I just read the whole thread.... all I have to say is WOW... my thoughts are with you... I know that I will not be strong enough to handle all that you have been through... and I have already given my hubby a timeline, and if we have not gotten the visa by then, I will be moving to India to live with him until we are able to get it.... the NOA2 is the I-797 that was mailed to you from the USCIS.... this would have had your case number on it and told you that your I-130 petition has been approved.....this is what you had been waiting on so that you could be transfered over to the NVC... :P this is what I scanned onto the computer and then my hubby printed it off

My husband is also in India... we had to get both PCC a couple of weeks back.... my hubby got his RPO PCC first... and then he took that along with a copy of the NOA2 to his district police office and was able to get it with out any delays < he also took all his neighbors and his parents, so they didnt even have to come to his house to prove residence> ... he his from Haryana...

I could be wrong... but what I think they want is to see the NOA2... what I did was scan the hard copy on the computer and then emailed it to him... then he printed it out and showed it to them along with the email that we recieved that said it was approved...


Honestly I havent seen too many situations where a little greasing of the palms didnt do the trick to get the ball rolling!!!

Bull$hit in what USCIS operator that had to put you on hold to even find out what the hell you were talking about!!!! You can believe that person OR go with what the people here on VJ have to say and have experienced!!! Your choice! FILING THE 129 WILL SLOW YOUR I-130 DOWN!!! They pull the application out of line and put it with the newly filed I-129... Then they are approved together and the I-129 is closed and you wasted time for them to process 2 applications (knowing that only the I-130) would be used...

Its' your time to wase however so choose as you will... believe who you want... But generally the people here on VJ have a better grasp of how things ACTUALLY work, versus an operator with a script who has never went through the process

Getting married in US is logistically very hard as I am yet to become financially secure and getting the folks here for just the wedding et all. it seems like a big mountain. If i go K3 route then according to the processing times K1 is faster, seemingly. With a difference of 3-4 months?
Also I have read that K3 approval and I-130 processing takes about the equal time give and take a month or two. As this whole activity governs next 5 yrs of both our lives I do not want to mess up unsure.gif
My other problem is having no contacts, i am in 2 minds about using an attorneys help. As in some posts here has been justified you dont need one if you have all bases covered.

Please let me know your thoughts on my case.

Ok, I was looking at the K3 flowchart and the process of the K3 visa. But, I am having conflicting opinions on what happens after your NOA2

Does K3 applicants follow anything on the LingChe Guide to fly through NVC? Because this is what it says

12. Final Stages of NVC
[edit] a. If you were also approved to apply for a K-3 visa (otherwise skip).
If (again big IF) you had simultaneously petitioned to apply for a K-3 visa (by sending in an I-129f) then you may be able to allow that process to continue in order to get an interview date at the consulate before your case is approved at NVC. This requires luck and timing.

USCIS will send your approved I-129f to NVC.
NVC will "touch" the I-129f long enough to give it a case number and pass it on to the embassy.
The embassy will notify the beneficiary of the next steps, and give them the case number assigned by NVC.
The embassy will tell the beneficiary how and where to setup the medical exam.
The beneficiary can then send in another copy of the DS-230 (just the signed pt.1, no other documents).
The beneficiary can schedule a medical exam.
The beneficiary can request an interview date, far enough in advance that their CR-1/IR-1 Visa case will be completed at NVC.
Once NVC completes the case, the beneficiary should NOT contact the embassy/consulate to request that they change the already scheduled K-3 interview for a CR-1/IR-1.
Instead, contact a supervisor at NVC, and request that your completed package be expeditiously sent to the embassy/consulate. This strategy is not guaranteed, It will vary by embassy.

Technically, if you have a CR-1/IR-1 that's ready, the embassy/consulate can not issue or schedule you for a K-3. They also can not schedule a CR-1/IR-1 interview...only NVC can.

My question is this... do I follow everything on the LingChe guide as if I was a CR1 petitioner, paying fees, mailing forms etc...... or...... once I have my NOA2 and USCIS forwards my case to the NVC then the NVC will send out my I-129f to my consulate, skipping everything that CR-1 petitions have to do, and the embassy will then contact the benificary to set up medical and send packet 4.....?

Please would love to chat with someone that has already gone through the K3 process

Amit also has his CBSC birth certificate, I personally didnt think that it was enough so I requested him to atleast see if he could go and get the long form certified live birth certificate from the court... and he was able to after he found out exactly where to go. Everyone that is born I believe after 1968 atleast in Delhi, has been recorded. When I mailed in both the I-130 and the I-129f I included both the CBSC birth certificate and a copy of the certified long form he got from court.


I think that if you can get the long form get it, never hurts to be overly prepared...

Interviews are unfortunately scheduled on the consulate's availability. Expediting may have helped you in bypassing NVC but if there no open CR-1 slots for February, then there's nothing they can do.

The only thing that I can add is I would look to see when your I-130 petition expires, and if it is going to expire anytime soon I would put in a request to extend it... I read somewhere that they were on AP and there I-130 petition expired so they had to start back over... IDK.... best of luck!!!

it is different at every consulate in India... which one are you at? My husband had his interview at the New Delhi consulate and I was able to attend the whole thing.... watched him get his fingerprints taken,answered most of the questions.... I was even sworn in with him during the interview

that sucks dear my thoughts are with you :crying: I cant believe that they kept your passport at the interview only later to return it to you and say that you dont have enough viable relationship evidence to prove that yall are really married... uggggh You would of thought at the interview they would of known this and given you a chance to rectify it then. Sometimes I think they do things on purpose just to jack with our lives... I pray that you can get your application reaffirmed at USCIS and have a second interview... hey did your wife attend the first interview? If not... I would highly reccomend that she attends the next one if you can get it reaffirmed.... she might not be able to actually be there with you but you could take her passport to show that she is present... also... this is the time to not break down... but to start collecting evidence for your NEXT interview.. be positive :thumbs:

At our interview I had submitted everything... but they handed it all back to me and only kept the current tax return... so go figure...IMO, I would suggest that you have everything so in the interview if it is requested you can pull it out and give it to them instead of recieveing a 221g and having to bring the information/documents back...

I wasnt saying that you would get denied :D I was saying in the worse case scenario... You would'nt file a wavier (I-601) until you get denied for the visa after the interview... It is always best to be prepared in any situation... This way nothing comes to you as a shock :thumbs:

Proof that you are married??? did you not submit a marriage certificate... sometimes I am a little slow.. But to me that is what it is sounding like wha they need.. I would definitely send in affidavites from family and friends that have witnessed your wedding and seen yall as a happy married couple. As far as other evidence, If you have bank account info and tax return info.. I agree with the others... DL with same address and the like... I would just like to know If you sent in a marriage certificate or not.... and then maybe we could help you better

If anyone could include a link for me, or tell me how to look it up... I tried searching it already. I think it was a process that claimed if you followed it you could get through the process in 1 month... or something like that..

This is what I gathered and sent in my I-751 packet:

Cover Letter

• Check Number XXXX, Payment of $590 for I-751 and Biometric fee

• Notice of Requirement to file Joint Petition

• I-751

• Pregnancy Letter from Stacey McClain FNP :o)

• Copies of Joint Tax Transcripts for the years 2010 and 2011

• Copy of Lease from our Landlord

• Copy of Green Card, Social Security Card, Passport, and Driver’s License (Hubby)

• Copy of Car Insurance Cards

• Copy of Driver’s License, Bank Card, Zoo Membership (Me)

• Copy of Bank Statements

• Copy of Geico Insurance Policies

• Copy of Car Title showing Joint ownership

• Copy of Bills to the House (Both of our names)

• Affidavits from Family and Friends with the knowledge of our Marriage and On-going Relationship

• Pictures from over the past 2 years (50 in order from his POE, showing Holidays, Birthdays and comingling with my Family)


Everything was color coded... and in proper place... checked it 1000 times... When the NOA came... at the bottom of the NOA it says:

If you have not already done so, provide supporting documents to assist the USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECIEPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but not limited to, the following items:

- Lease of joint tenancy or joint ownership of assets
- Joint Mortgage agreement and/or property deed
- Tax Returns
- Birth Certificate(s) of any child(ren) born from the marriage
- Joint polices of life, medical and/ or car insurance


I have already sent all of this with my I-751... But this list is much more managable... hahahahahahahahah mine was like a term paper!!!!

You can get an affidavit from your Grandparents or In-laws or whoever owns the house you are staying in for a rental agreement..


We lived with my parents for 1.5years... we just got our own house back in April... so... in my Dad's and Mom's affidavit.. it states that We lived with them as a happy couple.. bla bla bla from x date to x date... that should cover that...
