Okay Guys, I have a question about this whole mess....

My application is being sent tomorrow. Since we have the new I-129F form, how will this effect us? Will we be in line after everyone who USCIS is waiting for RFE's from? Not that I think it would be fair for us to skip over anyone in line, I do not, I believe it's only fair for things to progress in order of receipt but I am just trying to anticipate how much delay we may see.....

Hey Gang!

This may seem really mean, but everyone is affected by IMBRA; even people like me whose applications only went in this week with the new forms. There appears to be no rhyme or reason to what order people get their RFEs, or even their NOAs. As much as I hate the delay caused by this new law, the reasoning behind the law is to protect people before they are hurt.

Trust me, I feel your pain...I wish I could be with my love more than anything but I realize there is nothing I can do about it. I am about the least patient person I know but I know this will all be worth it in the end. My love is forever, this is only temporary.

Although it must be hard to hear of people who have come after you getting their RFE's first, or even new applicants moving through the process with what seems like ease but why not be happy for them and support them. I know, I may sound horrible but everytime I hear a positive story on here about how people have moved through the process, I am empowered to believe that maybe, just maybe, Daniel and I will have an easy journey. Or in the very least, will make it through eventually. Have faith and believe that you are travelling this road for a reason. God only gives us as much as we can handle, although there are times that He has more faith in us than we do.

:star: Remember, there is a light at the end of the tunnel, and that is being in the arms of the person you love for the rest of your life. Do not look so much to tomorrow that you forget to live today. :star:

USCIS Service CentersNew Processing Dates for CSC
I just checked it today and they are still listing it as a visa they process. That's where we sent our application....TSC doesn't list I129-F at all and VSC is saying March 6....if this is accurate, I really really hope we are staying at NSC..... :unsure: now I'm so bloody confused!!!!! Worst part is my fiance is away for this whole week and won't be back until Saturday so I won't know if our cheque was cashed until at least Saturday. He travels regularly for work so us being up-to-date with the status of our case may be interesting.....

K-3 Spouse Visa Process & ProceduresGuidance?

First what you should do is read the guides to get a slight overview of the visa types.

K1 is for fiances, K3 is a non-immigrant visa and you will have to adjust status in the US to obtain resident status. CR1 gives you conditional permanent residency for when you are married for less than 2 years. IR1 is an immigrant visa for residency if married for 2 years or more.


We have read all the visa types and are still discussing which will work best for us. We are curious though what the difference is between the K3 and the CR1...we are currently trying to decide whether to get married before or after the visa process....

What is the main difference between the IR-1/CR-1 and the K3? Is there any differences as far as times? My boyfriend is a US citizen and I am Canadian and we are wondering which is a better way to go....or if the K1 is a good solution. We are looking at myself going to the US around the end of September, beginning of October. Can anyone offer some guidance?

Hey Guys!

I tell you, I get a big kick out of reading some of these and wonder what sort of adventures I'm in for when I move to Chicago. I know from just driving down there that I'm in for some fun times with some inconsiderate drivers. The last time I was there, my honey and I went out with one of his friends. My goodness!!!!! :help: I thought I was taking my life in my hands....apparently, Americans don't drive near the same as we do....no consideration for each other. And it was amusing to me (I was just telling my dad and stepmom about this last night) that in IL, when you get a speeding ticket, you get the option to go to driving school and it doesn't end up on your record that way. Needless to say, Daniel has been to school a couple of times. It shocked me that you can get away with it that easily. Anyways, hope you all are doing well and the journey is going easily for all the Canucks out there!!!!

This topic has truly made me laugh today. Reason being, when I was in Chicago at the beginning of May, one of my first comments to my Honey when I arrived home (his, hopefully soon to be mine too ;) ) was, "I didn't need Ontario plates for people to know I'm Canadian!". Driving through Chicago was ridiculous (remember, this is coming from someone who lives an hour west of T.O....and I thought it was bad there). People don't use their signal lights, no one lets anyone in, it's all about them and no one else on the road matters. And here I was, the happy, polite Canadian, letting people in, turning on my signal light to change lanes :whistle: (not that it helped me get over at all)....here's hoping someday I can handle driving there! :unsure:

Thanks guys for posting about cars because at this point (although very early in the K1 process) we are trying to decide and figure out how to deal with my car. It is financed and my Honey wants us to keep it but I was not sure what all I had to do in regards to it, plates, insurance, drivers license, etc. Man oh man, so much to think about for this whole process but only 34 days til I get another visit! :)

Oh dear....see what I have done now....sorry gang, just thought a healthy debate was in order. I agree with you all that, while I still smoke, it is a disgusting habit. It is unhealthy as well but my biggest issue, and being a smoker or not I would feel this way, you are taking peoples right to choose how they want to live their life away from them and that is not right. In this case, we have chosen to make non-smokers rights more important than smokers. Again, I do agree with banning it from indoors or in any enclosed area, but outside everyone can simply move away from the smoke or not go in smoking areas at all. That is a choice that people can make...if you are standing in a smoking area, which is a limited space, then you will be exposed to smoke. If you don't want to be exposed, you can go inside any building and be smoke free, go into any restaurant, any bar, any coffee shop.....Is there not a way to be able to let everyone have the choice on how they want to live their life?

Easier than explaining it....I will post you the law as of 12:01 this morning. It is confusing as heck though.

Smoke Free Ontario Act

Here's what the law mandates:


Bans smoking in enclosed public places and all enclosed workplaces, including restaurants, bars, schools, private clubs, sports arenas, work vehicles, offices and entertainment venues, including casinos, bingo halls, bowling and billiard establishments.

Eliminates designated smoking rooms in restaurants and bars.

Permits residential care facilities to operate controlled smoking areas which are specially designed to ensure nobody outside the room is exposed to second-hand smoke. The law stipulates who may enter the area and under what conditions, as well as requirements for engineering design, function and maintenance of the areas.

Protects home health care workers from second-hand smoke when offering services in private residences.

Prohibits smoking on patios that have food and beverage service if they're either partially or completely covered by a roof. (A roof includes an awning, tarp, canvas sheeting or other permanent or temporary covering capable of excluding rain or impeding airflow, or both. A stand-alone umbrella covering a single table isn't considered a roof. But if umbrellas are used to serve as a roof, an inspector may view it as such and act accordingly.)

Toughens the rules prohibiting tobacco sales to minors.

Prevents the promotion of tobacco products in entertainment venues.

Prohibits smoking in motels, hotels or inns, expect in rooms designated as guest smoking rooms.

Prohibits smoking in common areas of condominiums, apartment buildings and college and university residences. Examples of common areas include elevators, stairwells, hallways, parking garages, laundry facilities, lobbies, exercise areas and party or entertainment rooms.

Prohibits smoking in public schools, private schools and on public or private school property.

Bars smoking within a nine metre radius of any entrance or exit of a hospital. (A hospital may choose to provide a smoking shelter outdoors, but must ensure the structure consists of no more than two walls and a roof.)

Immediately restricts the retail promotion of tobacco products and imposes a complete ban on the display of tobacco products by May 31, 2008.

It's not that I don't agree with the littering issue and such. I do agree...it's not right for smokers to just throw their butts on the ground. It's also not right for coffee drinkers to throw Timmy's cups on the sidewalk. Or gum chewers to throw their gum on the ground. And it isn't right for smokers to smoke in bus shelters or other enclosures where it is clearly marked that they are not to smoke. I had quit smoking for four years before and I totally understand and out of every smoker I know, I was the only one who agreed with the original ban where you were no longer able to smoke in public places. Make us go outside where we are not forcing people to inhale our smoke...or at least where they do have a choice as well. My point is more now that we don't have a choice anymore. We can not smoke anywhere anymore. What's next? I can't smoke in my own car? Or my own home? It's a matter of having the choice. So soon, tabacco companies will be out of business....and where I live, Imperial Tabacco already is...there are so many people out of work now. Not that I am condoning smoking...I am planning to quit myself. But if you are banning smoking....why not ban drinking? Thousands and thousands of people each year are killed in alcohol related accidents or diseases related to drinking. And what about every other unhealthy choice we can make? McDonald's, BK, Wendy's...all of the junk food we can buy help contribute to the massive problem North America has with obesity.

Courtesy is one thing, and I agree many smokers need to have more of that, but removing rights is another.

Btw...no harm no foul....just a debate...Canucks will always be united :thumbs:

Okay, so this totally going to spark some big discussion but I am fuming!! (literally and figuratively) I want to know when Canada, more specifically Ontario, forgot that we are supposed to be a free country. I am speaking of the new law that Ontario passed and came into effect today. The smoking ban in Ontario has gotten to the point of being utterly ridiculous. Even though I am a smoker, if I was not I would still think this is plain controlling....the fact that Ontarians no longer have a choice on how to live their lives is just beyond all my beliefs of what Canada is. I fully support and understand the laws that we had previously but not being able to smoke under an umbrella or on any patio? WHAT THE HELL IS THE GOVERNMENT DOING? :bonk: What will they think of next....you will no longer be able to eat what you want, wear what you want, if you have tattoos you will have to cover them? This is ridiculous! :ranting:

Hello Fellow Canucks!!!!! :D

Just wanted to take this opportunity to introduce myself and ask for any advice which any Canucks have to offer.

A little about me : My name's Tiffany and I live in Guelph, Ontario. I met my wonderful man Daniel a year ago when he was sent to the shop I work at to do some training. He is originally from Indiana but has been living outside Chicago for the last seven years. He is absolutely incredible and definitely the love of my life. We dated for about 4 months and he was planning on moving to Canada. At that point he had a minor breakdown (just a whole lot of fear) about leaving his job and his home and needed to take some time away. We separated at the end of September last year. We continued to stay friends and with a lot of consideration on his part and some very long conversations, we decided to try and make things work one more time. He has a great job, fabulous friends and the best family anyone could imagine at home in the US and we have since decided that it is me, not him that will make the big move out of the country. We know that we belong together and are so excited to start our life. We have decided this weekend (May 2-4, one year later) that we will be starting the K1 process and hope to be together soon.

I am so glad to have found VJ, and to have also found fellow Canucks who are going through the process. We are starting to get our I-129F package together and I am wondering if anyone has any advice to offer. I have read all the guides and FAQ's on VJ and feel fairly confident that we can make this work. One of the questions I have is in relation to the proof of relationship. Because of us only being an eight hour drive away from eachother, we have normally driven to visit eachother. We don't have many airline tickets to prove I have visited him in the States except when I visited his family in Indy. Will these airline tickets be enough? Outside those, he has travelled up here for work and visited me at the same time but does not have the tickets anymore. I am also curious about lengths of Canadian K1's as opposed to other countries and if I will be interviewed in Montreal since there is a Consulate in T.O.

Hi Everyone!

I am just in the process of getting together everything for my Sweetie so that I can send him what he needs from me for the I-129F package. I am one of those weird people who likes to be organized and prepared for everything. I have been reading some posts about criminal record checks, etc. I am wondering if there is anything I should be doing ahead of time in case we are asked about a criminal record for me. I have no criminal record in Canada (or anywhere else for that matter...hehehe... :P ) but am just looking at any possible catches I may run into...

So I'm more confused than ever.....

Now that some of our friends and family know we are moving forward with the visa process, they are all telling us stories of someone they know who married a non-US citizen then moved there. We have had a couple people say that they know someone who got married in Canada (or some other part of the world), then moved to the US and only had to deal with the AOS at that point. I thought that you had to apply for a K3 or IR1/CR1 if you married outside the US. If not, we were thinking by skipping the visa process first and only having to deal with the AOS, we could cut down on the time we are apart. Are they wrong...if we were to get married, do we need to apply for a visa after or can we go straight the the AOS?

I did speak directly with GM and they said since my financing was with General Motors, I will have no problems with it at all. Since it's a North American company and financed directly through them, I tend to believe that it won't be a problem. I am thinking that if you are financed through a bank, it would be different.

Hey All!!!

Just wanted to share some good news with everyone who is moving to the US. I called GM today to find out if I need to pay off my car before I move. Just in case anyone else is in the same situation as I am, if you are financing your vehicle, you do not need to pay off the entire remaining amount on the car. You can continue to pay for the vehicle through a Canadian account. If you are leasing, you must vehicle off....at least according to GM.

I am so confused by all the information I am reading! My name's Tiffany and I am from Ontario. I am dating a wonderful man from Chicago and we want to get married and have me move there. The major issue is we don't know where to even start. I have been researching on the internet but there are so many different websites with contridictory information that I am incredibly confused.

We are wondering what the best and fastest way is for us to be together. Anything at this point is an option. We have talked about getting married before I move if it will help the process or getting married after if that is quicker. We just want to be together and not 8 hours away. If anyone has any information on what will be the quickest and easiest way for us to go about this, please let me know.

Hey Everyone!

We are getting close now....hopefully in the next week or two, all of our paperwork for our I-129F will be on its way to Nebraska. Just curious...for proof of our relationship, can we use pics of me with his family or would these be helpful? We only have one or two pics of us (we didn't think to be documenting our relationship) but there are a few of me at his brothers wedding with his family. Also, I have a really good relationship with his sister and talk to her often. I was thinking to highlight her phone number on phone bills to show relationship to his family. And if it would help, I was thinking it might be good to include a letter from my family or his to use as supporting evidence of our relationship....has anyone done this?

In addition, according to the USCIS websites, I thought we needed to send the application to Nebraska (Daniel lives in IL)....does this mean we are going to be transfered causing us a further delay? We have already made plans for when I will quit my job and such....now I'm a little concerned I was premature here..... :unsure: In any case, I will be the happiest woman alive when this is over and I look forward to when this wait is over. It will all be worthwhile soon enough :D I think if I had to, I would wait a lifetime for my wonderful man :whistle:

May sound like a dumb question but how do you sign up to check your case status online? I was under the impression that we needed to receive our NOA1 first. I believe that Daniel included his email address on the application somewhere :blink: I know it's going to be hard for him to be checking very often since he is travelling so much for work but he has been very diligent with checking to see if they've cashed our cheque. just keeping my fingers crossed for now. And I (hopefully, as long as they are nice at customs) get to see him this weekend :P I have a letter from my employer, a return ticket and my lease all ready to go so it should be good I hope!

Other downfall is that my fiance travels a lot for work so we may not know from day to day where our application is in the process....just hoping that we get lucky and sail through the system with ease....lol...I'm eternally optimistic btw :lol:

Hey All!!!

Just wanted to post some good news for a change :dance: I just returned from a weekend in Indiana visiting my fiance!!!!! No problems at customs (was prepared with a letter from my employer, my return ticket and my lease for the condo). He asked me more questions than normal and wanted details of the last time I was in the U.S. but never asked me to prove ties to Canada :) Coming back here was easier than usual....questions were "Who did you go to see?" "My fiance" "Did you cry when he proposed?" "No, it was kind of an expected proposal." Then he handed my passport back and I looked at him funny and asked if we were done and, yep, that was it! :dance: WOO HOO!!! Only thing that got me wondering was that when they stamped my passport going into the U.S., there's a line for class and when they never usually fill anything out, they put B2 on mine. Dont know what it means but they still let me visit!!!!! :dance: :dance: :dance: :dance: :dance:

Feeling great, had my fix for a bit. I can't wait for the future!!!!

HI! :) Sorry I lost it there previously....wasn't really feeling myself this week at all. So our application is officially lost...not by Fedex or USCIS but by my fiance's work...they can't find the darn thing. Now we are stuck waiting until probably August 1st to try again on this. :huh: BUT....on a kind of decent news front...his boss and boss' boss want to hire me :dance: And they are aware that will mean a visa of some description for me to work. They need to talk to HR still so it's not for sure but we have fingers and toes crossed. I am still waiting for some information from my friend's mom (who works for an emmigration/immigration) lawyer but time will tell. We just have decided it's best to hold off on the K1 for now til the work thing is a definite no go....
