I was checking out the processing times for the i-130. I was wondering how does a Permanent resident filling for a spouse takes 5 months but a U.S. citizen filing for a spouse. Takes a longer time. I know nothing fair in life. I would think as a U.S. citizen I would be able to get my husband here sooner they a person that immigrated over here. That really blows my mind. girlwerewolf2xn.gif

Me and my husband never thought it would be this hard. With everything going on in Egypt is makes it harder. I ask Allah give us all sabr insha'allah. Its a blessing for skype that's for sure,Alhamdulia. If i had it my way i would be over there now waiting out the process with my husband. I so want to get rid of her. I talk to my husband about letting me do it on my own and get help from people on here that went thru this already. But he rather take the lawyer. Now i paid her the fee and the fee for the I-130. To me i could done it better. It seems like i knew more then her but to him she know more then me. But look where we are now stuck. and I-130 still not sent out. I should done what i wanted and get all the evidence to send in with it in the first place. And she done this many times before.SMH

I'm going thru anon profit organization for help. And before then send out the petitions they have a review on all. Due to limited funds this is the less expensive way,so i hope,. I wanted to do on my own but my loving husband thinks it better to go thru here at least she went to school for law... I hope i don't sound to silly, do i get the letter notarized or does my family do that before they send it to me.. If so im going to be wiring money out to pay for it. Thanks for the reply.

Me and my husband is starting the I-130 process. We got a lawyer to help to make sure everything goes right. The problem I'm having is, She said that we don't need to send in evidence with it that our wedding certificate is just fine. After having a review with her colleagues before she sends it out. It was said that we should send in evidence after all or wait to see if the RFE us.She said beside getting a letter from then i should also get proof of the being us citizens Here a part i took from the letter to give to everyone i ask for a letter from. "it would be most helpful to the couple if you were able to provide a copy of your proof of legal permanent residence or citizenship in the United States Examples of proof would be: your US birth certificate, your copy of naturalization certificate, a copy of your US passport, or a copy of your Legal Permanent Residency car" I don't feel comfortable asking family and close friend for a copy of their birth certificate. Has anyone had to get that to send in with letter of supporting evidence. I think that's doing to much.Or would it be safe to just send in their letters with the proof of their citizenship.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAdjustment of Status from K1 concerns in California

Hello everyone!

 

Maybe you can all give us an honest assessment and help us sort our current condition. 

 

1. We got married within 90 days of entry to the US (late April)

2. We filed the AOS, EAD, and AP early June with all relevant documents

3. Got our NOA1 for all 3 documents on June 4th

4. Did biometrics and photo on July 1. Had some difficulty with my fingerprints due to faded lines on my fingers but eventually got through the fingerprinting. 

 

---> The VERY NEXT DAY (July 2), my husband got laid off.

 

My husband is the only one listed in the original AOS packet as my sponsor (I-865). His former salary was above the poverty limits so we felt we were okay with just his income. Currently we are dependent on savings while he looks for work (I dont have my EAD yet). He also decided to apply for EDD (Employment Development Department), a financial assistance program in the state of California where you receive money (not much) while you are looking for work. We are confident he will find work within the next 2 weeks. He has not received approval for his EDD application as of today.

 

5. On July 21, we got notice that I am being scheduled for an interview and to wait for the letter in the mail. No interview date given yet.

6. Also on July 21, we got confirmation that I am pregnant and due to deliver in March 2015.

 

Our questions:

 

1. What kind of complications does this community foresee in our case? How can we be better prepared? Do you guys think I have a strong chance of getting denied?

2. Can we, at the time of our interview with the IO, add a joint sponsor and submit his/her paperwork at the interview? What should we expect at the interview given the situation?

3. Will I be considered a public charge? I have not applied for anything other than Medi-cal (low income health insurance) and I understand this does not fall under public charge

4. Again, we are confident that he will find sufficient work soon. But will the lapse between jobs make things complicated? 

 

We greatly appreciate any input, and welcome any bit of encouragement! We dont know if anyone has gone through something similar, we have been browsing the forums but haven't come across something similar to our situation.

Yes, she already has her B2 visa, she has been a frequent US traveler and even studied there for some time so she is sort of familiar with US immigration, having gotten her student (F1) on her own, and maintaining her B2 visa since she was 10 years old.

 

I hope you all don't mind if I ask about the affidavit of support... what exactly is the amount of money they need me to show (125% above poverty level - what does that salary look like?). Does that mean if I do not meet minimum requirement we could be denied of a spouse visa? Apologies if this may be a stupid question!

 

Are there requirements for a co-sponsor? (For instance, do they need to be family or can it be anyone willing to be our co-sponsor?) Will they have to pay for anything or incur any fines/fees?

 

Also, Caryh thank you for the tip on Balikbayan visa. Will look into that definitely!!

 

Penguin_ie, yes we do plan to come back and have family who can forward any postage to the Philippines. When you say "maintain a US residence" does it mean I need to show I have real estate with my name on it? (whether an apartment lease or actual ownership) Or does it mean I can use my family's address as my official US address while I am away?

Hello everyone! Its my first time to post here. Hope you can help clarify some things for me (USC) and my fiance (Philippine citizen)!

 

1. We are considering having her come to the US on her B1/B2 multiple entry visa to get married in City Hall. This will allow us to get married, have our honeymoon, and then she will return to the Philippines as I process her spouse visa in the US. I've read that this is perfectly legal.

 

- What are your thoughts on this? Should she declare this at POE, making sure she has all her paperwork to show strong ties to send her back to the Philippines? [property, work status, car registration, etc]. We are uncomfortable with the thought of lying to an officer at her POE. Besides, she is a terrible liar! LOL

 

2. Since I dont want to be apart from her, our thought is for me to relocate to the Philippines in the meantime after I send in all the paperwork to get her petition started. Couldn't find any information that states I need to be in the US while this is being processed. In the meantime, I plan to finish school and do freelance work (if possible) in the Philippines. Once her spouse visa comes in, she can relocate with me. The idea is to give her that extra bit of time to tie up loose ends, but allow us to be together faster.

 

- Is this possible? Do you think it is wise? Why/why not?

- Can I start her paperwork for spouse visa even while she is still in the US with me? (We will process it as soon as we are married, for instance.)

 

She has several obligations that don't allow her to migrate to the US just yet, and we are tired of being apart so we thought this might be a good option for us, completely legal (it seems) but not very common, apparently. The other option we are considering is the K1 visa, but I'm sure you understand that we want to be together ASAP.

Hello,

 

I just have a general question. I'm a US Citizen and I have a foreign fiancé who lives in the Philippines. If I marry my fiancé in the Philippines, can I bring her back with me to the states and start the Spouse Visa petition process then? Or does she have to stay in the Philippines until all the paperwork has been approved?

 

Any info would be greatly appreciated.

K-1 Fiance(e) Visa Process & Procedures129F Petitioner change of home address

Hello everyone! Wondering if you can enlighten me. 

 

I live in San Francisco and I am about to send in the 129F packet for the K1 (fiance is in the Philippines). There is also a big chance that I will move to a new address soon (also within SF) but the move date is not firm. 

 

Don't want to delay sending in the packet already because I'm ready to do so, but what happens when I move homes and I no longer live at the address that I first put in my petition?

 

Any help would be much appreciated. Thank you!
