I remember that I spent 2011 Christmas holidays with my then fiance and when He returned to the States on early- mid January our NoA 2 was wating for him on the mail :). The largest period we couldn't see each other was 3 month (twice september - december/ january -march) and we were already loosing our minds! But you know what? Even when is really hard being away from your better half, it only make your future marry life even better! I think everything that we'd been through was totally worth it! This whole k1 visa drama made our relation stronger and made us 1000% more committed to our love. I see other couples (who had the chance to had a regular relationship) and we are wayyy different. Being apart and struggle to be together since the very beginning taugh us to enjoy every single moment together, not to give up easily, to work for our relationship and build a strong-happy-healthy marriage. I think that we give more value to all the things we struggle and battle to get. Now that it's been almost a year since I finally moved to the US (on april 20) we look back and we could not believe not only, how fast time went by but also how much we'd accomplish together and how much we grew up as couple, but always thanking God for all the things He put us through. What it kepts us going, was the thinking of: instead of thinking how much time we had ahead with rather to think that every day that went by was a day closer to be together. In some embassy/consulate is not a requirement but is highly recommended to asist together. In my case, the date of my k1 visa interview I went with my now hubby. I met other girl applying for a k1 visa also, she went alone and her interview was wayyyy longer and hard compare to mine (in Caracas embassy the interview is performe in a open booth so EVERYBODY around can hear it) her interview last at least 30 min. When it was my turn I went with my then fiance and she asked 3 or 4 question and 2 questions to him and that was it! We were approved :). The other girl was approved too but our interviews were different. Im nit saying that going together will grant her, her visa but I thinks thats an extra plus for both of you

hi and welcome! Well I totally understand you cause I went through the same thing. My now husband and I are cousins too. We are third cousins. And yes you have to mark YES and explain how are you related to him. I know it can be scary going through a marriage petition when your fiance is your own family, and people may tell you is a "red flag". I think is completely fine. Get marry with your second, third, fourth etc etc is completely legal in the 50 states, and basically everywhere. Is accepted not only by the law but also for most of the religions I know so as long as you love each other and follow the guides you are going to be fine.

But since the very beginning we decided to be honest with this whole process. We wanted to hire a lawyer before finding this website, but when she told us to lie about the fact we were related, we knew that wasn't our choice, so we fired her.

When you lie or hide something its because you are doing something bad or ilegal and being in love with my third country was everything but a crime. We had nothing to hide so we rather to always come clean. So we did it, and our honesty paid off. During our interview I told the CO how we met and she was like nothing...she didn't say anything and it was like no big deal at all.

My biggest advice to you is always tell the truth, you have nothing to hide or been ashamed of. If you lie and they caught you can get in serious problems and jeopardize your petition.

We also prepare very well for our interview in case we needed to proof that beyond our family bond, we were truly in love. But the funny part is the CO never request nor a single photo of us :dance: she was completely sure we were a real couple.

60 days is nothing! In normal circumstances, the processing time for noa 2 is 5 month but this years the processing time reached the 7 and 9 month. Most of the august, sept, oct, november and december are still waiting for noa 2. And after the NOA2 you need to wait at least 2 month (after noa 2, the nvc receive your package, they check it again and then they send it to her embassy) so the normal processing time for an entire k1 process is not less than 7 month. I guess you are new member so you need to check the processing time chart for each stage of the process, so you have an idea how much time you need to wait

My now hubby and I met each other on 1995 and never saw each other again until june 2011. We met at june 3rd 2011, on june 21, 2011 he asked me to be his girlfriend and on august 8, 2011 he proposed to me!!! We only dated for 2 month when he asked to marry him. A month later we filed my k1 visa. When our interview time arrived on april 3, 2012 we only had 9 month dating. They asked how much time we were together and when I told the CO that we only had 9 month dating she was surprised but it was not an issue!! At all! Actually we got married 4 days before our 11 month mesesary lol! My family and friend were amaze by how quickly we did everything but our love was so strong and obvious that everybody supported us! We also had other "red flags" like we are also related (we are 3rd cousins), he is 12 years older than me (he is 39 and Im 26) and he is divorced. But none of those issues were never ever a problem! Actually it took me 6 month and 3 weeks to complete the whole journey. I also remember that during my interview they did not request nor a single photo or proof of relationship. So as long as you guys can proof how much you love each other, you will be fine :) good luck

When I received my k1 visa last year, the medical results had 1 year of validation. So you should apply for her adjustment before it expire.

 

But regarding the visa, the noa 2 has nothing to do with it, the NOA2 has indeed an expiration date but it only means that the NVC and the embassy should process you before the NOA2 expiration date. If this happens, your petition would be send back to the USCIS and basically you will need to start over again. But dont worry about this.  Just follow the steps and procedures according the US embassy at Brazil.

 

In my case I received my visa on April16 (MondaY) and by friday I was already here, but she can leave within does 6 months.

 

But before the interview, its impossible to know when she can move, but you are getting close!

I think you will need to start all over again...the noa2 is valid for 6 month...during that time the NVC and the local embassy must interview her and make a decision wether to approve or deny your petition. If she shows up to the interview and make it, she still have 6 month to leave brazil.  Once she arrive to the States she will only have 90 days to get marry with you.

 

If you guys are not ready to live together, you should call the USCIS toll free line and cancel your petition and start over by april or may 2014. In my 2 years being a Vj member I'd never read case where the visa can be delayed or reissued. I think you've a frame of time to work, otherwise your petition will be revoked.

 

I think the best thing for you is call off your plans and cancel your petition and file only when you are truly sure.

I dont know when your fiance had his interview, but I receive mine almost 2 weeks later. My interview took place on April 3, 2012 and I finally receive it on april 16 and it was issued on april 11. Be patient and wait at least for a couple of days, otherwise call the US embassy at your fiance's country

My masters in human genetics and 10 years at a biotech qualifies me to address your bigoted and wrong understanding of biology.



 

Maybe I dont have a degree in genetics but you are not profesional at all. The increase in the risk comes from when is there a family history with certain genetic decease like Tay- Sachs, haemophilia, cystic fibromas where the gene is normally recessive, and obviously you have an increase risk if you inbreed, to have a child with any of this deceases. But if you have a history with no relevant health issues, or genetics disorder and there's no evidence of previous inbreedings the chances are very low. I met a lot of people, children from 1st degree cousins and they are perfectly normal people. I'm married to my third cousin and we have a kid which is perfectly normal and other in the way. Before getting pregnant we went to a genetic specialist, even when the risk exist is not way much over a non related couple. Even he shown us a study where states that 87% of the babies born with genetics defects come from parents who are not related at all.

I think this won't affects the OP if he wants to file for anther k1 in the future if that the case. You are doing the right thing about let it go if you are not sure about getting married with your USC fiance.

I read so many cases about people, that knowing their relationship is over they still went through the whole process, made it successfully, but in the end the beneficiary went back to his/hers homecountry, with a divorce and some bad and painful memories.

It's very painful and heartbroken when you split at this point (or any) with a fiance, but at least you did not take it any further.

To file for a k1 visa we need to be 100000% sure and happy with ours decision.

My k1 petition took 6 month and 3 weeks since we file til the day I moved to the US. Got my noa2 within 3 month but it took me a month to get an interview appointment (My embassy doesn't have package 3 or 4 wich it makes everything faster) and they gave me my appointment for april 3, 2012 (2 month and 3 weeks after my noa2). I finally got my visa in hand in april 16 (3month after my noa2). So if I were you I wouldn't make plan until she got her visa. August 9 is aroubd the corner

Nope. My hubby and I date for 2 month when he proposed to me. By the time of my k1 interview we were only 8 month together and 9 month when we finally got married. It was never an issue. He also "asked me" to marry him in a sort of agreement and we submitted the k1 petition on Sept 2011. On december 2011, we both went to visit my parents in Spain and spent xmas with them. During xmas night my mom and him make an engagement party where he proposed to me with ring in hand and ask my dad permission to marry me :).

Aos= you should file as soon as you can after get married, if you have an interview the whole process can take 5 or 6 month, but you can also be approved without interview but takes 7 to 11 month. ROC= when you receive your green card is just for 2 years. When your gc is about to expire is when you file for ROC (exactly 90 days BEFORE your green card expire, you can file). CITIZENSHIP= 3rd year of your greencard minus 90 days.

Besides those numbers you should take in considerarion other documents like driver license. SSN it's free but also think in the costs of getting copies, translations and all the things you need for the further applucations. Also the wedding certificate (here in Florida is $100) and other cost if you are having a wedding. As a former k1 visa holder myself, the 1st year is the most expensive. My hubby spent a lot of money not only in terms of immigration but also to make sure I had everything I need (car, health and car insurance, driver's license, some clothes, etc etc) even when I brought everything I could, there's a lot of things I left behind (2 or 3 suitcases is not enough to move your life to another country)

You state that you wished the interview could have been done in his home country of Iraq, well, interviews for Iraq do not take place in Iraq as the US embassy there is closed, they are done in Amman, they have been for a long time(not sure why you wouldn't know this if you did your homework). Meeting only once is a BIG red flag for a male beneficiary from any MENA country, and being different religions is a red flag, as well. Marrying a Christian or Jew is allowed for Muslim men, but it  isn't the cultural norm. Also, approval of the family is really big in his culture, and the consulates know this. Did you send any evidence of his family supporting your relationship and the marriage in the US? The interview and evidence for a MENA country should go well beyond just proving that you met and that you speak every day. Family approval and involvement plays a BIG part. 
You need to do some homework on what the cultural norms are for his country, and also some more homework about the entire process. You weren't even aware that interviews for Irag are held in Amman. You need to spend more time with him, preferably with his family as well. You have 3 choices, wait for the petition to be sent back to USCIS for further review, where it will most likely expire and be dead in the water, File another I129f petition, but only after you have met him again and spent some face time, preferably with his family as well. Or meet again and get married and file an I130 petition for spouse. Just know that if you go the marriage route, it does not  equal an automatic approval, you need to address the reasons for the denial. You have a long road ahead of you, no matter which way you choose to go, just be prepared for that. I wish you the best, and if you have any questions feel free to ask. My husband is from Jordan, and I attended his interview with him in Amman a year ago.

I agree with one of the members who said the embassies that are considerate like High fraud, need more than just 1 visit. Irak like other middle east/ african embassy are super super hard. I've seen people with 3 visits and still gets a denial. From my perspective, you did a great job with your proof of bonafide relationship (you had a lot of things and variety) but the main thing and I think that jeopardized your case, is that 1 and only visit.

Hiring an attorney is wasting your money! I did my k1 and my AoS myself (well with the help of my hubby of course). It was quick an easy, never get a RFE, and I saved probably $3000. A friend of mine hired an attorney for her k1 and not only she wastes thousands of $ but also got 2 rfe and a delay of 5 month. Is not worth it. And SSM are going to be process equaly, just like any straight couple. Just follow instructions

The what I was thinking! Usually you get an RFE when you don't enough proof of a bonafide relationship, but sendind NONE normally end up in a complete denial. I dont know whats going on through this lady's mind cause is well known the one of the most important things of this package are those proof. My advice would be wait for a notification, and get rid of her! It's better to follow the vj guidelines and ask for help if you need it

It doesn't matter you can have it reprint all the times you need to! Thank God you realized about your mistake!! Don't worry bar code its for other's purposes. In my case my now hubby and I reprint everything like 10 times cause we always found a new mistake :( but it's ok, we rather that than getting a rejection. my thoughts for you is read your forms thousand times and put other people to read it.

Affidavit? The i134 is only required at the time of the interview not before. Can you explain us a detail list of the things they request you and what did you send? It's really important to know so you dont make the same mistake twice.

Which countries are considered "high risk countries for fraud"?

middle east country, Africa (mostly Morocco and Nigeria), Eastern Europe, Ecuador (is high fraud but not that high)
