or was not, he needs to be reported to the USCIS. Tell me his name and I will report him. He made a commitment to you and he needs to make good on the commitment. I do not want bums like that coming here. If your relationship went sour he needs to do the honorable thing and that is to go back.

Someone might be able to answer this better, but you probably should have sent the petition to the address that was listed on the form. If I remember correctly....it was a PO Box. It may or may not matter...

Yes, I sent mine to a PC Box number. I got the address off of the instructions for the I-129F. I also had my check cashed 15 days after USCIS received the package.

K-1 Fiance(e) Visa Process & ProceduresDocumented Evidence
QUOTE (ThePirateStar @ May 14 2009, 09:09 AM) <{POST_SNAPBACK}>
I'm in the middle of applying for a K-1. I've read the FAQs on this site and everywher else, but I had a quick concern.

For Documented Evidence of meeting within the last 2 years, I have my receipts for my airline tickets and confirmed booked flights, but I do not have all my boarding passes. I have the one for the last time. Will those count as evidence, or do they only look at boarding passes? I may have them laying around (which I will begin looking for) but the only one I know for sure I have (unless it got left at my fiance's lol), is the one for my most current visit.

I would try to find the boarding passes all that you can find. If you have any of the online e-mails from the airline as an itinerary and receipt I would submt those with any boarding pass. Of course it does not prove you are there, but the more evidence you can send it does add up. All you have to prove is you met within two years. The worst the USCIS would do is sent an RFE, which I guess would mean you need to take a visit. With your pictures you are proving you are together. Even if you have one boarding pass at or close to your destination the date on the boarding pass will say you were there within two years.

Good luck and please post how it all turns out.

im confused with this....

my fiancee have 1 full time and 1 part time job.. and his monthly military drills (because he is a reserve).. BUT comes MAY 2009 he was activated and now a full time military personnel ...

so my question is...

will he get a letter from employer from his 2 jobs?

or

will he just get the letter from the military??

THANK YOU

That letter you are talking about is for the affidavit. Yes I gess to prove employment and how much money someone makes a letter is needed. I think it will bepend if the full time position is still retained. As long as he in on active duty he is only making money from the military service. The only thing he can do is try to get the letter and maybe get one fro the military service.

K-1 Fiance(e) Visa Process & ProceduresI-129F - How I made the application package
QUOTE (gf97 @ Apr 29 2009, 10:15 AM) <{POST_SNAPBACK}>
How to make the I-129 F petition folder/package to send to Immigration: how I did it:

Ok. This is what I had: the US Citizen will be the one doing all the work at this stage. All the foreigner has to do is sign 4 sheets of paper and submit passport pix to the US Citizen, so that the US citizen can start putting the application together.

First, I bought a manila folder, the kind that opens up, like this http://en.wikipedia....iki/File_folder

On the cover of the folder I glued a sheet of paper that said, “ I-129F petition” . And I put our names on it.

Ok, now the inside of the folder:
First I put 2 holes at the top and I two hole punched everything, all the papers.
I fastened everything with the ACCO fasteners—
http://www.instaoffi...992-ctn.0.7.htm

Then I had dividers, the kind you put in a Binder with the colored tabs, they are three hole punched on the sides, but I 2 hole punched the top.. these kind of dividers: http://www.jiffysupp...Dividers/Detail

With these dividers they come with the sheet of paper that allows me to write in what the topic is on the tab.

Ok, so now for assembling—everything I am saying applies to the US Citizen—

A. The first thing you will put in the folder will be the I 129 Cover letter. This letter will look like the following (look below for example - edit it based on your needs. And make sure you put the right USCIS address on it—vermont, Ca, or somewhere else):

US Citizen name,address, number

United States Department of Homeland Security
U.S. Citizenship and Immigration Services
Accurate address

Date

Nature of the submission: I-129F ORIGINAL SUBMISSION

To whom it may concern:
Enclosed please find my form I-129F, Petition for K-1 Fiance(e) Visa for (put your fiance(e) name here), and supporting documents.

Contents Include:

-Payment in the amount of $XX – whatever the current amount it—look here:
http://www.uscis.gov...00045f3d6a1RCRD

-I-129F Petition
-I-129F Supplement: Part B, Question 18, Explanation of meeting in person
-G-325A and Passport Style photograph (petitioner)
-G-325A and Passport Style Photograph (Beneficiary)
Letter Certifying intent to marry (Petitioner and Beneficiary)
Petitioners Birth Certificate
Petitioners Passport –(copies of passport and all the entry /leave stamps that sghow you visited your persons country)
-Letter Certifying intent to marry (Petitioner and Beneficiary)
-Proof of having met in person in the past two years (state the proof you are including)

Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an immigration or consular officer at a later date.

Sincerely,

your name, sign it
-------------------------

Ok, so lets talk about the contents of the package:
1. The petition –the I-129F petition- you the US Citizen will sign that petition.
2. i-129 F supplement: this is just a brief detail of how you met your honey.thats all—just type it up on a sheet of paper because that box they give you in the petition is too small. Sign it and date it.
3. the G 325 A- the Us Citizen will fill out 4 copies of it and sign each copy. The immigrant also needs to sign four copies of it and sign it. You will see how each copy says something different in the left bottom corner, like consulate, etc. Make sure you, the US Citizen send immigration the copies with the ORIGINAL signatures. So if you need to send the immigrant the forms to sign and then have that person send them back to you in the mail, that is what you will have to do.
Make sure you fill out these forms accurate and accordingly. Look here for
examples of how to fill out the form right.
This website is GOLD!!! Look at it because it gives you EXACT examples of what you will need: Look at how they filled out the I-129F petition and the G-325A.
http://www.visajourn...p;page=examples

4. You and your honeys passport pictures. Write your name in pencil on the back of your passport picture and on the back of the foreigners picture, write their name and “ No alien number” on the back of the foreigners pix cuz they probably dot have an alien number... When your foreigner goes to take his/her passport picture , make sure HE/She tells the photographer that it is for a US PASSPORT/Immigration, so that the photographer will give the foreigner the picture in the RIGHT size. It needs to be the right size.
So when you have the picture, and you have written on the back, stick it in a clear Ziploc bag. Zip up the Ziploc bag. Print a sheet of paper that has your name on it. Put the picture in the bag. And staple the bag to the sheet of paper that has your name on it. Do it for both pictures.

Proof of relationship:
You , the US Citizen, can include: used phone cards, copies of envelopes you have been sent through the mail, some emails, some Skype calls, pictures, your plane itinerary when you went to the foreigners country, the boarding pass, the stamps in your passport are proof, receipts of things you may have purchased while in the foreign land, the stickers they stick on your suitcase that show the destination, copies of the money receipts you have sent to the foreigner- like money gram or western union, post office receipts that show you sent something to the foreign country.

On the back of the photos, make sure you write your names, date, and where you were in the photo.

ASSEMBLING
So you will have the manila folder and all your stuff will be 2-hole punched at the top. Don’t STAPLE ANYTHING – only staple the Ziploc bag with the picture to a white sheet of paper that has your names on it. So you will only use two-3 staples.

Ok, you have your manila folder:And all your papers, including the dividers that are 2 hole punched at the top
1. get your cover letter , the one that says what is in the folder, example above. Type this letter (US citizen) and date it and sign it. turn it over.
2. get the divider and write i-129F on the white tab that comes with it. Turn it over.
3. get your 1-129F petition form. Make sure it is signed and dated by the US citizen, Hole punch it and turn it over. Take your 1-129F supplement, sign and date it and turn it over
4. get the divider and write G325A. turn it over
5. get the US Citizen G-325 As. There should be 4 with the same exact data, all with the original signatures and all signed. All 2 hole punched at the top . Flip them over
get the US Citizen photo. Write the name in pencil on the back. Stick it in a Ziploc bag. Staple the bag (make sure you don’t staple the actual picture) to a sheet of paper that has the US citizens name on it. Flip it over
get the foreigners G-325 As. There should be 4 with the same exact data, all with
the original signatures and all signed. All 2 hole punched at the top . Flip them
over.

Get the foreigners pic. Write the name in pencil on the back and write ,”no alien number”. Stick it in a Ziploc bag. Staple the bag (make sure you don’t staple the actual picture) to a sheet of paper that simply has the foreigners name on it. Flip it over

6. Get the divider and write : Letter of intent on the tab
7. print out the letter of intent which should have original signatures by both of you. Us citizen can type the letter and email it foreigner. Foreigner prints it, signs it, and sends it through the mail to U S citizen. Then Us citizen gets that letter and signs his/her signature too—this way two signatures will be on the same page. Hole punch this letter and flip it over.

8. Divider – write birth certificate or passport . Flip it over on top of everything else that is flipped over.
9. Get your birth certificate. If you don’t have it, you can submit a copy of the pages of your passport (copies- do NOT send the original of these document). On the copies of your passport pages, highlight the stamps which show when you visited the country of your fiancé. Hole punch the copies and flip them over.
10. get divider tab and write : Proof
11. Now, put a sample of your phone cards on a photocopy machine and photocopy the front and back, if you have any. Hole punch, flip over.
B. Print phone records of the times you have called your foreigner or/anf when the foreigner called/texted the US American. Hole punch, flip over
C. Us citizen should photocopy plane itineraries, boarding passes, luggage tags. Hole punch the photocopy and flip over.
D. US Citizen should photocopy envelopes he/she has received from foreigner. Hole punch and flip over.
E. US citizen should photocopy money receipts he/she has sent. Hole punch and flip over.
F. US citizen should photocopy some emails that have been sent to each other. Hole punch and flip over.
G. US Citizen should photocopy receipts from post office showing he/she sent packages/letters to the foreigner.
H. US Citizen should submit pictures of the couple together – at least 2. Make sure you write your names and locations on the back of the pictures..Put these pictures in an envelope or a strong Ziploc bag.Seal the bag and punch two holes in the bag so you can fasten it. Flip it over.

That’s it. Now flip everything over and put it on the fasteners – the two pronged fasteners. Everything is in order. Get a paperclip and attach your check/money order to the cover sheet in the folder. Everything is in order – make sure your pictures are not backwards. Make sure the check is the right amount.

Now, make two copies of this file—the petitioner and the beneficiary will need EXACT copies of the file. So now you, the US Citizen, will have 3 files which are IDENTICAL. Us citizen keeps one for themselves, foreigner will eventually get the other copy when the US citizen gives it to him/her, and the copy with the live check will go to USCIS.

Send it off and wait.

It does sound like you have put some thought into the packaging of the submission for organization. You have come up with a good procedural process. Your post may be of interest to someone trying to figure it out. Before I put mine together I ran accross a page at the USCIS site that advised not to use folders and dividers. The reason was for filing the petitions. This is the web page: http://www.uscis.gov...45f3d6a1RCRDThe Acco fasteners were advised because it made the package easy to disassemble.

Dale

K-1 Fiance(e) Visa Process & ProceduresEMPLOYMENT LETTER
QUOTE (L_0_V_E @ May 19 2009, 05:10 PM) <{POST_SNAPBACK}>
Im confused with the employment letter. my fiancee was activated this may (because he was a reserve)... so the only letter he have.. is THE EMPLOYMENT LETTER (for his other 3 civilian jobs) from the military that states that he will be activated and will be deployed to afghanistan this august...

is this enough??? or should we still get the employment letter from his civilian jobs?

thank you

Some companies will not issue a letter on letterhead or otherwise, but will furnish a toll free phone number, or in the case of my company; they go through an outfit called The Work Number. They furnish employment verification and employee pay. What makes it difficult is when he was put on active duty. If it were me I would go back to the employer for the information and verification. The more the better.

K-1 Fiance(e) Visa Process & ProceduresWorries about timeline and considering options, need immediate HELP!
QUOTE (mandahulusi @ Apr 29 2009, 02:31 PM) <{POST_SNAPBACK}>
Hi,

I got my I-129F package completed and ready to go but have some last minute reservations about sending it.

I consulted a lawyer yesterday, asking how long this process can take and she said it would take 8 months at the shortest and getting married on a tourist visa would be safer and quicker. The safer part, she argued, is due to the fact that she will be over here in the US anyways so there will be less people and paperwork involved that is going to travel to the other side of the world and thus, less can go wrong. The fact that she already has the tourist visa and she already visited me once with that visa and didn't overstay is another strong argument for this option.

When I asked her about the visa fraud thing, she said there is no way they can prove her intentions were to get married when she was entering the US and they usually don't even bother if you do it after 3 months she enters. This is the third (yes that's right, three in three in fact) lawyer suggesting me to go the "illegal" way and I'm very confused right now.

I know once I send my I-129f, there will be no turning back and the tourist visa option will be gone forever. And if after that, the K-1 visa takes like 10 months or even more to get issued, I would be very frustrated to have chosen this way. And as far as I can see from the other posts there are like infinite possibilities for stuff to go wrong so that the process takes longer and longer. That is something we cannot afford.

I'm in desparate need of help on this decision and the more confused I get, the later the process will start.

Another question I have about the timeline is that it says on the USCIS website that the timeline is case specific. Most of the couples I'm seeing here in this forum met on the internet, whereas I grew up in my fiancee's home country, we actually met in college and have been dating since. We even correspond in the native language of her country. So is it safe to assume that these facts might shorten the process?

PLEASE HELP!

Oh, one last question: Do I need to get my passport copy notarized?

thanks

I know someone that married a Canadian. Canadians can come here without a visa for short stays. Getting a visa has turned out to be a nightmare. So they spend half there time in the US and half in Canada. Forget the visiting visa, go for the K1. Send in the package.

First I would like to say this site is Awesome there is a tremendous wealth of information here. I was planning on using a lawyer but I am glad I found you guys. I guess the whole process seemed a little intimidating, but you guys help ease these fear. good.gif

I am currently in Mexico with my SO and I don't want to send the petition through regular mail. We all know that it could take weeks for the petition to reach USCIS through "snail mail" and this process is long enough no need to add extra time. Do you think I should use FEDX or DHL? Also would I have to use a different address?

Thanks for the help!

Andrea

One things to consider when sending the petition is the service whether it be UPS, DHL, or FedEx is the address to the USCIS is a PO Box number. Make sure they can deliver to a PO Box number. I sent mine by regular mail, but I did do it from inside the US borders. I know UPS does not deliver to a PO Box number. That may be a good question to ask DHL or FedEx in deciding which one. It maybe you will have to use regular mail if none of the carriers sends to PO Box numbers.

My fiancee holds a degree in Education and was a scholar. I am trying to get her certified in Florida so she can teach here upon arrival. Will the Embassy view her degree and the fact she is a Certified Licensed Teacher as a plus in evaluating her as less likely to becoming a public charge. My I-134 should hopefully be adequate as well, but you never know. Any opinions?

I think others have answered the I134 question, but it will not hurt to get the teaching certificate in Florida. From what I have heard the degrees in the Philippines do not always have the same weight as here in the USA. I do not know about a teaching degree, but I have heard of this will Filipino doctors not being able to be doctors i nthe US Navy, but they are medical assitants and need a few classes to become doctors in the USA. It may be the same for teachers. My fiancee may be able to answer the question better than I can.

Hello everyone! I just wanted to ask what are the evidences you prepare for proof of relationship. I have heard from friends who were approved that they had snail mails. Unfortunately, my fiancee doesn't want to do the snail mails. What if we don't have the snail mails, would that be a demerit?

I would appreciate any advice you may give to enlighten me... Thank you in advance... God bless us all innocent.gif

It will be interesting to see what happens. My fiancee and I have had some e-mails, one snail mail, but many many IMs. So maybe they may alos look at how often you talk by what ever method you talk. The nice thing is if the internet is fast enough at both ends you can talk using voice. My fiancee's internet slows at times so the voice drop to nothing, so text works fine too.

I've read on previous topics that exchanged e-mails are good for proof of ongoing relationship. I'm wondering how I should pick them? Can I just pick random e-mails from the both of us or whatever e-mails I include should have a "time line"? For example: if I add one e-mail from him, the e-mail from me should be an answer to that e-mail of his? I'm confused. I'm sorry if I don't sound very clear.

I picked random e-mails. I added 3 from him, one from 2007, one from 2008 and one from 2009. From me I picked 4, from 2006 to 2009. Should that be ok? Please tell me how you guys did it. I'm afraid I will get an RFE if that doesn't sound very consistent to them.

I was wondering about e-mails and instant messages. I did like you and picked a few random e-mails plus I created a listing of all the e-mails and printed them off. That way USCIS can see all the e-mails over time with some samples. I did the same for the instant messages. I hope I did it right.

We communicated for months via Skype Video and everything was going ok, then yestarday she "went off" on my telling me that i am not strong, a whinny guy, i told her i loved her too much and so on. Lastly i was to see her in July and her comment was "if you do not listen to me do not come to me in july" So, am i wrong for canceling this? is her heart not in the right place..?? i do not think so.. With that said, what format? i understand it needs to be notarized and sent to same address as i sent the petition. Correct? Finally,, can i file again at a later date without a waiver... I write this with a heavy heart.... Dan from seattle..

Dan,
Being apart and waiting is very stressful. If you are feeling she is not the love of your life, and if that is what you want; the love of your life, well... . You might want to consider if she is showing you disrespect and trying to control you in some way. As a wife she is to be a help mate. I can understand a woman under stress can say things they do not mean. That is rough, but only you can decide what is right. There is nothing wrong with a waiting peroid. Good luck.

If this does not work out you may want to meet an Asian woman. They are taught to respect the husband and take care of the family, but also expect the husband to be kind and loving plus help to care for the family. Only you can decide what is right for you.

My K1 visa app is going on 5 1/2 months and up to this point Ive been good and refrained from calling uscis but I saw where CSC has updated thier K1 dates to 5 months so I was now over the alloted time frame so I called and after much ado finally got to talk to a real person. Told her my date was over what it says on the website and she said" has it been 6 months yet sir?" I say no but your website says.... she cuts me off and begins to read from a script basically telling me in legalese to go and F@#k myself until its been 6 months. Very rude to say the least.
I realize she probably gets a million calls a day but if I treated my customers that way Id be out of business.
Has anyone else had similar experiences with them?

I see the 5 month goal is to be achieved by the end of 2009. To get such an average they may process some of the easiest ones first, then it decreases the average cycle time. If you are at 5 1/2 months now you should be done soon. Good luck.

I'm getting ready to start the K-1 process. My fiancee had talked with somebody who just got their K-1. She said it took about 1 year and that they used an immigration attorney. I've noticed a lot of people on this site have had their visa from The Philippines after around 6 months.

Did most of you file for the visa or your own or did you hire an attorney? The girl suggested we use an attorney. Since I have obviously never gone through this before and I hear about problems a lot, I was starting to consider it. Now that I have found this website, I'm gaining some confidence for doing it myself. I can't see how much a local immigration attorney could do other than fill out the forms, and I'm a little skeptical of the websites out there that claim to work the entire visa process. It seems like an easy scam.

I guess I'm just looking for other's opinions or reassurance.

If you use the link at the top of the page called Guides it will take you to the K1 guide. Use the guides as your main source of info. Also use the PDF files from the USCIS for filling out some of the forms. I used the K1 guide with the exception of final assembly. I used the recommendations from the USCIS in using the two hole ACCO fasteners and tabs at the bottom of the pages that divide the whole package according to table of contents. Yes, do it yourself.

I am just starting the K-1 visa process. I wanted to hire an attorney to make sure everything was done right and I don't screw anything up. Has anyone out there used easyfiancevisa.com? They seem to be cheaper than anyone else, but also seem to be fairly new to the game. They have been very prompt and through in the conversations I've had with them. I know they're a main advertiser on this site....anybody have personal experience with them?

You might want to save the money and do it yourself. To file the I129F petition it really is easy. The hard part is putting the information together and getting the information, which you have to do even if you have easyfinancevisa.com do it.

Here is my thought for having easyfinancevisa.com do it. If there are not complaints from a forum at this site and they have been advertising at this site, they are probably a good bet if you want to have someone process everything for you.

Good luck on your journey

QUOTE (jegcs @ May 28 2009, 05:43 PM) <{POST_SNAPBACK}>
I came to the US through a Fiance Visa. My fiance is a doctor. When I got here, we decided to wait at least before 90 days to get married so we would know each other more because though we've been talking with each other for almost 4 years, we've only spent time in person for a week.

To cut this story short, my fiance had been seeing this girl whom he dating or have been dating for 10 years. Because of my work background, I am able to access information from him including emails, pics, call logs, sms's and other information which he is unaware that I have access to. So basically, this is not accusations, I have profs and picture with dates on it. The worse part is when they both flew to vegas 2 months before I came here. This is evidenced by dated pics and credit card bill statement and confrontation with him which he admitted.

I am decided to go back home to my country because I can't marry him because of what he did and his incapabilities to recogniize his mistake and make amends to them. I have given him lots of chances, tried to work things out with him and compromised for him. I have dealt with his repeated infedility to me until my few days before my visa expires. He is unwilling to correct things and that is why I am going home.

Is there anyway for me to stay in the states "Legally" without having to marry him? What processes would there be? If none, I am more than happy to go home and restart a life and hopefully get my job back.

Pat and I are sad to hear of your unfaithful fiance. There are other men somewhere that would want to meet you and make a good faithful spouse. As far as I know you will have to return to your country.

Meeting the right person makes all the difference. Pat an I just developed and interest in each other and there was a chemistry like I have never experienced with anyone. It built over time, then we met in person, and the chemistry seems the same and I felt very much at ease with Pat and I can just be myself with her. She has expressed the same with me. The best to you on your search, your prince awaits.

We're considering the ramifications of getting married in Mexico, applying for the Spouse Visa, then I as a Mexican resident with a US Tourist Visa, 'visiting' my husband using that while we wait for the Spouse Visa. Can someone be kind enough to tell us if that's the way we should proceed? What is the best option for us - the Spouse Visa or the Fiancee Visa? Or, could we apply for the Direct Consular Filing?

Thanks! Blessings

If you have not found this page at this site here is the link http://www.visajourn...page=compare#k3

There may be more paperwork with the K3 than the K1. According to the California Service Center both takes 5 months now. I met someone in the Philippines and I am going with the K1. Everyone tells me it is less hastle than the K3. I thought that a Mexican can visit the USA without a visa and vise versa. If this is true you can still visit while you wait.

K-1 Fiance(e) Visa Process & ProceduresK-1 doubts
QUOTE (Carolina+James @ Jul 1 2009, 02:21 PM) <{POST_SNAPBACK}>
I'm starting my K-1 process this month, but a few doubts persist, and I still haven't found the answer. I'm sorry if maybe the answers are already around and I could not find them yet, and some of them I believe to be more specific to my case.

As of our case, in short: I am Carolina (brazilian) and my fiance is James (american) and we are both free to marry, I have no children, and he has two kids who live with their mother, to which he pays child support. We met each other online, knowing each other for a year and a half, and spent 6 months living together. I went to US and spent the whole time provided to me, 6 months, and came back respecting that time.

-------------------------------------------------
The first one is: from the documents that my finace needs to send the first package (I-129F), which need to be notorized? Or is that uncessary to all of them?

As far as I understood, I need to send him, so that he can send the I-129F:
- my "letter of intent"
- my G-325a, all pages.
- my picture, passport style (5x5), name written behind with pencil and keep it in a plastic with label written "Photo of <my name>"
- copies of the proofs of relationship that are with me.

So, with that in mind, any of those need to be notorized? Or I just need to print, writte, take copies and mail it all to my fiance?

-------------------------------------------------
Second, a series of doubts on the things I have to prove our relationship:

- We havepictures together, but they are digital ones without the day printed on them. I have around 15 pictures, but only 3 of them are clearly on different days, we have many just on a same moment, different positions, etc. My doubt: how many are good enough?
- I have my flying tickets from my visit to US, will send copy of that, no mystery, right?
- Personal letters. My doubt: should we take a copy of the envelopes too? Both sides? And the contents with that? All together? And all of them? There is a good number of letters.
- A receipt from a gift he sent and ended up becoming a big bill I had to pay, because he forgot to declare it was a gift, not sure to add or not.
- I could print the credit card expenses history from my time in US, or is it irrelevant? I also kept receipts of all kinds of things, from movie theatre and rock show to wal-mart weekly groceries. MANY receipts.
- Not many e-mails, but a lot of chat logs from Yahoo and specially Skype, where we do computer to computer calls, which are free. Doubt is: I don't know how to print the Skype logs without copying and pasting them on a word processor! It has no direct print button, so I am lost here, I am not sure if they would accept or have doubts that it was true or made by me. Only idea I had so far was to take screen shots of the logs and then print, which will be a long work. Any ideas on that?

And just to confirm... for I-129F... I send only the COPIES of the relationship proofs? I keep originals for the interview, is that it?

-------------------------------------------------
Specific I-129F doubt:

Part B, question 20: "Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at" and then it asks for city and country. I can't remember this one, but I once read somewhere that for Brazil, it would always be default on Rio de Janeiro for fiance and marriage visas. Can someone confirm me that please?

-------------------------------------------------
Affidavit of Support: It is not for this first part, but... we are still a little confused on this part, so just to confirm (in short): my fiance must have an income on the past 5 years of 125% higher then the poverty level of the current year? And if not, have a co-sponsor? Is it interesting to have a co-sponsor just in case the numbers seem to close to the limit?

-------------------------------------------------
Well, these are my only doubts so far. But I am so... paranoic about it all. At first, the process seemed to be so much more complicated, and now that I read it over and over again, it seems simple, just very long waiting and many documents to gather. I am even getting affraid to read the posts around here, they make me sometimes happy because things worked out and I think it will be the same for me, or I get sad it will go very hard and bad like some other case. I guess I should just keep breathing as my fiance said, and be patient...

Sorry for the long post, hope someone can clarify my head a little! Thanks in advance!

One of the best aids was the guides in this website. They also have samples of how to fill in the forms also. It sure does help to see how to fill things in. Once you have everything for the petition and sent in you have time to get employment information and so forth. As for the chat logs I talk to Pat using Yahoo IM. My petition has not been processed yet, but I just took and made a screen shot of the chat log and a few samples of conversations. I will soon see if my method was successful.

K-1 Fiance(e) Visa Process & Proceduresquick engagement?
QUOTE (chrisc85 @ Jul 6 2009, 04:43 PM) <{POST_SNAPBACK}>
Hey,

I was worried that our situation might be considered a "quick engagment" and was wondering if it might cause any problems for us...

Some of you might already know my story... I met my fiancee in Morocco while I was studying abroad last fall, we first met in October and we got engaged a couple weeks right before I left in mid December right before Christmas... so it was about 2 months of knowing each other before i proposed to her. we technically kind of had to get engaged quickly because in their culture parents shouldnt know of casual relationships, only when he proposes and it is serious enough for marriage. and of course there is no way her parents would have accepted if they hadnt met me first before my leaving. we both graduated college just this past semester and now im starting a full-time job. so obviously i havent been able to save the money to go back there again for another visit. its hard saving money for that especially in my situation.

might that be a problem though? im gonna front-load the petition a lot and im writing a little extra for the "how we met" question. what does everyone think?

The short engagement may not be all that much of a problem. The money situation may present to be a problem. The USCIS will want to see that you can afford to care for your fiancee. The petitioner is responsible financially for the fiancee. Just coming out of school you must be broke. You may need someone to co-sign so you can reach the minimum financial requirement. Hey, give it try, it is a journey. God bless the two on your visa journey.
