YEAH!!! I did it! :dance:

I’m very happy and I’m feeling the most lucky girl in this world! First of all, because I have Chris in my life... And second, because everything went smooth to me in this interview.... I may say that it was amazing! Much better than I could ever imagine... The documents of the Affidavit of Support were missing... All I had (related to the Affidavit), was a copy of the I-134 of our co-sponsor (Chris’ mom) and the copy of her 2005 income taxes... So, the maximmun I was hoping was that they would ask me to send the documents over mail for them to give me the visa right away! Well, let me tell ya how everything went:

My interview was scheduled to 8:00 am (like everyone’s, I know...hehe) and I arrived at Rio’s Consulate at 7:00 am... There was a big line outside and, when it was 7:45, they started separating people according to the visa category, and we started entering the building.

In the immigration visa section, there was a woman that gave us a paper with the documents order.. Since mine were already in order, I was the first one to handle the documents... So, the woman checked them and asked me to take another pictures for the visa (she asked me to fasten my hair). While she was checking the documents, I told her that there were some documents missing (related to the Affidavit) and she asked why... I told her that it was because they didn’t arrive to me in the mail yet. She said nothing.

Then, it was already 10:15 (and I was very very nervous) when the girl by my side was called by a woman in one of the interview rooms... 20 minutes later, she went out of the room saying that everything was okay and that she was asked to send them her police records (that were missing), so that they would give her the visa... She said that the woman that interviewd her was very lovely, so I started to root for me to be interviewd by the same woman, of course...hehe

It was 10:25 when that woman called my name (Ohoooo!)... So, she talked to me in portuguese and took my fingerprints and asked me swear that I was saying the truth and bla bla bla... Then, she asked me:

1 – How did you met Chris? (I explained in a concise way, spontaneously smiling like I always do when I talk about our story... hehe)
2 – What does he do? (He works in a restaurant... He does almost everything there!)
3 – You were married once... How long did it take and why did you brake up? (Yes, I stayed married for about 3 years and we broke up unanimously, because we are not getting along lately... But we are friends nowadays.)
* She was asking in portuguese and I was asking to some things in english... So, she asked me whether I did prefer to be interviewd in english or in portuguese. I told her I didn’t have preference and she said: Let’s continue in portuguese, then... COOL! lol
4 – Do your family knew him? (Yes, most of my family since he stayed at our house while he was here in Brazil.)
5 – Do you have more pictures? Can I see them? (Then, I showed her the 8 pictures in a small album) Is this your mother? (I said: Yes... And the other people are friends of our family that took him to the airport with us.)

After I said this, she pulled up a green paper and asked me to come back to pick up my visa within two days... I was shocked! I just asked her: I AM.... APPROVED?? She said: YES! And I said: I DON’T NEED TO SEND MORE DOCUMENTS? She said: NO, YOU ALREADY BROUGHT THEM! :huh:

Yeah, guys... That was really awesome! The only explanation I have for this is: GOD! :P

I’m feeling like I am walking in clouds....

Hi,

Fiance's interview was tomorrow at 9am. Just got call today that his interview has been cancelled by USCIS because they need to re-review the petition and if approved once again then they would reschedule the appointment. Anyone have this happen to them? Does the whole process start all over again? How long would it take? So upset right now cuz the interview was tomorrow!!! all the excitement down the drain. They said it was because of some immigration marriage law or something. I called USCIS and they dont have any status on my petition except that it has been approved (1st approval). Would the petition go back to USCIS and then resent to NVC and then back to london? Any input would be greatly appreciated. Thank you. =(



What????? Maybe you can give us more info......your timeline is not updated so not sure what is happening with you case. Was your interview scheduled at the embassy in London???? When did you receive packet 3 and drop of the DS230???? Were you and your fiance ever married before???? What marriage law are they talking about????



I dont have the exact dates with me but my fiance sent his packet 3 the same day he received it because he had everything ready. I believe it came right after easter. Then they sent him packet 4 on May 4th but he received it late so he called the embassy to check the status and they told him his interview is on may 11th. Then today he got a call from the embassy telling him that they have been contacted by USCIS and his appointment has been canceled because they need to go over our petition again and approve it again. I dont know why?? i have never read any cases like this before and I dont want our case to be "lost in the system" and for us to wait forever for it to finally be approved. I dont know what to do and no one can provide more information. My fiance called the embassy and they said its right that it has been canceled and that he should contact USCIS if he has any questions. I called them and they said "things like this can occur" but they cant give me any information on this cuz they dont even have it in their system! What to do?? He had his medical done right after packet 3 was sent back so he was just waiting for his interview date. We are both so lost now. =(


So, I guess you'd have to contact your Congresman for him to check what's really going on! That's not a normal thing and, since you don't have anything diferent from the others to investigate, your process should be done like anyone else's is!

Please, friends... Does anyone has another suggestion?

I think you should call the consulate again and ask for more details about the reasons they had to do this and how long this "review" will take!

Here in Brazil, I knew about a case where the petitioner couldn't sponsor his fiance... In the day of the interview they didn't give the girl the visa because of this, but they didn't deny as well! They only asked her to tell him to find a sponsor and schedule a new interview! So, few days later, she had her interview again and got her visa!

Yes... I agree with you but I heard a mixed news some said a co-sponsor can't used to applying for k-1 visa and other said it's ok to have a co-sponsor....For this case, they didn't totally reject my fiancee's k-1 visa and allows the u.s petitioner to re-submit additional financial documents only if the financial situation improve significantly!


Since I didn't earn enough income for last year and I've brought in a co-sposor who makes more than enough as a qualified co-sponsor at the interview and Consulate Officer said, " I can't use a sponsor for K-1 Visa, and she concluded that only the U.S petitioner's income is taken into account". This why K-1 was delayed and I have just been employed for a couple weeks will this help to prove to the Consulate officer that my beneficiary will not become a publuc charge after entering U.S. I don't know why on the USCIS web site states that if the petitioner doesn't earn enough income, he/she can ask for a co-sponsor but this is a contradiction ! I will try to appeal.

But there is something really unfair in this story! :angry:

At USCIS website they say YOU CAN use a co-sponsor and every consulates I've heard about do accept this! So, I really don't understand how they had the nerves to deny it to you! I guess it's something wrong happening in Vietnamese consulates and you should really appeal this stupid "decision" of them! If it's allowed for another countries, it must be allowed for Vietnam too!

I'll need a co-sponsor too and I would be really mad and would appeal in every way I could if they denied my visa because of this!


Besides...

This sponsor thing, as I know, is only for the beneficiary not to give expanses to US government, specially in the first months, when there's not work permit... But then, the beneficiary can work normally and help to support the family!
For example... In my case, my fiance is still a student! He can't work more than he already does only to make de 125% poverty guideline that US asks! But his father can help us financially if we need it in an emergency, specially while I'm still not working! (he'll be our sponsor)
So, my fiance would have to quit school and all his plans to work more hours to get me to USA, with no need, since I'll work as soon as I can!? That's ridiculous! They can't obligate you to be the only sponsor!

Well, friend.... I really wish they use the common sense and give you what's a right of yours!

I dunno how you could possibly be confused about it, given all of the information people have posted here, PLUS the info from the instructions.

The foreigner is permitted to apply for citizenship after being married to the same u.s. citizen for 3 years AND after the citizen has been a permanent resident for 3 years minus 90 days - assuming that all other conditions are met (continuous residence, real relationship, etc.). If the resident since date on your PR card is MM/DD/YYYY then subtract 90 days, then add 3 years. That's the date when you can file the N400, assuming you have been married to the same u.s. citizen for 3 years on whatever date that turns out to be.

It is still a little confusing to me too, but as I know, when they send you the package 3 the only thing you need to do in a hurry is to send the DS-230 forms back with the copy of your passport and 2 passport pictures! Then, they'll send you the package 4 with more instructions and you have to join all the documents necessary for the interview day!
Anyway, it's reccomended for us to START getting all the documents (including those ones necessary for the affidavity of support) and the medical exams ready right after you know the papers are with NVC (a little after you receive the 2nd NOA), so you have time to get the documents little by little and don't take the risk of having any of them missing!

What you are saying is not applicable to the London Embassy. The London Packet 3 contains a lot more than DS230, and you do NOT send in your passport nor an pictures to the London Embassy. These are things you bring to your actual interview. The only thing you send back to London is what they send you in the packet 3 (DS 230, DS 156, DS 156K, DS 157 (if the foreign fiance is male), and checklist (IV 15)).

Its gets transfered to NVC, then onto the London embassy
I then get the Packet 3 and do the neccesary paperwork
Book and attend a medical
Then get an interview date and interview
Finished! :dance:


To be ready for this Packet 3, i can get my police certificates ready and should have my finace have the avident of support form completed and all the associated paperwrok so he can send it to me....Apart from that is there anything else i can do to be ready for packet 3 from the embassy? Or just generally do to be as prepared as possible?

Should i be worried that i have not heard anything since January 20th??

We filed our I29F and recieved a letter saying it had been recieved and was being processed and we have not heard anything since. Is this normal for Nebraska or is something wrong?

I hate this!!!

I live in England so when i called to chase or get an update i just get told they cannot tell me anything which annoys the hell out of me. I am able to check my case online but that never changes.

Any tips on finding out whats going on????? :( :wacko:

This letter you received is probably your 1st NOA and have a receipt number on it that starts with three letters and have 10 numbers, ex.: LIN0852925252.
With this receipt number you can check your case status online at USCIS website and receive every update of your case status by e-mail.

If you already have the receipt number, don't worry in relation to the waiting... It sucks, I know, but it's normal... There are a lot of people that had their 1st NOA's in December and are being touched again only now! If you have doubts, check up the timelines!

But yes! As long as you already know about this risk and are not sure whether your income is enough or not, find a sponsor in order to avoid having to wait even more... I already know I'll need one! hehe ;)

Yes, it is possible, but your timing is a bit short--you need to add in the time for the naturalisation process (after which you can petition for your mum as immediate relative).

Dont pay so much attention to the dates. they can really be misleading. sometimes they just have the dates further back because they do not want people callling all the time I think. The dates that they post will really drive you nuts. It did me :hehe:

That's really weird the diference in the processing dates... Most people that applied for the visa in the same time as you did, got their 2nd NOA's a long time before! It pisses us off, because we get even more anxious! :unsure: :protest:

They misspelled my my fiances first name, but no problems on it. His name is EdUard, and they keep spelling it EdWard, might be good to spell the names right when they send out documents.
