Maju, the reason this won't help if you are going to take the K1 route is because they may believe that you are actually legally married, and therefore do not qualify for the K1, which is a fiancee visa.

Nope, doesn't effect you at all. I have a little bit of student loan debt in the UK, too. But I called them before I left and they sent me a form to change my address to my US one (I think you are required to let them know you're leaving the country), then I got a letter over in the US that if I recall correctly, basically said to let them know when I start working again. So I'd give them a call.

Yeah, I know some people on the forums have mentioned coming over on a tourist visa and adjusting their status, but it seems dangerously close to immigration fraud in my book. The VWP is not an immigrant visa, so your fiance(e) would be coming to the US with the intent to immigrate and without an immigrant visa. Regardless of whether other people have done it, USCIS saying it's a "grey" area means you might get in trouble for it, might not, but the risk would be too great for me.


Exactly. The reason they say it is a grey area is because there are genuinely people who come over on vacation and end up meeting the love of their life and marry them all on the same visit. But if you are already dating a USC and you come over and "just happen" to get married. Then you may end up in trouble, because just dating before you come over to the US on the VWP is a pretty strong indicator of immigration intent and the VWP is for non-immigrant intent only. It is possible though to come over on VWP, marry and then adjust, but I think your spouse would have to have pretty compelling evidence that they did not intend to get married when they entered the US.

IMO, it's not worth, the risk. For me and my husband it was important for us to be sure that we could be together once we were married. So we applied for the K-1 visa, sure it took sometime. But we didn't risk my having to return home and be separated for the first 6-12 months of our marriage.

You are not the first people to fall in love from different countries (obviously) and you are not the first couple to have to wait and get paperwork processed before being able to live together in the US, you'll make it through the process. Apply for the K-1. Just thinking about using the VWP in this way because your friend's wife had done so previously gives you prior intent of immigration. If it were legal for people from VWP to "skip" getting a K-1 to get married and settle in the US. No one with a fiance in a VWP country would ever file for a K-1 visa.

Check our "Direct Consular filing." You marry in the UK, then because you are a citizen there as well, you file through the consulate and go fast fast zoom for a spousal visa (a CR1, not a K3). Good luck.


I agree. I don't know DCF very well, but it sounds like the best fit for you guys. But you will need to be married in order to do it. Here's the DCF guide: http://www.visajourney.com/content/dcf Check it out and ask some questions in the Direct Consular Filing forum, I think you can call the US Embassy in London too and they will advise you as to whether you qualify (I think you should once you are married) and will let you know what documents they require.

I dont think you would be denied no. I read a huge age gap might cause them to look a little more into it, but not a cause for denial. Idk, i've seen older guys (50s-60s) with young gals (20s looking) get approved, so i wouldnt worry!

The operators at USCIS really don't know any more then we do, they just look up our page and see the same thing we do, "case is received and pending". The guy I talked to had no info either, only to saying "you are still pending, meaning we haven't made a decision yet". Not very helpful! He said, "its looking close" but had no info.
Unfortunately there is no way to know. I have been waiting a long time myself and have talked with many other VJ members who cannot get answers.
You can write your senator and congressman, which I did recently and have not heard anything back.
It is very heart wrenching, you are right. If only they could give us some sort of answer but I have yet to get one myself.
I hope someone has an answer for you, I will be watching. I am in the same lonely boat! sad.gif

Just wait. this is the worst stage of the process because there is no way to know when you'll get your NOA2. It could be 2 months, could be 8 months. I didnt do anything because anything you need has to be up to date. For example, I waited 7 months for my NOA2...Just got it recently, Now I am gathering all our emails and chats during that 7 month time as evidence; also, we visited each other during that time and i gathered evidence of trips to be together. as our interview stage nears I am now gathering financial info.

So no, there is nothing you MUST do. Just chat alot with ur fiance, keep records of emails, letters, calls, phone bills, etc and work and save money for your future together! best wishes! hope your noa1 - noa2 waiting time is brief!

For me it was just a source of discouragement. They never updated it. I got my NOA1 dated July 23 and they set up my account on July 29. I got approved on Feb 27th but my last update still says July 29 and it still says "case received and pending". I got a letter in the mail and no email.
Checking that uscis website every day and seeing last update July 29, for 7 months was quite torturous! So, dont be too concerned with that.

Oh wow, that was only a week ago. I didnt hear anything about mine for about 3 weeks, they approved it in 2 weeks after they received it and i found out in 3 weeks. (i sent mine july 9, they got it july 10, i live right next to csc, n it still took them awhile). then got approved july 23 and i didnt hear from them til about a week after that. your good, its coming! dont worry!

Oh I agree, life isn't fair. But our government is supposed to be. It's probably unintentional, but it is discriminatory towards citizens who happen to have addresses closer to Vermont.

correct, VJ is a small percentage of all applicants. If we want to do whats fair, they should start working on cases of ppl who have been waiting for 6 months and beyond, some ppl have been waiting a year and a half. thats just wrong!
i was a CSC filer who waited a painful amount of time.
This process can cause lots of emotional pain and stress. We just need to be patient and be prepared for a long wait.

Don't need to worry about that.....USCIS has a problem in their website.....Since I filed my AOS, I couldn't check my status online....I just received mails from USCIS. It could be better that way, cuz checking your status online just gives you frustrations...There website is not updated.



Yeah, no worries. they set mine up but never once updated. it said pending even after i got approved, n not one single update! for 7 months...nothing, it was very frustrating. i never got emails from uscis either, got my noa2 in the mail. so dont worry about it.

I think you should probly wait til your 6 month mark then, if nothing, contact your congressman. I know its painful and seems hopeless! I wouldnt recommend calling uscis as they will just tell you that you are still in normal processing times, even tho you arent...they are never helpful. If it will make u feel better, call them (i know the feeling of wanting to do something!.) but dont expect satisfactory answers.
Go ahead and start writing up a letter to your congressman n mail it next week. You may just get your approval before the 6 months. Sorrry, i know how painful and discouraging this is!! rose.gif

As a law-abiding US citizen, I request your assistance with my USCIS petition. At present, the time frame for reviewing cases is six months or longer. Despite published announcements to the contrary, I have been separated from my fiancé for a painful amount of time. After following the guidelines posted on the USCIS website and paying all applicable fees, my fiancé and I are waiting in suspense for an approval (the Notice of Action 2 – NOA2), and this is the source of our dilemma—an inordinate amount of waiting time and no clear explanations for delays. Hence, I ask you, Honorable U.S. Representative, to investigate this seemingly negligent period of inaction.

The first step is to submit the petition to establish the existence of a relationship. Then, once approved, our petition and all documents submitted are forwarded to the National Visa Center for further processing. As you are aware, the next phase is the embassy approval with required medical examination and an interview. Unfortunately, we have not moved past the first step because there have been no updates sent to us. When an inquiry was made, I received the generic, “We’re within our processing time” and “It’s looking close.”

The entire process thus far has proven to be quite discouraging. I cannot get an accurate, specific response to my inquiry, nor do I receive the “first in, first out” treatment we were promised. Hence, I need and request your assistance. Perhaps an inquiry from you will garner a more substantive, more accurate response. Attached, please find a copy of NOA 1 for our petition (I-129F) and a copy of the USCIS website page showing my status as pending and case last updated (“touched”) over 6 months ago. Below, see our receipt numbers given by USCIS. It is with great respect that I request your inquiry into this matter. Hopefully my fiancé and I will receive our NOA2 and continue positively on the path of reunification.

Yes, we are waiting also until he actually gets the K1 in his hand. (course this makes it annoying with friends, family, coworkers asking daily, 'when's the wedding??') but, it cant be helped. Yes. My UK fiance had no problem, neither did I when i went to visit him (both during K1 process). Your fiance might want to bring a letter from work stating when he will be returning, n a copy of his return ticket too. When i went there, they asked me what my trip was for, i said to visit. He said 'anyone in particular'? So i told them my fiance, he asked me wen i was returning to work and if i had a copy of my return ticket..i had nothing, but he let me through. He should be fine, ppl do it all the time, but proof that he is returning back to the UK (has ties) are good to have.

Yes, a K1 is for the foreign person to enter the US as a fiance. then get married in US. You cant get married in Brazil and then return to the US b/c the Brazilian will not be a fiance anymore, but a spouse. the K1 is for entry into the US as an unmarried person only.

Where does this go? ON the intent to marry...or somewhere else? And also, how long should both (petitioner/beneficiary) letters of intent to marry be? Because the example form has such a short format.

i used the example letter for my letter of intent. my description of relationship was very brief and concise. they approved it so both were apparently fine.

congrats! ours took past 7 months as well.
1. no worries, my case also never got updated online n still says 'received and pending'. dont worry about that online status site anymore.

2. national visa center is where your application is being sent from csc. they will then forward it to the foreign's country's embassy.

3. you will receive a letter in the mail from nvc (or the USC will) and then you will receive a letter from the foreign country's US Embassy. you can start working on Packet 3.

time it takes varies. check out my timeline (as well as others filing from your beneficiary's country) to get a rough estimate. interviews usually take a couple months at least from submission of packet 3.
