For my "wife" my case was a bit special since I were married traditionally , according to the custom of my country, unfortunately did not have a valid marriage certificate.Also had a I130 denied because of that.

You can message me if you want. I had my kiddo in sweden before my visa was done so I went through the process of getting her a dual citizenship. Its quite a hassle with all the paperwork but if you have it all together by the time the baby is born you will have a interview time at the embassy pretty fast and the baby's passport will arrive rathet fast too. Remember that the baby must travel on the american passport and not a swedish one.

I've never flown to Kosovo so my advice is strictly generic airline flight tips.  Please keep this in mind when reading what I have to say here:

 

First thing I'd do is guesstimate the date now and shop around for your tickets and see what the pricing is.  Some airlines have a high flat fee for one way tickets between destinations and can often times be more than a round trip ticket. Other airlines have fairly liberal policies when it comes to one way ticketing.  

 

You can do your shopping at any of the websites that cater to travel and list your necessary airports, but another tip is, once you've used these sites, go check out the individual airline websites and see what rates they are offering for the same flights. Sometimes you can save money doing this, because often, airlines offer the same rate online as they do to these sites and you don't pay the site fee that is automatically added into the fares you see on non-airline sites.

 

Another tip, goes along with the reason some airlines charge higher fees for one way vs. round trip, and that is you may want to purchase a round trip, then when you are safely at your destination, cancel your return flight.  They won't refund any portion of the trip for this, but if it was cheaper than a one-way, it won't matter because you'll have saved some money.

 

Hopefully these help get you a starting point and maybe some more people will be able to chime in with more advice for you that is better than this and maybe even specific to your destinations.

It's my understanding that the beneficiary brings the affidavit of support and other forms with them to the interview, but as I haven't gone through the process yet myself, I'm not 100% on that.

I got my tax transcript just a few weeks after I filed, although I did file electronically, but if he's got his return, then they should have processed his return.  Once it's processed they should be able to send you a transcript.

Because the date will be before the filing. Think they will prefer that.

CSC should be just asking for her original signature.

Then I think you should just wait to get the letter and then you will know for sure what they're asking for.

In my case, I was the beneficiary and my letter of intend was scanned, but that was not a problem, I got my K visa and I am in the US now.

I have read many cases of people who have sent scanned copies and had no problem, and I've seen some where people have said that they got an RFE.  I knew it was a risk when I sent it, but at the time it felt like the odds were 50/50 of it getting through without delay and waiting for it to show up before filing was going to be a guaranteed delay so I took the risk.  Obviously it didn't pay off.  Of course with USCIS it could be an RFE for anything since it's possible they could have lost some portion of my file, but I have copies of everything I sent to them, so anything they need I should be able to turn it around and get it back to them by the next day.   My only concern while I wait is if I may need a new version of the Intent to Marry if that indeed is the problem as I suspected or if the original will suffice.  Guess I'll just keep my fingers crossed a little bit longer.

Hello

 

Did you get the letter from the USCIS and it says you've gotten the RFE because of the letter of intend? I am asking because that should not be an issue since many of the beneficiaries of the visa K1 are not in The States and usually send a scanned letter of intend to USCIS.

 

I haven't received the letter, just the notification, but it was/is the only thing that I know I screwed up in the filing.  I know they want original signatures, so I'm guessing that's what it is.  When we filed, we filed out the g-325a with original signatures, sent in the proper size passport photos.  Used boarding passes and photos as evidence of having met, so not sure what else it could possibly be.

I just received notice to day that they are requesting further evidence.   I'm not overly surprised because my fiancee forgot to mail over the letter of intent, so she scanned it and I printed it and sent it in.  I hoped they wouldn't worry over it too much, but just in case, I had her bring it over here on her last trip so I'd have the original.  My question is, with an RFE, will the original which they have a copy of be sufficient to fulfill the RFE or will they wan to see an updated one with a current date?

 

I am sure she could send over an updated one, but if it's not necessary then I'd rather save the expense.

 

Does anyone have experience with this situation where they've sent in the original and got approved or did anyone try this and get another request for an updated version?

I'll go to the point.

 

When i first filed for a K1 i got 2 certified divorce decree copies, one was sent along with the application and the other one i still have it with me. I know i have to send this with the I134 and other documents to my fiance, but as i was looking at the date on the court seal, i notice it was issued over 9 months ago. My question is, do theses certified copies expire? is it better to get a new one? or do you think i won't have any problem with that one even if it is from August 20th 2012? 

 

I did a search online but found nothing, also did a search on the forum but all i got was just related to divorce intering with GC or any other process...but nothing on expiration dates....

 

I hope you can help me...Thanks!!!

 

I can only speak from my personal circumstances, double checking with your own state is always best, but here, when you get a certified copy of a divorce or marriage or birth or anything like that, you get it from the state's department of vital statistics.  They give it to you with the certification that the document is real.  This certifies it as an official government record of the event.  It never expires.  Hope it's similar in your instance

The above posters are both correct.  I just want to add my personal experience to this point.

 

When I filed in February, I included as evidence of meeting, the following:

 

1)  Multiple sets of boarding passes from trips within the past two years

 

2) One picture of us together at from each of those trips with the date and location written on the back

 

3) Included in my cover letter a brief history of the steps of our relationship which included mentioning dates from each trip.

 

That is all we included.  They did send me an RFE for divorce documents from my first marriage, but did not request any additional evidence of meeting in person.

 

Of course each individual adjudicator is going to like to see different things, so sending more than the minimum is not going to hurt your case any, but at this point all the I-129F petition requires is evidence that you met within the past 2 years.

Here's a link to the USCIS page explaining the form i-134 which is the affidavit of support form for the K-1 visa.  The Co-Sponsor is anyone willing to sign this affidavit who makes a qualifying income.  They don't have to actually pay anything to do this, they just have to insure that the person coming over will not become a public charge. 

 

One thing you want to do though is make sure that the consulate through which you are applying for the Visa (in your case It looks like Turkey) accepts co-sponsors.  I know some do not, but not sure which ones those are.

A blip from last year's tax return will likely get them to take a little deeper look into your finances, but shore up a little extra evidence for your current situation and I would think you should be fine.

 

To accomplish this, I would, on top of the letter from your employer, see if you can get copies of your most recent few pay stubs to add to the letter so they can see for themselves what you are currently making.

I'm wanting to know if there is anything I need to do now that my I129F has been approved. Do I just wait until my application is processed through the NVC and arrives at the US embassy in London?

 

I know I need to have a medical before I can book my interview. Does anyone know a helpful list of things that need to be done for the medical/for the interview?

 

I need to have my interview before August so I can start my MBA, but see that the processing times are almost 3 months! Any helpful suggestions on speeding the processes up?

Im already in the country on the visa waiver. At the port of entry I had no intent to marry during this trip, I naively thought the visa would come through in time and that I would go back to the UK then re-enter on the K1. They questioned me at port of entry and were satisfied.

Does anyone actually know of anyone who has been denied the K1 on the grounds of already being married, when there has been no legally binding event or record to point to? In my mind I would just argue that I haven't had a marriage yet, and that I plan to when I enter the USA. Which would all be true.


Here's the issue as I see it. If you get married only the one time, and the pastor fills out the certificate later, he has two options, one would be to lie and put a later date for the ceremony on the certificate, and that is wrong enough to the point where I'd be worried about any pastor who would do such a thing. The other would be to put the actual date of the ceremony on the certificate. This has two problems. The first problem is that most states require the marriage certificate to be filed within a short time period after the wedding. If you can get past that issue, then you have your adjustment of status. Are you really planning to send in a marriage certificate (which you need to prove that you are eligible to adjust status) that says you were married BEFORE the visa? If they see the date, and I'd imagine that's one of the things they look for, I'd guess you'd get an automatic denial, and you could end up getting deported for entering illegally since they'd then consider you to be have entered on a K-1 while married ( a BIG no-no).

I wish I could go back in time and say don't make plans yet, it's not worth the risk, but it's too late for that. In your current situation I'd say you have two options. Either have the real ceremony and withdraw your K-1 petition and switch to spousal, or option two, Have your Faux marriage as you wish, but call it a celebration of love ceremony or something (anything) besides a wedding, and when you return, be sure to have a LEGALLY binding wedding to use to file with.

When I look at the current G-1055 ((date is 11/23/10 on the pdf (http://www.uscis.gov...form/g-1055.pdf)) on the USCIS website it shows 340 USD. I have seen and heard of a 455 filling fee. Which one is the correct one?

Including both won't hurt your case, but it's not necessary, unless you are using your passport pages to help prove the requirement of you meeting within the previous 2 years of your filing.

 

I used Boarding passes to prove the meeting (along with 1 photo from each trip) and my birth certificate to prove citizenship.  I didn't send in a copy of my passport at all. I did receive an RFE, but it was for a copy of my divorce decree from my first marriage (I only sent the one from my second marriage).  There was no mention of any issues involving our having met or of my citizenship requirements in my RFE.

I was wondering if anyone knew if me and my soon to be wife would be allowed to marry on a cruise ship ? We both understand that a K-1 Fiance Visa is a single entry visa but we would love to marry on a cruise ship that does a cruise to "nowhere". In other words there are NO ports of call. The ship would leave Tampa, Florida on a Friday night and return back to Tampa, Florida on Sunday morning. Again there are NO ports of call. I have called and asked many people abd even a travel agent but no one knows if this allowed. Any help or advice would be greatly appreciated. ( we would marry BEFORE the ship left Tampa, Florida )

 

I would check with the cruise company.  They would know if their passengers have to pass through customs upon re-entry.  If so, then it's likely going to be a problem, but if you can disembark freely, without any customs/border control checks, then you should be fine.   

 

Of course, this is just my opinion.  Be sure to double and triple check everything.  We don't want anyone getting stuck and not able to enter the country

You will want to send with those forms, a legible copy of the petitioners legal birth certificate to prove residency.  If you were not born here or cannot access it, send copies of your entire US Passport to fill this requirement.

 

You will also need to send evidence of having met in person within the last 2 years, you can accomplish this with boarding passes or copying the passport pages of the person who traveled.

 

You also need to each send an original signed letter of intent to marry within the 90 days from entering the country.

What type of evidence do they need?

 

Both of the above posters are absolutely correct, you cannot know for sure until you receive the hard copy in the mail.  When you file, they require certain information to be included with your petition. If you are missing one piece or multiple pieces when they are attempting to make a decision, they will send the RFE stating exactly what piece (or pieces) of information which were either missing or insufficient.  Sometimes you can go back over the information you sent (assuming you kept copies of everything) and try to figure it out.  Many times there's something that will jump out at you that you didn't send or forgot to sign or something along those lines.  

 

The good news though, is once you get the RFE, all you have to do is follow the instructions carefully and give them exactly what they ask for.  If you do this within the timeframe (they give you 2 months), then RFE's are almost always approved.  Also, the RFE should be to you fairly soon, of course dependent on how good the postal service is in your area.  They generally put it in the mail a day or two after the notice and then however long it took for the NOA1 to arrive is about how long my RFE took to arrive as well.

The beneficiary has their own forms to fill out for which they will receive instruction once the petition arrives at their consulate.  To get a head start, I'd recommend going to the consulate which will handle the case and find the specific information there as details will vary from country to country.
