Hey,

I applied for my social security number about 8 weeks ago. I got a letter through the post yesterday saying that they couldn't process my social security number the problem is my I-94 expired the day before. I think the reason it couldn't be processed it a clerical error by them placing my middle names as my first name.

I've just been to the social security office for the third time. They said there's nothing they can do because my I-94 has expired now. I need to update it or get a new one. How do I do this? Can I do it online?

Also I haven't sent for my change of status yet. My wife keeps telling me that we need to get a social security number before I send this off. If we file for it now we need to file for it a second time when I get the social security number? Is this true? I'm nervous because, although we married well within the 90 days, my I-94 has expired so I'm kind of floating in limbo.





You asked how to renew your I-94. A K1 can't. It is all over after 90 days. You were only eligible to get a SSN based on the K1 visa during that 90 days, and they actually cut it off 2 weeks before. Your next chance will be when you get your EAD card that gives you permission to work. You can also get a SSN based on having a greencard.

Apply for your AOS/EAD/AP as soon as possible leaving the SSN blank.
All K1s go through a limbo after the I-94 expires while they wait for their next document showing they are allowed to be in the US. You can stay while you wait on your adjustment of status, but there isn't anything with a date to prove it. Most states won't give you a driver license either during this limbo.

Huh! I was sure I had seen somewhere that if your income will continue after emmigration (which it will, since I work from home and my location changing won't change anything about my income) then you're allowed to count it as part of you and your spouse's US household income. Does anyone know for sure?
 
Edit: Ahh, okay, it's only for AOS. So it'd be allowed under AOS but not for a Visa? Even CR-1?

K1 uses the affidavit of support form I-134. It has no strict rules written into the law. It is a subjective opinion by the officer at the consulate doing the interview. Some consulates apparently are in "I-need-a-lot-of-convincing" mode. London is very flexible. Show the officer your income and how it will continue in the US and it will contribute to the over-all picture that you are not likely to become a public charge. Her income, your income, both of your savings will be considered in London. London would let you self-sponsor on your assets alone if they were sufficient.

That doesn't mean every consulate goes by this. It is still the officer's decision and as I said, some are tougher than London.

Once you marry, you still have to apply for permanent residence. That requires a new affidavit of support for I-864. It has strict rules. Read the instructions for it and you will learn the requirements better than short posts on a forum. Yes the immigrant's income can count if continues from the same source in the US. But a K1 isn't authorized to work at first. So you get into that much debated area of "Does my UK internet based job count as working"? I have seen many opinions but never a black and white definitive answer. Your assets will count. Read the form instructions.

Now to CR1 visa briefly. It uses the stricter I-864 and London follows the letter of the law on that one. Your source of income will count because it continues. (Did I mention that is explained in the I-864 instructions?) A CR1 is a permanent resident the day they land in the US, so no gray area of what is defined as working. You are clearly authorized to work on Day 1.

Mull all the above around, and I think you have many positive options.

No Live Trace means there is something on her record. Ask her if she ever got a caution. That is not what we in the US call a warning where a police officer tells you he's giving you a warning and sends you on your way. A caution in the UK is basically pleading guilty to an offense on the spot instead of going to court. In her case it was expunged and a check by an employer would not reveal her offense. The US wants to know all charges ever, even the hidden ones. She can request her complete record. Get a Subject Access Report from ACPO which should state the offense she was charged with. She will need this again down the line if she applies for US citizenship.

No Trace is a clean police record. Nothing to discuss. The website is off on that statement.

From my experience with transfers...a notification tells you where it is going. Then another (like you posted) is from the new place basically saying "we got it and it's processing now". It is a generic message so rather than saying where it is processing, it merely says "at a USCIS office".

That makes me wonder where the heck it has been all theses months. Lost? Did somebody just find it behind a desk and are only now saying we got the transferred file? Geez!

You do not mail or courier anything TO the embassy. The arrangement you make with the courier is for after the interview. The embassy will courier your passport with K1 visa inside to the location you give when you arrange the courier. Also in the courier package will be a DO NOT OPEN envelope to hand over at your POE. it will contain your entire file to date...I-129 F petition file from USCIS, London file, and medical results.

You take your personal documents in hand to the interview, along with the affidavit of support things from your fiancé. Go over the list of your documents on the London website. Read the details. Click the links for more details.

Show up in line with the DS-160 confirmation and the interview letter because they usually ask to see those when organizing the queue.

Inside when you are first called, a clerical worker will take your documents and ask to see proof that you paid. Then he/she organizes your documents and file and passes them back to the interviewer. Meanwhile you sit and wait to be called to an interview window.

This post will tell you how to schedule the return courier and pay for the visa. Print it so you can follow the steps in order. Don't get out of order or it can be unforgiving. It is a little weird because you pick a courier depot, then pay the visa fee, then go back and choose the option for home delivery and give the details of the address.

If the depot is close and convenient, you can pick it up there at no cost. Most opt for the $30 home delivery.

I've got my interview scheduled in for London and I'm just getting everything together for the courier. On the embassy website it says I must have the originals or certified copies of my documents. Does this include the package my fiancée sent me or is it just the documents that I have been required to gather and any extra evidence I might have gathered in the meantime?

You will have to explain the courier part you mentioned. It sounds like you are getting documents ready for the courier to pick up. ? ?

For your London interview you need original or certified documents (YOURS, not fiance's) that are listed on the website....birth certificate, police report, divorce decree, name changes, military records... Whatever applies to you.

From you fiancé you need her signed I-134 and proof of her income. If it is an employer letter, then original letter is best, but some employment verifications are online and printed so not a problem. Any other proofs can be photocopies. You don't need to prove her income with 4 different things. Two is actually more than enough for London. That is ALL your fiancé needed to send you.

You do NOT need--
Fiance's documents like birth certificate, divorce decree, efc
Photocopy of I-129 F packet or any documents that are part of it.
NOA2 original or photocopy
Photos of you and fiancé
Skype logs
Evidence of meeting, getting engaged, posting on Facebook, etc
Any evidence of your relationship acquired since the petition was filed. None, nada, zip.


They will also like to see your DS-160 confirmation and your appointment letter when you queue outside.

Once you pay the visa fee online, print the confirmation/receipt and take that to show that you have paid.

We already have the police report issued in early march, he is working on the shots. From your other post, you mentioned that when the beneficiary complete the form online, it asks if you have your wedding date planned, sometimes they will try to schedule the interview to accommodate it, but it is not guaranteed. I will see when they assign me the LND number to see which way is better.
 
Some web site said the police report is only good for half year, your post has one year, is it half or one year?

The website that matters is London Embassy. Read it. Study it. You don't want to miss a detail. It says--

Police Certificates for the United Kingdom: A visa applicant who has resided in the United Kingdom for 6 months or more since the age of 16, is required to obtain a police certificate from the ACPO Criminal Records Office (ACRO). Further information is available from their website at www.acro.police.uk. This police certificate will serve to advise the U.S. Embassy, London whether or not any criminal conviction is held against him/her. The police certificate will be sent to the applicant's address provided at the time of application. Please note that the Immigrant Visa Unit considers the police certificate valid for 12 months from the date of issuance, not six months as stated on the certificate.

There are maybe, if you get lucky, shortcuts, but it is all depending on USCIS to NVC before you can start your engines. He needs stuff in place like yesterday so when you get the word from NVC, he can book that medical for the next appointment and zap off the DS-160. He could have that filled out but not submitted....ready to go. PM me when you connect with NVC.

Do you think it is possible to have the Visa printed before 10/1, does it take more than 2 weeks to receive the visa from the interview date? or we should do it later just to be safe


I don't keep up with timelines, so don't know how long it will take you to get from the Service Center to NVC. Mine was in London days after NOA2, but I see people commenting on it taking a month now. I just don't study that part. What do you know about that part?

A visa would normally be delivered within a week after interview. Right now they are delayed because of a computer/database problem. An overall average would be interview maybe 6 weeks after everything is in and visa a week later. But you can't count on being average. Stuff happens like computer problems. Even if your file had already sailed through NVC to the embassy and your medical appointment was this week (results delivered early next week), I think it would be shaky to think he might have a visa in time. My gut tells me it is a very long shot.

Call the NVC to find out when they get the file and assign your LND number. Then work out your odds from there. I am assuming you have already done shots and police report. I suppose you could try to push through and if it didn't work out, then send the form asking for a new date. Right now it depends on how soon it gets to NVC and a case number assigned.

I need help, I am so happy that finally we got our NOA2 but then I realize a big potential problem. We have already planned our wedding on 10/3 this year and my fiance just got the NOA2 last monday (7/28), it seems like most likely the interview will be scheduled around mid-Sep, after they approve it, they will take his passport for visa printing, and it might take up to 2 weeks or more for him to receive the passport which means he might not have his passport with him in Oct.
 
But he NEEDS the passport to travel to the US before Oct, the wedding has been planned more than half year ago and most money has been paid, his friends and fmailys have also bought the tickets and booked hotel, we cannot pospone the wedding. I am really worried now, any idea how we should manage this situation?

Replying to your question "Can we request to postpone the interview date?"

You are very much in control of your interview date in London. Three things must be in place to even be eligible:
1) you submit DS-160
2) your medical results are received by the embassy
3) you submit the Readiness for Interview form

Hold off on any of the three and you won't be assigned an interview. If you haven't interviewed by Nov 28 (petition approval expiration) then London requests a new letter of intent from the American to revalidate it. Simple enough to take that to your interview.

For a London interview she will be fine without a tax return. They love employer letters as proof. But when you file adjustment of status after marriage, there is another affidavit of support form I-864. It is stricter and she will be required to have filed her US tax returns. There is a provision for folks who were not required to file ...as in earning no income, unemployed, in school. But if she earned money anywhere in the world, and it was above the required income for filing, then she can not be excused. She can start looking now into filing back returns if needed so you can apply for your greencard in a timely. You will be fine for your K1 without.

That is the correct guidance for the many passport style photos you will need before you are done with immigration. The photo tool works well for do-it-yourself. Hint. Take a photo showing most of the torso. The tool will zoom and crop to the right proportions. If you try to take the photo of just the face, it will be too large to shrink to a 2x2 and work properly with the tool. It will create a 4x6 white photo with 2 passport sized pics in the middle that you cut out. You can print at home on glossy photo paper or take the file to a photo place or kiosk and have it printed there.

I think that is the going rate to see a private physician in London and have an exam, chest x-Ray, and blood testing. Yes there are private physicians not in the National Health Service.

And I think using the exchange rate to US dollars is muddying the concept. I have found that at US Subway sandwich shops a "$5 footlong" as the ad used to say was a £5 footlong in the UK. A Starbucks grande cappuccino is $3.60 in the US and £3.60 in the UK. It's only when you are a tourist you think in terms of "OMG! I just paid over $6.00 for this cappuccino."

Sure include your visits to the US. A few photos together is always nice If you want to tell a little background of how you got together or when you decided to marry, type it on a blank page with the Form number, question number, and Petitioner's name (the US person who sends the petition) at the top of the page. It does not have to be long. That one sentence covers the requirements, but many like to tell a story. Don't write a novel. I am a minimalist having seen the whole picture of fiancé petition to US citizen. It is easier to separate requirements from goopy fluff from that vantage point of experience. But you don't have to believe me any more than somebody else. Try to be logical about the objective and do the best application after reading the instructions.

When you're all shiny new at this, it is easy to get overwhelmed by differing responses. Keep in mind you lived in the same country and speak the same language and your consulate in London doesn't even want further evidence of your relationship when you go interview. Each consulate is different. Prove firstly that you met in person, not that you Skype 12 hours a day or posted "in a relationship" on Facebook, or mail each other valentines. My theory is if you send too much fluff, they might miss the important stuff or pass over your giant file in favor of one they can go through quickly. "Oh this looks easy. I'll do it before lunch. That giant file can wait until next week. I have a headache". :P

My Fiancé and I are compiling all the forms and evidence that needs to be sent off with the I-129F. I've searched and searched this site but can't find all the info I need. I have a few questions, so if anybody could, I'd be ever so grateful!
 
I keep getting confliciting views when it comes to filling in questions that have no answeres. On both, I-129F and G-325A, if the question does not apply (e.g current Husband/Wife) shall we leave this blank or write 'None'?

Do we (petitioner and benificiary) need to put our forenames, middle name(s) and surnames on the intent and cover letter, or will the forname and surname suffice?


Doesn't matter on a letter. They will throw out the cover sheet in the mailroom. Not a pass/fail issue. Full names seem more posh and official.

 

My Fiancé (the petitioner) is in the US Airforce and was stationed in England from 2011 - 2013. Will he need to show boarding passes from back then to show evidence he was here for us to meet? How much detail do I need to give for Q 34a on I-129F?


You don't fit the typical filer who flew over to visit and meet. So boarding passes aren't necessarily for your packet. They want to know you have laid eyes on each other physically in person during the last two years. Show he lived in England and you're done. What document will prove he was in England during the last two years?
Detail of Q34--"We were together weekly near [Name] AFB, United Kingdomfrom [date] to [date] where I was stationed." (It is not your love story. They want to know you met in person so you meet the requirement.) This isn't as hard as people make it out to be. Well maybe if they met on the internet and in person once for only two weeks and speak different languages. You are not that person.

Would it present a problem if the current address is not the one she will be living in in France (so that any correspondence is sent to her mother) or does she need to put her French address and we could request correspondence to an address in the US? I guess what I'm effectively asking is if her mother can be the person taking care of the petition (if my fiancée can manage to get all documents needed ready and sign the necessary documents)
 
So she's is going to be a teaching assistant in France from October - April with a monthly stipend that will put her at below the poverty line. As she has a co-sponsor (her father) who is comfortably over the poverty line, does she need to provide proof of this role? Having had experience of French bureaucracy, this would be a real hassle as well as to get whatever documents she manages to get translated. Or would it suffice to use all the proof that her father will provide of his income?

Just some general info and thoughts for you from a old timer who has finished everything.

This process is not romantic. Don't worry about getting down on one knee. If she files a petition along with the letters of intent that say you are free to marry and intend to marry within 90 days of entering the country on your K1 visa....you are engaged for immigration purposes. You don't have to announce it to Granny and Cousin Fran on that date. Our personal example-- we did not get "engaged" on a specific date, I got no engagement ring, we didn't have a formal wedding, we don't have wedding rings, I didn't change my name to my husbands. Yet we moved right through immigration to citizenship with never a question about those things or any requests for further evidence.

Your consulate in London will not want to see your photos, love letters, Skype, etc. The interview is a easy chat. If they say "when did you get engaged.", it is perfectly okay to say "we decided together we wanted to get married in January or February last year." If they say "how did you propose?" It is okay to say, "well I really didn't propose as such. We just decided together we wanted to get married in January or February last year. I guess I am a boring boyfriend, but I couldn't afford an engagement ring at the time. I did surprise her with a ring for Christmas." That will not in the tiniest way get you denied in London. In London it is a very informal chat. Just tell your story.

So on to filing. If you have looked at form I-129F, there is a way to fill it out with an "in care of".
Fiancés name
In care of her mother's name
Her mother's address.

Is that where the fiancé lives right now?

Then there is form G-325A where she lists addresses and background. If you mail this off before October, then there is no French address to list, right? Her mail will go to Mom's house. That will be her receipt and her approval. If she leaves something out, then a request for evidence would go to Mom, but she isn't going to make any mistakes, right?

For Affidavit of Support-- London will accept one just from Dad. Nothing from her. Really, they do that in London. Or if you have a bunch of cash, you can sponsor yourself.

Update for us, we got our hard copy Rfe, they want proof of intent to marry within 90 days.

I'm sure like a lot of other people, we haven't made a whole lot of definite plans due to the nature of not actually knowing when your likely to be together so at this point:

I've written a letter of intent
Mike has written a letter of intent
Provided emails and wattsapp conversations of wedding plans
Provided my engagement ring receipt
Provided my wedding dress receipt
Provided congrats cards we received after engagement.

We haven't actually booked a venue or officiant yet as we were intending a very small legal ceremony in Florida and an intimate meal with his parents. Nothing fancy.

Any views on whether we should preliminary book a officiant as proof of intent?

You do not need bridal show brochures, ring or dress receipts, or venues. The petition requirement is you each sign your name to a statement of intent. Positive.

If you didn't include those two statements, then that's why the RFE. If you did include two, did they have the words "free to marry" and "intend" and "90 days" in the text to be thorough?

That will not speed up your case. Nor will a lawyer. The best way to speed up your case is make no mistakes where they have to ask for more information, and be prepared for the next step before you get there. Learn what happens next and what documents you will need. Make a timeline and it will predict petition approval aka NOA2. That's when you will move on to the NVC, then London.

The I-129F petition can take that long to be approved. But there's more. It has to go through NVC and on to the embassy in London. Then your fiance can apply for a K1 visa. That's another 2-3 months after your petition is approved.

The doctors at Knightsbridge may want more information than they can get from examining a person for 15 minutes. So they will sometimes (often) request the doctor who attended him or has his medical records write a little summary in medical terms of when, what was corrected and he's fine now. Or in the case of ongoing conditions, what kind of meds are taken. It doesn't mean he wouldn't get a visa. They just gather more info on more serious medical history. Many take in a report from their GP so they don't have to get it later and hold up their medical exam files going to the embassy.

Nich-Nick - just a quick question.
 
I am about to send all my completed forms to London but I will not be having the medical until 29 May when I return to the UK.  I have all the documents in hand for the interview.
 
Should I be sending the completed forms now and the DS-2001 when I've had the medical?  Or can I send all of the forms now including the DS-2001?  If the latter, should I say in my covering letter that I have scheduled my medical for 29 May?  I realize that London will not schedule an interview for me until they have the results of the medical.




Yes, it's okay to do that because you have all the documents in hand. Yes, include the medical date in the cover letter. They are specific about what info goes in a cover letter with the DS-2001. Go back and review the instruction page for it.

The other comment was to the person who thought about waiting to send the forms until they had all the interview documents too. London doesn't expect that. They instruct to get the forms in so they can start processing them, but they know it may take some time to gather documents (especially if you didn't read ahead and their letter was your first clue of what happens next.). So they say send the DS-2001 when you have gathered your docs and arranged a medical. Either way is okay. A few years ago, when they actually sent a paper packet of forms and instructions, there was a "checklist" included of the documents needed. You literally put checkmarks on the paper list and mailed it back when you had all of them. At the bottom of the checklist were places to fill in date of medical, date of wedding, date of intended travel, etc. The newer form DS-2001 just has a place to sign that you are ready, so they ask for a cover letter to tell the other Info they use for scheduling.

Also if you are only a few months into the process go to your doctors and get your vaccinations that you require cause the knights bridge doctors do charge a lot for these especially when they are free on the NHS, i got all mine done free of charge: 
 
I got the following vaccinations done: 
Hepatitus A&B combined 
TDP - Tetanus, Diphtheria and Polio
MMR - Measles, Mumps and Rubella
Influenza - if you are in the risk group i believe its 50 and over and in flu season 
Varicella - not needed if you have not had chicken pox
 
But these all depends on your age so check out going for your medical forum, all the info is there
 









If you are no longer a teen, then Hepatitis is not required. Influenza statement is outdated info.

Heres the shots needed for 19 through 59 years of age:

Td or Tdap - Tetanus, diptheria, pertussis (not polio). You may get DT, DTP or DtaP and it will be accepted for AOS. Must be no longer than 10 years ago or get a booster.
MMR (if born in 1957 or later) Two doses are required. If you had only one as a child, you may need #2.
Varicella Not routinely given in the UK ; a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam.
Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months. Older lists will say flu shots for over age 50. It changed.

In the meantime I sent off all the forms except the ds2001, with a cover note saying I will send in the ds2001 once i am in receipt of the police certificate and my fiancee's documents.
 
I wrestled with holding off on sending the forms until i could sent everything, but after reading the official instructions about a hundred times, it does state to send stage one in asap, then stage two as soon as the documents are in hand.
 
I did a lot of forum searching, and found a few post whereby others have also done it this way. 
 
 





You did it exactly as London prefers. :thumbs:
Get your forms in immediately.
Gather your interview documents and have the medical.
Send the DS-2001 to let them know you are ready to interview because you have all documents in hand.

I really don't think the CBP knows you have a petition in the works unless you told them on a previous trip and they addeded a note of having a fiancé. Three different CBP people told me they didn't have access to petitions filed because I asked them.

Getting refused admission doesn't not affect your visa path.

You can officially request to have your petition extended, but most consulates will do so for you, up to 1 year. I know in Argentina, they told me that if they hear nothing from us within 1 year of them receiving our case, they'll close it.

Her consulate London specifically gives the written instruction to bring a new beneficiary letter of intent to the interview and all is well. Easy. No worries. After NOA2, K1s need to follow the procedure of their consulate. Each can have different ways to get to the desired outcome---a visa in hand.

There is an expiration on your petition approval--4 months. London's letter of instruction was asking for a new letter of intent from the petitioner if you don't interview before your petition expires. Easy enough for you to get and take to the interview. Several recently have said they were past their expiration, took a letter, but were never asked about it. When you get your version of the London instruction letter (aka Packet 3) see if they are still asking for a new letter of intent to revalidate an expired petition. You may need one if you have to stall your timeline.

The actual law on a fiancé and meeting the public charge requirement is not very detailed. It is very much a subjective decision by the interviewing officer. London tends to be pretty flexible on the matter compared to what convinces an officer at another embassy. The documentation that I have read from the Dept. of State does not say the sponsor must be living in America or American. It does say that the officer should be careful because a sponsor not in America would be less motivated to assist you financially if needed. I don't know of anybody here on VJ who has tried it in London. (The next affidavit of support for your adjustment I-864 has very strict rules and absolutely requires the joint sponsor be a Us citizen or permanent resident.)

If you have sufficient savings or assets, London will allow you to self sponsor yourself by presenting proof of your money. That isn't your salary, but cash money plus cash from selling a house, car, etc. The catch is there is no published amount. I recall around $40,000 worked for someone. If you have a combination of fiancé earning 12,000 and you have some significant savings, that might work. You just won't know until you try it and see what the officer decides.

Okay I was clearly getting very confused by this, here's what I have learnt and plan to do. Any advise or knowledge would be great on this!
 
So my fiance will use a Co-Sponser, her mum. I have known her mom as long as I have known my fiance which would be around 1 year and a half on the interview day. she Earns around $80,000 a year.
 
But my fiance is at university doing her Masters degree with only a part time job as her income and loans.
 
Would this cause any problems?

No problems at all. The mother fills out the I-134 and provides proof of her income. Your fiancé fills out nothing. That's the way LONDON does it.

Different rules will apply when you adjust status and need a different affidavit of support, but the above will get you through the London part.

The visa denial will not keep you from getting a K1.

Things that could come up that seem to surprise UK young people--

A caution counts as a criminal record that must be explained if you have ever had one. It isn't just an arrest and going to court. Many in the UK don't understand that. It is not a deal breaker however.

The Medical clinic will often ask you about drug use, even just once at a party or experimental. Yes, that counts and something to deal with if you admit to it.

Other than that your consulate in London will make sure you have a financial sponsor, ask you a few simple questions about your fiancé, and doesn't care to see photos, engagement rings, or evidence of how often you skype, or send love letters. No further relationship evidence at your interview which is against everything Visa Journey folks tell you, but it is true.

I have no clue how long the transfer will take. Not many transfer and they never come back and report when they do. Hoping you will bookmark this thread and update it. Okay? Thinking in terms of waiting on London to reply to you, London getting around to asking for your case, then Montreal getting around to sending it...well you know how that can go...s-l-o-w-l-y. But one can always hope.

You may get some special instructions from London, but I think a new DS-160 would be correct since you start it by picking a consulate. That way you know it goes to London instead of depending on it getting retrieved. And the address where they will mail your interview will be there in the new document. Less chance for something falling through the cracks. I would do it even if they say you don't have to.
