Hi All:

I don't understand how you have been going back and forth to Canada for the 12 months and nobody said anything to you about the ban? In any way go for the waiver 12 months is closer than 2011.

Im sorry to hear this im not sur what advice I could give you but we are in the same boat. We forgot to return an I-94 card the last time my fiancee visited the US and we are worried about a ban too. Our interview is coming up in montreal in march so we are freaking out a little. if you want check out my last post and see our situation.

Actually the A# is usually a sign that the person has an "Expedited Removal" which is for all intents and purposes a Deportation. It has all of the same implications.

The A# (which is several digits long; I think the OP left it out for privacy reasons) is a registration/ID number. A#'s at least used to be on all forms sent to petitioners by the USCIS. My husband was issued one for his I-130 and it was used to identify him on the I-129F when I used it as his ID# on the application. It keeps the applications in order. He was assigned a separate one for his Expedited Removal, even though he had one for his previous applications. I hear rumor that they've stopped doing this, but it's still on all of our paperwork.

In order to be certain what they did, whether it was a deportation or not you will either want to do a Freedom of Information Act Request or an FBI fingerprint check, or both. These could list if she has a deportation against her or not. They should have given her a stack of papers referring to what exactly they had done, but those sometimes get lost in the shuffle. Those papers, if she can find them, would detail any charges or accusations they may have made to support their decision to deny her entry.

Thanks for the compliment Jason-Sasha! I am in the coast guard and believe it or not we have to be pretty well versed in Immigration laws.

Just wanted to add that if she did not see an immigration judge then she was not deported she was just refused entry. As for the A# it refers to why the immigration officer refused her entry.

They claim to do it for just 100 Canadian dollars. Still a better deal than $525 unless you are talking more than 5 reports or unreasonably delay.

Yes she inquired about it and they told her it could take anywhere from 4 to 6 months to get it. we are dealing with the Montreal consulate for our case and there interview wait times were from 4 to 6 months for an interview. So we would have got it from the Russian consulate in advance but we were worried that it would expire by the time we got our interview and we would be SOL! In any way they were not very helpful to her when she went to the consulate to get permission for her son, and charged her a crazy amount to fix her internal passport. Yes we investigated the consulate TRUST ME! but this lawyer was the best option for our case and it is why i suggested him to the OP because it seemed his case was more complicated. just trying to help like the rest of you are thats it.

Well I am bit torn here and will call the embassy to get a final answer. She went to the Rostov Information Center for IA and requested a certificate. My sweetie claims it covers all of Russia, but I just want to make sure....

$525 although is expensive it might be our only option. She would need to get on a train or plane, travel to Moscow which quite a distance away just to request the certificate. At least here she just needs to get the POA and submit the documents through mail.....

Yes I agree 525 was alot but it is easy for you to comment because you lady was probably in Russia to get her certificate. my fiancee is in canada and had some issues with her internal passport that she had to correct at the Russian embassy in Toronto. Was a very complicated situation like the OP is having. 525$ is not alot to pay if she is worth it!! Leaving steaks and BJ's out it laughing.gif

If we make copies of the originals and present the original translations with the copies at the interview will they return the original copies to us? I am asking because we will need these original copies of the translations of the birth certificates to get our marriage license, and we don't want to pay to get them translated again if we can avoid it. But we sent it at the end of December and we are worried that her departure wont be recored by the time we have our interview at the end of march. Ahh I see. Well personally, I wouldn't worry too much about it. As they mention, the next time you go to cross the border they suggest you take all the documentation you sent to them with you to explain at the border entry/crossing, just in case the record hasn't been updated.

One would hope that the same type of reasoning applies to your interview.

My Husband didn't turn in his I-94 once. The next time we drove over the border we had to go in and speak with a CBP officer. He was none-too-nice (that's putting it mildly) - you can be banned etc etc etc.

My Husband showed him a stamp in his passport, for another country, that was after the date when he visited the U.S. - and all was well and we went on our way.

So I guess what I'm saying is, as you have all your proof to bring to the interview, it shouldn't be a problem.

Have you called CBP and asked them if they have cleared it?

they say we are supposed to wait for about four months and then write a letter to CBP asking if it has been corrected. we just sent everything to CBP at the end of decmber and our interview is march 26th. So we are worried that it wont be entered in time. unsure.gif. I guess we are cutting it very close!! Just looking for some VJ support!

1st and most important Include her daughter on your K1 Petition. You will need to show documentation of sole custody, and written permission from the father of the child for her to immigrate. Then she will need all the same documents that apply to her as your fiancee like birth certificates, and everything will need to be translated.

when we requested it we gave them both addresses where we lived and they said it did not matter because the check are done through the national criminal database. hope there right about this too? unsure.gif

From what I have seen before it usualy takes 7 to 14 days to recive the visa after the interview at The Montreal consulate. Maybe I am missing somthing? Any info would be great our interview is coming up on the 26th of March.

Maybe....maybe not. One thing, we never sent copies to NVC with our originals and my Husband didn't take any copies to the interview - but - some people get their originals back - that's why I think it is up to the CO (he did get his original birth certificate back at the interview).

It sure can't hurt to ask when you are there, if it looks like they aren't going to give them back to you. Mind you my Husband asked the CO about the marriage certificate and he said it would be mailed out with the visa - it wasn't.


yes your right we will just ask at the interview. we just would like to get them back because we need them for our marriage license and social security cards.

Thanks again Ladywhite but we already have the proper Translations. We just want to keep the originals because there are certified and notarized and we can probably use them for the rest of there lives, and also like i said we paid decent money for them and we would like them back so we can always use them.

Which consulate are you going through, MTL or Vancouver?

I was just thinking about this and you know, I think it is really up to the CO, someone here must have had an interview where they took translations though so at least you should be able to get some idea....anyone?

For us, although no translations, they kept our original marriage certificate.

We are going through Montreal on the 26th

We paid decent money to have my Fiancee and her sons birth certificates translated. If we make copies of the originals and present the original translations with the copies at the interview will they return the original copies to us? I am asking because we will need these original copies of the translations of the birth certificates to get our marriage license, and we don't want to pay to get them translated again if we can avoid it. Any info would be appreciated.

If you just give them simple evidence you will just blend in with the other thousands of Canadians who cross into Buffalo for shopping and to use the aiport you will be just fine. Honestly the CBP officer is not intrested in your story about your visa journey. Complacency of the officer is on your side here use it to your advantage. Im sure you will be fine in any way you choose just giving you a heads up and some facts about CBP.

flames is right not only varies form POE but also varies from the CBP officer. Little fact here a CBP officer is on probation for two years once they are hired and can be fired for breathing wrong. So if you get a young one or a newbie and you start pulling out all of these immigration papers like your NOA1 & NOA2 you are likely going to start raising red flags. Remember every person at a POE is a potential immigrgant in the eyes of an CBP officer. Because look at it yes the officer may see that you are going the leagle route but he might also suspect that maybe you have been denied your visa at your interview. Look at your NOA2 if the date has expired because you are going through montreal you start waving that around you could be in for trouble. And yes you can still make it through your interview if you were denied entry but this is already a stressful process do you realy want to add that to your list? Better leave all your important immigration documents at home where they should be. Your flight Itinerary and some pay stubs should be sufficient. Remember KISS.. Keep It simple stupid.

Better to say your going to visit friends in newy york or going site seeing in new york the customs officers are very familiar with Canadian's driving across the POE to fly from the Buffalo Airport because of cheaper flights it very common. My friend is a CBP Officer and he says they get training scenerios all the time about women coming to the POE saying they are engaged to US citizens ans such. They are trained to deny your entry trust in that ecspecialy if you start pulling NOA2 and such. Keep it simple you dont want to have to explain you were denied entry at your interview.

they are refering to the 601 waiver but honestly i dont think you will need it. but fill it out and bring it in any way but you will have to prove extreem hardship and dont forget the 400+ dollars it cost to file it. but like i said i really dont think you will need it. you live near toronto so im sur before you went to visit your husband you went to the US to do shopping or other stuff. Honestly if they ask you when the last time you visted the us be honest and tell them of your last vist and thats it. Just be direct and dont give more info than what they ask for.

I would just chill out a little if you were not issued a green I-94 card at the border when you entered it is pretty hard track. here is a link to a some info and a study that explains the tracking of overstays from canada and mexico with out being issued an I-94.http://www.gao.gov/new.items/d0482.pdf
If the consulate see that you have traveld back and forth from canada and the us it could be enough for them to see that you are aware of the laws and tha you abide by them.
