It's a shame that with all the progress that KZ has made, that it still violates basic human rights by having us go through the whole exit thing. She will also lose her pension. My Wife has been working for 20 years and KZ gets her pension. Good luck to you two! :)

4 weeks ago I sent the packet 3 to NVC in hard copies. just a moment ago I was lucky to talk with a representative at NVC. The lady said I have to file online, otherwise the case won´t proceed to next step.

From what I have read on VJ, (hint), you wont be able to do it online. You have to fill out a w-7 and attach your joint return and mail it to a different place than you would for normal returns. I don't know the specifics.

Hello all visajourney memebers,
i am new here,i've been reading this forum for while,found really useful informations.finally decided to sign up now.I am USC,and my wife is nepali citizen,she is living there.On Nov 10,2010, I recieved my NOA1 I130 and on Dec 2,2010 recieved NOA1 for I129f.I guess that is for K3,or IR1 as our marriage is less than 2 years. (L) Still waiting for NOA2.By the way,my service center is VSC,I guess the slowest one. :unsure: I found many useful informations in this forum,so first of all i want to thank all of the users. :thumbs:

Solution 1: Ask your boss for a 1 dollar raise. That would equal a little more than 2000 dollars for a year.
Solution 2: Get a part time job. One day a week at minimum wage will put you over the 2000 dollars.
Solution 3: The 20k listed as assets should put you over the 18000.:star:
Answer to your question 2: Yes, she can sign it when ever. I had my Wife sign everything including a w-7 form needed for taxes when I visited her.

p.s.
You do know that you wont get a K-3, right? And if you haven't been married for more than 2 years then you will get a cr-1 visa. They will close your i-129f.

Thats later. Make sure you read the guides that are on this forum. They are really helpful and will answer most of your questions. I printed them, along with the instructions on the uscis website.

Interesting. I guess I wasn't paying that much attention back then.

So, from what I understand from your link, if the I-130 reaches the NVC first then it has to wait for the I-129F but if the I-129F reaches first they will proceed to process it?

My attorney had basically told me they will process whichever they get first, CR-1 if they get the I-130 first or K3 if they get the I-129F first.

You are also saying the I-130 will be delayed by the I-129F, anyone know by how much? I heard both of these are getting approved in a similar timeframe.



K-3's don't get approved anymore. If your I-130 gets there first, nvc will wait until your I-129f gets there, close the I-129f and continue with the I-130. You should tell your lawyer to go back to school!

Someone on here made the suggestion to discuss the option to life in the alien spouses country instead of the US and see what the reaction is. A person who is out to get a greencard won't be to happy about that idea...:whistle:

Red flags for me would be:
my SO is unavailable a lot of times I call
doesn't engage much in conversations
seems not interested in how I am doing
usually I am the one who stays in touch while apart

the list probably goes on and on...

Why not go to the post office and notify them of the error? Ask to speak to the Postmaster or Postmistress and explain your situation. They will know what employee has that route to deliver. Ask them to instruct that employee (or the sorting department if that is also appropriate) not to list it as undeliverable but ask them if they will 'hold' any mail sent to that address and then notify you so you can go in and pick it up with proper identification. I am not sure if your Post office will do this but some of the smaller Post Offices tend to be more sympathetic to situations like this and may be willing to work 'with you' on this matter. It is at least worth a try. In the meantime, be sure to change your address to the correct address with USCIS.

The USCitizen files to the Chicago LockBox, then later, if the USCitizen won't file said damsel's IV application for her, said damsel must file it herself, via postal mail, to the NVC postal address (in the USA)

OTOH, if you are trying to refer to DCF, Direct Consular Filing of an I-130, chasing after a Visa *that way*, why not say so ?

they need originals and when it gets to NVC, they also need originals. I had to get 2 copies of all and he sent me one for myself.
If you send copies, they will ask for originals and the process is delayed by that much more.



I sent copies and was approved in 4 months at USCIS. I sent originals to NVC.

If it was your thinking process then everyone always would have to have their original documents translated into English, because we all apply initially through the US. However, what "application for a visa" means in this case is where you will physically go to have an interview at the embasssy/consulate abroad and as long as your original documents are from the same language (German for Austria and applying through the US embassy/consulate in Austria), then all you need is original docs without English translation.



The consulate in Almaty, Kazakhstan requires documents to be translated. At least thats what the woman said when I called them and asked.

Sorry that I interfere your discussion but I wanted to make something sure. It says or in the official language of the country, in which application for a visa is being made. My application is made in the US, same as yours, right? How will they able to read all the documents in all the different languages? I'm preparing my stuff for NVC and I'm still not sure if I should get a translation. It just seems so unlikely that they accept papers in all the different languages if they can't even read them. Maybe I'm paranoid, but I just want to be 100% sure.



I don't know about everyone else, but I'm playing it safe and getting everything translated. It isn't a requirement to speak the language of the country that the conlulate you work in is. I just want to make it as easy as possible for the ajudicators and interviewers.:)

I got my approved notice and it says now it has sent to NVC.
NVC will contact the petitioning(beneficiary) concerning further processing.


it also says...the approval of this visa application does not itself grant any immigration status
and does not guarantee that the alien beneficiary will subsequently be found to be eligible for a visa, for admission to the US or an extension change or adjustment of status. ( should I be worried about this last paragraph)

I am filing our US taxes as "Married filing jointly" and claiming wife as exemption. Filling out Form W-7 for her ITIN.

Questions:

  • Do I have to include wife's Canadian income in my US tax return?

I have noticed conflicting advice with regard to filing taxes whilst the spouse of a USA citizen is out of the country. This is the procedure we used. It is recommended that once married, for maximum financial benefit, the spouses file as married, filing jointly. The foreign spouse does NOT need to be in the USA in order to do this.

Firstly, it is impossible to e-file, as e-filers need SSN's for both spouses. As the non USA spouse will not have an SSN, it is necessary to apply for an ITIN number.

The procedure is as follows:

Download IRS form W7, and the instructions from the IRS website.

The foreign spouse must complete the form, sign it and send it to the USA spouse complete with a notarized copy of their passport.
On receipt, the USA resident has to file taxes by mail. I highly recommend Turbo Tax 2010, as this program allows a the IRS tax returns to be easily printed and filed. As stated above, you can NOT use the e-file feature, you print the tax return the old fashioned way.

Once you have completed (married, filing jointly) and printed the return, gather your supporting documents, attach your foreign spouses completed W7 form to the front, and mail to:

P.O. Box 149342
Austin, TX 78714-9342

You must do this before April 17th 2011. Once this is received, an ITIN number will be issued, and the tax form processed. You should get your refund in around 8 weeks, as it takes 6 weeks to get the ITIN number allocated.

That's all there is to it.


Copies of documents must have an Apostille also.
