Sorry to disagree with you, but my interview was on the 21st and the USEM told me they will issue my visa when they receive co-sponsor dox package... LES, W2s, Turbotax and IRS transcripts provided, copy of enlistment contract (showing 3 years left), current yearly income as of Aug 2009 - 36k... Like I said - varies from USEM to USEM and person to person...

Current yearly income as what...an E-2, E-3? You need to deduct all taxes, and witholdings from your BASE PAY only. I understand that different conculates will require different docs. BUT, the CURRENT yearly income is all that they look at for meeting the poverty level.

One other thing I forgot. When calculating, you need to subtract all of his deductions on his LES for Federal, and State taxes, sosial security tax, and medicare tax. I hope he still falls above. PM me if you need help.

No, all 3 years are not combined. I am assuming that he used his allowances when figuring his income. Only his base pay is used to calculate total income for the year. If he still meets the 100% guideline, have him re-submit the I-134 with the new numbers, and his tax returns/transcripts. I also included previous 6 months worth of LES.

It should have zero impact. Current incomoe is all that is considered for poverty guidelines. It states this on the I-134/I-864.


And another note for the military folks....we are only required to meet 100% of the poverty guidelines....because the government realizes that we don't make as much as our civilian counterparts.

The reason they look at past years is to show income history. Past years income has NO bearing on the affidavit of support. ONLY current years income.



And by the way, US Embassy Manila will require 3 previous years tax returns or transcripts. I used all transcripts...they're easier to read.

Okay, I think I can clear up a few of the questions on here.

MILITARY PAY:

When figuring income for Affidavit of Support, only taxable income is allowed, so only BASE PAY is used to calculate. I am Active Duty AF, and just recently passed this portion of my wife's process. All was well, even though I was deployed 5 months last year, I still met the 125% threshold. :whistle:

CHILDREN:

I have 3 children with my ex-wife. She has custody, but I claim 2 on my taxes every year based on the amount of support I provide. Those 2 children are included in my household size. Rule of thumb: If you claim them as a deduction on your tax return, they are a member of your household, whether or not they live with you.

As for the OPs RFE, I have always assumed that the current years income is what matters when it comes to the I-134. He can take his LES, take his base pay, and multiply it by 12. That will be his GROSS income. NET income is minus taxes, social security, and medicare. If he is military, all of these can be found on the LES.

I have everything together that he needs for the interview and it will be a big pain to make copies of all this stuff. Is CR-1/R-1 visa faster than K3 visa? I'm just confused..me & my husband just got married last month here in the philippines & we are planning to do the K3 visa soon..but from my research here on VJ,they were saying that if the NVC receives both the I-130 & the I-129F,they will drop the K3 & pursue the I-130...I need advice on what we're gonna do. Is it smart that we just send I-130 w/o the I-129F? I also wanna know how long it takes until they issue the visa? Thanks for the advises that anyone can give.....


From what I've seen, the K-3 visa process is dead. My wife and I were going to file K-3 as well, but now we are just going to file the I-130. Looks easier anyways, and if I am correct, you get your greencard before you leave the PI, and the fees are lower....

yes, it's important that you remember to match her ticket name to whatever's on the passport.

make sure also that her passport is valid for 6 months minimum but if you're still in the process of preparing docs, you have plenty of time to renew passport if it's close to expiration. if it's good gor at least a year more, then you're good :)

I have a question regarding my wife's passport. When she goes in for her interview, will she need to have her name changed on her passport? Nothing I have read anywhere specifies, and we are curious whether or not she should change it before the interview. If she doesn't, will she get flack at the POE? Town, City is Quezon City, State/Country, Philippines... On page 2 where it asks for the province, if she's in Cavite, she is technically in Metro Manila, which the province is National Capitol Region. I just put NCR.



My bad. Cavite is the province, and GMA would be the city. My wife is in Quezon city, so since it's part of Manila, it's a little easier...at least there is enough room for the full addy on page 2. I had to omit half of her address on page 1 because of space.

I agree that the entire process can be confusing, but the guides on this site have eased most of my confusion. If I have any questions, I ask. Now, as far as the petition going to USCIS, if you originally sent it to the Chicago lockbox, they forward it to the CSC based on where you live in the states, i.e., I live in South Dakota, so mine will be forwarded to the Nebraska SC. I understand this completely. From there, it will go to the NVC, and once complete, they forward everything to the US Embassy. The Embassy in Manila is a cluster. I attest to that whole heartedly, as it took me 4 hours of waiting in a tiny room packed with 60 people and their Filipina brides/fiances to get my Affidavit in lieu of LC to M. I was confused as to where to go from the get go. Twould be nice if they hired Americans to direct traffic in there...But I digress.

My advice would be to sit back, take a deep breath, and relax. I know how it feels to be away from your love. I'm there as we speak, but I know that with the help of the good folks on VJ, We will make it through the process....

As long as your marrige is legally recognized BY the US then you are golden. Check married. I assume you have some document that shows your union together is legal and accepted.

If the marriage is not legally recognized, then you either need to get married again legally or file I129f :blink:



The US recognizes Filipino marriage licenses, so it's all legal. We have the certified NSO copies of the marriage certificates too, so I will leave it checked MARRIED. I am just double checking eveything before I mail the package out. I do nnot want an RFE.

DS-3032 can be sent by the beneficiary through email. The beneficiary just have to follow the DS-3032 template which can be found on this website.

You cannot send copies of original for the DS-230 package. It has to be original or certified which is same as the original except you can only get that from the place where they issued the original. Hope that made sense, haha. Even if you send the original with the DS-230 package, you can get them back at the interview.

I know it all seems confusing and I was confused myself. I read the guides so many times and read so many threads, but we all are here for eachother so don't worry :thumbs:



So the originals aren't required until the AOS process. I read through the guide, and it made sense, until I started thinking about it. Guess I need to not think. :blush:

They're going to need proof of domicile in the states. I agree that you should wait til the case is sent to the NVC, and proceed to the PI from there. Yes, you'll have to mail all of the forms, but it's up to you to decide whether it's worth the hassle or not. I'm thinking it would be. :)

On the I-130, it asks if you have ever filed a petition for the beneficiary before. I am in a similar situation. I filed a K-1 for my wife in '08, but due to finances, and military "obligations" I couldn't press forward. I am going to type up a letter to include with the I-130 petition that explains why we didn't move on the K-1 petition. If yours was cancelled outright, I don't see as it would be a problem. Mine is still showing up ini the USCIS website as post approval action status...so, I may just write to the USCIS, and tell them to cancel. All of this info is littered throughout the site. Just search the entire forum for it. Tons of good info on here! Good luck!

You can cancel a pending petition. Just send a letter to both the NVC in New Hampshire, and to the US Embassy where the petition was sent. I included in my letter that the reason for cancelling was that I was instead filing an I-130 petition. It took about 60 days to receive notice from the Embassy, which stated that the I-129F petition had been cancelled. They may ask for the reason again at interview, but I wouldn't worry about it too much.

My wife and I had a civil ceremony in a bar meeting room...we lucked out and "met" a photographer when we paid our license fees to the minister. I think he was there just for us...but at any rate, he took all of the "necessary" pics...taking vows, placing rings, signing the marriage license, witnesses signing...I think he had done that before. LOL

Hello everyone. Newbie here at VJ forums. :)

A little background first. I am recently engaged and is to be married here in the Philippines to a US citizen. We were discussing future plans of settling in the USA and I stumbled upon this website to guide me through the process. My fiancee has not ever filed any Federal Income Tax Returns. He is currently renting a place and getting Supplemental Security Income (SSI) as his only source of living along with his Health Insurance and Food Stamps. He earned his SSI by means of filing disability. He is currently receiving a little over 700 USD every month, and recently has filed for Housing Support as well, but has not been approved yet.

Having said that all of his source of living is under Means-Tested Public Benefits;

Here are my questions:

1. Will our only option be is to have a joint sponsor? YES Does the joint sponsor have to be a relative? NO What would be the requirements for one to be able to be a joint sponsor?Co-sponsor must meet the same requirements as the original sponsor, to include support for you and your spouse.

2. The form that the joint sponsor would fill up is I-864 and not I-864A, correct? Correct

3. How will my fiancee present his sponsorship/AOS when he has not filed any Federal Income Tax Returns? Someone with a bit more experience in this area may be able to give you a good answer..

Everyone here prays for good advice. Many people have different ideas of what is good and what is not. I can only tell you what we did and what our results have been. Looking at the I-130 instruction form...it tells what documents are needed to "prove" a relationship.

You have to prove that there is a family relationship between you and your relative. If you are filing for:
1. A husband or wife, submit the following documentation:
What Documents Do You Need to Prove Family Relationship?
C. A passport-style color photo of yourself and a passport-style color photo of your husband or wife, taken within 30 days of the date of this petition. The photos must have a white background and be glossy unretouched and not mounted. The dimensions of the full frontal facial image should be about 1 inch from the chin to top of the hair. Using pencil or felt pen, lightly print the name (and Alien Registration Number, if known) on the back of each photograph.
B. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated.
A. A copy of your marriage certificate.
D. A completed and signed Form G-325A, Biographic Information, for you and a Form G-325A for your husband or wife. Except for your name and signature you do not have to repeat on Form G-325A the information given on your Form I-130 petition.

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:
E. Documentation showing joint ownership or property; or
F. A lease showing joint tenancy of a common residence; or
G. Documentation showing co-mingling of financial resources; or
H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
J. Any other relevant documentation to establish that there is an ongoing marital union.

Take it for what its worth.....we submitted everything we could to "prove" our relationship!
Unless you think the USCIS is trying to trip you up on the instruction form...I would say you are on the right track!


I have only been to the Philippinies one time...and it was when we got married. I filed K-1 for her in '07, but because of deployments and a very slow process to fix her birth certificate, the petition expired, and we chose this route instead. With just one trip to the PI for me, will this raise a flag? We have been engaged since 06, and I have done an evolution of relationship letter to include in the package...I'm a bit nervous now because I have only been to the PI once, and it was for the marriage. Hopefully the fact we filed K-1 before will help...

Basically leaves it wide open as to what you feel is sufficient. I don't really see why 1-3 are even considered. Hard to get a joint lease/ownership when the beneficiary isn't even here. Same with co-mingling accounts. My bank would not open a joint account, because she doesn't have a SSN. Same with my landlord. Couldn't add her to the lease without a SSN.

I have pics from the wedding, pics of me with her family outside the wedding, and pics of the two of us in different places in the PI. I also have 4 affidavits, one from a sister, one from an aunt who was one of the witnesses, and signed the marriage license, and I will include chat logs from Skype from when I returned from the Philippines until I file...

Any advice from anyone else on what to include would be nice. I'm sure Mikhail would like some good answers too, instead of "read the guide? Becasue as seen above, the "guide" leaves it wide open....

Required income for a household of 2 is $18,212. So, with your dad as a co-sponsor, you should be okay. Check USCIS form I-864P for further info on required income.

It takes the NVC about 2 weeks to complete a case after all paperwork has been received. Keep calling until the IVR says that it has been completed. The NVC makes interview appointments with the embassies during the first two weeks of May for the following month. Your case would have to be completed by Friday so that it can have a chance of getting a June interview but it will more likely get a July interview.

As for the passport issue, I'm not sure how it works in the Philippines but in Colombia the embassy requests that all passports have a minimum six months of validity left from the date the visa is issued. Check the guidelines with the US embassy in the Philippines to find out what their rules are.

Go to USCIS website. Click on FORMS, download I-864P. Look at the table based on number in household, including your wife/fiance/any dependents you claim on your taxes, and you must meet the 125% guideline for that number.

Based on current timelines, you will most likely hit the AOS stage of the CR-1 by March or April. From what I read, you currently have a part-time job. Every little bit helps. As for your age, current plus three previous years tax returns are required. If required, you can use any assets you may have to include on the Affidavit of Support. Savings account balances, property, vehicles, etc.. My best advice would be to find another co-sponsor. It doesn't necessarily have to be family. Could be a friend, or anyoone else willing to co-sponsor your hubby.Good luck!

My story: I am Italian and got married in March 2010 in Las Vegas with my American fiancè. I live in Italy and she lives in California (she never lived in Italy and I never lived in USA). Today we sent all the paperwork to the USICS to get my CR-1 VISA. I haven't already registered our wedding in Italy.

Therefore my question is the following: if I don't register our wedding in Italy, can I get the CR-1 VISA as well? In other words, is for USCIS important that I register or not our wedding in Italy to give me the CR-1 VISA? (But I will do it in the future).

Check with your local consulate. Some countries require you to register marriages, and births abroad. Better to be safe than sorry. Congrats on your marriage, and good luck!

according to your timeline, you are well within your window for processing. It has only been a month since your NOA1... Most people get their NOA2s around 60-90 days. It took us 53 days and I had a military expedite (athough I did have an RFE which slowed us down for 30 days...) Just be patient...hopefully you wont have to wait the 5 months for "normal" processing.


I agree. The OP has to realize that all those "foreign workers" are also paying money to get here, and they all have just as valid reasons as we US citizens who have wives and fiances waiting anxiously to come here.Patience is key in the process.

Any assets are included at a 3:1 ratio for income. Home equity is usable, but it will be assesed at 3 dollars required for every dollar the primary sponsor is short on income to qualify.

IMHO, I would wait until you know what her status is going to be. If she is denied annother work visa, she will have to go back to Germany anyways. Timewise, you should be fine either way, but there's no sense in making it more complex than it is already. Take it one process at a time. I would rather know definitely what her status in Canada is before submitting paperwork.

With YM went to messenger/preferences/archive/view archive and save the chat session as text... Then edited/printed that text file...

Note,,, I only printed one chat session for every 10 days for the interview... The idea/requirment is to show a continous relationship.
It is Not necessary to show every detail of your daily lives. I had 12 printed sessions for the 4 months we were apart.

As always,,, better to have more then less. But, I tend to lean toward "What is reasonable,,, plus a bit more".

This is good info. If my wife and I only video chat, will a printout of the video chat log, and screen shots suffice, or should we start typing our fannies off?
